In England, a data centre cannot be treated as only a planning application. Depending on its location, scale and equipment, the project may need an environmental impact assessment (EIA) decision, environmental permits, water-discharge or abstraction permissions, flood-risk consents and evidence on noise, air quality, biodiversity, drainage and climate resilience. The safest route is to define the complete project envelope first, obtain early advice from the local planning authority and Environment Agency, then keep every approval and condition in one controlled register.
This checklist is England-focused. Scotland, Wales, Northern Ireland, EU member states and other countries use different thresholds, authorities, permit names and consultation procedures. Confirm the country, constituent nation, local planning authority and consenting route before relying on any step below.
1. Fix the jurisdiction and the project envelope
Environmental approval depends on facts that are often still moving during early design. Create a written project description before asking whether an approval is needed. Record the following, with assumptions clearly marked:
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →- Site boundary, proposed floorspace, building height, phasing and construction compounds.
- Electrical import capacity, on-site generation, battery systems and connection infrastructure.
- Backup-generator fuel type, number of units, rated capacity, operating hours and testing regime.
- Cooling technology, refrigerants, heat rejection equipment and expected water use.
- Any abstraction from rivers, groundwater or public supplies, and every proposed discharge route.
- Surface-water drainage, foul drainage, attenuation, outfalls and flood-zone location.
- Construction traffic, piling, demolition, excavation, spoil, hazardous materials and waste streams.
- Noise and vibration sources, including generators, chillers, fans, transformers, deliveries and alarms.
- Nearby homes, schools, protected sites, water bodies, heritage assets and other sensitive receptors.
Freeze a version of this envelope for each submission. If generator capacity, cooling plant, discharge points or building phases change, re-check the screening and permit conclusions rather than assuming the original approvals still cover the design.

2. Ask the planning authority for EIA screening early
England’s EIA process distinguishes between projects that require an assessment and projects that first need a screening decision. Schedule 1 projects require EIA. Schedule 2 projects require the competent authority to decide whether likely significant environmental effects make EIA necessary. A data-centre proposal must be classified against the applicable development and consenting regulations; its label alone does not determine the answer.
Request a formal screening opinion from the local planning authority as soon as the site and principal plant are defined. Supply a location plan, indicative layout, floorspace and phasing, power and generation details, cooling and water information, construction methods, likely emissions, drainage strategy and a description of nearby sensitive receptors. Ask the authority to confirm which EIA regulations and consultation bodies apply to the route being pursued.
“EIA helps to ensure that an authority giving development consent for a project makes its decision in the full knowledge of any likely significant environmental effects on the environment.” — Planning Inspectorate, Environmental impact assessment screening checklist.

3. Prepare an environmental statement when EIA is required
If the authority determines that EIA is required, appoint competent specialists and define the assessment scope before surveys begin. The environmental statement should describe the project, its realistic alternatives and the effects that matter at construction, operation, decommissioning and (where relevant) future phases.
Topics the assessment must address
- Energy demand and infrastructure: imported electricity, standby generation, fuel storage, heat rejection and material energy implications.
- Natural resources: water, land, soil, minerals and biodiversity consumed or affected by construction and operation.
- Residues and emissions: discharges to water, air and soil; noise; vibration; light; heat; radiation where relevant; and all waste streams.
- Alternatives: reasonable alternatives for site, layout, plant, energy supply, cooling, drainage and construction method, with reasons for the chosen option.
- Baseline conditions: current air, water, soil, noise, ecological and climatic conditions, supported by proportionate surveys and data.
- Accidents and disasters: fire, fuel release, battery incident, flood, extreme weather, loss of utilities and other credible major events.
- Cumulative and transboundary effects: interaction with nearby developments, utility projects, transport schemes and other data centres; transboundary effects where legally relevant.
- Climate: the project’s greenhouse-gas implications and its vulnerability to heat, drought, flooding, storms and other climate hazards.
Explain the methods, uncertainty, mitigation hierarchy and residual effects. Distinguish construction impacts from normal operation, maintenance, generator testing and abnormal events. A concise non-technical summary should let residents understand the proposal without reading the specialist chapters.
4. Build a permit and consent register
Planning permission and EIA do not authorise regulated emissions or water activities. Create a register with the activity, legal basis, regulator, application status, design assumption, pre-application advice, operating limit, monitoring duty and responsible owner.
| Activity or risk | Possible approval or check | Information to confirm |
|---|---|---|
| Combustion plant and specified generators | Environmental permit for an installation or specified generator, where the applicable rules capture the plant | Fuel, rated capacity, unit count, stack arrangement, operating hours, testing and emission controls |
| Discharge to surface water, sewer or groundwater | Water-discharge or groundwater activity authorisation, in addition to any sewer connection requirements | Flow, chemistry, temperature, outfall, receiving body, treatment and sampling method |
| Works near a main river, flood defence or sea defence | Flood-risk activity consent or environmental permit, as applicable | Location, construction method, temporary works, flood levels and effect on conveyance or defences |
| Water taken from a source or stored by impoundment | Abstraction or impoundment licence where the activity is regulated | Source, rate, seasonal profile, drought restrictions, storage volume and fallback supply |
| Radioactive substances | Radioactive-substances registration or permit if the project stores or uses regulated materials | Isotopes, quantities, intended use, shielding, storage and disposal route |
| Waste and hazardous materials | Waste-duty, storage, transfer and carrier requirements; check whether an environmental permit applies to any treatment or storage activity | Waste codes, volumes, containers, transfer notes, contractors and emergency arrangements |
Ask the Environment Agency for pre-application advice when the boundary between exempt and regulated activity is uncertain. The agency’s guidance states: “You are breaking the law if you operate without a permit or licence when you should have one.” Do not commission plant or begin a regulated discharge on the assumption that a pending planning application provides permission.

