Short answer: a district attorney is generally the public prosecutor for a defined state-law district, while a county attorney may prosecute crimes, represent county government in civil matters, or do both. The titles are not standardized nationally. State statutes, a county charter, and court rules determine which office handles a particular offense, court, lawsuit, or investigation.
That is why a county attorney may prosecute criminal cases in one state but serve mainly as the county’s civil lawyer in another. Before directing a complaint or filing a case, identify the governing jurisdiction and confirm the current assignment of duties with its statutes and official offices.
The difference in one view
The most reliable distinction is functional, not based on the job title. Compare the offices by the type of matter, court, geographic area, government represented, and authority granted by local law.
| Question | District attorney | County attorney | Why the answer can change |
|---|---|---|---|
| Primary work | Usually prosecutes criminal cases for the state. | May prosecute crimes, advise county officials, handle civil litigation, or combine those roles. | State statutes and county charters assign the work. |
| Government represented | Usually represents the state in criminal court, even when the office is organized by county or district. | May represent the state in criminal matters, the county in civil matters, or both. | “County” in the title does not by itself identify the client. |
| Court coverage | Often a specified level of trial court and related appeals. | Often lower-level or non-district trial courts where criminal authority exists; in some states, no criminal role. | Court names and divisions differ by state. |
| Geographic area | A prosecutorial district, county, or group of counties defined by law. | Usually one county, but the assigned criminal or civil territory can be defined differently. | Boundaries and shared districts are jurisdiction-specific. |
| Civil representation | Usually not the county’s general civil lawyer where a separate county counsel exists. | May defend the county, collect debts, advise officials, or handle contracts and litigation. | General-law and charter counties can use different structures. |
| Selection and oversight | Election or appointment, funding, and supervision vary. | Election or appointment, funding, and supervision vary. | Check the constitution, statutes, charter, and local rules. |
“Power” means legal authority granted by a constitution, statute, court rule, or charter. It does not mean that either office replaces the police, decides guilt, or provides a defendant’s legal representation.

Why the same title means different work
There is no single national job description for either office. Legislatures create prosecutorial districts, assign courts, define which crimes each office may prosecute, and decide whether county government has a separate civil-law department. County charters can add or modify arrangements where state law permits.
Two counties next to each other can therefore use different titles for similar work, or the same title for different work. A “county attorney” can be the county’s civil adviser in one state and a criminal prosecutor in another. A “district attorney” can cover one county, several counties, or a statutory district that does not match county lines.
Selection also varies. Some prosecutors are elected; others are appointed or selected under local government rules. The office’s budget, staffing, reporting relationships, and authority to hire special prosecutors are local-law questions rather than consequences of the title alone.

Decides whether to bring charges
A district attorney’s office reviews reports, evidence, and applicable law and decides whether to file, decline, or modify criminal charges. Charging discretion is constrained by statutes, constitutional protections, professional-conduct rules, and evidence. The office can also dismiss or amend charges as a case develops, subject to required court procedures.
The decision is not a finding of guilt. A prosecutor presents the government’s case; a judge or jury decides the outcome under the applicable burden of proof.
Prosecutes cases in assigned courts
The court level is often the most important practical boundary. Texas Code of Criminal Procedure article 2A.102(a), for example, says: “Each district attorney shall represent the state in all criminal cases in the district courts of the attorney’s district and in appeals from those cases.” The same article also addresses certain examining-court and habeas proceedings.

New York County Law §700 describes the district attorney as conducting prosecutions for crimes and offenses cognizable by the county courts and performing related duties prescribed by law. The wording ties the office to the courts and offenses defined by New York law; it should not be generalized to another state.
Directs or requests further investigation
General descriptions of a state’s attorney’s role include presenting criminal cases, directing further investigation, deciding charges, recommending sentences, and participating in grand-jury proceedings. In practice, prosecutors may ask law-enforcement agencies to obtain additional evidence, issue subpoenas where authorized, or coordinate specialized investigations. Police retain their own investigative powers and operational responsibilities.
Participates in grand-jury proceedings
Where a jurisdiction uses grand juries, the prosecutor may present evidence, question witnesses, prepare legal instructions, and seek an indictment. Grand-jury procedures, secrecy rules, and who may initiate a presentation differ by state. An indictment authorizes prosecution; it does not establish guilt.
Handles pleas, sentencing recommendations, and appeals
Most criminal cases resolve through negotiated pleas. The prosecutor may offer or reject a plea, recommend a sentence, and litigate conditions, but the judge must apply the law and any required approval standards. District attorneys also handle appeals or supervise appellate work when statutes assign those cases to the office.
Serves the state’s interest, not a conviction quota
Texas Code of Criminal Procedure article 2A.101(a) states: “The primary duty of an attorney representing the state, including a special prosecutor, is not to convict but to see that justice is done.” Similar ethical principles require prosecutors to disclose material exculpatory information and avoid unsupported charges. The precise duties and remedies for violations depend on governing law.

