The Delhi High Court has allowed a taxpayer to file a statutory GST appeal and ask the appellate authority to exempt it from pre-deposit requirements to the extent permitted by law, after the taxpayer alleged that parallel proceedings involved overlapping demands. The Court did not rule that the demands were duplicates or grant a blanket waiver, according to a JurisHour report published on 13 October 2026.
What the Delhi High Court allowed
The reported relief is procedural: the taxpayer may file an appeal under Section 107 of the Central Goods and Services Tax Act, 2017, against an order dated 30 August 2024, and accompany it with an application seeking exemption from pre-deposit “to the extent permissible in law.” The report attributes that formulation to the respondents’ position and says the Court relied on their statement in declining to restore the writ petition.
The appellate authority—not the High Court in this proceeding—is to consider the taxpayer’s claim that demands overlap and its request for exemption. The report does not establish that any exemption was ultimately granted.
How the dispute reached the Court
The matter arose from a restoration application after the High Court disposed of a batch of 48 petitions on 11 August 2026. The petitioner said counsel’s consent to disposal of the batch had been wrongly recorded and asked the Court to restore its writ petition. The petition had challenged an order dated 30 August 2024 and Notification Nos. 09/2023 and 56/2023, dated 31 March 2023 and 28 December 2023.

The bench, identified in the report as Justice Anil Kshetarpal and Justice Bharat Parashar, condoned an 11-day delay in filing the restoration application. It did not restore the writ petition. Instead, the taxpayer received liberty to pursue the statutory appeal and submit its exemption request.
Why the taxpayer said another pre-deposit was an issue
The taxpayer’s counsel reportedly argued that parallel proceedings had produced demands that overlapped. In particular, counsel said a show-cause notice dated 5 April 2023 overlapped with another dated 14 August 2024, and that an appeal had already been filed against an order dated 14 August 2023. The taxpayer’s concern was that appealing a further order would require another pre-deposit even if the underlying demands covered the same matter.

Those details are reported submissions, not findings by the Court that the notices or demands were identical. The appellate authority is to assess the overlap claim when considering the appeal and the accompanying request.
What the decision does—and does not—mean
- It permits a route to appeal: the taxpayer may pursue a Section 107 appeal against the 30 August 2024 order.
- It permits a request, not an automatic waiver: the taxpayer may ask for exemption from pre-deposit to the extent allowed by law.
- It leaves overlap unresolved: the report says the appellate authority may examine whether proceedings involved overlap or duplication.
- It did not revive the writ petition: condoning the 11-day delay in the restoration application was not the same as restoring the petition.
- It is case-specific: the report does not establish a general rule that an allegation of overlapping demands lets taxpayers appeal without pre-deposit.
What Section 107 and the report establish
Section 107 is the statutory appeal mechanism identified in the report. The report does not reproduce or analyze the full pre-deposit provisions, specify a percentage or calculation, or state the applicable appeal deadline. Those details should not be inferred from this procedural outcome; taxpayers should check the legislation applicable to their case and the underlying court order before relying on a particular amount or filing period.

JurisHour’s report, published 13 October 2026, is the available account of the ruling. The underlying 2026 order was not located in the reporting material, so the Court’s precise wording beyond what the report attributes to the parties cannot be independently confirmed here. The report also does not identify the petitioner or case number in its surfaced text.

Materials concerning Vaneeta Impex Private Limited v. Union of India describe a different procedural record, in which a previously deposited amount was relevant and the court allowed an appeal without a further deposit on that case’s facts. That outcome should not be treated as the result in this 2026 Delhi High Court matter: here, the reported relief is permission to appeal and apply for exemption, with the overlap question left for the appellate authority.
