Not every website needs a cookie banner, and leaving one out does not automatically trigger a €20 million fine. The risk arises when a site uses cookies or other tracking that require consent without obtaining valid consent. Under the GDPR, the maximum for certain infringements is €20 million or, for an undertaking, 4% of its total worldwide annual turnover from the preceding financial year, whichever is higher. Regulators decide whether to fine and what measure is proportionate to the circumstances.
Why the headline figure is not an automatic penalty
The GDPR’s €20 million figure is a statutory maximum, not a standard charge for an absent or poorly designed banner. Article 83(5) covers specified infringements, including breaches of basic data-processing principles and consent conditions. For an undertaking, the maximum is €20 million or 4% of worldwide annual turnover from the preceding financial year, whichever is higher. The amount is denominated in euros; converting it to dollars would require a dated exchange rate. GDPR Article 83 sets the ceiling and the categories of infringement.
That ceiling does not determine the outcome of an individual case. Regulators may issue a warning, reprimand, order, or fine. The European Commission says relevant factors include the infringement’s gravity and duration, whether it was intentional or negligent, steps taken to mitigate harm, and cooperation with the authority. Article 83(1) requires administrative fines to be effective, proportionate, and dissuasive in each case. See the European Data Protection Board’s fines overview and the European Commission’s explanation of enforcement and sanctions.
Does every website need a cookie banner?
No. The legal question is not simply whether a site has cookies, but what its technologies do, for what purpose, and under which country’s rules. The ePrivacy Directive addresses storing information on, or accessing information from, a user’s device. Its rules are implemented through national law. The GDPR may also govern personal-data processing and the conditions for valid consent when applicable.
Ireland’s Data Protection Commission says a site using only cookies that do not require consent may not need a banner or consent-management tool. It still recommends explaining strictly necessary cookies in a cookie policy or privacy notice, and says users need clear information before cookies or tracking are used. Its guidance answers whether a website has to have a banner; it is Irish guidance, not a universal implementation checklist for every country.
How to assess your site’s cookie and tracking choices
- Inventory what the site uses. Check cookies, pixels, software development kits, and other technologies that store information on or access information from a user’s device. Record their purposes and when they run.
- Assess which uses are strictly necessary and which need consent. Do not assume that a technology’s label or vendor description settles its legal status. The purpose and applicable national rules matter.
- Give clear information before consent-requiring storage or access. Explain the purposes in understandable terms and make the way to refuse clear.
- Make refusal as easy to find and use as acceptance. Avoid hiding the reject choice in dense text, diminishing it through color, size, or style, or presenting repeated accept choices beside one ambiguous refusal.
- Review the result against the countries where the site operates and the technologies it uses. National implementation and regulator guidance vary; seek qualified privacy or legal advice when the stakes are material.
Retaining evidence of the consent choices offered and the site’s resulting configuration is a sensible compliance practice. The cited guidance does not prescribe a particular log format or retention period.

What misleading banner design can mean in practice
On 12 December 2024, France’s CNIL said it had ordered publishers to change banners it considered misleading after complaints. Examples included a reject link visually subordinated by color, size, or style; a refusal choice embedded so it was not readily apparent; inadequate visual separation; and multiple ways to accept paired with a single ambiguous refusal. CNIL said the publishers had one month to modify the banners so consent would be valid. This is a France-specific enforcement account, not evidence that every missing banner leads to the GDPR maximum. CNIL’s notice on dark patterns in cookie banners describes the cases.

CNIL says authorities do not set one universal color or contrast standard, but a design must not mislead users. The practical test is whether people can understand the purposes and make a real choice—not whether the buttons follow one prescribed color scheme.
What regulators’ coordinated banner review found
CNIL’s summary of the EDPB Cookie Banner Task Force report says that 18 EU/EEA data protection authorities received several hundred complaints from NOYB between May 2021 and August 2022, and that the task force held 13 working meetings. The summary reports that a vast majority of authorities considered the absence of a reject or refuse option at the same level as accept contrary to ePrivacy requirements. These are dated findings from that coordinated work, not a current count of complaints or a measurement of all websites. CNIL’s summary of the task-force report provides the details.
