To appeal a GST penalty or demand order, file FORM GST APL-01 with the order, proof of when it was communicated, taxpayer and officer details, a precise calculation of every disputed amount, statement of facts, grounds of appeal, prayer, verification and evidence supporting each ground. Keep the original notices, replies, returns, invoices, ledgers, payment records and hearing papers in the same evidence bundle. A first appeal generally must be filed within three months of communication, and the GST portal FAQ states that at least 10% of the disputed tax (not automatically 10% of the penalty) must be deposited before filing.

What you must have before starting the appeal

The first appeal is made by an aggrieved registered taxpayer or an unregistered person in FORM GST APL-01. The form and supporting-document requirements are set out in the CGST Rules form reproduced by the Central Board of Indirect Taxes and Customs (CBIC): FORM GST APL-01. The GST portal’s appeal FAQ states that the normal time limit is three months from communication of the order and that the minimum pre-deposit is at least 10% of disputed tax: GST portal appeal FAQ.

Before entering data, create a dated working file containing the order, the notice that led to it, your reply, hearing submissions and all records that prove the facts. Record the exact communication date shown in the portal or on the service record; the limitation period runs from communication, not from the date printed on the order.

FORM GST APL-01: field-by-field document checklist

APL-01 is not just an upload screen. Each field needs a document or calculation that can be checked by the appellate authority.

APL-01 item What to keep ready Practical check
GSTIN, temporary ID or UIN GST registration certificate, temporary ID allotment or UIN record Use the identifier connected with the impugned order; check every digit.
Legal name, trade name and address Registration certificate and current principal-place-of-business details Use the name and address applicable to the period and order.
Order number and date Complete penalty or demand order PDF, including annexures Do not rely on a screenshot that omits pages or annexures.
Issuing officer’s designation and address Order heading, signature block and department address Copy the designation exactly as shown in the order.
Date the order was communicated Portal download history, email, physical service record or other proof of service Preserve the file metadata and a printout or PDF showing the date.
Authorised representative Written authorisation, power of attorney or appointment letter, plus the representative’s details Ensure the authorisation covers the appeal and hearing.
Brief issue, goods/services, classification and dispute period Show-cause notice, demand summary, return periods, invoices and classification material State the precise tax period and disputed transaction, not a broad business description.
Amounts under dispute Working paper reconciling CGST, SGST/UTGST, IGST and cess Separate tax or cess, interest, penalty, fees and other charges.
Market value of seized goods, where relevant Seizure memo, inventory, valuation report and photographs, if available Leave this issue out only when no seizure is involved.
Personal-hearing choice Instruction to request or not request a hearing Mark the choice deliberately; retain a copy of the submitted selection.
Statement of facts Chronology supported by notices, replies, returns and correspondence Use numbered facts tied to exhibit numbers.
Grounds of appeal Issue-by-issue legal and factual objections with supporting records Give a separate ground for each error instead of one general denial.
Prayer Exact relief sought, such as setting aside or reducing the penalty and consequential demand Make the requested order consistent with the grounds and calculations.
Demand created, admitted and disputed; verification and signature Signed verification, authority proof and a reconciliation of admitted versus disputed amounts Check that the signer is authorised on the filing date.

Core documents to attach

The impugned order and service proof

Attach the complete penalty or demand order, every annexure, and the notice or summary that identifies the demand. Add proof of communication: portal download or view record, email header, service acknowledgement or the department’s delivery record. The communication proof establishes the limitation date and helps explain any difference between the order date and the date you actually received it.

Earlier submissions and hearing record

Include the original show-cause notice, your reply, written submissions, adjournment requests, documents filed during the hearing and any hearing minutes or order-sheet entries. If the officer rejected an explanation, identify the page where it was made and show why the rejection is factually or legally wrong.

Returns, reconciliations and transaction records

Use the GST returns for each disputed period, electronic liability or credit-ledger extracts, tax invoices, debit and credit notes, e-way bills where relevant, sales and purchase ledgers, bank statements and a reconciliation to the figures in the order. Label each document with the period, supplier or customer and the APL-01 ground it proves.

