The Department of Homeland Security rejected a Government Accountability Office recommendation that Immigration and Customs Enforcement add automated controls to activate body-worn cameras. DHS accepted six other GAO recommendations, but opposed automatic activation because triggers could record sensitive people or activity when no enforcement incident is occurring.

What GAO recommended—and what DHS rejected

GAO recommendation 5 asks ICE to implement additional controls, including automated camera activation, to improve compliance with ICE’s own recording policy. GAO said technology tied to events such as emergency-light activation could provide better assurance that unexpected incidents are recorded.

DHS did not concur with that recommendation. In its written response, the department cited “operational risks, including inadvertent or false activations during routine movement,” along with the possibility of unauthorized recording of informants, victims and protected First Amendment activity. DHS agreed with six other GAO recommendations.

The disagreement is a policy response to GAO recommendation 5, not a law permanently prohibiting automatic activation. GAO lists the recommendation as open while it awaits confirmation of agency action.

Why automatic activation is contested

GAO’s reliability argument

Manual activation depends on an employee recognizing an event, remembering the rule and operating the camera at the right moment. An unexpected use-of-force incident, vehicle stop or emergency response can unfold before an officer has time to press a button. GAO’s position is that event-based controls could reduce missed recordings and make policy compliance less dependent on individual judgment.

DHS’s privacy and control argument

DHS says a trigger connected to vehicle movement, emergency equipment or another operational signal could activate during ordinary activity. That could capture confidential conversations with informants or victims, bystanders who are not part of an enforcement action, or constitutionally protected demonstrations and other First Amendment activity. DHS therefore favors retaining human control rather than accepting a system that may record first and sort out exceptions later.

Would a weapon draw or emergency lights automatically start a camera?

GAO’s recommendation supports considering automated activation controls; it does not establish a nationwide list of required triggers. Emergency-light activation is an example of the type of event agencies could evaluate. The report does not require a camera to turn on whenever an ICE officer draws a weapon, and DHS’s response rejects automated controls generally rather than approving or banning one specific sensor. Any trigger design would have to define exceptions, notification, access, retention and audit rules.

How many cameras ICE and CBP have deployed

The published figures count cameras, not agents. They do not show how many employees have an assigned device or how often each device records.

Agency Deployment began Reported deployment Additional context
ICE Fiscal year 2024 Approximately 4,800 cameras as of April 2026 Nearly evenly divided between Enforcement and Removal Operations and Homeland Security Investigations
CBP Fiscal year 2021 Approximately 11,500 cameras as of June 2026 GAO reported the figure for CBP’s broader body-camera program

GAO reported that CBP and ICE paused further camera deployment in February and June 2025, respectively, after program funding decisions. The pauses and the later deployment totals describe program scale; they do not establish that every field employee had a camera or that every recording-required event was captured.

What GAO found about oversight and day-to-day use

GAO reviewed program management, policies, deployment information and interviews at 10 field locations. It identified several controls that can affect recording compliance even without an automated trigger:

  • Program plans were outdated.
  • Agencies lacked results-oriented performance measures showing whether cameras improved transparency, public trust or the availability of footage for use-of-force investigations.
  • Many offices lacked sufficiently detailed operational guidance.
  • Interviewed personnel were unsure when to activate cameras during vehicle searches and detainee transport.
  • At one ICE office, employees had completed training but had not begun using cameras because they were uncertain about the rules.

These findings concern management and policy execution. GAO did not adjudicate the high-profile shootings discussed in some news coverage or determine the facts of individual incidents.

Where the two positions differ

Issue GAO’s approach DHS’s response
Capture reliability Use additional controls, including automated activation, to reduce missed footage during unexpected events. Keep activation under operational control because automatic signals can fire when no recording is appropriate.
Privacy exposure Improve assurance that policy-required encounters are recorded, with controls still needed for sensitive material. Prioritize preventing inadvertent recording of informants, victims and protected activity.
Operational clarity Pair technology with clearer policy and field guidance. Reject the automated-control recommendation while other policy and management actions proceed.
Accountability measurement Establish outcome-focused measures rather than tracking deployment alone. Accepted six GAO recommendations; the response to automated activation remains nonconcurrence.
Implementation status Recommendation 5 remains open pending evidence of corrective action. No commitment to implement automated activation controls was made in the written response.

What happens next

GAO’s September 15, 2026, report, GAO-26-108157, leaves the dispute in an oversight phase. ICE and DHS can still improve compliance through clearer situation-specific instructions, supervisor review, training refreshers and measures that test whether required footage is actually available. Those steps would address the manual-use problems GAO documented even if DHS maintains its opposition to automatic triggers.

The issue became public on October 14, 2026, when The Associated Press and congressional lawmakers highlighted DHS’s response. The public record therefore shows a disagreement over how to balance reliable capture with privacy—not a final determination that every ICE camera must, or must not, activate automatically.

What the findings mean for readers

  • A deployment total is not a compliance rate. Knowing that ICE had approximately 4,800 cameras in April 2026 does not show whether a particular encounter was recorded.
  • Manual activation rules matter as much as hardware. Unclear instructions for searches, transport and unexpected incidents can leave gaps even when equipment is available.
  • Automatic activation is not the same as unrestricted recording. A workable system would need event definitions, privacy exceptions, access controls, retention limits and audits.
  • A consumer body-worn camera cannot be assumed to have ICE’s evidence-management, retention or privacy controls.
