The right place to report discrimination depends on the setting, the law, the respondent and the deadline. A report through the U.S. Department of Justice (DOJ) Civil Rights Portal can alert DOJ and help with routing, but it is not automatically a formal charge with the Equal Employment Opportunity Commission (EEOC), Veterans’ Employment and Training Service (VETS), HUD or a state agency. Identify the alleged conduct first, use the claim-specific filing channel, and verify every deadline directly with the agency handling that claim.

Start with the setting, not the word “discrimination”

“Discrimination” is a broad description, not a filing category. The correct intake office changes with the place where the conduct occurred, the protected characteristic or activity involved, the type of respondent and the statute that may apply. Employment, housing, a federally funded program, education, voting, law enforcement and public services can each follow different procedures.

DOJ’s Civil Rights Division says its filing information is intended to help people identify the “right place to file.” It also says the person making the allegation remains responsible for filing with the correct agency within the applicable time limit, and that DOJ cannot provide individualized legal advice. Treat the portal as one possible reporting and routing tool, not as a universal substitute for a formal complaint.

A quick routing checklist

  • Workplace discrimination or retaliation: Determine whether the allegation fits a statute handled by EEOC, VETS or DOJ’s Immigrant and Employee Rights Section (IER).
  • Individual housing discrimination: HUD is the primary federal filing route identified by DOJ for Fair Housing Act complaints.
  • Discrimination by a recipient of federal financial assistance: DOJ’s Federal Coordination and Compliance Section (FCS), or the civil-rights office of the federal agency administering the program, may have jurisdiction.
  • State or local protections: A state or local civil rights agency may accept the matter, but coverage, deadlines and cross-filing rules vary.
  • Unclear setting or agency: A DOJ portal report or contact with FCS can help identify a destination, while you separately protect any claim-specific filing deadline.

What a DOJ Civil Rights Portal report does—and does not do

The general DOJ Civil Rights Portal lets people report an alleged civil-rights violation to the Civil Rights Division. DOJ can review the information for its enforcement responsibilities or route the person toward a more appropriate office. That makes the portal useful when the facts involve a federal civil-rights issue but the correct agency is not obvious.

A portal report is different from a formal charge or complaint required by another agency. DOJ expressly warns that reporting through the portal is not the same as filing a discrimination or retaliation complaint with EEOC or VETS. If a statute requires a charge with one of those agencies to preserve legal rights, sending information to DOJ alone may not satisfy that requirement.

The portal also does not guarantee that DOJ will investigate an individual dispute. DOJ’s Civil Rights Division enforces particular federal laws and generally selects matters according to statutory authority and enforcement priorities. A submission can be useful for alerting the government, but it should not be treated as proof that an investigation has opened or that a filing deadline has been extended.

When the portal is a sensible first contact

  • You cannot identify which federal agency oversees the program or conduct.
  • The facts suggest a broader pattern affecting a group rather than only one incident.
  • You want to report a possible federal civil-rights issue while confirming the formal filing route elsewhere.
  • The conduct may involve a federally funded program and you need help locating the responsible agency.

When not to rely on the portal alone

  • You have a workplace claim that requires an EEOC charge.
  • You are asserting a USERRA employment-rights violation that belongs with VETS.
  • You have an INA-related employment discrimination charge subject to IER’s deadline.
  • You are pursuing an individual Fair Housing Act complaint through HUD.
  • A state or local law gives you a separate administrative claim with its own deadline.

Federal employment complaints: EEOC, VETS and DOJ IER

EEOC for Title VII and Pregnant Workers Fairness Act claims

DOJ’s filing guide directs people with employment discrimination or retaliation claims under Title VII of the Civil Rights Act or the Pregnant Workers Fairness Act to the EEOC. This includes allegations involving protected characteristics or protected activity covered by those statutes. The formal act is an EEOC charge, not merely a narrative report to DOJ.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For certain charges against state or local government employers, DOJ explains that EEOC may refer an unresolved matter to DOJ’s Employment Litigation Section after attempting settlement. That possible referral happens after the initial EEOC process; it does not remove the need to file with EEOC first when EEOC is the designated intake agency.

VETS for USERRA

Claims under the Uniformed Services Employment and Reemployment Rights Act (USERRA) are directed to the Department of Labor’s Veterans’ Employment and Training Service. A DOJ portal submission does not replace a USERRA complaint with VETS. Use the VETS process for the formal claim and keep the confirmation of filing.

DOJ’s Immigrant and Employee Rights Section

DOJ’s IER handles specified employment discrimination charges under the Immigration and Nationality Act. The IER guidance states that a charge must be filed within 180 days of the alleged discrimination or retaliation. That 180-day period applies to the IER claims described by DOJ, not to every workplace allegation.

