CVS Pharmacy Inc. and related entities agreed to pay $315 million to resolve U.S. Department of Justice allegations involving unlawful opioid and other controlled-substance dispensing and reimbursement claims submitted to federal health programs. Announced October 13, 2026, the civil resolution also requires new monitoring and reporting controls under an agreement with the Drug Enforcement Administration. The settlement resolves allegations, not a court finding that CVS was liable.

What the $315 million settlement covers

The Justice Department said the alleged conduct occurred from October 17, 2013, through December 2, 2025. Prosecutors invoked the Controlled Substances Act (CSA) and the False Claims Act (FCA), alleging that prescriptions were unlawfully filled and that CVS sought reimbursement for many of them from Medicare and other federal healthcare programs.

The government’s civil complaint was filed on December 13, 2024, in the U.S. District Court for the District of Rhode Island. The October 2026 announcement resolves that civil case through a monetary payment and compliance commitments. The government expressly said the underlying claims remain allegations and that there has been no determination of liability.

What prosecutors alleged CVS pharmacies did

Excessive, early and high-risk opioid fills

DOJ alleged that CVS pharmacies filled opioid prescriptions for dangerous or excessive quantities and filled some prescriptions earlier than permitted. Those allegations concern the pharmacy’s obligation to identify warning signs and determine whether a controlled-substance prescription is legitimate and medically appropriate.

“Trinity” prescriptions

Prosecutors also alleged that pharmacies filled “trinity” combinations: an opioid, a benzodiazepine and a muscle relaxant. The combination has been associated with abuse risk because the drugs can compound sedation and respiratory-depression dangers.

Prescriptions linked to alleged pill mills

The complaint further alleged that CVS filled large quantities of controlled-substance prescriptions from prescribers described by the government as “pill mills”—operations that issued prescriptions without a legitimate medical purpose. These statements have not been adjudicated.

Corporate pressures and warning information

The 2024 complaint alleged that pharmacists faced production metrics, incentive compensation and staffing policies that made it difficult to meet corporate expectations while performing the legal checks required for controlled substances. It also alleged that pharmacists were prevented from sharing some warning information about prescribers whose practices appeared problematic.

The complaint said some prescriptions were reimbursed by federal programs and alleged that, in some instances, patients died after overdosing soon after filling unlawful prescriptions. Those patient-harm and workplace-policy assertions are allegations in the complaint, not established findings.

What CVS must do under the DEA agreement

In addition to the $315 million payment, CVS entered a memorandum of agreement with the DEA. DOJ described the measures as safeguards intended to ensure controlled substances are dispensed only when medically appropriate.

  • Reporting hotline: CVS must establish a channel for employees and members of the public to report suspected illegal dispensing.
  • Proactive dispensing monitoring: The company must monitor pharmacy dispensing patterns for warning signs.
  • Prescriber review: CVS must create a process to evaluate prescribers suspected of illegal prescribing.

These obligations are compliance terms of the settlement and DEA agreement; the announcement did not provide a separate dollar allocation for each measure.

Did CVS admit wrongdoing?

No. CVS said it strongly disagreed with the claims and that the settlement included no admission of wrongdoing. The Justice Department likewise stated that the resolution settles allegations and does not represent a determination that CVS violated the law. The $315 million figure is the announced monetary component, not a judicially determined damages award.

How the False Claims Act brought the case

The matter began as a qui tam action by former CVS employee Hillary Estright under the False Claims Act. The United States intervened and took over the litigation. The case is captioned United States ex rel. Hillary Estright v. CVS Health Corporation, et al., No. 22-cv-00222 (D.R.I.). DOJ said the amount of any recovery that may be owed to Estright had not yet been determined.

Why the FCA matters in a pharmacy case

The FCA can impose civil consequences when a company allegedly submits, or causes others to submit, false claims for payment to the federal government. In this case, the government’s theory linked allegedly unlawful dispensing to reimbursement requests sent to Medicare and other federal healthcare programs. The pharmacy-related conduct was also analyzed under the CSA, which governs controlled-substance handling and dispensing.

The scale described in the earlier complaint

When the government unsealed its complaint in December 2024, it described CVS as the nation’s largest pharmacy chain, with more than 9,000 pharmacies across the United States. The complaint alleged that the company knowingly filled controlled-substance prescriptions lacking a legitimate medical purpose, validity or a basis in ordinary professional practice. That description comes from the complaint and is not a finding entered after trial.

Is the CVS opioid case over?

The civil action addressed by the October 13, 2026 announcement is resolved through the settlement, subject to its payment and compliance terms. The resolution does not convert the complaint’s allegations into proven facts, and it does not include an admission of wrongdoing by CVS. The DEA memorandum creates continuing monitoring, reporting and prescriber-review obligations beyond the payment itself.
