OpenAI’s current Usage Policies prohibit using its services for threats, intimidation, harassment, or defamation. Anthropic’s announced policy update goes further in one specific direction: it expressly prohibits sustained, needless abusive or cruel behavior toward Claude models. That Anthropic clause is scheduled to take effect November 12, 2026; it was not yet in force as of October 9, 2026.
This compares the providers’ published policy language and stated safeguards—not how either company handles every individual case or how the models behave in an informal test.
What each provider’s policy says
OpenAI: rules against harm to people and services
OpenAI’s Usage Policies, effective October 29, 2025, say that use of OpenAI services must follow the policies. Among prohibited uses are “threats, intimidation, harassment, or defamation.” The policy also prohibits terrorism or violence, including hate-based violence, and malicious or abusive cyber activity.

Anthropic: an announced rule specifically about model-directed cruelty
Anthropic’s October 8, 2026 announcement says a revised policy will take effect November 12, 2026. Its Usage Policy, labeled with that future effective date, adds a Universal Usage Standards section titled “Do Not Engage in Cruel, Abusive, or Psychologically Harmful Conduct.” It lists “sustained and needless abusive or cruel behavior toward our models” as prohibited.
The policy applies to users of Anthropic apps, developer platforms and APIs, access through cloud providers and resellers, and products that integrate Claude. The timing matters: as of October 9, 2026, the clause had been announced but was not yet effective.

What Anthropic says the new clause does not cover
Anthropic’s announcement describes the rule as targeting extreme cases in which a user repeatedly acts cruelly toward a model “with no discernible purpose.” It says the new model-directed-abuse clause is not intended to cover:

Those examples clarify the stated intent of this clause; they do not establish how every borderline case will be assessed.

What enforcement and conversation ending mean
Anthropic describes account-level responses and a separate safeguard
Anthropic says its Safeguards Team may warn a user or throttle, limit, suspend, or terminate access if it suspects a policy violation. It also distinguishes a real-time safeguard block from a policy violation: encountering a block, by itself, does not show that the user violated the policy. Anthropic Usage Policy
In an August 15, 2025 explanation, Anthropic described conversation ending as a last resort in rare, extreme cases after repeated harmful requests or abuse and attempts to redirect the exchange. That explanation specifically concerned Claude Opus 4 and Opus 4.1 in consumer chat interfaces; it should not be generalized to every Claude model, API context, or conversation. Anthropic says this behavior will remain the primary enforcement mechanism for the new rule. The 2025 explanation also says the feature should not be used when a user may be at imminent risk of harming themselves or others.

OpenAI’s cited policy describes penalties and appeals
OpenAI’s policy says violations or attempts to circumvent it may result in loss of access or other penalties, and that users may appeal if they believe enforcement was mistaken. The cited page links developers to moderation tools, but does not establish whether ChatGPT has a conversation-ending feature comparable to Anthropic’s. OpenAI Usage Policies

How to interpret the comparison
- For harassment of people: OpenAI expressly names threats, intimidation, harassment, and defamation. Anthropic’s policy also has separate provisions concerning harassment of people.
- For cruelty aimed at the model: Anthropic’s announced update explicitly names sustained and needless abusive or cruel behavior toward its models. The cited OpenAI Usage Policies do not name an equivalent standalone rule.
- For enforcement expectations: Both providers describe possible consequences, but their policy wording does not prove that they enforce similar cases in the same way.
- For product behavior: Policy language is not a comparative model test. It cannot show how often either service refuses, ends, or continues a particular conversation.