Payments and compliance records

Attach challans, payment references, DRC forms or other proof for tax, interest or penalty already paid, together with proof of any reversal or credit adjustment. Separate amounts admitted from amounts challenged so the appellate authority can see what remains in dispute.

Authorisations and correspondence

Where a GST practitioner, chartered accountant, tax lawyer or other authorised representative acts, include the signed authorisation and identity details requested by the portal. Keep correspondence with the proper officer, help-desk tickets and notices that affect the calculation or filing route.

How to prepare the statement of facts, grounds and prayer

Statement of facts

Write a short chronological account: registration and business activity, the relevant transactions and tax periods, notice and reply dates, hearing events, the officer’s findings and the resulting demand. Put one factual proposition in each numbered paragraph and cite the document or exhibit that proves it. The APL-01 form labels this section “Statement of facts:-”.

Grounds of appeal

Turn each error into a distinct ground. Typical categories include an incorrect classification or rate, a calculation that ignores returns or payments, denial of an opportunity to respond, reliance on facts contradicted by invoices or ledgers, or a penalty imposed without the statutory conditions being met. State the factual evidence first, then the legal consequence you say follows. Do not introduce a new figure in the grounds that is absent from the amount schedule.

Prayer

Specify the relief: annulment of the penalty, deletion or reduction of a particular component, correction of tax or interest, recognition of payments, or any consequential direction that the appellate authority can grant. The form labels this section “Prayer:-”. Make the prayer match the disputed-amount table and the grounds; an unrequested remedy may not be considered.

Amounts, pre-deposit and the seven-day order-copy rule

Separate every component

Prepare a schedule with separate columns for CGST, SGST/UTGST, IGST and cess, and separate rows for tax or cess, interest, penalty, fees and other charges. Show the amount created by the order, the amount admitted, the amount already paid and the amount disputed. This prevents a penalty-only dispute from being incorrectly described as a tax dispute.

Amount category How to present it
Tax or cess Identify the statutory head and period; show the order figure, payments and disputed balance.
Interest Show the computation period, rate used in the order and any payment or correction claimed.
Penalty Identify the provision and event relied on; state whether the entire penalty or only a portion is challenged.
Fees and other charges List each charge separately rather than folding it into tax or penalty.
Pre-deposit The GST portal FAQ states a minimum of at least 10% of disputed tax before filing. Do not calculate this as 10% of the penalty unless the applicable law expressly requires that treatment.

If the order is not uploaded

The GST portal FAQ and Rule 108 state that, when the order is not uploaded, a self-certified copy is to be submitted within seven days in the stated circumstances. Rule 108 also refers to submission of the certified decision or order and explains how the filing date is treated. Follow the portal prompt and the applicable rule for your case, upload a legible complete copy, and keep the upload receipt. If a certified copy is required, obtain it from the issuing authority rather than assuming a self-certified scan will suffice.

When the appeal is legally filed

Under Rule 108, the appeal is treated as filed when the final acknowledgement, FORM GST APL-02, carrying the appeal number is issued. Save APL-02, the ARN, payment challan and every uploaded file in a read-only folder. A draft, saved application or APL-01 preview is not the same as the final acknowledgement.

