There is no reliable “Chinese versus US versus European” privacy ranking. The decisive variables are the specific service, account tier, API endpoint, hosting route, retention setting and whether another provider receives your prompts. The same model can have different protections in a consumer app, a first-party enterprise API, a third-party platform or a self-hosted deployment.
For sensitive information, compare documented data controls rather than nationality. Check training use, abuse-monitoring retention, files and application state, regional processing, subprocessors, security evidence and the legal entity in your contract. Provider policies are commitments and descriptions of practice—not independent proof that controls are implemented or that one jurisdiction is categorically safer.
What “safe for privacy” actually means
Privacy and security are separate questions. A provider can prohibit using business prompts to train a foundation model while retaining logs for abuse monitoring. It can offer encryption while storing uploaded files for a stateful feature. It can process a request in a selected region while routing the prompt to a third-party model vendor. A useful comparison therefore examines several controls together:
- Scope: consumer app, enterprise workspace, first-party API, third-party host or self-hosted model.
- Training: whether prompts, outputs, feedback, files or other content may improve models, and whether an opt-in or opt-out changes the default.
- Retention: normal request logs, abuse-monitoring logs, files, conversation history, caches and application state.
- Configuration: zero-data-retention (ZDR) or similar controls, eligibility, covered models and endpoints, and features that bypass the setting.
- Location and routing: processing region, residency commitments, subprocessors and any external model provider that receives the request.
- Security evidence: encryption, access controls, independent audits or certifications, incident disclosures and stated limitations.
- Jurisdiction: the contracting entity, governing terms, transfer mechanisms and applicable law. Provider nationality alone does not establish a particular government-access outcome.
These categories prevent a common mistake: treating a model name as if it were a complete product. “Qwen,” “DeepSeek,” “Claude” or an OpenAI model may be available through several services with materially different terms.

Chinese services: what their published policies say
Alibaba Cloud Model Studio
Alibaba Cloud’s Model Studio Data Retention Policy states that prompts and responses from inference calls are retained for no longer than 30 days by default. The policy allows legal and security exceptions, so “30 days” is a stated maximum under the standard handling described there, not a guarantee that every record is deleted at exactly that point.
The same policy says, “Without your separate consent, we will not use your business data (including inputs, outputs, and files) to train, fine-tune or improve any foundation model.” That statement concerns covered business data under Model Studio’s policy; it should not be generalized to every Alibaba product, model distribution or excluded feature.
Model Studio offers ZDR only to eligible enterprise customers that apply through an account manager. ZDR applies to listed adapted model series, not automatically to every model available in the console. Calls to unsupported models continue under standard retention. The policy also excludes third-party vendor inference offered on the platform, meaning a workspace’s ZDR setting does not necessarily control a vendor’s copy of the prompt.
Stateful and asynchronous capabilities require particular care. Agent, retrieval-augmented generation (RAG), batch, playground and Responses API paths can have separate handling or be excluded from ZDR. A request that looks like a normal chat completion may therefore receive different retention treatment when it uses files, conversation state, tools or asynchronous processing. Verify the model list and endpoint-specific exclusions in the current policy before sending regulated data.
QwenWork
Alibaba’s QwenWork privacy and security summary applies to its web and desktop product. It directs users to the full privacy policy for matters such as disclosure and international transfers. That summary is not a blanket statement about every Qwen model, API, regional deployment or self-hosted installation. A Qwen model running in your own infrastructure has a different data path from QwenWork’s hosted application.
Rank #2
DeepSeek Harness
The DeepSeek Harness privacy policy describes a model-calling scenario in which inputs go directly to the relevant model provider and Harness does not store or process those inputs and outputs on its servers. In that arrangement, the model provider’s own terms govern prompt processing. Harness still says it collects session logs and device or network information, and it warns that the services are not designed for sensitive personal data.
That distinction matters operationally. “Harness does not store the prompt” does not mean the downstream model provider does not. Before using the service, identify the provider selected for the call, read that provider’s retention and training terms, and determine whether the request is routed outside your approved region.

