Possibly. An overseas software subscription can attract GST, HST, VAT or an equivalent consumption tax, but there is no worldwide yes-or-no rule. The result depends on the customer’s country, whether the buyer is a consumer or a registered business, how the subscription is classified, and whether the vendor, a marketplace or the customer is responsible for accounting for tax.
Why the vendor’s country is not the deciding factor
Cross-border tax generally follows the place where a digital service is consumed, not simply the location of the company taking payment. A subscription supplied by a company abroad may therefore be taxable in the customer’s country. The customer’s country can require the overseas supplier or a distribution platform to collect tax from consumers, or it can require a business customer to calculate and report tax under a reverse-charge or imported-services mechanism.
“GST” is also not one global system. Singapore, New Zealand, India, Australia and Canada use different legislation, definitions, registration tests and business-accounting rules. The United Kingdom uses VAT rather than GST. Those systems are useful comparisons, but one country’s treatment cannot be applied automatically to another.

Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteThe four facts that determine the result
1. Where the customer is located and uses the subscription
Tax authorities normally look for evidence of the customer’s location and the place of use. Account address, billing address, payment details, business registration and other location indicators may be relevant. A foreign currency or an overseas bank account does not, by itself, move the place of consumption outside the customer’s country.

2. Whether the buyer is a consumer or a registered business
Consumer rules often make the non-resident vendor or platform responsible for collection. Business rules may instead make the recipient calculate tax on its return. “Business customer” is not the same as “customer using a business email address”: registration status and the purpose of the purchase matter.
3. What the contract supplies
Automated access to hosted software, a downloadable licence, software updates, cloud storage, technical support and human consulting may be classified differently. A package containing software and services may need to be analysed as a bundle. The classification can change the place-of-supply rule and who must account for tax.
4. Which party has the legal collection or reporting duty
The invoice may show tax collected by the vendor or a marketplace. Alternatively, it may show no tax because the customer must self-assess under reverse charge. An invoice without tax is not proof that the purchase is tax-free.

How responsibility is divided
| Situation | Party commonly responsible | What to check |
|---|---|---|
| Private consumer buys a digital subscription | Overseas vendor or platform where local overseas-supplier rules apply | Whether the supplier is registered in the customer’s country and whether the invoice shows local tax |
| Registered business buys software for business use | Often the customer under reverse-charge or imported-service rules | Registration status, business-use test, place of supply and return procedure |
| Unregistered business buys software | Depends on the country; consumer-style collection or another recipient rule may apply | Whether the law distinguishes taxable businesses from registered businesses |
| Subscription purchased through an app store or marketplace | Vendor, platform or both, according to local rules and contractual role | Which entity issued the invoice and whose tax registration number appears |
Collection responsibility and recoverability are separate. Even when a business is charged GST, HST or VAT, an input-tax credit is available only if local law permits it and the purchase supports eligible taxable activities. A reverse-charge amount may be reportable even when no cash tax is ultimately payable after a valid credit.

Country examples
Singapore
Singapore’s Inland Revenue Authority (IRAS) treats software and cloud storage as examples of remote services purchased from overseas providers. Its overseas-vendor-registration regime addresses relevant business-to-consumer supplies. A Singapore consumer should check whether the provider is registered for GST and whether the invoice includes Singapore GST.
Do not assume every overseas software company must charge Singapore GST. Registration status, the type of customer and the transaction’s facts determine whether the overseas-vendor rules apply. A provider can be outside Singapore while still having a local GST collection obligation, but the absence of GST on an invoice does not by itself establish that no tax is due.
New Zealand
New Zealand Inland Revenue says a non-resident supplying remote services from outside New Zealand to New Zealand tax-resident customers may have to register, collect and return GST. Its examples expressly include software and software maintenance.

There is an important business-customer qualification: a supplier does not need to register under this remote-services rule when it supplies remote services only to GST-registered New Zealand businesses for their business use. A mixed customer base, an unregistered business purchaser or private consumer can produce a different result. Check the supplier’s registration and the customer’s status for the relevant subscription period.

India
India’s Integrated Goods and Services Tax Act defines an import of services using three elements: the supplier is outside India, the recipient is in India, and the place of supply is in India. Online information-database access or retrieval (OIDAR) services include software and cloud services delivered online, and the OIDAR place-of-supply rule generally points to the recipient’s location.
The Central Board of Indirect Taxes and Customs (CBIC) explains that an Indian GST-registered business buying foreign software for firm use can owe IGST under reverse charge when the import-of-services conditions are met. The CBIC FAQ also states that the currency used for payment is immaterial to whether those conditions are satisfied. Paying in US dollars, euros or another currency does not remove an Indian tax obligation.
For qualifying OIDAR supplied to an unregistered, non-taxable online recipient, the statutory mechanism places registration and payment responsibility on the overseas supplier. Service classification, recipient status and current amendments still need to be checked before filing or treating an invoice as final.

