Short answer: Tax breaks reduce a private developer’s cost in exchange for conditions such as investment, jobs or location. Direct public investment spends appropriated government money to build infrastructure or capacity. Tax breaks can mobilize private capital quickly, but they are difficult to justify when projects would have proceeded anyway. Public investment makes the counterfactual explicit and can deliver shared infrastructure, while leaving taxpayers with construction, demand and operating risks. The sound choice depends on additionality, fiscal cost, delivery speed, accountability and who pays for power, water, roads and other local services.

What the two approaches actually buy

A data-center incentive is not a single policy. A state may exempt eligible equipment from sales or use tax, reduce property taxes, offer a credit against a tax liability, or condition a benefit on capital spending, employment or a particular location. The government forgoes revenue when a qualifying company claims the benefit; the private owner or tenant decides how to design, finance and operate the facility.

Direct public investment reverses that allocation. Legislators appropriate money, borrow against future revenues or direct a public authority to construct assets such as substations, transmission upgrades, water systems, roads, fiber routes or publicly owned computing capacity. Government selects the project and remains responsible for procurement, delivery and operations, although contractors may do the physical work.

Question Tax break Direct public investment
What leaves the public budget? Foregone tax revenue, often uncertain until claims are filed Appropriated spending and, where used, borrowing shown in budgets
Who chooses the project? Private firms choose projects that meet eligibility rules Government chooses and funds a project through a public process
What is the counterfactual? Whether the facility would have been built without the incentive Whether the public asset would have been built without the appropriation
Where can benefits go? To firms, landowners, workers and the locality hosting the facility To users of shared infrastructure and other public objectives defined in the project
Who carries major risks? The public carries revenue risk and may subsidize investment that was already viable The public carries construction, demand and operating risk

The difference matters because a large facility can create substantial economic activity without the tax preference having caused it. A headline investment total, or a large total of taxes generated by an industry, does not by itself show that the policy produced value greater than its cost.

Additionality is the central test

Additionality asks what changed because of the policy. A credible evaluation compares the subsidized outcome with the outcome expected without the benefit: Would the company have selected the same site, built the same capacity and hired the same people anyway?

This is harder than counting projects that received an exemption. Firms may apply for an incentive after making a location decision, or may claim it for a refurbishment that would have happened under normal commercial conditions. Proximity to customers, available land, power reliability, fiber connectivity, labor, permitting and an existing building can all matter more than the tax treatment.

Evaluators should therefore separate:

  • Investment that is genuinely induced by the incentive;
  • Investment that is accelerated but would otherwise occur later;
  • Investment shifted from another jurisdiction; and
  • Investment that would have occurred without public support.

The last category is an inframarginal subsidy: it has a fiscal cost but no incremental project. A program can show impressive construction numbers and still fail an additionality test.

Washington: a cautionary result on causality

Washington’s Joint Legislative Audit and Review Committee (JLARC) reviewed the state’s urban data-center tax preference in 2026. Owners had claimed four exemptions and tenants six. Estimated beneficiary savings rose from $4.1 million in fiscal year 2023 to a projected $14.6 million in fiscal year 2026; JLARC reported estimated beneficiary savings of $42.4 million in its review.

JLARC found no new urban data centers built under the preference. Every reviewed project was a refurbishment. The audit said some of the capital investment probably would have occurred without the exemption and noted that business factors such as proximity to customers influenced location. Because the projects predated the preference, the audit could not determine how much activity was caused by it.

Reported Washington outcome What it means
Four owner exemptions and six tenant exemptions Both property owners and occupiers used the program
$4.1 million estimated savings in fiscal year 2023 Annual beneficiary savings at the start of the review period
$14.6 million projected savings in fiscal year 2026 A projection, not a final claim total
$42.4 million estimated beneficiary savings reported by JLARC A program-level estimate; it is not a measure of induced investment
296 temporary construction and trade jobs Short-term employment associated with reported work
53 cumulative reported permanent family-wage jobs Reported ongoing jobs; JLARC said the job figures had not yet been verified
At least $111 million in added assessed value New taxable value reported in the review
Approximately $1.2 million in additional property taxes Additional tax associated with the assessed value, not net fiscal benefit

JLARC recommended allowing the preference to expire because no new data centers were built with it. That recommendation does not prove that every tax incentive fails; it shows why a program needs a documented baseline and a way to test whether the benefit changed a decision.

