Short answer: In the United States, cryptocurrency is generally treated as property for federal tax purposes, a crypto balance at an exchange is not automatically insured like a bank deposit, and staking does not have a single legal classification. The answer depends on what you hold, who controls the keys, how a service is structured, and which agency’s jurisdiction is involved. Keep complete transaction records, read custody and insolvency terms, and treat demands for crypto payments or guaranteed profits as scam warnings.

How federal tax rules apply to crypto

The IRS established the baseline in Notice 2014-21: virtual currency is property for federal income-tax purposes. The IRS uses “digital assets” broadly to include cryptocurrency, stablecoins, and non-fungible tokens (NFTs). A federal return includes a digital-asset question asking whether you received, sold, exchanged, or otherwise disposed of a digital asset.

The IRS virtual-currency FAQ states that its general answers apply to transactions occurring before January 1, 2025. For transactions on or after that date, use the current-year IRS forms and instructions and check for later IRS guidance. State income-tax rules can differ from the federal treatment.

Events that can create income or a reportable disposition

Do not treat every wallet movement as taxable. The key question is whether you received value or disposed of property. Common events that require analysis include:

  • Protect your signer: keep it in mint condition at all times with a bespoke Pod or Case to avoid scratches and everyday wear and tear.
  • Selling cryptocurrency, stablecoins, or NFTs for U.S. dollars or another fiat currency.
  • Exchanging one digital asset for another, even when no dollars pass through your bank account.
  • Using digital assets to pay for goods or services; spending is generally analyzed as a disposition of the asset you used.
  • Receiving digital assets as compensation, payment, a reward, or a staking distribution. The income question and the later gain-or-loss question are separate calculations.

The tax result depends on facts such as the asset, date, fair-market value in U.S. dollars, your basis, and whether the transaction was personal, investment-related, or connected with a business. There is no single federal tax rate or universal rule that answers every staking-reward question.

Records to preserve

Save records while they are available rather than trying to reconstruct them after an exchange closes or a wallet is lost. For each acquisition, disposal, transfer, or reward, retain:

  • Date and time, asset, number of units, and U.S.-dollar value at the relevant time.
  • Cost basis and fees, including how the basis was allocated when assets were exchanged or transferred.
  • Wallet addresses, exchange account statements, and transaction IDs.
  • Documents showing whether an amount was a payment, reward, sale, exchange, or transfer between wallets you control.
  • Records of locked, wrapped, or receipt-token positions and any later redemption.

Download statements regularly and keep an independent backup. A tax software export is useful, but it does not replace the underlying statements and on-chain evidence.

Answering the digital-asset question

Read the wording on the current federal return carefully. It asks about receiving, selling, exchanging, or otherwise disposing of a digital asset; merely owning an asset is not the same as one of those events. If your activity includes mining, staking, payments, a business, or multiple wallets, gather the facts before answering and obtain professional advice when the treatment is uncertain.

Custody is different from insurance

A crypto account is not automatically protected by the FDIC merely because a bank, broker-dealer, or other regulated institution is involved. FTC consumer guidance says cryptocurrency accounts are not insured by a government in the way FDIC-insured bank deposits are. A bank’s permission to conduct a crypto activity and its compliance obligations do not turn the crypto asset into an insured deposit.

Losses can result from a forgotten password or seed phrase, a hack, sending assets to the wrong address, a provider failure, or an insolvency proceeding. In those situations, recovery may be impossible or may depend on contract terms and the legal treatment of customer property.

Questions to ask before depositing assets

  1. Who controls the private keys? In self-custody, you control the keys; in a hosted account, the provider generally controls them. Key control determines who can authorize withdrawals and who must respond to a compromise.
  2. What is the institution? Identify whether you are dealing with a bank, broker-dealer, exchange, staking provider, or another entity, and verify any claimed registration with the relevant regulator.
  3. Are customer assets segregated? Look for specific language on separation from the firm’s own assets, recordkeeping, and what happens if the firm fails.
  4. What does the insolvency contract say? Read whether you retain a property interest, become an unsecured creditor, or consent to lending, rehypothecation, or pooling.
  5. What can delay a withdrawal? Note lockups, review periods, network limits, suspension rights, and procedures for changing a destination address.
  6. What risks sit outside the custody agreement? Smart-contract, validator, counterparty, and operational risks may remain even when a provider is supervised.
  7. What records will you receive? Confirm that the provider supplies transaction history, cost-basis information, reward statements, and a way to export data.

Custody models compared

Arrangement Key control Insurance and failure questions Additional issues
Self-custody wallet You control the private keys. No government insurance for the asset; loss of credentials or a mistaken transfer may be unrecoverable. You handle backups, device security, address checks, and transaction records.
Exchange or hosted account The provider generally controls the keys. Crypto is not automatically an insured deposit; review segregation, insolvency language, withdrawal terms, and provider recovery procedures. Account freezes, outages, hacks, and incomplete tax records can affect access.
Bank custodian Depends on the service contract; the bank may hold keys for you. Bank supervision addresses safety, soundness, and legal compliance, not a promise that customer crypto is covered by deposit insurance. Read the custody agreement and identify which assets, if any, are actually deposits.
Broker-dealer custody Set by the customer agreement and applicable securities rules. Do not assume ordinary securities protections or deposit insurance cover every digital asset; determine the exact account and asset treatment. Review segregation, lending permissions, disclosures, and transfer limits.
Staking provider The provider may pool or control assets while performing the service. Insurance, if offered, does not by itself resolve protocol, counterparty, or insolvency risk; verify what is covered and excluded. Check receipt tokens, lockups, reward calculations, lending or rehypothecation, and redemption rights.

