Usually, no: buying a digital game does not guarantee that you can keep playing it forever. In many storefronts, the transaction gives you a personal license to access software under platform and publisher terms, not ownership of the copyright or an unrestricted, transferable copy. Continued use can depend on your account, the storefront still operating, digital-rights management (DRM), console compatibility, and the game’s own online servers.
A disc or cartridge can reduce reliance on a download store, but it is not automatically a permanent-play guarantee. The exact answer depends on the title and edition, the applicable contract, technical requirements, and consumer law where you live.
What you actually get when you click “Buy”
The word “buy” on a store button describes the checkout transaction; it does not, by itself, define the legal rights that follow. The Federal Trade Commission (FTC) explains that digital access may depend on an active account or the platform remaining in business, and that DRM can restrict how and where content works. Its consumer guidance, published 18 April 2024, says a buyer may receive a license to access digital content rather than an unrestricted copy. Read the FTC guidance.

Federal Trade Commission consumer guidance, 18 April 2024
A license is permission to use software under stated conditions. It is different from owning the game’s copyright, being able to transfer the license to another person, or having a promise that the publisher will operate every required service indefinitely. A platform’s purchase terms can also impose account, territory, device, subscription, or non-commercial-use restrictions.
License, copy, and copyright are separate concepts
- Copyright ownership: The publisher or other rights holder generally controls the intellectual property. Paying for a copy does not transfer that copyright.
- Use license: The platform or publisher can grant personal permission to run the software under its terms. The permission may be non-exclusive, non-transferable, and limited to specified systems.
- Access to data: You need a way to download or launch the files. An account, store infrastructure, activation service, or DRM check can be part of that pathway.
- Service availability: Multiplayer, progression, cloud saves, authentication, and even a game’s launch process may depend on servers that can later be changed or shut down.
Sony’s US PlayStation software terms state, “The Software is licensed to you, not sold.” The same terms describe a limited, non-exclusive, non-transferable, personal license for private, non-commercial use on the intended system or device. They also reserve the ability to stop supporting or discontinue software and terminate online services, which can mean losing access to gameplay, progression, or virtual content. Those are contractual terms for covered PlayStation software, not a universal rule for every game or country. Read the PlayStation Software EULA (US).

Why “keep forever” is an unsafe assumption
“Forever” combines several different promises that a digital purchase may not make. A game can remain listed in your account while a required authentication service fails. You may retain downloaded files but lose the ability to activate them on a replacement console. A title can disappear from sale while existing customers retain downloads, or a store can eventually change the download service itself. The contract and technical design determine which outcome applies.
Your account can be part of the product
Digital licenses are commonly linked to the account that made the purchase. Losing access to that account, violating platform rules, changing a territory, or encountering a platform migration can affect the ability to redownload or launch the game. Nintendo’s US purchase terms, for example, describe account ties and territory limits, and say that some software and digital content are licensed rather than sold. They also describe possible restrictions across devices. These provisions apply to the covered Nintendo purchases and region, not automatically to every storefront. Read Nintendo’s US Purchase and Subscription Terms.

DRM can limit where and how a game runs
DRM is technology that checks authorization or enforces use conditions. Depending on the title, it can require periodic or one-time online activation, restrict the number of devices, or prevent use outside an approved platform. The FTC identifies DRM as a reason digital content may not be fully under the buyer’s control. The presence of DRM does not predict a particular game’s future; you must check that game’s requirements.
Publisher services can be a hidden dependency
A game may need a publisher account, an authentication endpoint, cloud infrastructure, or a matchmaking service even when the software is installed locally. If the publisher loses a license for music, characters, sports leagues, or another component, it may also alter or withdraw the game. The FTC specifically warns that the seller’s own content-licensing problems can affect a buyer’s access.

1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteDo physical games give you permanent ownership?
Physical media gives you a disc or cartridge that you can hold. The FTC uses that distinction plainly: “When you buy a physical item, you’ve got it. It’s yours.” That statement explains why a physical copy is less dependent on a store account than a purely digital entitlement; it does not promise that every feature of a game will remain usable. FTC consumer guidance.
A physical release can still require an internet connection, an activation check, a large download, a patch, a launcher, or a publisher account. Multiplayer and other online features can disappear when servers close. A disc can also be incomplete: some releases put only a small installer or an older build on the medium and download the playable content later.
Sony’s US terms provide a narrow practical example. If a PlayStation device is suspended, disc games that run on the console can still be played when they do not need to connect to PlayStation services. That does not mean every disc works offline, that every release is complete, or that it will run on future hardware. See the PlayStation Terms of Service (US).

