An expired e-way bill and an e-way bill with incorrect details are different compliance problems. Expiry concerns whether the transport document remained valid for the journey. An incorrect entry concerns whether the submitted particulars accurately describe the consignment, vehicle and parties. Neither condition should be described as automatic detention by itself. The practical result depends on whether a bill exists, whether the error is one of the narrow minor errors recognized in Circular No. 64/38/2018-GST, whether the invoice and other prescribed documents accompany the goods, whether a replacement or further bill can lawfully be generated, and which officer has jurisdiction.
Section 129 is the main detention and seizure provision for goods or a conveyance in transit when the Act or rules are contravened. The Government of India FAQ dated 9 October 2026 describes proposed limits on interception and detention, but its commencement was not established in the material available here. Verify the Gazette, operative statute, portal instructions and any state notification before relying on those proposed safeguards as settled law.
Start with the distinction: expiry is not the same as a wrong entry
When a truck is stopped, the inspecting officer is not looking only at the date displayed on the e-way bill. The relevant questions are whether the movement is covered by a generated bill, whether its validity period has run out, whether the particulars match the invoice and the physical goods, whether a listed minor error is involved, and whether the officer is acting in the jurisdiction described by the applicable law and guidance.
| Situation | What it means | Action described in official guidance | What not to assume |
|---|---|---|---|
| Validity has expired | The distance-based period counted from generation has ended before the movement was completed. | Check exceptional-circumstance extension or a fresh bill after updating Part B, and confirm the live portal and operative rule. | Expiry does not automatically prove that detention must follow. |
| A submitted field is wrong | The bill contains a mismatch in a party, address, document, HSN or vehicle detail. | The portal FAQ says the submitted bill cannot be edited; cancel where permitted and generate a corrected bill. | Do not edit a submitted bill in place. |
| Error fits a listed minor example | The discrepancy falls within the specific examples in Circular No. 64/38/2018-GST. | Section 129 proceedings may not be initiated when the required invoice or specified document and an e-way bill accompany the goods; a section 125 penalty is still described as possible. | A “small” typo is not blanket immunity. |
| No e-way bill information or prescribed documents | The electronic record or required transport papers are absent. | The 9 October 2026 Government FAQ says an authorised officer may inspect and detain or seize even in a transit state. | Transit-state officers can never detain. |
Use that distinction before arguing with a driver, transporter or officer. A bill that is valid but has a materially wrong vehicle number raises a different issue from a correct bill whose validity has expired. The remedy, evidence and jurisdiction can differ.

How Rule 138 calculates ordinary validity
The November 2025 compiled CGST rules provide one day of validity for movement up to 100 kilometres and one additional day for every further 100 kilometres or part of 100 kilometres. The period is counted from generation in 24-hour periods, not simply by treating the calendar date as a midnight-to-midnight ticket.
Distance examples
- A movement of up to 100 km receives one day under the ordinary rule.
- A movement beyond 100 km receives one additional day for each further 100 km or part of 100 km. The “part thereof” wording means a fraction of the next 100 km counts for another day.
The distance used for the calculation should be the transport distance represented in the e-way bill and supporting records. If the route changes materially, keep evidence explaining the change and review whether Part B and the validity calculation still describe the actual movement.
Why the expiry time matters
Because validity runs in 24-hour periods from generation, a bill generated during the day does not ordinarily expire merely at the start of the final calendar date. Compare the generation time, the distance-based allowance and the time of inspection. Do not rely on a printed date alone.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteIf the e-way bill has expired
The official E-Way Bill System FAQ recognizes an extension facility for exceptional circumstances, including a natural calamity, a law-and-order problem, a trans-shipment delay or a vehicle accident. Rule 138 also provides that, when exceptional circumstances prevent transport within validity, the transporter may generate another e-way bill after updating Part B of FORM GST EWB-01.
What to do before movement continues
- Confirm the record. Check the e-way bill number, generation time, calculated distance, validity end and the Part B vehicle or transport details. Match the record against the invoice, delivery challan where applicable and the vehicle actually carrying the goods.
- Document the exceptional event. Preserve an accident report, repair record, trans-shipment record, law-and-order communication, weather or disaster evidence, toll or GPS history, and the time at which the delay occurred. The stronger the contemporaneous record, the easier it is to explain why the ordinary period was insufficient.
- Use the portal process that is currently available. The FAQ describes a request containing the reason, current place, approximate remaining distance and Part B details. It describes the interface as available before and after the expiry window, but portal wording and rule amendments can change.
- Generate a further bill when the rule permits it. Rule 138 allows another e-way bill after Part B is updated when exceptional circumstances prevent timely transport. Retain the old bill and the reason for the replacement rather than deleting the audit trail.
- Stop and obtain advice if no lawful correction is available. Continuing a movement on an assumption that an expired bill will be accepted can turn a manageable delay into a document mismatch at inspection.
Do not promise that an extension is available for ordinary planning failure. The cited guidance describes exceptional circumstances, not a general way to reset every expired bill.