The banking agencies’ July 14, 2025 joint safekeeping statement emphasizes risk management and legal compliance for banks engaging in crypto-related safekeeping. It does not promise that customers will recover crypto after a failure.

Is staking legal in the United States?

There is no one-word answer for all staking. The SEC has issued staff materials discussing certain protocol-staking and liquid-staking activities and later FAQs addressing staking receipt tokens. Those materials describe particular structures; they do not declare every staking arrangement legal or illegal.

Analyze the actual arrangement

Ask how the service operates rather than relying on labels such as “delegation,” “earn,” or “liquid staking.” Important facts include:

  • Whether a provider pools customer assets or performs the validation activity for customers.
  • Whether customers rely on the provider’s managerial or technical efforts.
  • Whether the provider promises a return, yield, or a particular reward rate.
  • Whether customers receive a receipt token and what rights that token represents.
  • Whether the provider lends, rehypothecates, or otherwise uses the assets beyond protocol participation.
  • Whether customers can withdraw immediately, must observe an unbonding or lockup period, or depend on a secondary market for a receipt token.

The SEC’s May 15, 2025 staking and custody responses include an explicit limitation: “These responses represent the views of the staff of the Division of Trading and Markets. They are not a rule, regulation or statement of the Commission.” Staff FAQs therefore should not be treated as binding law or as a substitute for analyzing a specific contract and set of facts.

Staking taxes are a separate question

Whether a staking service falls within a securities-law discussion does not determine when rewards are taxable. For tax purposes, record when rewards become available, the number of units, their U.S.-dollar value, the wallet or account receiving them, and any later sale or exchange. A reward received in kind can create an income issue first and a capital gain or loss issue later. Current IRS rules and instructions control; do not apply a single timing rule to every protocol, custodial service, or receipt token.

Due diligence checklist for a staking offer

  1. Read the service agreement, risk disclosures, and reward methodology.
  2. Identify who controls keys and who may halt withdrawals.
  3. Confirm whether assets are pooled, lent, rehypothecated, or pledged.
  4. Determine whether a receipt token is issued, how it is valued, and how it is redeemed.
  5. Check lockup, unbonding, slashing, fee, and counterparty provisions in the applicable documents.
  6. Ask for complete reward and transaction records for tax reporting.
  7. Compare the provider’s claims with the relevant SEC, state, and banking-regulator materials instead of relying on a marketing label.

Which U.S. agency applies?

Crypto regulation is activity-based. More than one agency can matter for the same product, and state law may add licensing, securities, money-transmission, tax, or consumer-protection requirements.

Consumer protections and scam prevention

Why crypto scam payments are difficult to recover

CFPB guidance notes that scammers often request cryptocurrency because payments can be difficult to trace or recover. Blockchain visibility does not mean a mistaken or fraudulent transfer can be reversed by a bank. FTC guidance warns that password loss, hacking, wrong-address transfers, and provider failure may leave funds unrecoverable.

FTC’s direct warning is concise: “Only scammers demand payment in cryptocurrency.” A legitimate business or government agency will not require crypto to “protect” your money, unlock an account, pay a supposed tax, or avoid arrest. Guaranteed profits, urgent instructions, and requests to move assets to a “safe” wallet are strong warning signs.

Common approaches used by fraudsters

  • Impersonation: someone claims to be from a government office, exchange, bank, or technical-support team.
  • Romance and relationship scams: a person builds trust and then recommends an investment or requests an urgent transfer.
  • Investment scams: a website or app displays fabricated profits and demands more crypto to withdraw them.
  • Recovery scams: a second party promises to retrieve lost crypto for an upfront fee or additional wallet access.

If you sent crypto to a scammer

  1. Stop communicating and do not send more funds for taxes, verification, liquidity, or recovery.
  2. Preserve messages, email headers, phone numbers, wallet addresses, transaction IDs, screenshots, and payment receipts.
  3. Secure remaining accounts: change passwords, revoke suspicious wallet approvals where applicable, and move unaffected assets only after confirming the destination address.
  4. Notify the exchange, custodian, bank, or payment service involved and ask what freeze or investigation process is available.
  5. Report the fraud through the appropriate FTC, CFPB, law-enforcement, and state channels. A report creates evidence for investigators but cannot promise reimbursement.

A practical decision framework before you use a crypto service

Use this sequence for an exchange, bank custodian, broker-dealer, staking provider, or self-custody setup:

  1. Define the activity: buying, selling, exchanging, paying, lending, staking, or simply holding.
  2. Identify the legal actor: name the entity that holds keys, executes transactions, provides advice, or promises returns.
  3. Map the assets: record the token, network, receipt token, and any wrapped or pooled position.
  4. Read the failure path: find withdrawal, suspension, insurance, segregation, and insolvency provisions before depositing.
  5. Plan tax records: confirm how you will capture dates, units, dollar values, basis, fees, addresses, and transaction IDs.
  6. Check jurisdiction: review current IRS, SEC, CFTC, banking, FTC, CFPB, and state guidance relevant to your facts.
  7. Test a small transfer: verify the network and destination address before moving a larger balance; a wrong-address transfer may not be reversible.

What this means for a U.S. crypto holder

Tax reporting, custody risk, securities analysis, and consumer protection are separate questions. Keep auditable records for every taxable event, do not mistake bank supervision for insurance, evaluate staking by its structure rather than its name, and assume that an irreversible payment request is a scam until independently verified. This overview is general information, not individualized tax or legal advice; your state law, the current year’s IRS instructions, and the exact provider contract control your situation.
