Usually, no permission is needed just to link to a publicly accessible page—but that is not a universal rule, and the details matter. A deep link is a hyperlink that takes someone to a specific page inside another website rather than its homepage. Linking to a page is different from copying its content, embedding or framing it, bypassing access controls, or knowingly directing people to infringing material.
What counts as an ordinary deep link?
A text link or button that sends visitors to a public article, product page, or other internal page is an ordinary deep link. It points to a web location; it does not, by itself, reproduce the text, images, or other work found there.
The World Wide Web Consortium (W3C) states in its linking policy that permission is not required to link to its site or other websites. That is useful guidance from the publisher of the W3C site, not a statute or a universal court ruling. Read the W3C intellectual-rights policy.

When does linking raise a different legal issue?
Copying the destination’s content
Quoting or reproducing protected text, images, video, or other material on your own site is a separate act from linking to it. That use may require permission or a valid defense. In the United States, fair use is assessed case by case; the U.S. Copyright Office says there is no automatic safe number of words, musical notes, or percentage of a work. This guidance concerns use of copyrighted material, not the ordinary act of linking. Read the Copyright Office fair-use FAQ.
Embedding or framing a page
An embedded item or framed page can appear within your own site’s layout, unlike a plain hyperlink that takes the visitor to another location. The legal analysis can depend on the implementation and presentation. A Digital Media Law Project explainer notes potential confusion or trademark concerns when framing makes outside content appear affiliated with the linking site; it is background guidance, not a categorical rule for every fact or jurisdiction. Read its guide to linking to copyrighted materials.

Linking to material you know is infringing
A link to legitimate public material is not the same situation as knowingly directing people to clearly infringing material. The Digital Media Law Project describes possible contributory copyright liability in the United States for knowing links to infringing works. Whether that theory applies depends on the facts and governing law; the explainer does not establish an outcome for every link.

Bypassing a paywall or other access control
A link that simply points to a URL is not automatically circumvention. But if the link, code, or associated tool avoids an effective technological measure controlling access to a protected work, that behavior calls for a separate analysis.

In the United States, 17 U.S.C. § 1201 addresses circumvention of technological measures that effectively control access to copyrighted works, subject to the statute’s scope and exceptions. The technical behavior matters: ordinary navigation and bypassing an access control are not interchangeable. Read 17 U.S.C. § 1201 in the 2024 U.S. Code edition.
Implying endorsement or affiliation
A link should be presented honestly. The W3C cautions against using links or related techniques to misrepresent a source or imply sponsorship or endorsement. Clear labels and a layout that does not suggest a false relationship help avoid that problem.

What U.S. law says about links to infringing locations
Section 512(d) of the U.S. Copyright Act addresses information-location tools that refer or link users to online locations containing infringing material. It provides a conditional limitation on liability for qualifying service providers—not blanket permission for every person or every link. The statute includes requirements relating to knowledge, financial benefit and control, and responding to notices. Read 17 U.S.C. § 512 in the 2024 U.S. Code edition.
The Copyright Office also provides resources explaining Section 512’s service-provider safe harbors and notice-and-takedown system. See the Copyright Office’s Section 512 resources. The safe harbor’s conditions should not be confused with a general rule that anyone may link to anything without consequences.

Do website terms prohibit deep linking?
A site’s terms may raise contract or access questions, but whether they apply to a particular linker depends on matters such as notice, assent, conduct, and governing jurisdiction. The available authorities here do not establish that a no-linking clause is always enforceable—or that terms never matter. Check the terms and the circumstances rather than assuming either conclusion.
How to assess a specific link
Before publishing or relying on a deep link, identify the facts that could change the legal analysis:
- Where the dispute would be governed: The relevant country’s law matters; the sources discussed here do not establish a worldwide rule.
- What the link does: Distinguish a plain navigational link from copied content, an embed, a frame, or a tool that changes access behavior.
- What is at the destination: Determine whether the page and material are authorized, public, or clearly infringing.
- Whether access controls are involved: Check whether reaching the page requires bypassing a login, paywall, or other effective measure.
- How the link is presented: Avoid wording or design that suggests sponsorship, endorsement, or affiliation that does not exist.
- What the site’s terms say: Consider whether the terms were presented and accepted, along with the conduct and governing law.
For an actual dispute, have a lawyer in the relevant jurisdiction review the specific link, destination, applicable terms, and access behavior.