Check a physical edition before relying on it
- Confirm the exact console generation, region, and edition.
- Find out whether the disc or cartridge contains a playable build rather than only an installer.
- Check for mandatory downloads, patches, launchers, account linking, or online activation.
- Test or verify whether single-player starts and continues without publisher servers.
- Treat multiplayer, cloud saves, events, and other connected features as service-dependent.
- Confirm that the hardware you own, and any hardware you plan to use later, supports the release.
What is the difference between delisting and losing access?
Delisting means a game is removed from sale or distribution through a storefront. Loss of access means an existing customer can no longer download, launch, or use some or all of the game. Delisting alone does not answer the second question.
After a delisting, existing buyers might still be able to redownload the title from their account. They might instead lose redownload access if the store retires its delivery system, or be able to download but not launch if activation servers are gone. The relevant variables are the store account, the platform’s download service, the license terms, DRM, console support, and the game’s server architecture. No single rule covers every store, game, territory, or purchase.
Questions to ask when a title leaves a store
- Does the publisher or platform say whether previous purchasers retain redownload rights?
- Can the game be downloaded to a currently supported device while the service remains available?
- Does first launch or later play require online authentication?
- Does single-player continue if the publisher’s servers are unreachable?
- Are saved games, expansions, or virtual items tied to a subscription or server?
What happens when a game’s servers shut down?
Server closure can have different effects. A fully offline game may continue to run from an installed copy. A game that requires authentication, cloud streaming, an online world, or server-side progression may become partly or wholly unplayable. Multiplayer can stop even when a single-player campaign remains available. A patch, account service, or downloadable content endpoint can also be a dependency.
The European Commission’s 17 June 2026 announcement about the “Stop Destroying Videogames” citizens’ initiative says modern games often rely on publisher servers and can become partly or wholly unplayable when support stops. The Commission stated: “The Commission considers that at this stage it cannot propose a legal obligation to keep video games playable after they stop being provided commercially.” This is an EU-level policy position, not a ruling on an individual game or a universal statement of law. Read the Commission announcement.

What platform terms say about subscriptions and termination
Subscription access is usually more conditional than a one-time purchase. Nintendo’s US terms say subscription features are licensed for the subscription term and describe possible deletion of data associated with a subscription after expiration or termination. That means a paid subscription should not be treated as ownership of every game or feature it exposes. Read the terms for your territory and the specific service.
Sony’s US software terms likewise reserve the ability to discontinue software support and online services. They preserve applicable local-law consumer rights, including rights for residents in the European Economic Area, but those rights do not turn every digital purchase into an unconditional perpetual license.

Consumer protections vary by jurisdiction. Contract terms, mandatory digital-content rules, remedies for non-conforming products, and limits on unfair terms can all change the result. US guidance from the FTC is educational and does not decide a particular dispute or override a platform contract.
European Union protections
The European Commission says EU providers must tell consumers before signup about a digital service’s duration and termination conditions. Under the EU digital-content and digital-services rules, consumers can have remedies when supplied content or a service does not conform to the contract or to reasonable expectations. Depending on the circumstances, remedies can include bringing the content or service into conformity, a proportionate price reduction, or ending the contract.

The Commission’s 2026 position also says it cannot currently propose a general legal obligation requiring publishers to keep games playable after commercial provision ends, citing issues that include intellectual-property rights. EU rules may still provide remedies in a particular case; they do not establish a universal “play forever” guarantee.
Digital versus physical: a practical comparison
| Question | Digital purchase | Physical copy |
|---|---|---|
| What you hold | Account-linked access under platform or publisher terms; the FTC says digital purchases are often licenses. | A disc or cartridge held by the buyer, although the software can still have contractual and technical conditions. |
| Store dependence | Download and account services can matter for installation, redownload, or authorization. | Reduces dependence on a download storefront, but may still need activation, updates, or downloads. |
| Offline play | Depends on DRM, launch checks, and whether the game calls online services. | Depends on whether that particular release runs from the medium without services. |
| After delisting | Existing access depends on account, redownload service, license, and technical dependencies. | The medium may remain usable, subject to required downloads, activation, servers, and hardware compatibility. |
| After server shutdown | Online modes or even launch can fail if they require the server. | Offline modes may remain, while server-dependent modes can still stop. |
| Future hardware | Compatibility depends on the platform supporting the license and software. | Compatibility depends on the console accepting the medium and supporting the game. |
A buying checklist for people who want long-term access
No format is “forever-proof,” so evaluate the individual title before paying.
- Read the purchase and software terms. Look for license duration, transfer restrictions, termination language, account requirements, territory limits, and service-discontinuation clauses.
- Identify the delivery path. Determine whether you can download an installer or full build, whether the store keeps redownloads available, and whether the game uses DRM or activation.
- Map online dependencies. Check launch authentication, single-player saves, multiplayer, cloud features, virtual items, and downloadable content separately.
- Check the edition. A deluxe, remastered, regional, or subscription edition may have different downloads, entitlements, or servers from the base release.
- Check hardware support. Confirm the console generation and whether the platform supports the title on the hardware you expect to use.
- Prefer documented offline capability when it matters. A publisher statement or reliable technical documentation is stronger evidence than the presence of a disc alone.
If you already bought the digital version
Keep your account credentials secure and maintain access to the email, recovery methods, and territory associated with the purchase. Download the game while the platform supports it, and record the edition and required add-ons. If the title has an offline mode, verify its behavior before you lose network access rather than assuming that an installed copy will launch indefinitely.

How to choose between digital and physical
Digital is a reasonable choice when
- You value immediate delivery, portability across your supported devices, or a library tied to one account.
- The title has a clear offline mode and you accept the platform’s license and service terms.
- You understand that redownload, DRM, and future compatibility remain platform-dependent.
Physical is preferable when
- You want a copy you can hold and a way to reduce dependence on a storefront account.
- The exact edition is documented as playable without mandatory servers or activation.
- You have checked that the disc or cartridge contains enough data and works on hardware you intend to keep using.
Neither format solves every risk when
- The game is built around an online world or server-side progression.
- Required content is delivered only through a service that can be discontinued.
- Future hardware compatibility is uncertain and no supported migration path is promised.
The most accurate answer to “Do I really own the digital games I buy?” is therefore conditional: you generally obtain a license to use the software under stated terms, while continued play depends on accounts, technology, services, and local law. Treat “keep forever” as a claim to verify for each game, not as an automatic result of clicking “Buy.”
