China has opened a consultation on a draft export-control catalogue that would cover 40 technologies, including 23 artificial-intelligence technologies, while requiring interim registration for covered exports immediately. The proposal is not yet the final catalogue: the consultation runs from October 16 through November 15, 2026, and technical thresholds and implementation details can still change.
What China announced on October 16, 2026
China’s Ministry of Commerce and Ministry of Science and Technology issued Announcement No. 48 to revise the catalogue of technologies prohibited or restricted from export. The notice also introduces interim pre-export registration for transfers covered by the draft from the announcement date until a revised catalogue takes effect.
The Associated Press reported that the draft spans 40 technologies across artificial intelligence, chips, solar power and biomedicine. The ministries’ public description highlights artificial intelligence, biomedicine and photovoltaics, with chip-related technology also appearing in the reported scope.

Which technologies are covered?
| Area | What the draft addresses | Proposed treatment |
|---|---|---|
| Artificial intelligence | Large models, AI agents, computing clusters and information-processing technologies, including malicious-code generation and mutation and AI-assisted vulnerability discovery | Prohibited or restricted depending on the specific technology |
| Biomedicine | Cell and gene-therapy technologies and other listed biomedical capabilities | Prohibition or restriction/licensing |
| Photovoltaics and related manufacturing | Polysilicon engineering and battery technologies, among other listed energy and solar capabilities | Prohibition or restriction/licensing |
| Chips and computing | Chip-related technologies and computing capabilities described in public accounts of the draft | Category-specific control; the final technical entries are not yet fixed |
The announcement does not make every Chinese AI product or every semiconductor shipment subject to a blanket ban. The controlling question will be whether the technical content matches a final catalogue entry and whether the transaction is an export covered by the rules.
Does this ban overseas use of Chinese AI models?
No blanket ban on overseas use has been announced. The ministry’s explanation distinguishes the transfer of restricted large-model technology from access to a model as a service.
Transfers likely to be in scope
Local deployment of restricted large-model technology at an overseas site is identified as falling within scope. The same is true of ownership transfers, overseas licensing, and changes in ownership or control to an overseas entity when the underlying technology is covered.

The ministry says that API calls, interaction through an app or website, software-as-a-service access and lightweight on-device deployment generally are not treated as exporting the large-model technology itself. That distinction does not remove other legal or contractual obligations, and the final catalogue could refine the boundary.

For example, sending prompts to a China-hosted model through an API is described differently from installing the restricted model and its associated technology on servers operated by an overseas subsidiary. Companies should document which of those delivery models they use rather than treating “AI export” as a single category.
What exporters must do during the consultation
Interim registration applies from October 16, 2026, for transfers that fall within the covered technology categories. Businesses should not wait for the final catalogue before building a transaction file.
- Classify the technology. Map model architecture, training or inference software, chip designs, manufacturing know-how, solar-process engineering and biomedical methods to the draft descriptions. Record the technical version and any thresholds used.
- Identify the transaction. Check whether the arrangement is a sale, licence, technical service, transfer of ownership, overseas deployment, or a change in ownership or control involving an overseas entity.
- Prepare registration data. The notice calls for exporter and recipient identities, destination, intended use and expected transaction value. Keep supporting contracts, technical descriptions and end-use statements with the submission.
- Separate access from technology transfer. For AI services, document whether the customer receives an API, app or SaaS service, or whether the customer receives a model, weights, software, equipment or local installation.
- Check the latest ministry instructions. Because the catalogue is under consultation, confirm the current registration and licensing procedure before shipment, licence execution or deployment.
What is prohibited versus restricted?
The proposed split matters operationally. Fourteen entries are proposed for prohibition, while 26 would be restricted and handled through licensing. The draft identifies examples such as malicious-code generation and mutation and AI-assisted vulnerability discovery on the AI side, plus cell and gene therapy, polysilicon engineering and battery technologies elsewhere in the draft. It does not establish a complete entry-by-entry list or final thresholds for each item, so companies should not infer that every technology in one broad field receives the same treatment.

Why Beijing says it is doing this
China’s commerce ministry said the measures are intended to “reinforc[e] the security bottom line, prevent[] misuse and abuse, and ensur[e] that AI remains under human control,” in wording quoted by the Associated Press on October 16, 2026. The ministry’s official Q&A says the revision has a legal basis, is designed to prevent misuse and uncontrolled diffusion, and is not aimed at a particular country, region or entity.

- Single core ARM Cortex-A7 32-bit core, integrated with NEON and FPU
- Built in Micro's self-developed 4th generation NPU, with high computational accuracy and support for mixed quantization of int4, int8, and int16. Among them, int8 has a computing power of 0.5 TOPS and int4 has a computing power of up to 1.0 TOPS
- Built in self-developed 3rd generation ISP3.2, supports 4 million pixels, and supports various image enhancement and correction algorithms such as HDR, WDR, and multi-level denoisin
- It has powerful encoding performance, supports intelligent encoding, adapts to save bit rates according to the scene, and saves more than 50% of the bit rate compared to conventional CBR mode, making the captured images high-definition, smaller in size, and doubling the storage space
- The design with built-in RISC-V MCU supports low-power fast startup, 250ms fast capture, and simultaneous loading of AI model library, enabling facial recognition to be completed within 1 second
The Associated Press placed the announcement in the context of intensified technology competition with the United States. That is geopolitical context, not a statement that the Chinese catalogue is legally targeted at the United States; Beijing’s published explanation expressly rejects a country-specific rationale.
Open-source, research and cooperation channels
The draft is not designed to stop every form of technical cooperation. Publicly available technology released through open-source channels or academic publication is proposed to fall outside the administration. The precise conditions will matter: publishing material does not automatically make a separate proprietary implementation or controlled hardware transfer public.
The ministries also describe automatic-licensing facilitation for specified overseas computing, chip-fabrication, joint-research and standards activities. “Automatic” in this context refers to the facilitation described by the ministry; companies still need to verify that a project meets the qualifying conditions and retain evidence of that qualification.
How this differs from a simple product embargo
The proposal is centered on technology transfers and controlled transactions rather than a single list of finished products. A compliance review therefore needs to examine:

- the technical content being transferred, not only the product name;
- whether the recipient is in China or overseas and whether control or ownership changes;
- whether the delivery is a local deployment, licence or transfer versus remote service access;
- whether the entry is prohibited or subject to licensing;
- whether an open-source, academic, research or standards pathway applies; and
- what registration evidence and end-use information the authorities require.
A direct legal comparison with United States export controls would require separate sourcing for the U.S. rules. The Chinese announcement alone does not establish how the two systems align on extraterritorial reach, end users or enforcement.
What happens next
The public consultation closes on November 15, 2026. Until the revised catalogue formally takes effect, the interim registration requirement is the immediate compliance issue for potentially covered transfers. After consultation, China may change entries, definitions, thresholds, exemptions or procedures before issuing a final catalogue.
Companies with planned overseas AI deployments, chip-related transfers, photovoltaic process licences or biomedical collaborations should preserve a dated record of the technology classification and delivery model used for each transaction. That record will help determine whether a final rule changes the analysis and whether a registration or licence was required when the transfer occurred.
