An e-way bill (EWB) remains valid for a distance-based period under current CGST Rule 138. The ordinary calculation uses 200-kilometre intervals; over-dimensional cargo (ODC) and qualifying multimodal consignments that include a ship leg use 20-kilometre intervals. The validity clock starts when the first relevant Part-B transport detail is entered, not when later vehicle details are updated.

If an exceptional delay prevents delivery, the current transporter can request an extension through the E-Way Bill System during a narrow window around expiry. Once validity has expired, goods are not supposed to keep moving on that bill. The correct response depends on whether the request is still within that window and whether the portal accepts the documented reason and trip details.

What the e-way bill validity period is based on

Rule 138 sets validity by distance rather than by a single universal number of days. The amended rule replaced the earlier 100-kilometre unit with 200 kilometres from 1 January 2021 through Notification No. 94/2020-Central Tax. The CBIC amended CGST Rules PDF dated 1 June 2021 and the E-Way Bill System guidance both reflect this calculation.

Movement category Validity calculation Practical meaning
Ordinary transport One day for up to 200 km, then one additional day for every further 200 km or part of 200 km A distance that exceeds an exact 200-km block by even a small amount uses the next day
ODC or multimodal transport with at least one leg by ship One day for up to 20 km, then one additional day for every further 20 km or part of 20 km The shorter interval applies only when the consignment meets the rule’s ODC or qualifying ship-multimodal condition

Examples for ordinary transport

  • Up to 200 km requires one day.
  • 201 km through 400 km requires two days because the second 200-km block is started.
  • A 310-km trip therefore falls into a two-day validity period under the distance formula.
  • 401 km requires three days, because the distance includes a part of a third 200-km block.

Use the distance declared for the actual bill and verify the portal’s generated “valid up to” value. The examples explain the rule; they do not replace the validity displayed for a particular EWB.

Examples for ODC and ship multimodal movement

For a qualifying ODC or ship-multimodal movement, 20 km is the unit. A trip of 20 km or less receives one day; 21 km through 40 km receives two days; and 41 km requires three days. Do not apply the 20-km schedule merely because a shipment is large or uses more than one carrier: the ODC or ship-leg condition must actually apply.

When validity starts and when it ends

The E-Way Bill System FAQ identifies the first relevant Part-B transport entry as the start of validity. For road transport, this is the first vehicle entry. For rail, air or ship, it is the first transport-document number. Whichever applicable entry is made first starts the clock.

Adding another vehicle or transport document later does not recalculate the original validity period. Plan the first Part-B entry carefully, because a delayed hand-off does not create a fresh distance allowance.

The portal FAQ states that validity ends at midnight on the last validity day. Check the bill’s displayed “valid up to” date and time rather than relying on an informal estimate based on departure or expected arrival.

Why some government pages show a different calculation

A separately hosted CBIC HTML page still displays a legacy table based on 100-km brackets and fixed day totals. That table conflicts with the amended Rule 138 text and current portal guidance. For present calculations, use the amended rules PDF, the portal’s current FAQ and the validity generated for the specific bill. The 200-km ordinary interval, effective from 1 January 2021, resolves the discrepancy.

How to check an EWB before a trip

  1. Open the bill in the E-Way Bill System and note the displayed “valid up to” date and time.
  2. Confirm that the movement category is correct: ordinary transport, ODC or qualifying ship multimodal transport.
  3. Review the first Part-B entry and identify when the validity clock started.
  4. Compare the remaining route and expected delivery time with the validity still available.
  5. Record the consignment’s actual location and the remaining distance in case an extension becomes necessary.

These checks should be done before dispatch and again when a delay occurs. A later Part-B update cannot undo a validity period that has already started.

When an extension is allowed

An extension is intended for exceptional circumstances, not for routine convenience or an avoidable planning delay. The E-Way Bill System FAQ lists examples including a natural calamity, a law-and-order problem, a trans-shipment delay and a conveyance accident. A breakdown or comparable event should be described specifically in the reason and remarks fields.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The system allows an extension request from eight hours before expiry until eight hours after expiry. This is a system window, not an extra period during which goods may freely move on an expired bill. If the bill has already expired, stop movement while making an eligible request.

Who submits the request

The current transporter submits the extension. If no transporter has been assigned, the official API documentation allows the generator to update the bill. A transporter who is no longer handling the consignment should not be treated as the current requester merely because that party created an earlier Part-B entry.

Information needed for the request

  • The exceptional reason, selected through the applicable reason code, plus clear remarks describing what happened.
  • The consignment’s present place and pincode, not the original dispatch location.
  • The distance still to be covered.
  • The applicable Part-B transport details.

For road mode, the API documentation requires a vehicle number. For rail, air and ship, it requires the relevant transport-document number. The extension flow does not permit Part A to be changed. The remaining distance also cannot exceed the distance declared when the bill was generated.

