Your family cannot inherit self-custodied cryptocurrency merely because your name appears in a will. The blockchain records ownership movements, but control requires the private key, recovery phrase, PIN, or another valid signing method. Create an inventory, give a fiduciary legal authority to act, and preserve a secure operational path to the credentials without placing the secrets in a document that may become public.

This guidance is U.S.-centered educational information, not individualized legal or tax advice. Probate, privacy, unclaimed-property, securities and estate-tax rules vary by jurisdiction, and provider procedures can change.

What heirs actually receive

A blockchain does not hold coins inside a physical wallet. The Internal Revenue Service has explained that “digital assets are not actually stored in wallets”; wallets hold or help use the credentials that authorize transactions. Anyone who controls the relevant private key can generally move a self-custodied asset, while a person without that key cannot make the network release it.

Recovery phrases are commonly 12 or 24 words, and a wallet may also require a PIN or passphrase. The American Bar Association warns that without the recovery phrase or PIN, access is “almost impossible.” The Securities and Exchange Commission’s Crypto Task Force stated on May 5, 2025, that self-custody wallets are not custodians under U.S. securities law because users retain exclusive control of their private keys and assets.

Arrangement Who controls access What happens after death Main exposure
Custodial exchange or hosted wallet The provider controls or administers key access The provider applies its identity, death, probate and documentation process Provider dependency, account restrictions, insolvency exposure and disclosure of account information
Self-custody wallet The owner or designated keyholders control the keys Heirs need the credentials and legal authority to use them A court or executor cannot recreate a missing seed phrase; loss or disclosure of the key can mean permanent loss or theft

Mixed arrangements are common. An owner may hold Bitcoin in a hardware wallet, tokens in a browser extension, an NFT account, and a staking position while also maintaining an exchange account. Each location needs its own discovery and access plan.

Build a complete inventory before anyone needs it

Start with a private inventory that tells a fiduciary what exists and where the instructions are, without revealing the secrets themselves.

  • List every exchange and hosted wallet, including accounts used only for trading or transfers.
  • List hardware, mobile and browser-extension wallets, plus the devices on which they are installed.
  • Record NFT marketplaces or accounts, staking positions, liquidity or lending positions, and any other service that can hold or administer digital assets.
  • Record public wallet addresses, supported networks, account identifiers and the location of recovery instructions.
  • Note related email accounts, authentication devices and backup codes, but store their passwords and seed phrases in the protected credential system rather than in the inventory itself.
  • Record the existence of multiple wallets derived from one recovery phrase and any passphrase or secondary account that changes the visible balance.

Update the inventory whenever an account, device, network or custody arrangement changes. A list that omits a small wallet can leave assets undiscovered even when the major holdings are transferred correctly.

Separate legal authority from operational secrets

A will, trust, power of attorney or another estate instrument gives a fiduciary authority to act; it does not reveal or reconstruct a private key. A will may become part of a public probate file, so putting a seed phrase, PIN or password directly in it can expose the assets.

Use the estate documents to identify the fiduciary, authorize management or transfer of digital assets, and explain where the confidential instructions are held. Keep the actual secrets in a secure, accessible location or controlled backup. Tell the appropriate fiduciary how to locate that container, but do not put the secret words in an ordinary letter, email or publicly filed document.

Because state rules and the terms of each instrument differ, have an attorney familiar with digital-asset estate planning review the authority language. The practical instructions and the legal document must point to one another: the document authorizes access, while the protected record supplies the information needed to perform it.