Illinois: large fiscal totals with a different limitation

Illinois’ 2024 updated data-center investment report presents a different picture. It says industry fiscal support to state and local governments increased from $1.66 billion in 2022 to $1.85 billion in 2023, for $3.51 billion over the two years. The report lists 27 projects and 534 new full-time operations and maintenance jobs.

The Illinois program relies on sales and use tax exemptions rather than upfront subsidies. The report also states that no claims for tax credits had been made as of December 31, 2024. These details describe the program’s design and reported activity, but they do not establish a counterfactual. The $3.51 billion total combines industry activity and tax revenues; it does not show how much revenue would have existed without the exemption or whether another state would have won the same projects.

Illinois figure Qualification
$1.66 billion in state and local fiscal support in 2022 Program/industry total reported by the Illinois Department of Commerce and Economic Opportunity
$1.85 billion in 2023 Program/industry total for the following year
$3.51 billion over 2022–2023 Two-year aggregate; descriptive rather than causal
27 projects Projects reported by the program
534 new full-time operations and maintenance jobs Reported jobs, not a net estimate relative to a no-incentive scenario
No tax-credit claims as of December 31, 2024 Official status at that date

Illinois illustrates why gross tax revenue is not the same as return on investment. A proper return calculation subtracts the revenue forgone, public infrastructure costs, administrative expenses and any services supplied below cost, then asks how much of the remaining activity was incremental.

Virginia’s reporting model shows what to demand

Virginia’s Department of Taxation describes a biennial data-center report that aggregates qualifying expenses and the total tax benefit. It also includes return-on-investment analysis of direct and indirect jobs and state and local tax revenues. This is a useful reporting standard even when the resulting figures are favorable to the program.

A report using that model should disclose, for each period:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Eligible investment and the tax benefit actually claimed, rather than only the maximum benefit available;
  • Direct jobs, indirect jobs and the method used to avoid double counting;
  • State and local revenue, with recurring revenue separated from one-time construction effects;
  • Electricity, water, road, emergency-service and grid costs attributable to the facility;
  • The assumed no-incentive scenario and the evidence supporting it; and
  • Clawbacks or repayment provisions when promised investment, jobs or operating dates are missed.

Publishing these items before declaring success makes it possible for legislators and residents to evaluate a program on net incremental value rather than promotional totals.

What the evidence says about direct public investment

Public investment has an opportunity cost: money committed to a data-center-related project cannot be spent simultaneously on other infrastructure, maintenance or services. Cutting public investment can also weaken private investment. The European Investment Bank’s 2023/2024 Investment Report, drawing on historical data from 16 OECD countries, says fiscal consolidation has a disproportionate and long-lasting effect on public investment. It summarizes evidence that a consolidation equal to 1% of GDP can be expected to produce a 1% fall in private investment, partly through spillovers and the removal of tax incentives and subsidies.

That finding is not a forecast for one proposed data center. It is macroeconomic evidence that reducing public capital formation can crowd out, rather than simply release, private investment. A government comparing a tax break with a public project should therefore count the projects displaced by the appropriation and the broader value of the infrastructure created.

Public construction can be especially useful when an asset serves many users: a transmission upgrade that improves reliability for a region, a water system that supports several employers, or a fiber route that connects public institutions as well as private facilities. Conversely, a publicly financed asset built for one speculative customer can leave taxpayers with an underused project if that customer scales back or relocates.

Why there is no national template

JLARC counted at least 38 states with data-center-specific preferential tax treatment. The benefits range from sales and use tax exemptions to property-tax incentives, and eligibility rules differ by state. Some programs focus on new construction; others cover equipment, refurbishment or a defined geographic area.

This variation prevents a simple national ranking. A state with abundant power and existing industrial infrastructure may need little public spending, while a constrained region may face major grid, water or road costs. A sales-tax exemption can have a different fiscal profile from a property-tax abatement, and a benefit that is modest for a small retrofit can be large for a multi-building campus.

Who pays for power and local infrastructure?

The private facility pays its contracted utility bills and ordinary taxes, but those payments do not automatically cover every public cost. A large load can require new generation, transmission, substations, distribution equipment, demand-management systems or reliability upgrades. Construction can also increase road wear, permitting workload, fire protection needs and emergency-response requirements. Water-cooled designs may create treatment and supply costs, while backup generation raises air-quality and fuel-storage questions.