5. Complete the technical risk assessments
Use the project envelope and baseline evidence to show how risks will be prevented, minimised, monitored and reported. The exact studies depend on the site and design, but a robust data-centre package normally considers:
Air emissions
Model stack locations, fuel use, testing frequency, emergency operation and nearby receptors. Include cumulative generator emissions and explain dispersion assumptions. State how maintenance, alarms and abnormal operation are controlled.
Water, drainage and groundwater
Quantify potable, process, make-up and fire-test water. Describe discharge quality, temperature and flow, attenuation, treatment, pollution shut-off and spill response. Demonstrate that excavation, fuel storage and chemical handling will not contaminate groundwater.
Noise and vibration
Inventory continuous and intermittent sources, day and night scenarios, construction phases, tonal characteristics and low-frequency effects. Assess nearest sensitive receptors and specify enclosure, barriers, resilient mounts, operating controls and verification testing.

Maintain a consultation log that records the issue, respondent, technical owner, response, design change and final commitment. If consultation reveals a new receptor or a material design change, update the relevant assessment and disclose the change rather than treating it as a post-submission detail.
7. Align decisions before construction starts
Before issuing a notice to proceed, hold a consent-gate review. The project should have the planning decision, EIA determination or environmental statement decision, environmental permits, discharge or abstraction licences and flood-risk consents that apply to the approved design.
- Map every planning condition to a drawing, specification, survey, calculation or management plan.
- Assign one accountable owner and one evidence location for each condition and permit duty.
- Check that permit descriptions match the final generator count, fuel, stack, cooling plant and discharge route.
- Confirm pre-commencement surveys, ecological timing windows, archaeological or drainage requirements and construction environmental controls.
- Set hold points so contractors cannot excavate, discharge, remove vegetation or energise regulated plant before the relevant approval is effective.
- Record regulator correspondence and retain the approved versions used for construction.
8. Maintain compliance during operation
Approval is not the end of the environmental work. Operate a compliance calendar covering emissions, noise, water, waste, inspections, calibration, incidents, complaints and reporting deadlines. Retain monitoring records in the format and period required by each permit or condition.
Use change control for additional generator capacity, altered fuel, new cooling technology, revised operating hours, increased abstraction, a new discharge point, building expansion or a changed waste contractor. Screen the change against planning, EIA, permit, flood and water requirements before procurement. Investigate exceedances promptly, notify the regulator when required, document corrective action and verify that controls remain effective.
How to compare candidate sites and designs
Use a weighted, evidence-based comparison rather than choosing on grid capacity alone. For each option, record the evidence, uncertainty, mitigation cost and residual approval risk against these axes:
| Comparison axis | Questions for the decision team |
|---|---|
| EIA likelihood and environmental sensitivity | Is the site near designated land, sensitive receptors or constrained resources that could make significant effects more likely? |
| Generation and air emissions | How many generators are needed, what fuel will they use, where can stacks be placed and how difficult is cumulative modelling? |
| Water demand and drought resilience | Can the design minimise potable or abstraction demand, maintain cooling in drought and control discharge temperature and quality? |
| Flood and drainage | What flood mechanisms apply, can critical equipment be protected and is there a robust exceedance route? |
| Noise and vibration | How close are homes and other receptors, and can plant be enclosed without undermining cooling or maintenance? |
| Biodiversity and protected sites | Are surveys seasonal, can impacts be avoided and will lighting, traffic or water changes affect designated features? |
| Construction traffic and waste | Can abnormal loads, spoil, hazardous materials and peak construction traffic be managed safely? |
| Cumulative effects and consultation | What nearby schemes must be assessed and how complex will the consultation be? |
| Permit lead time and monitoring | Which consents are critical-path items, and can the finished design produce reliable evidence of compliance? |
Common approval failures and practical fixes
- Starting with a generic building description: fix the envelope with generator, cooling, water and drainage data before screening.
- Treating EIA screening as a permit: maintain separate planning, EIA and environmental-permit workstreams.
- Leaving backup generation until late design: model fuel, stack, noise and testing impacts at concept stage.
- Relying on desktop ecology or flood assumptions: commission seasonally appropriate surveys and site-specific hydraulic evidence.
- Ignoring construction phases: assess temporary compounds, piling, traffic, dust, spoil and temporary drainage separately from operation.
- Failing to track conditions: use an evidence tracker with owners, due dates, hold points and regulator correspondence.
- Changing plant after approval without review: run formal change control before ordering or installing the change.
What developers should expect
There is no authoritative universal approval percentage, cost or duration for data-centre environmental consenting. Timing and effort depend on the route, site sensitivity, survey seasons, design maturity, consultation and regulator workload. A complete early envelope, competent specialists, pre-application discussions and a live consent register reduce avoidable rework, but they do not guarantee a particular decision.