US providers: business and API controls are product-specific
OpenAI business products and API
OpenAI’s business-data policy says data from listed business products and the API platform is not used for training by default. It describes encryption in transit and at rest and retention controls for qualifying organizations. “Not used for training” addresses model-improvement use; it does not automatically mean that no operational logs, files or application state are retained.
The API data-controls documentation explains that abuse-monitoring logs may contain prompts and responses and are normally retained for up to 30 days, subject to stated exceptions. ZDR and Modified Abuse Monitoring require approval. Some endpoints and features can still store application state even when an organization has a special monitoring arrangement. Review the endpoint table rather than assuming one organization-wide switch covers every API feature.
The API documentation also describes regional request processing when requests are sent to US or EU API domains. TLS termination and HTTPS decryption can occur within the selected processing region through Cloudflare Regional Services. This is not proof that every downstream processing or storage operation remains in that region; confirm the current residency documentation, service scope and subprocessor terms for your account.
Anthropic and the consumer/commercial split
Anthropic’s Privacy Center lists publicly available internet information, commercially obtained datasets, user or crowd-worker contributions and data users permit it to use among possible training sources. The cited consumer Privacy Policy does not apply when Anthropic acts as a processor for commercial customers. In that commercial context, the customer is the controller for its own processing.
Consequently, a consumer account and a contracted commercial API should not be described with one sentence about “Anthropic privacy.” Obtain the terms attached to the specific plan, data-processing agreement, retention option and API route.
What the European context does—and does not—establish
The European Data Protection Board’s 2025 report, AI Privacy Risks & Mitigations – Large Language Models (LLMs), is regulator-authored context on risks and mitigations. It names Chinese model families such as DeepSeek and Qwen, and European initiatives and providers such as Mistral AI, Aleph Alpha and OpenEuroLLM. Read the report at the EDPB’s PDF.
The report is not a certification, a live vendor-policy comparison or evidence that European services share one data-handling posture. European data-protection law can affect contracts, transfer mechanisms and rights, but the practical answer still depends on the provider, service tier, hosting location, subprocessors and configuration. A European-hosted endpoint can still use external infrastructure; a Chinese, US or European model can be deployed privately under a customer-controlled environment.

How to evaluate an AI service before sending sensitive data
- Name the exact endpoint. Record the product, plan, API hostname, model version, region and whether a reseller, gateway or cloud marketplace sits between you and the model provider.
- Map the data journey. List prompts, outputs, uploaded files, conversation history, tool results, feedback, telemetry and support tickets. Identify which company receives each item.
- Separate training from operations. Find the sentence covering training, fine-tuning and product improvement, then separately locate abuse-monitoring logs, diagnostics, human review, backups and application-state retention.
- Check the actual retention number. Note whether it is a default, maximum, one-time allowance or recurring period; record exceptions for legal requests, security investigations, outages and backups.
- Validate ZDR eligibility. Confirm that your organization qualifies, the model is on the covered list, the endpoint supports the setting and stateful features do not bypass it. Obtain written confirmation when the setting requires approval.
- Inspect regional processing and transfers. Check where TLS terminates, where prompts are decrypted, where logs and files are stored, which subprocessors are involved and whether a third-party model receives the request. Do not infer complete residency from a regional domain alone.
- Review security evidence. Look for encryption in transit and at rest, role-based access, key management, audit reports, penetration-testing summaries, incident-notification terms and deletion procedures. Treat a policy promise as different from an independent audit.
- Match the legal arrangement to your role. Determine whether the provider is your processor or controller, which entity signs the contract, what transfer mechanism applies and how data-subject requests are handled.
- Minimize before transmission. Remove names, account numbers, secrets and unnecessary attachments; use synthetic or redacted examples for testing. If the service says it is not designed for sensitive personal data, honor that limitation rather than trying to solve it with a prompt instruction.