If an e-way bill contains incorrect details
The portal FAQ gives a clear answer to the question “If there is a mistake or wrong entry in the e-way bill, what has to be done?” A submitted bill cannot be edited. The stated route is cancellation followed by generation of a new bill containing the correct details.
Cancellation limits
Rule 138 permits cancellation within 24 hours when the goods were not transported or were not transported as specified. A bill cannot be cancelled after verification in transit. That creates two separate checks: whether the 24-hour cancellation window is still open and whether an officer has already verified the movement. If either condition prevents cancellation, do not represent the original bill as corrected; seek the appropriate procedural response and keep the supporting documents.

- Compare every material field with the tax invoice or other prescribed document: supplier and recipient GSTIN, legal names, addresses, PIN codes, invoice or document number and date, taxable value and tax, HSN, quantity, and the vehicle number.
- Identify whether the goods have actually started moving. Cancellation is not a substitute for a new bill after an in-transit verification.
- If cancellation remains permitted, cancel the wrong bill within the applicable period.
- Generate a new bill with the corrected particulars and the actual Part B transport details.
- Give the driver or transporter the new number and retain a record linking the corrected bill to the invoice and the cancelled bill.
Never tell a driver to overwrite a submitted field or to carry a handwritten alteration as if it changed the electronic record. The FAQ’s instruction is cancellation and re-generation, subject to the rule’s time and verification limits.
When a wrong detail may be treated as a minor error
Circular No. 64/38/2018-GST lists specific examples in which proceedings under section 129 may not be initiated, provided the consignment is accompanied by an invoice or other specified document and an e-way bill. The protection is conditional and should be tested against the exact facts.
| Listed example | Condition described in the circular |
|---|---|
| Spelling error in consignor or consignee name | The GSTIN is correct. |
| PIN-code error | The addresses are correct and the error does not increase the e-way bill validity. |
| Consignee-address error | The discrepancy falls within the circular’s specified address situations and the other required records are present. |
| Document-number error | One or two digits in the document number are wrong. |
| HSN error | The error is at the four- or six-digit level, while the first two HSN digits and the tax rate are correct. |
| Vehicle-number error | One or two digits or characters are wrong. |
The circular also describes a possible penalty under section 125 for these listed situations. Therefore, “minor” does not mean “no consequence.” It means only that the stated section 129 proceedings may not be initiated when the accompanying-document and e-way-bill conditions are satisfied.

Errors outside the list
A wrong GSTIN, a material change of destination, an HSN error that affects the first two digits or tax rate, a document number that does not identify the invoice, or a vehicle detail that does not reasonably identify the conveyance should not be casually described as a listed minor error. Ask whether the goods, invoice, parties, tax treatment and route still correspond. If they do not, the issue may be a substantive contravention rather than clerical noise.
What section 129 covers
Section 129 addresses goods or a conveyance in transit when the Act or rules are contravened. The inspection question is therefore broader than “Is the date expired?” It can include the absence of an electronic bill, missing prescribed documents, a mismatch between the goods and invoice, or an inaccurate transport detail that is not protected by the circular.
The current government FAQ also states: “Goods and conveyances in transit shall be dealt with only under section 129, read with section 68.” That sentence should be attributed to the Press Information Bureau FAQ, not to an individual official.
Detention is not the same as confiscation under section 130
The same FAQ says goods and conveyances in transit are dealt with under section 129 read with section 68, rather than confiscated under section 130. This distinction matters when explaining an inspection notice: a detention or seizure action under the transit provisions is not automatically a section 130 confiscation case.
Which officer may intercept or detain?
The Government of India FAQ posted on 9 October 2026 describes a reform under which random interception is not allowed. It says interception requires written reasons to believe and authorisation by a proper officer not below Joint Commissioner rank. The FAQ frames the change as proposed, and the commencement notification was not established. Verify the Gazette and operative statute before treating that requirement as enforceable in every inspection.

Ordinary jurisdiction described in the FAQ
The FAQ says section 129 inspection, detention or seizure ordinarily lies with the state or Union Territory where the supplier or recipient is located. If a transit-state officer finds an issue such as an incorrect HSN, the described approach is to allow the goods to proceed and pass information to the supplier’s or recipient’s jurisdictional officer.
The important exception
If no consignment information has been furnished electronically because no e-way bill was generated, or if the conveyance lacks prescribed documents, the FAQ says an authorised officer may inspect and detain or seize goods even when neither supplier nor recipient is located in that state. This is why carrying the electronic bill and the invoice or other prescribed document is more than a formality.
Documents to keep with the movement
The minor-error protection and the jurisdiction guidance both assume that the movement can be identified from its records. The driver or transporter should be able to produce:
- The e-way bill number or an accessible electronic representation of the bill.
- The tax invoice, bill of supply, delivery challan or other prescribed document applicable to the movement.
- Part B transport details that match the vehicle and the actual leg of the journey.
- Evidence supporting an exceptional delay when an extension or further bill is claimed.
- The corrected bill and cancellation record when a wrong bill was replaced before movement.
The documents should agree on the supplier, recipient, goods description, HSN and tax treatment, document identity, route and conveyance. A document that exists but describes a different consignment may not cure the underlying mismatch.