What a county attorney may do
Criminal prosecution in some states
Texas illustrates a criminal-prosecutor model. Article 2A.103(a) provides: “Each county attorney shall attend the terms of court for trial courts other than district courts in the attorney’s county and represent the state in all criminal cases under examination or prosecution in that county.” In that arrangement, the county attorney’s criminal jurisdiction is linked to trial courts other than district courts, while the district attorney handles district-court criminal cases.

This means a Texas county attorney can prosecute criminal cases even though the title sounds like a civil county-law position. Whether a particular felony, misdemeanor, or examining proceeding belongs in that office depends on the court and statutory assignment, not on the word “felony” alone.
County civil counsel in other states
In other jurisdictions, the county attorney is primarily the county government’s lawyer. Duties can include advising commissioners or supervisors, reviewing contracts, defending the county in civil suits, handling property and employment matters, and collecting money owed to the county. Some offices also prosecute local offenses; others share that work with a district attorney or a separate prosecutor.
California demonstrates the importance of the county structure. California Attorney General Opinion No. 81-117 explains that, in general-law counties with a county counsel, the district attorney has no authority to perform duties that the law assigns to county counsel, while the district attorney remains the public prosecutor. Charter-county arrangements can differ.
Combined criminal and civil responsibilities
Some counties do not maintain a separate county-counsel office, so the county attorney may advise the government and prosecute crimes. Nevada’s Chapter 252 calls the district attorney the county’s public prosecutor and also lists drawing indictments, defending suits brought against the county, and recovering county debts, fines, penalties, and forfeitures. That combination is a statutory choice, not a national rule.
Criminal versus civil authority
Criminal and civil matters use different parties, procedures, and remedies. In a criminal case, the government prosecutes an accused person for an offense defined by law. In a civil case, a person, business, or government seeks a remedy such as damages, an injunction, a declaration, or collection of a debt.
| Situation | Likely office or party | What to verify |
|---|---|---|
| State criminal charge | District attorney or another statutory prosecutor | Which court has jurisdiction and which office represents the state there. |
| County sued for negligence, employment, or contract | County counsel, county attorney, or another designated civil lawyer | Whether the county has a separate counsel and whether the charter changes the default. |
| County collecting fines, penalties, or debts | District attorney, county attorney, treasurer, or civil-collections unit | The statute creating the debt and assigning collection authority. |
| Private dispute between two residents | Neither prosecutor’s office as a private advocate | Parties generally need private counsel or a court-approved self-help process. |
A prosecutor normally cannot represent a private complainant as that person’s lawyer. The office represents the government and must make independent decisions, even when a victim or witness strongly supports a particular outcome. A county civil lawyer likewise represents the county entity, not individual residents whose interests happen to overlap with the county’s.

Who handles misdemeanors and felonies?
There is no nationwide misdemeanor-versus-felony rule assigning every misdemeanor to a county attorney and every felony to a district attorney. Legislatures commonly divide work by court, geographic district, or offense category, and those divisions do not always track the labels readers use.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesTexas is a clear example of a court-based allocation: the district attorney represents the state in district-court criminal cases, while the county attorney represents the state in criminal cases in other trial courts in the county. A felony prosecuted in a district court therefore ordinarily falls within the district attorney’s assignment, while a lower-level case in another trial court may belong to the county attorney. The charging level, transfer rules, and local court structure still matter.
In another state, a district attorney may handle misdemeanors and felonies in the same office, or a municipal prosecutor may handle certain local offenses. Confirm the current statute and the clerk’s filing information before assuming which office is responsible.
Is a district attorney a county or state official?
The answer has two parts. Organizationally, a district attorney may be elected or appointed for a county or multi-county district and funded through local government processes. In a criminal case, however, the district attorney generally represents the state. That is why charging papers often identify the state as the prosecuting party even when the office is located in a county courthouse.
The title “district” describes the prosecutorial territory or court assignment; it does not by itself mean the lawyer is a state-agency employee. Selection, compensation, removal, and supervision are controlled by the jurisdiction’s constitution, statutes, and local rules.

- They do not adjudicate guilt. Judges manage proceedings, rule on legal issues, and impose sentences within the law; juries or judges determine guilt.
- They do not replace police investigators. Prosecutors can request or direct investigative steps where authorized, but law-enforcement agencies collect evidence and make arrests under their own legal authority.
- They do not provide defense counsel. An accused person needs a private lawyer or appointed public defender, not the prosecuting office.
- They cannot charge outside their jurisdiction. Venue, territorial statutes, and court authority limit where a case may be filed.
- They cannot ignore conflicts of interest. Recusal, special-prosecutor, and disclosure rules apply when the assigned office has a disqualifying conflict.

