Electronic instructions for use (eIFU) are not automatically permitted for every medical device. In the EU, eligibility depends on the device, its intended user and the conditions in the amended eIFU regulation. In the United States, the FDA authority described in its 2003 memorandum is narrower: it covers certain prescription devices intended for use within healthcare facilities, with paper labeling available promptly and at no extra cost on request. A PDF posted online, by itself, does not establish compliance in either jurisdiction.

What changed in the EU eIFU rules in 2025?

The EU’s eIFU framework is Commission Implementing Regulation (EU) 2021/2226, as amended by Commission Implementing Regulation (EU) 2025/1234. The amendment is dated 25 June 2025 and was published in the Official Journal on 26 June 2025. It broadened the kinds of devices that may provide instructions electronically, including devices and accessories intended for professional users. It did not make electronic-only instructions a universal option for every device or user.

The amendment’s scope must be read alongside the operative conditions in the consolidated regulation. In particular, a manufacturer needs to assess the device type and whether its intended users are professionals or lay users; the latter distinction can affect whether electronic-only instructions are appropriate. For a device-specific decision, consult the applicable clauses in the consolidated regulation and the 2025 amendment, and check for later amendments before implementation.

How do EU eIFU and FDA electronic labeling differ?

The EU regulation sets conditions for when instructions may be provided electronically and for the websites that host them. The FDA sources cited here describe a narrower established route for electronic-only device labeling, alongside a broader expansion that was still proposed—not final—in the Unified Agenda entry available on 8 October 2026.

Question EU eIFU US FDA electronic labeling
What is the governing framework? Commission Implementing Regulation (EU) 2021/2226, amended by Regulation (EU) 2025/1234. Consolidated text. General device-labeling requirements are set out in 21 CFR Part 801. FDA’s 2003 memorandum discusses the specific electronic-only authority under Section 206 of MDUFMA. FDA general labeling requirements; FDA memorandum.
Who or what may qualify? Eligibility depends on device type and intended user, subject to the regulation’s conditions; the 2025 amendment broadened eligibility, including for devices and accessories intended for professional users. The established electronic-only authority described in the 2003 memorandum covers prescription devices intended for use within healthcare facilities.
What paper access is described? Follow the applicable EU conditions for the device and its electronic instructions; the cited materials do not support treating online availability alone as sufficient. Users must have the opportunity to request paper labeling, which must be provided promptly and at no additional cost under the authority described in the memorandum.
What was the broader-rule status? The 2025 amendment is an adopted regulation; apply the consolidated text and check for later changes. The Unified Agenda entry for RIN 0910-AJ17 listed broader electronic labeling as a proposed rule, with an NPRM projected for November 2026. An agenda projection is not a final rule. FDA/OIRA Unified Agenda entry.

What does EU compliance involve beyond posting a PDF?

The consolidated regulation recognizes instructions displayed by the device, stored on portable electronic media supplied with it, or made available through software or a website. It also imposes conditions on electronic instructions and on websites used to provide them instead of paper. A PDF upload alone does not demonstrate that the device is eligible, that the required delivery conditions are met, or that the website satisfies the regulation.

For an EU implementation, assess the full chain: the device’s eligibility and intended users, how the instructions are delivered, and the relevant website requirements in the consolidated legal text. The precise requirements depend on the applicable provisions, so use the current consolidated regulation rather than relying on a general statement that eIFU is allowed.

What does the FDA position allow, and what remains proposed?

Established electronic-only route described by FDA

FDA’s 2003 memorandum describes Section 206 of MDUFMA as allowing electronic-only labeling for prescription devices intended for use within healthcare facilities, provided users can request paper labeling and receive it promptly without additional cost. The memorandum also says electronic labeling remains subject to other applicable labeling requirements. FDA’s general device-labeling page identifies 21 CFR Part 801 as the home of general medical-device labeling requirements.

The memorandum dates from 2003, so it should not substitute for checking current statutory and regulatory language for an individual device. It does not establish a blanket right to replace paper labeling for every device or user. FDA states that manufacturers electing electronic labeling must ensure it is not false or misleading and meet other applicable requirements, including those in 21 CFR Parts 801 and 809.

Broader electronic labeling proposal

In the Unified Agenda entry available on 8 October 2026, FDA’s “Electronic Labeling for Medical Devices” rulemaking (RIN 0910-AJ17) was at the proposed-rule stage, with an NPRM projected for November 2026. The agenda described a possible expansion for certain prescription and non-prescription devices used outside healthcare settings, involving ready, unrestricted electronic access and paper copies promptly available on request. This was a proposed direction and projected timeline, not an adopted rule. Check the Unified Agenda entry and current FDA requirements before relying on a later status.

How should a manufacturer assess eIFU services?

A vendor platform can help publish and control instructions, but buying software does not establish regulatory compliance. Requirements depend on the device, intended users and jurisdiction; the manufacturer still needs to determine eligibility and verify that the selected workflow meets applicable obligations.

What should be verified before switching a device to eIFU?

  1. Identify the market and applicable rule. Separate EU requirements from US FDA requirements; do not assume permission in one jurisdiction carries over to another.
  2. Document the device and intended user. Establish the device category and whether its intended users are professionals, lay users or both, then assess eligibility under the current applicable text.
  3. Map how instructions reach users. Specify whether they are displayed by the device, supplied on portable media, or provided through software or a website, and assess the conditions attached to that method.
  4. Validate the website or platform. Review the applicable legal requirements and verify version control, availability, access, language handling and fallback processes against the actual implementation—not just the vendor’s feature list.
  5. Confirm paper procedures where required. For the FDA route described in the 2003 memorandum, paper labeling must be available promptly and without additional cost on request. Verify the requirements applicable to the specific device and current rules.
  6. Recheck legal status before release. Use the latest consolidated EU regulation and current FDA materials; a projected rulemaking date is not a substitute for an adopted regulation.