What happens during an inspection
Remain precise about the officer’s question and the evidence being shown. Record the time, location, vehicle number, e-way bill number, invoice number, officer’s designation and the discrepancy identified. Do not alter an electronic record after the fact or ask the driver to make an unsupported declaration.

Inspection reporting
GST Council-hosted enforcement material says the inspection summary is uploaded in Part A of FORM GST EWB-03 within 24 hours and the final report in Part B within three days. These are reporting obligations described in that guidance; they do not turn every inspection into a detention.
Reporting a long vehicle detention
The transporter may upload detention information in FORM GST EWB-04 if the vehicle has been detained for more than 30 minutes, according to the cited official FAQ. Preserve the timestamp and any acknowledgement so the duration can be demonstrated.
A practical decision path
- Is an e-way bill generated? If no, the exception described in the 9 October 2026 FAQ can permit an authorised transit-state officer to inspect and detain or seize where prescribed documents are also absent.
- Is the bill still within its 24-hour distance-based validity? If yes, move to the accuracy check. If no, examine an exceptional-circumstance extension or a fresh bill after Part B is updated; do not resume solely on verbal assurance.
- Do the bill, invoice and goods match? Check GSTINs, names, addresses, PIN code, document number, HSN, tax rate, quantity and vehicle details.
- Does the mismatch fit the circular’s exact minor-error list? If yes, confirm the invoice or specified document and e-way bill are present, and remember that section 125 penalty exposure is still described.
- Has the bill already been verified in transit or has the 24-hour cancellation period passed? If yes, the ordinary cancel-and-reissue route may not be available.
- Which jurisdiction is acting? Apply the operative law and current notification. The proposed FAQ approach generally points an ordinary discrepancy in a transit state to the supplier’s or recipient’s jurisdiction, subject to the no-bill or missing-document exception.
Worked situations
Vehicle delayed by an accident after the bill expires
The transporter should preserve the accident and repair evidence, check the portal’s extension function and update Part B with the current place and remaining distance as requested by the FAQ. Rule 138 permits another bill after Part B is updated when an exceptional circumstance prevents timely transport. The fact of expiry alone does not establish automatic detention, but movement should not continue without a lawful current record.

If the invoice or specified document and an e-way bill accompany the goods, and the error is one of the one-or-two-character vehicle errors listed in Circular No. 64/38/2018-GST, the circular says section 129 proceedings may not be initiated. A section 125 penalty is still possible. Correct the record through the permitted cancellation and new-bill process when the timing and verification conditions allow it.
Transit-state officer identifies an HSN mismatch
First determine whether the mismatch is within the circular’s HSN example: an error at the four- or six-digit level while the first two digits and tax rate are correct. If the proposed 9 October 2026 FAQ framework is operative, an ordinary discrepancy found by a transit-state officer should be passed to the supplier’s or recipient’s jurisdiction while the goods proceed. If there is no e-way bill information or prescribed document, the stated exception changes the result.
Compliance checklist for suppliers and transporters
- Generate the bill with the actual invoice, destination and transport distance.
- Calculate validity from the generation time in 24-hour periods.
- Verify Part B before the vehicle leaves and after every vehicle or trans-shipment change.
- Carry the invoice or other prescribed document with access to the e-way bill number.
- Use the portal’s cancellation and re-generation process; never attempt an in-place edit.
- Monitor expiry during loading, trans-shipment, border or warehouse delays.
- Keep evidence for accidents, natural calamities, law-and-order problems and trans-shipment delays.
- Train drivers to record inspection time and request an EWB-04 upload when detention exceeds 30 minutes.
- Check the current Gazette, CGST rule text, portal instructions and state notifications before relying on the proposed interception safeguards.
Bottom line
An expired e-way bill calls for a validity and exceptional-delay analysis. An incorrect e-way bill calls for an accuracy check, a narrow minor-error test and, where allowed, cancellation and generation of a corrected bill. Detention under section 129 turns on the actual contravention, accompanying documents, the presence or absence of electronic consignment information and the inspecting officer’s operative jurisdiction. Treat neither expiry nor every clerical error as an automatic detention trigger, and do not treat either as harmless without checking the specific rule, circular and current enforcement procedure.