The Australian Taxation Office describes a reverse-charge rule for certain offshore supplies of intangibles. Recipient-side GST applies only where the recipient is registered or required to be registered, the connection requirement is met and the purpose requirement is satisfied. The supply is excluded to the extent it is GST-free or input taxed.

That framework does not mean every Australian business software subscription is automatically reverse charged. Determine whether the particular subscription is an offshore intangible supply, whether the business-use and registration conditions are met, and whether an exclusion applies.
Canada
Canada applies GST/HST measures to cross-border digital products and services. Depending on the supply and the applicable regime, the collection role can fall on the non-resident supplier or a distribution platform. The invoice, the customer’s province and the platform’s contractual role can therefore matter. Canadian GST/HST rules should be analysed independently rather than treated as an Australian, Singaporean or Indian GST rule.
United Kingdom
The United Kingdom uses VAT. HM Revenue & Customs treats software and software updates as digital services. For cross-border business-to-business supplies, HMRC says the customer is responsible for accounting for VAT due in the customer’s country under the applicable reverse-charge rules, while business-to-consumer treatment focuses on the consumer’s location. Calling the charge “GST” does not change the UK VAT analysis.

- Identify the jurisdiction. Use the country where the customer is resident and the subscription is consumed. If staff use the service in more than one country, document the allocation rather than assuming the billing address answers every question.
- Confirm purchaser status. Record whether the buyer is a private consumer, a GST/HST/VAT-registered business, a business required to register, or an unregistered business. Do not rely solely on an email domain.
- Read the service description. Separate automated software access, downloads, updates, cloud storage, support and consulting. Note whether the agreement bundles several elements.
- Inspect the account and invoice. Look for the supplier’s local tax-registration number, tax line, marketplace name, customer tax ID and wording such as “reverse charge” or “recipient accounting.” Save the order confirmation and terms.
- Check the local collection rule. Determine whether the vendor or platform is required to collect tax from this customer category. Do not infer an exemption merely because the vendor is incorporated abroad.
- For a business, test reverse charge. Check the imported-service or offshore-intangible conditions, the place-of-supply rule, registration requirement, taxable-business-use test and any GST-free or input-taxed exclusion.
- Calculate any credit separately. Establish whether the tax can be claimed as an input credit, in what period, and with what evidence. Tax charged on an invoice and tax recoverable on a return are different questions.
- Recheck the period. Tax rules and vendor registrations can change. Verify the authority guidance that applies to the subscription date, not only the date the account was first opened.
Common mistakes and how to correct them
“The vendor is overseas, so no local tax applies.”
Remote-service and digital-supply regimes are designed precisely for cross-border transactions. Check the customer-location and supplier-registration rules in the destination country.

“No tax appears on the invoice, so I have nothing to report.”
Reverse charge can move the accounting duty from the supplier to the customer. A tax-free-looking invoice may require a self-assessment entry.
“It is software, so every country treats it identically.”
Software, cloud storage, maintenance, support and consulting can have different statutory definitions. Use the country’s wording and the actual contract.
“The company paid, so it can claim the tax.”
Payment by a company does not establish registration, taxable use or credit entitlement. Keep the tax invoice and verify the input-credit restrictions that apply to the purchaser’s activities.

“The payment currency determines the tax.”
Currency is not a substitute for place-of-supply analysis. India’s CBIC specifically says currency is immaterial to the import-of-services conditions, and the same practical caution applies elsewhere: identify the customer, service and statutory rule first.
What records a business should keep
- The subscription agreement, renewal date and description of each service component.
- Invoices, credit notes, payment confirmations and the platform or vendor identity.
- Customer tax-registration details and the evidence used to establish location.
- Reverse-charge calculations, return entries and the reasoning for any exemption or exclusion.
- Evidence that the service supports taxable business activities when an input credit is claimed.
These records help reconcile recurring monthly or annual charges when a vendor changes its tax registration, invoice format or marketplace arrangement.
When professional advice is warranted
Obtain advice from a qualified tax professional in the customer’s jurisdiction when the subscription is bundled with consulting, users are spread across countries, the purchaser is near a registration threshold, the vendor’s invoice conflicts with the local rule, or a large reverse-charge or input-credit amount is involved. Ask the adviser to identify the exact service classification, place-of-supply provision, reporting period and evidence required—not merely whether the vendor is “foreign.”
Bottom line
An overseas software subscription may be taxable, but the answer is determined by the buyer’s country and status rather than by the vendor’s location or payment currency. Consumers may see local tax collected by the overseas vendor or platform. Registered businesses may instead need to self-assess under reverse charge or imported-service rules, with credit eligibility considered separately. Start with jurisdiction, purchaser status, service classification and invoice treatment, then verify the current authority guidance for the subscription period.