IER also directs other employment discrimination matters—such as many claims involving race, sex, religion or disability—to EEOC. If the same facts could implicate more than one law, identify each theory and confirm with both agencies whether separate filings are required. Do not assume that an IER submission automatically starts an EEOC charge or vice versa.

Housing: HUD for individual Fair Housing Act complaints

For an individual complaint under the Fair Housing Act, DOJ identifies HUD as the federal filing route. HUD’s administrative process is designed to receive a person’s allegation about discriminatory housing practices. DOJ describes its own housing litigation role as focused on pattern-or-practice discrimination and matters involving denial of rights to groups or issues of broader public importance.

DOJ’s housing information gives a one-year HUD filing period and a two-year period for bringing a federal lawsuit in the specific disability-housing scenario described on that page. Those periods are context-specific. They should not be generalized to every housing allegation, every remedy or every jurisdiction. Confirm the controlling deadline with HUD or a qualified legal professional using the facts of your case.

What to collect before a housing filing

  • Addresses and dates for the property, application, accommodation request or transaction.
  • Names and contact information for the landlord, seller, broker, property manager or housing provider.
  • Copies of applications, denial letters, notices, messages and accommodation requests.
  • A factual timeline showing what was requested, what response was received and when.
  • Names of witnesses and any evidence that comparable applicants were treated differently.

Federally funded programs: DOJ FCS or the program agency

DOJ’s Federal Coordination and Compliance Section implements Title VI and related authorities for discrimination by recipients of federal financial assistance within its remit. A recipient can include an organization or government program receiving federal funds, but the responsible civil-rights office may be the federal agency that administers the particular program.

DOJ’s federal-agency directory explains that people who do not know which agency is appropriate may contact FCS for assistance. The practical question is not simply whether money originated with the federal government; it is which agency funds or oversees the program and which statute covers the alleged conduct.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Examples of questions that affect FCS jurisdiction

  • Which federal department awarded or administers the funding?
  • Is the allegation based on race, color, national origin, disability, age or another protected basis covered by the program’s authority?
  • Is the respondent a recipient or subrecipient of federal assistance?
  • Does the agency provide a specific civil-rights complaint form or deadline?

FCS guidance and federal program requirements can change. DOJ’s FCS materials include notices about guidance rescinded or revised in 2025, so use the current instructions from the responsible agency rather than relying on an old form or directory entry.

State and local civil rights agencies

State and local civil rights agencies may enforce protections that are broader than federal law, cover additional workplaces or housing providers, or provide an administrative forum close to where the conduct occurred. Some agencies participate in cooperative arrangements with federal agencies; others handle only claims created by state or local law.

There is no single national rule for state agencies. Their jurisdiction, filing deadlines, required forms, respondent coverage, remedies and relationship to federal agencies differ. A state filing may be cross-filed with a federal agency in some circumstances, but you must confirm that arrangement for the specific claim instead of assuming it.

Questions to ask the state agency before filing

  1. Does the agency cover this setting, respondent and protected basis?
  2. What is the exact deadline, and what event starts the clock?
  3. Does submitting the state form also transmit a charge to EEOC, HUD or another federal agency?
  4. If cross-filing occurs, will the agency send confirmation and identify the federal filing date?
  5. What remedies and procedures are available—investigation, mediation, conciliation, hearing or referral?
  6. Are there separate filing fees, notarization rules, language-access options or service requirements?

DOJ’s state and local directory has been identified as a legacy page. Use it as a lead only, then verify the current agency website, telephone number, intake portal and filing instructions through the state or local government.

DOJ versus a state agency: a decision framework

Neither route is always “better.” Compare the options against the law, jurisdiction, filing act, deadline, coordination and process available for your facts.

Comparison point DOJ Civil Rights Division State or local civil rights agency
Primary authority Specific federal statutes and programs, including selected federally funded-program, INA and pattern-or-practice matters. State or local anti-discrimination laws and any cooperative federal authority assigned to the agency.
Typical intake A civil-rights report through the portal, or a specialized DOJ complaint route. The agency’s own charge, complaint form or online intake process.
Does the filing preserve every other claim? No. A portal report does not replace a required EEOC or VETS filing. Not automatically. Confirm whether a separate federal charge is required.
Deadline Depends on the statute and route; IER states 180 days for its described INA charges. Varies by state, locality, claim and triggering event.
Coordination May route a report or refer matters within its authority; other agencies may remain the formal intake office. May cross-file or coordinate in some cases, but the effect must be verified.
Possible process Federal review, investigation, referral, litigation or pattern-and-practice enforcement where authorized. Investigation, mediation, conciliation, administrative hearing or referral, depending on local law.

