DPO as a Service can be a practical way for a UK small or midsize business to appoint a data protection officer, but handling personal data alone does not make that appointment mandatory. First check whether your organisation meets the UK GDPR’s legal test; then compare the cost and scope of an external service with the actual work and safeguards you need. A service contract does not transfer the organisation’s responsibility to resource the DPO or protect the role’s independence.

Does a small business need a DPO?

Under UK GDPR Article 37, an organisation must designate a data protection officer (DPO) if it is a public authority or body, subject to the provision’s statutory exception, or if its core activities involve either of these kinds of processing on a large scale:

  • Regular and systematic monitoring of individuals.
  • Special-category personal data or personal data about criminal convictions and offences.

The test turns on the nature, scope and purpose of the organisation’s processing—not simply its staff count, turnover or status as a small business. The Information Commissioner’s Office (ICO) says a small organisation is unlikely to need a DPO. That is a likelihood, not an exemption: assess what the organisation actually does and document why it does or does not meet the test.

Not having to appoint a DPO does not remove other data-protection obligations. If your processing does not trigger the appointment duty, you may still need appropriate people, processes and expertise to meet those obligations.

What does DPO as a Service mean?

DPO as a Service—also called an external, outsourced or fractional DPO—is an arrangement in which an organisation contracts the DPO role to an individual or service provider instead of assigning it to an employee. UK GDPR allows a DPO to be a staff member or to perform the tasks under a service contract. The ICO says an organisation can contract the role to an individual or an organisation; the external DPO should have the same position, tasks and duties as an internal one.

A group of organisations can share a DPO if the officer remains accessible and can perform the work effectively. In any arrangement, the controller or processor remains responsible for enabling the role to function properly.

What should an external DPO arrangement provide?

The appointment is more than access to occasional advice. The organisation must involve the DPO properly and in a timely manner, provide the resources and access needed to do the work, protect the officer from instructions about how to carry out DPO tasks, and ensure direct reporting to the highest management level. The DPO also serves as a contact point for data subjects and is subject to confidentiality requirements.

Before appointing a provider, define how those duties will work in practice. Ask who the named practitioner is, how they can reach relevant staff and records, how they report concerns to senior management, and how the organisation can contact them. The European Data Protection Board (EDPB) advises checking a candidate’s data-protection expertise and potential conflicts of interest. Other duties can be combined with the DPO role only if they do not create a conflict; management responsibilities that determine the purposes and means of processing are a particular concern.

How much does an outsourced DPO cost?

Engage Compliance’s 2026 provider article estimates that a properly resourced outsourced DPO engagement in the UK costs £1,500–£5,000 per month. This is a commercial estimate, not an independent market survey. It does not establish a representative market price or show that engagements in that range offer equivalent scope.

Cost item Published figure What it covers
Outsourced DPO engagement £1,500–£5,000 per month, as estimated by Engage Compliance in 2026 A provider’s estimate for a properly resourced UK engagement; comparable inclusions have not been established.
ICO data-protection fee £52 or £78 per year for most organisations, including SMBs, according to current GOV.UK guidance consulted in 2026 A separate regulatory fee, not the price of DPO cover. Larger organisations may pay more.

A monthly quote is meaningful only alongside its written scope. Ask the provider to identify any limits, response commitments, jurisdictional coverage and separately charged work. Advice, monitoring, training, data protection impact assessments (DPIAs), breach support and data-subject requests are useful items to check, but do not assume they are included unless the provider confirms them. The available price estimate does not establish that providers package these services alike.

How to assess value and ROI

There is no independent, SMB-specific evidence establishing that an outsourced DPO produces a particular return on investment, cuts breach rates, reduces enforcement penalties or lowers total compliance costs. A fixed payback period, savings percentage or avoided-fine estimate would therefore be misleading.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Instead, make a buyer-specific comparison. Estimate the full cost of an internal arrangement, including the time and continuity needed to perform the DPO tasks, and compare it with a clearly scoped service contract. Then account for work the quote excludes or caps, the organisation’s existing expertise and the level of oversight its processing requires. This is a decision framework, not a measured ROI result.

Risks to check before signing

  • Appointing when the legal test does not require it: Do not treat the handling of personal data as sufficient by itself. Assess Article 37 against the organisation’s core activities and record the reasoning.
  • A conflict that weakens independence: Check whether the named DPO or service team also decides why or how the organisation processes personal data. Agree a route for independent reporting and escalation.
  • Too little access or capacity: Confirm who will do the work, how much time is available, how the DPO will reach staff and records, what response arrangements apply, and what continuity cover exists. The organisation must provide the resources the role needs.
  • A low price with unclear limits: Identify what is included, what is capped by hours or service limits, and what costs extra. Check each service you expect in the written contract rather than relying on a general description.
  • The wrong legal jurisdiction: Verify that the provider can support the applicable legal regime and is accessible to the organisation and data subjects. UK and EU guidance are distinct; cross-border needs call for jurisdiction-specific review.
  • Confusing software with a DPO: Privacy-management tools may support records and workflows, but they do not themselves meet a requirement to designate an expert DPO with appropriate access and independence.

How to compare providers or internal and external options

Compare like with like rather than choosing on monthly price alone. Use the same expected workload and ask each option to address the following in writing:

  • Whether the arrangement is suitable for the organisation’s legal duties and jurisdictions.
  • The named practitioner’s expertise and any potential conflicts.
  • Available time, response arrangements and escalation routes.
  • Included work, service limits, caps and extra charges.
  • Access to senior management and protection of independent reporting.
  • Accessibility to staff and data subjects, plus continuity arrangements.
  • Total annual cost against the organisation’s actual workload.