- For an emergency or immediate threat, contact local law enforcement. Prosecutor offices generally do not dispatch officers or take emergency calls.
- For a suspected crime, use the police or sheriff’s reporting process first unless the local prosecutor publishes a different intake procedure. Preserve documents, messages, dates, names, and other lawful evidence.
- For a pending criminal case, contact the prosecutor listed on the case docket. Do not assume the county attorney is involved merely because the case arose in that county.
- For a county contract, claim, records issue, or civil lawsuit, identify the county’s civil-law office. It may be called county counsel, county attorney, corporation counsel, or another statutory title.
- Check the current authority. Read the state code, county charter, court rules, and the official office directory. Ask the clerk which court has the case if the filing location is unclear.
Submitting a complaint to the wrong office can delay review, but it does not create jurisdiction. A prosecutor may decline a referral, transfer it, or ask another agency to investigate.
Jurisdiction examples side by side
| Jurisdiction | District attorney rule described in the law | County attorney or civil-counsel rule | Practical lesson |
|---|---|---|---|
| Texas | Represents the state in criminal cases in district courts of the district and appeals from those cases; certain examining-court and habeas matters are also addressed. | Represents the state in criminal cases under examination or prosecution in county trial courts other than district courts. | Court level, not the offense label alone, drives the division. |
| New York | County Law §700 assigns prosecution of crimes and offenses cognizable by county courts and related legal duties. | Assignment varies under New York law and local structure. | Read the court-jurisdiction language rather than importing a Texas model. |
| North Carolina | Must prepare trial dockets, prosecute criminal actions and infractions in the prosecutorial district, advise justice officers, and represent the state in specified juvenile cases; the statute requires full-time service and prohibits private practice. | County-attorney duties are separate questions under state and local law. | The office can have broad prosecution and advisory duties within a defined district. |
| Nevada | Chapter 252 identifies the district attorney as the county’s public prosecutor and lists indictment, county-defense, and debt-recovery functions. | A separate county-attorney model is not assumed by the title comparison. | One office can combine criminal prosecution and county civil functions. |
| California general-law county | District attorney remains the public prosecutor. | County counsel generally performs civil duties assigned by law; the district attorney may not take over those duties. | Charter counties can have different arrangements. |
Common mistakes and how to avoid them
Assuming “county attorney” always means civil lawyer
That assumption fails in Texas and in any jurisdiction where the county attorney prosecutes criminal cases. Look for the statute assigning courts and offenses.
Assuming every district attorney handles every crime
Municipal prosecutors, county attorneys, special prosecutors, and attorneys general can have overlapping or separate authority. Court level, venue, juvenile jurisdiction, and appellate assignments may divide cases.
Confusing a prosecutor with the victim’s lawyer
The prosecutor represents the government. Victims may have statutory rights and access to a victim-witness unit, but the prosecutor’s charging and plea decisions remain independent.
Using an old office directory or statute
County boundaries, court names, elected offices, and charter provisions can change. Use the current official website, clerk’s docket, and codified law for the date and county involved.
Expecting a prosecutor to resolve a private civil dispute
A broken contract, boundary disagreement, or personal-injury claim is not automatically a criminal matter. If no criminal statute applies, the dispute may require civil court, mediation, an agency complaint, or private counsel.
A reliable method for identifying the right office
- Name the conduct and desired remedy. Is the goal an arrest, a criminal charge, an injunction, damages, debt collection, or advice to a county agency?
- Identify the location and court. Record the county, municipality, courthouse, and case number if one exists.
- Classify the matter under local law. Check whether it is a state crime, local ordinance, juvenile case, administrative issue, or civil claim.
- Read the assignment statute or charter provision. Search for the office’s authority over the specific court and proceeding, not only broad descriptions on a webpage.
- Confirm with the clerk or official office. Ask where a filing or referral belongs; do not seek legal advice from a clerk about the merits.
- Get individual legal advice when rights or deadlines are at stake. A prosecutor or county lawyer cannot advise an opposing private party.
Bottom line
District attorneys are generally public prosecutors for the state, but their territory and court assignments vary. County attorneys are the less predictable title: they may prosecute criminal cases, serve as county civil counsel, or perform both roles. Texas assigns district-court criminal cases to district attorneys and other trial-court criminal cases to county attorneys; California general-law counties commonly separate the district attorney’s prosecutorial role from county counsel’s civil role; Nevada combines several functions in the district attorney’s statutory office. For any live matter, verify the current state code, county charter, court rules, and official office directory before filing or directing a complaint.