How to file without losing a deadline

  1. Write a one-page fact summary. State what happened, who acted, where it happened, the protected basis or protected activity, and the dates. Separate what you personally observed from what someone else told you.
  2. Identify every potentially relevant setting. Mark whether the matter concerns employment, housing, education, a federally funded service, public accommodations, law enforcement, voting or another government service.
  3. Map the claim to the named intake agency. Use EEOC for the cited Title VII or Pregnant Workers Fairness Act charges, VETS for USERRA, HUD for individual Fair Housing Act complaints, IER for its specified INA charges, and FCS or the responsible program agency for covered federally funded-program complaints.
  4. Check the deadline before gathering perfect evidence. Ask the agency what date controls and whether an intake call, online form, mailed charge or signed complaint is required to meet the deadline.
  5. File through the official channel. Complete the agency’s form, follow signature and service instructions, and state clearly that you are seeking to file the formal charge or complaint rather than merely submit information.
  6. Use the DOJ portal separately when appropriate. If DOJ may have a pattern, federal-program or routing interest, submit a report, but do not describe it as replacing the claim-specific filing.
  7. Save proof. Keep the submitted form, attachments, confirmation number, email receipts, delivery tracking and any agency response in more than one secure location.
  8. Confirm next steps in writing. Ask whether the matter was accepted, transferred, cross-filed or declined, and request the controlling filing date and assigned contact if available.

Deadlines, cross-filing and records

Deadlines are legal requirements, not suggestions. The 180-day IER period and the housing periods described by DOJ illustrate why a general portal report is risky when a formal charge may be required. A state agency’s deadline may be shorter or longer, and a federal deadline can continue to run while you wait for an informal response.

Ask specifically whether an agency’s receipt of your submission stops the clock. “We received your message” is not necessarily the same as “a sufficient charge was filed.” If an agency says it will forward or cross-file your complaint, obtain written confirmation of the destination, filing date, claims transmitted and any additional signature or verification required.

Common mistakes and how to correct them

Submitting only a DOJ portal report for an EEOC or VETS claim

Problem: The portal report may not be the formal charge required by EEOC or VETS. Correction: File with the designated agency immediately and tell it about any DOJ report, including its confirmation number.

Assuming every state agency is a “deferral” or partner agency

Problem: State arrangements and cross-filing rules are not uniform. Correction: Ask the state agency and the relevant federal agency to confirm whether the specific claim will be cross-filed and what date controls.

Using a general deadline found online

Problem: Deadlines depend on statute, setting, respondent and location. Correction: Verify the period with the agency handling the exact claim and provide all relevant dates.

Waiting for DOJ to decide where to route the matter

Problem: Routing assistance does not necessarily pause another agency’s clock. Correction: File with the likely formal intake agency while requesting routing help, subject to that agency’s instructions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Sending a long narrative without a clear filing request

Problem: An agency may treat an email as an inquiry rather than a charge or complaint. Correction: Use the official form and state plainly which formal filing you intend to make.

Worked routing examples

Retaliation after reporting workplace discrimination

If the employer is covered and the allegation falls under Title VII or the Pregnant Workers Fairness Act, start with an EEOC charge. A DOJ portal report can provide additional information but does not replace the EEOC filing. If the retaliation concerns rights protected by USERRA, use VETS instead. If the allegation concerns immigration-status or citizenship-related discrimination covered by the INA, check IER’s 180-day charge rule.

Denied disability accommodation in housing

For an individual Fair Housing Act complaint, contact HUD through its complaint process and verify the deadline for the facts involved. DOJ may be interested when the facts indicate a broader pattern or public importance, but that possibility does not eliminate the HUD route.

Language-access discrimination in a federally funded program

Identify the federal department that funds or administers the program and ask its civil-rights office about the complaint process. If you cannot identify that department, contact FCS for routing assistance. Confirm whether the program agency or FCS requires a particular form and deadline.

Discrimination covered by a state law

Contact the current state or local civil rights agency, ask whether it has jurisdiction and whether it cross-files with a federal agency, then file any separate federal charge that the federal agency says is necessary. Do not rely solely on a legacy directory listing.

When professional help is appropriate

Agency staff can explain filing mechanics, but they generally cannot decide your legal strategy. Consider consulting a qualified attorney or legal-aid provider when multiple statutes may apply, deadlines are imminent, a government employer is involved, the facts span several states, you need urgent accommodation or protection from retaliation, or you are evaluating a lawsuit. Bring your timeline, evidence index and every agency confirmation to the consultation.

Agency procedures and guidance change. DOJ’s filing guide was updated January 28, 2025, and its IER charge page was updated April 28, 2026. Before submitting anything, confirm that you are using the current form, contact information and instructions for the agency with jurisdiction over your claim.