- Verify deletion. Test account, file and conversation deletion, record the expected timeline and ask how backups, abuse logs and legal holds are treated. Recheck the policy when the model, endpoint or plan changes.
Choosing a deployment for different risk levels
Routine, non-sensitive work
For public text, brainstorming and low-impact transformations, a consumer app may be adequate if you avoid confidential attachments and understand whether content can be retained or used for improvement. Keep prompts free of personal data and credentials even when the service advertises strong security.
Confidential business information
Prefer a contracted enterprise workspace or first-party API with an explicit no-training default, a documented retention period, access controls and a data-processing agreement. Confirm whether files, tools and conversation state follow the same terms as ordinary inference. OpenAI’s business/API documentation and Alibaba Model Studio’s business-data language illustrate why these details must be checked feature by feature.
Regulated or highly sensitive data
Use only a deployment whose contract, residency terms, retention controls and audit evidence satisfy your sector’s requirements. A provider-approved ZDR arrangement can reduce exposure, but it is not a universal guarantee: unsupported models, asynchronous jobs, agent tools, RAG stores and third-party inference can remain outside the control. Consider self-hosting a model when your organization can operate patching, identity, network isolation, logging and incident response; self-hosting shifts responsibility to you rather than eliminating it.

Third-party gateways and orchestration tools
Treat the gateway as an additional data controller or processor until its terms prove otherwise. Determine whether it logs prompts, injects telemetry, selects a different model provider or stores cached responses. DeepSeek Harness’s distinction between its own server handling and the downstream model provider is a useful pattern for this review.
Common comparison mistakes
- Ranking countries instead of services. Jurisdiction affects legal obligations, but it does not reveal the retention settings of a particular API or the security of a self-hosted deployment.
- Equating no training with no storage. Training exclusion can coexist with abuse logs, files, backups or application state.
- Assuming ZDR covers everything. Eligibility, model lists, endpoint support and stateful features can narrow the scope.
- Combining consumer and enterprise policies. A consumer privacy notice may not apply when a provider acts as a commercial processor, and an enterprise API policy may not cover a consumer chatbot.
- Ignoring third-party routing. A platform can send your request to a vendor whose terms and geography differ from the platform’s own.
- Reading a regional hostname as a residency guarantee. Regional request processing can coexist with other storage or support operations outside that region.
- Calling a regulator’s risk report a certification. The EDPB report provides analysis and mitigations, not a safety score for every named model.
- Trusting a single old screenshot. Retention periods, eligible model lists and feature coverage change; verify the live policy and contract at deployment time.
Answers to the questions readers usually ask
Are Chinese AI models safe for privacy?
Some services publish strong controls, while others expose more limited or different terms. Safety cannot be answered for “Chinese models” as a group. Evaluate the exact app, API or host using the seven control categories above.
Is DeepSeek less private than ChatGPT or Claude?
There is no fair model-to-model answer without fixing the product and plan. DeepSeek Harness says it does not store model inputs and outputs in the described server-side scenario, but the downstream provider’s terms govern those inputs. OpenAI and Anthropic likewise distinguish consumer and commercial services, retention and processor roles. Compare equivalent deployments, not brand names.
Which AI model is safest for sensitive data?
The safest choice is the service that gives your organization enforceable controls: approved processing region, minimal retention, no-training terms, limited access, documented deletion, suitable contracts and independent security evidence. That may be a managed enterprise API, a private cloud deployment or a self-hosted model depending on your operational capability; no model family wins automatically.
Does Alibaba’s 30-day figure mean my data is deleted after 30 days?
It means Model Studio’s policy describes inference prompts and responses as retained for no longer than 30 days by default, with legal and security exceptions. ZDR eligibility and feature exclusions can change the applicable handling, so check the exact model and endpoint.
Does OpenAI’s EU API domain guarantee EU-only storage?
No. The API documentation describes regional request processing, including TLS termination and HTTPS decryption within the selected region through Cloudflare Regional Services. It cautions against treating that as proof that every downstream processing or storage operation remains there; verify the current residency scope and subprocessors.