The 360-day system restriction

E-Way Bill System release notes and the extend-validity API documentation list a validation that limits extension activity to 360 days from the bill’s generation. That validation is recorded as effective from 1 January 2025. A bill that has been open for an unusually long period may therefore fail an extension request even if other fields are correct.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How to request an extension in the portal

  1. Confirm the timing. Check whether the request falls between eight hours before and eight hours after the displayed expiry. If it is outside that interval, the standard extension route may not be available.
  2. Locate the extension facility. Use the E-Way Bill System’s validity-extension function for the relevant bill, rather than creating a routine update that does not explain the delay.
  3. Describe the exceptional event. Select the applicable reason and enter factual remarks, such as the location of an accident, the nature of a trans-shipment delay or the period of a law-and-order restriction.
  4. Enter the live trip position. Provide the current place, pincode and remaining distance. These values should match the consignment’s actual status when the request is filed.
  5. Complete Part-B transport details. Enter the vehicle number for road movement or the transport-document number for rail, air or ship, as required by the mode.
  6. Submit and retain the result. Save the acknowledgement or updated bill details and confirm the new “valid up to” value before resuming movement.

An extension request with a generic remark, an incorrect current location or an inflated remaining distance can be rejected by validation or create a mismatch during inspection. The portal’s acceptance is not a substitute for accurately recording the event that caused the delay.

What to do when the EWB has expired

Situation Action What not to assume
Still before the displayed expiry Continue only with a valid bill and check that the route and Part-B details remain accurate. Do not wait until the last minute if an exceptional delay is already evident.
Expired, but within eight hours after expiry Stop movement on the expired bill and have the current transporter, or the generator when no transporter is assigned, submit an eligible extension request immediately. The eight-hour post-expiry window does not authorize continued movement while the request is pending.
More than eight hours after expiry, or the portal rejects the request Do not continue on the expired bill. Preserve trip records and obtain case-specific advice from a qualified GST professional or the relevant tax authority. Official materials do not establish one universal post-window cure or say that issuing a new bill is automatically the correct remedy.

The E-Way Bill System FAQ states: “If validity of the e-way bill expires, the goods are not supposed to be moved.” Treat that as the operational rule for the consignment while the compliance position is assessed.

Do not restart the clock by changing vehicles

Entering a later vehicle number in Part B does not recalculate validity. If the first Part-B entry started the period, a subsequent trans-shipment or vehicle replacement leaves the original expiry framework in place unless a valid extension is granted.

Do not change Part A through the extension flow

The extension process is designed to update the current journey, reason and transport details. The portal documentation says Part A cannot be changed in that flow. A material error in the underlying invoice or destination therefore needs a separate, fact-specific compliance decision rather than an assumed extension edit.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Detention and penalty exposure

Moving goods after expiry can expose the goods and conveyance to enforcement under the GST framework. Section 129 of the CGST Act provides for detention or seizure and release proceedings for goods and conveyances in transit, including statutory penalty conditions.

That framework does not mean every expired bill produces an identical, automatic penalty. Authorities may consider the documents, the movement, the reason for the lapse, the conduct of the parties and the applicable statutory conditions. Keep the original bill, Part-B history, dispatch records, accident or breakdown evidence, transporter communications and extension attempt details.

Common mistakes and how to prevent them

  • Using the old 100-km table: calculate ordinary validity in 200-km units under the amended rule and check the portal result.
  • Starting the calculation at invoice time: the validity clock is tied to the first applicable Part-B entry, not simply the invoice date.
  • Assuming a later vehicle entry creates new days: later Part-B entries do not reset validity.
  • Requesting an extension as a routine renewal: document an exceptional circumstance and provide specific remarks.
  • Using the wrong requester: the current transporter should submit; the generator is the fallback only when no transporter is assigned.
  • Entering the original dispatch location: the request requires the consignment’s present place and pincode.
  • Overstating remaining distance: the API validation bars a remaining distance greater than the distance declared at generation.
  • Continuing during a post-expiry request: stop movement until the bill is validly extended or professional advice addresses the case.
  • Assuming a new EWB is always the fix: the official materials reviewed do not establish that blanket rule after the extension window has closed.

Operational checklist for transport and tax teams

  1. Classify the movement correctly as ordinary, ODC or qualifying ship multimodal transport.
  2. Calculate the distance-based period using 200-km or 20-km increments as applicable.
  3. Enter the first Part-B transport detail only when the movement is ready to start.
  4. Record the displayed expiry and monitor it against the actual route progress.
  5. When an exceptional delay occurs, capture evidence and the exact current location immediately.
  6. Submit the extension through the current transporter between eight hours before and eight hours after expiry.
  7. Verify mode-specific details, the remaining-distance limit and the 360-day generation restriction.
  8. If the bill expires without an accepted extension, halt movement and escalate for fact-specific GST advice.

Bottom line

For ordinary transport, current Rule 138 uses one day up to 200 km plus one day for every additional 200 km or part. ODC and qualifying ship-multimodal movements use 20-km intervals. Validity begins with the first relevant Part-B entry and ends at midnight on the final day shown by the portal. An exceptional delay can support an extension only through the narrow eight-hour-before-to-eight-hour-after window, with accurate current-trip details. After expiry, do not move goods on that bill; if the window has closed or the request fails, obtain advice for the specific facts rather than assuming a universal replacement procedure.