  • Who finances each upgrade and whether the cost is recovered through rates, connection charges or general taxes;
  • Whether other ratepayers receive a measurable reliability or capacity benefit;
  • Expected peak electricity and water demand, including expansion phases;
  • Responsibility for stranded assets if the facility closes or reduces load; and
  • Local-service costs that are not captured in state revenue estimates.

A tax break can make a site attractive while leaving a city or utility to absorb these externalities. Direct investment can build shared capacity, but only if the project is sized for realistic demand and priced transparently.

A practical method for comparing the options

1. Define the no-policy baseline

List the facilities, jobs, tax receipts, infrastructure and timing expected without either intervention. Include plausible alternatives: a different site, a smaller facility, delayed construction or no project. Have an independent agency review the assumptions.

2. Measure the incremental fiscal effect

For a tax break, calculate revenue forgone by year and by taxing jurisdiction. For public investment, include capital spending, debt service, maintenance and operating subsidies. Subtract costs for grid, water, roads and services in both cases. Report nominal and discounted values with the discount rate stated.

3. Verify outcomes rather than accept claims

Require payroll or employment records for job counts, invoices or audited statements for qualifying investment, and meter or utility data for actual consumption. Distinguish temporary construction jobs from permanent operations jobs. Do not count an announced project as delivered capacity.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. Test location and timing effects

Ask whether the incentive moved a project across a state border, moved it within the state, accelerated construction or merely reduced the cost of an already selected site. A project transferred from another locality may create a local gain but little statewide gain.

Using 2 holes wire tray saves extra space, helps you easily cabling and wire protection. The mesh design is not easy to accumulate dust, but avoids safety accidents caused by messy wires.

5. Value non-fiscal objectives separately

Reliability, digital access, resilience, research capacity and regional development may justify a project even when direct tax returns are modest. State those objectives and score them separately instead of presenting them as tax revenue.

6. Set review and recovery rules

Use sunset dates, periodic audits, public beneficiary lists where lawful, and clawbacks for missed commitments. A benefit that grows automatically while evidence remains unverified shifts risk to taxpayers.

When a tax break is more defensible

  • The firm demonstrates that competing locations without the benefit are credible and that the incentive changes the site or timing decision.
  • The benefit is capped, transparent and smaller than the documented gap between the preferred site and the next-best alternative.
  • Infrastructure costs are assigned to the party causing them or are justified by benefits to other users.
  • Jobs, investment and operating dates are independently verified.
  • The state can recover the benefit if conditions are not met.

Even in this case, officials should compare the tax expenditure with a targeted grant, a utility-financed upgrade or a shared public project. The least expensive instrument that achieves the stated objective is preferable.

When direct public investment is more defensible

  • The asset has multiple users or a clear public-service function beyond one data-center customer.
  • Private firms cannot capture enough of the benefits to finance the infrastructure, creating a genuine coordination problem.
  • The public owner can procure and operate the asset at a known cost, with a credible demand forecast.
  • Public control is important for resilience, access, safety or long-term capacity planning.
  • The project remains valuable if the originally expected data center is delayed, downsized or cancelled.

Public ownership is not automatically safer. A poorly specified project can run over budget, become obsolete or leave the government responsible for unused capacity. Procurement milestones, independent cost estimates and a clear operating plan are essential.

Questions legislators and residents should ask

  • What exact decision did the incentive change, and what evidence supports that claim?
  • How much revenue is forgone each year, by state, county, city and school district?
  • Are reported jobs temporary, permanent, direct or indirect, and have they been verified?
  • What electricity, water, transportation and emergency-service costs fall on other users?
  • Would the public infrastructure retain value if the facility never opens?
  • Are results reported per dollar of foregone revenue or public spending?
  • What happens if the company misses investment, employment or operating commitments?
  • When will an independent audit test the program against a no-incentive baseline?

Bottom line

Tax breaks and direct public investment solve different problems. A tax break is a price reduction intended to influence a private decision; direct investment is a public decision to build capacity and accept delivery risk. Washington’s 2026 audit shows the danger of treating claimed projects and jobs as proof of causation. Illinois’ large 2022–2023 fiscal totals show why industry revenue is not the same as net program return. Virginia demonstrates the value of publishing qualifying costs, benefits and job analysis, while the European Investment Bank evidence warns that cutting public investment can reduce private investment as well.

The credible choice is the one with the clearest counterfactual and the best incremental result after tax expenditures, construction, operating, electricity, water and local-service costs are counted. If officials cannot show what would not have happened without the policy, they do not yet know whether taxpayers are buying new capacity or simply discounting a private project that was already on its way.