Choose a handoff design deliberately

Design Security and recoverability Trust and coordination Maintenance burden
Single hardware or cold wallet with documented recovery Strong isolation when the device and backup are protected; recovery depends on the phrase, PIN and any passphrase One trusted fiduciary can act, subject to the estate documents Keep device instructions, firmware compatibility and backup locations current
Multisignature arrangement No single key is sufficient, which can reduce single-point loss or theft Requires several reliable keyholders and a clear death or incapacity procedure Higher coordination and more complicated recovery; test the signing process while the owner is alive
Separate instruction letter Can explain locations and sequence without placing secrets in a will Works only if the fiduciary can find the letter and has legal authority Revise it after every material change and protect it from unauthorized disclosure
Automated dead-man’s switch May release instructions after missed check-ins, but creates software, account and timing risks Requires trusted recipients and a carefully defined trigger Substantial ongoing maintenance; a failed service, changed login or false trigger can break the plan

A hardware wallet can reduce exposure to an always-online device, but it does not replace legal authority, a recovery record or a tested inheritance procedure. For any physical backup, weigh durability, secrecy, geographic redundancy and the risk that an unauthorized person could copy it. A durable metal record may resist fire or water better than paper, but its location and access still need protection.

Write instructions an executor can follow

  1. Identify the governing document. State which will, trust or other instrument names the fiduciary and authorizes digital-asset actions.
  2. Locate the protected records. Give the fiduciary the storage location and access procedure for the recovery phrase, PINs, passphrases, passwords and authentication backups, without printing those secrets in the will.
  3. Map each asset to its network and tool. Specify whether an item is reached through an exchange, hardware device, mobile app, browser extension or NFT account. Similar symbols can exist on different networks, so the network name matters.
  4. Explain the safe sequence. Describe how to power and unlock a device, connect it to the correct software, verify an address and obtain professional help before sending anything. Do not include an untested transaction shortcut.
  5. Provide contact and verification details. List the provider’s official support route and the documents the fiduciary should expect to supply. The fiduciary should independently verify any request for a seed phrase or transfer.
  6. Test the plan during life. Confirm that the backup restores the intended accounts and that the designated people understand their roles without exposing the full secret unnecessarily.

Preserve tax and transaction records

Keep acquisition dates, purchase amounts, cost basis, wallet-to-wallet transfers, staking and mining income, forks, airdrops where relevant, and disposition history. Maintain records by wallet or account so transactions can be reconciled across addresses and providers. IRS guidance addresses basis allocation to wallets and accounts and reporting obligations, which can change; retain the records a preparer will need rather than relying on an exchange’s current download alone.

Under 26 U.S.C. §1014, inherited property generally receives a fair-market-value basis at the decedent’s death, subject to exceptions. That rule does not eliminate the need to establish what was owned, when it was acquired, or how it moved before death. Preserve contemporaneous statements and exportable records in a format the fiduciary can read.

What the fiduciary should do after death

For an exchange or hosted wallet

Do not assume that knowing the username is enough. The fiduciary should notify the provider through its current official process and be prepared for identity, death-certificate, probate or trust documentation. Provider terms, jurisdiction and account type determine what can be released and when.

For self-custody

Locate the documented device and backup, confirm the fiduciary’s authority, and preserve the evidence before moving assets. A court can order a person to cooperate when the key exists, but it cannot recreate a missing recovery phrase. If a passphrase, PIN or multisignature participant is absent, stop and obtain specialist advice rather than improvising.

For an unknown or damaged device

Do not guess PINs, reset firmware, wipe storage or connect an unfamiliar device to a computer or network. Preserve the device in its current state and involve professionals experienced in digital-asset recovery and estate administration. The ABA specifically recommends preserving the device and seeking qualified help when credentials or hardware are uncertain.

Common failure points and preventive checks

  • Only the will is updated: The legal authority exists, but nobody knows where the operational records are. Add a private location map and review it after every move.
  • A seed phrase is photographed or emailed: Copies can be stolen silently. Use controlled storage, limit who can reach it and audit access.
  • A backup omits a passphrase or second factor: The words alone may open the wrong account or none at all. Document every additional credential and test restoration.
  • A multisignature plan has no surviving quorum: List each signer, location and replacement or incapacity process, then rehearse it.
  • Tax records are scattered: Export statements and transaction histories periodically and reconcile transfers between addresses.
  • Instructions become stale: Review the inventory, providers, devices, fiduciaries and storage locations whenever one changes, and at regular estate-planning reviews.