Filing workflow on the GST system

  1. Confirm limitation and jurisdiction. Record the communication date, calculate three months, identify the appellate authority and verify whether the order is available in the portal.
  2. Reconcile the demand. Match the order with returns, ledgers and payments. Mark each line as admitted, paid or disputed and calculate the disputed-tax pre-deposit separately from disputed penalty, interest and fees.
  3. Assemble searchable PDFs. Put the order first, then notices, submissions and evidence in a logical index. Use file names that identify the exhibit and ground; check that pages are readable and within the portal’s current size limits.
  4. Open the appeal service and select APL-01. Enter the GSTIN, legal details, order number, officer details, communication date, issue, classification, period and amount schedule exactly as supported by the documents.
  5. Complete the narrative fields. Paste the statement of facts, grounds and prayer into the relevant fields or upload them in the format permitted by the portal. Select the personal-hearing preference and add the representative only when a valid authorisation is ready.
  6. Upload evidence and the order copy. Attach the impugned order and every document directly tied to a ground. If the order is missing from the portal, follow the seven-day self-certified or certified-copy process that the system and Rule 108 prescribe.
  7. Pay the required pre-deposit and any displayed fee. Use the portal’s current payment instructions, retain the challan and verify that the payment is linked to the appeal before final submission.
  8. Verify and submit. Check names, dates, tax heads, disputed figures, hearing choice and attachments. Complete the verification and authorised signature or electronic verification, then submit.
  9. Download the final record. Confirm that APL-02 with the appeal number has been generated. Download the acknowledgement, ARN, filed APL-01, payment proof and attachment list; these establish what was actually filed.

Special choices and variations to check

Electronic versus otherwise-notified filing

Electronic filing is the normal route shown by the GST portal, but legislation or a notification may permit a different method for a particular class of taxpayer, order or technical situation. Check the current portal instructions and applicable CGST, SGST or UTGST notifications before sending a physical or alternative filing. Do not assume that mailing documents preserves the deadline unless the applicable rule says so.

Self-representation versus an authorised representative

You may prepare and sign the appeal yourself, or appoint a qualified GST practitioner, chartered accountant or tax lawyer. A representative can help organise the chronology, legal grounds and evidence, but the taxpayer remains responsible for the accuracy of GSTIN, figures, dates and authorisation. Give the representative the complete order and service proof, not only the penalty page.

Personal hearing

APL-01 asks whether a personal hearing is requested. If the dispute turns on an explanation, classification, reconciliation or an adverse inference from documents, consider requesting one and prepare a short speaking note keyed to the grounds. Keep the request and any later hearing notice with the appeal file.

State-specific fees

Fees and portal amounts can vary by applicable state rule and may change. For example, the Karnataka KGST Rules PDF reproduces a Rule 108 amount of ₹1,000 for every ₹1 lakh of tax or input-tax-credit involved, subject to a maximum of ₹25,000: Karnataka KGST Rules. Treat that as a Karnataka rule example, not a nationwide amount; confirm the current rule and the amount displayed for your appeal before payment.

Common document and filing mistakes

  • Counting from the order date. Use the documented communication date and preserve the service evidence.
  • Calling the pre-deposit a penalty deposit. The portal FAQ expresses the minimum as at least 10% of disputed tax; calculate the tax component separately.
  • Uploading an incomplete order. Include annexures, demand summaries and pages bearing digital signatures or computation tables.
  • Using one unexplained total. Split CGST, SGST/UTGST, IGST and cess, then split tax, interest, penalty, fees and other charges.
  • Repeating the notice instead of proving the defence. Link every ground to an invoice, return, ledger, payment or procedural record.
  • Leaving the hearing choice accidental. Review the yes-or-no selection before signing.
  • Assuming a saved draft is filed. Retain APL-02 and its appeal number; without the final acknowledgement, you may not have proof of filing.
  • Using the wrong state fee or route. Check current CGST, SGST/UTGST rules, notifications and portal instructions for the order’s jurisdiction.

Final pre-submission check

  • The three-month deadline has been calculated from communication and the evidence of that date is attached.
  • The complete order, notices, replies, hearing papers and proof of communication are readable.
  • Every disputed figure reconciles to returns, ledgers and payment records.
  • Tax, interest, penalty, fees and other charges are separated by GST head.
  • The pre-deposit is based on disputed tax, and the challan is saved.
  • The statement of facts, grounds and prayer are numbered, internally consistent and supported by exhibits.
  • Any representative’s authorisation and the signer’s authority are valid.
  • The order-copy procedure has been followed where the order was not uploaded, including the seven-day requirement when applicable.
  • APL-02 with the appeal number has been downloaded after final submission.

Because portal fields, fees and filing notifications can change, verify the live GST portal instructions and the CGST, SGST or UTGST rule governing the particular order immediately before submission.
