You do not automatically need consent to create or use every customer identity profile. Under the GDPR, consent is one of six possible lawful bases and must meet a demanding evidence standard when chosen. California’s CCPA/CPRA is mainly a notice-and-rights system: covered businesses must explain their practices and honor consumer controls such as deletion, correction and opting out of sale or sharing. The practical requirement in both regimes is an identity-and-preference record that can be acted on across every system holding the person’s data.
Start by deciding what identity processing you are doing
“Customer identity” is more than a login table. An inventory should include account IDs, email and telephone hashes, authentication events, device and cookie identifiers, inferred segments, precise location, biometrics and linked household records. Map where each element is collected, copied, enriched, disclosed and deleted.
Classify every field by purpose and sensitivity before presenting a choice. Under the CCPA, sensitive personal information includes account credentials, precise geolocation, biometric information used to identify a consumer, health information and racial or ethnic origin. GDPR special-category data has additional processing restrictions. A single profile can therefore contain fields governed by different rules and different retention periods.
When GDPR requires consent—and when it does not
The GDPR provides six lawful bases: consent, contract necessity, legal obligation, vital interests, public task and legitimate interests. Select the basis separately for each purpose, such as account authentication, fraud prevention, service delivery, product analytics or targeted advertising. Document the reasoning in the processing record.

Do not call an operation “consent-based” if you would process the data anyway. The UK Information Commissioner’s Office warns that consent is misleading where an organization has no intention of offering a real choice. Contract necessity may fit a login required to provide a service; a legal obligation may support statutory recordkeeping; legitimate interests may be available only after a documented necessity and balancing assessment.
When consent is the selected basis, it must be freely given, specific, informed and granular, with a clear affirmative action. The controller must be able to demonstrate that the individual consented. Consent cannot be inferred from silence, inactivity or a pre-ticked box, and separate purposes should not be bundled into one unavoidable “accept” action.
“Where processing is based on consent, the controller shall be able to demonstrate that the data subject has consented to processing of his or her personal data.”

Design a notice and choice interface people can understand
Present the controller’s identity, the purposes, relevant data categories, third parties or recipient categories and the withdrawal method at the point of choice. Consent requests should be prominent, concise, understandable and separate from general terms and conditions. Use independent controls for materially different purposes, for example one toggle for personalized advertising and another for optional location-based recommendations.
Record the exact notice or configuration shown. A later privacy-policy revision does not prove what a person saw at the time of enrollment. The European Data Protection Board describes a valid choice as one in which individuals have a genuinely free option to agree or refuse; avoid interface designs that make refusal materially harder than acceptance.

Build a consent and preference ledger
A durable ledger turns a one-time click or opt-out signal into an enforceable instruction. At minimum, store:

- Processing purpose and the legal or choice basis.
- Action taken, such as granted, refused, withdrawn, opted out or limited.
- Date and time, including the time zone or normalized timestamp.
- Collection channel and jurisdiction.
- Notice, privacy-policy and consent-form version numbers.
- The text, form snapshot or configuration presented at the event.
- Downstream recipients, processors or systems that received the data.
- Withdrawal, opt-out or deletion events and their effective times.
- Request status, completion evidence, exceptions and the reason for any denial.
ICO guidance specifically recommends retaining the master form or document containing the consent statement, associated privacy information, version numbers and dates. Store the evidence so an auditor can reconstruct the event without relying on a mutable current webpage.
Make withdrawal and California opt-out changes propagate
Withdrawal must be as easy as giving consent. Provide a persistent preference center and an equivalent customer-service route; do not force someone to navigate a different or more burdensome process to reverse a choice. When a withdrawal arrives, update the identity graph, marketing and analytics tools, data warehouses, processors and suppression lists that use the affected purpose.

For California residents, provide a clear way to opt out of the sale or sharing of personal information and honor qualifying global privacy control signals where applicable. “Sale” and “sharing” are distinct CCPA concepts; map each disclosure so the correct control reaches the correct recipient. A business cannot require account creation for an opt-out request. California Department of Justice guidance says the business should respond as soon as feasible, with up to 15 business days for the opt-out request described in its 2026 FAQ.
Keep the original signal and the propagation log. The record should show when each downstream system received the change, whether it acknowledged the update and which statutory or operational exception prevented a change, if any.

Handle California rights requests without losing the person in the graph
The CCPA/CPRA gives California consumers rights to know, delete, correct, opt out of sale or sharing, and limit use or disclosure of sensitive personal information. A request workflow must search every identity representation, including account records, hashed contact points, device IDs, inferred profiles and linked household records, while avoiding disclosure of another person’s data.

Verify proportionately
Ask only for the evidence needed to identify the correct consumer and match the relevant records. CCPA regulations address verification and authorized agents. Keep verification material separate from the profile where possible, use it only for the request, and do not repurpose it for marketing or enrichment.
Apply deletion exceptions deliberately
A deletion request is not an instruction to erase records that a law, security need or other CCPA exception requires the business to retain. Record the specific exception, the systems affected, the data retained and the person’s notification. Notify relevant processors and recipients when the request requires it, then preserve completion evidence in the request ledger.

Coverage, exemptions and definitions are fact-dependent. Confirm the current statutory text and regulations for the business, data and transaction in question rather than applying these thresholds as a universal test.

Dates and controls teams should track
- CCPA regulations became effective on August 14, 2020; additional amendments became effective March 15, 2021.
- Record the notice and preference version at every event, not just the date of the latest policy.
- Separate account-level identity from household-level records so a request does not expose or erase the wrong person’s information.
- Recheck thresholds, regulatory amendments and global-privacy-control implementation for the jurisdictions in which the service operates.
A practical implementation sequence
- Inventory: diagram identifiers, copies, inferences, recipients and retention locations.
- Classify: mark purpose, sensitivity, jurisdiction and whether the record concerns an individual or household.
- Choose the basis: assign a GDPR lawful basis or California choice requirement to each purpose and document the rationale.
- Design: create separate, plain-language notices and controls, including withdrawal and opt-out paths.
- Capture: write the event, presented text or configuration, version and timestamp to an append-only or otherwise tamper-evident ledger.
- Route: connect the ledger to marketing, analytics, identity, processor and suppression systems.
- Verify: test proportionate matching for know, delete, correct, opt-out and limit requests, including authorized-agent cases.
- Audit: reconcile propagation acknowledgments, unresolved exceptions and request deadlines, and retain the rationale for every outcome.
This sequence prevents a common failure: collecting a valid preference at the front door while an old identity copy, household record or downstream vendor continues processing the data.
