Yes—only when the specific contest rules permit it. Contest eligibility and copyright are separate questions. An organizer may prohibit all generative-AI use even when your human work around an AI-generated image could qualify for some copyright protection. Read the rules for the exact contest edition, identify what it calls “AI assistance” or “generative AI,” and disclose use in the form and timeframe the organizer requires.
Contest permission comes before copyright analysis
A game jam, art competition, or other contest sets its own entry conditions. Those conditions can be stricter than copyright law. For example, the official Just Play Game Jam rules require entrants to represent that “no generative AI was used by you or your team in the creation of your project.” That wording is an eligibility condition: using a generative tool could disqualify an entry even if the finished game also contains substantial human-authored material.
Copyright law answers a different question: which parts of the work, if any, receive legal protection, and who can claim it? A contest can ban AI-assisted art without making a legal finding about copyrightability. Conversely, a contest can allow a tool while reserving ownership, promotional, or licensing rights in its own terms.

What U.S. copyright guidance says about AI-assisted art
Human creative contribution is the central issue
The U.S. Copyright Office’s Part 2 report, issued January 29, 2025, states that “the use of AI to assist in the process of creation or the inclusion of AI-generated material in a larger human-generated work does not bar copyrightability.” The statement does not mean every AI-assisted image is protected. Protection depends on whether a human author determined enough of the expressive elements in the material being claimed.
Human-authored material that remains perceptible in the final output can qualify. So can a creative human arrangement, selection, or modification of generated material. The Office says that merely providing prompts does not, by itself, supply enough authorship. A prompt may communicate an idea or direction, but a claim to the resulting image must be based on human expressive choices that are sufficiently original and fixed in the work.
What may be protected in a game
Section 102 of Title 17 protects original works fixed in a tangible medium, including pictorial, graphic, sculptural, and audiovisual works. The statute excludes ideas, procedures, processes, systems, and methods of operation. The Copyright Office Compendium applies those principles to games: original text, artwork, sound recordings, and audiovisual material may be protected when they contain sufficient original authorship, while the underlying game idea and methods of play are not registrable as such.

In practical terms, a hand-painted character sheet, original dialogue, or a human-created animation sequence may contain protectable expression. The concept “a platform game in which the player reverses gravity,” the scoring system, and the rules for winning are ideas or methods rather than exclusive expression. Protectable elements can coexist with unprotectable mechanics in the same project.
AI-generated content can affect the scope of a claim
If an image contains both generated material and your own edits, identify which elements reflect your choices. Cropping, compositing, repainting, redesigning silhouettes, replacing details, and arranging multiple assets can contribute human authorship when the choices are sufficiently creative. A claim should not imply that you authored every pixel if the tool generated substantial portions without human control over their expressive details.
The Office’s position concerns copyrightability, not a promise that a registration will be granted for a particular file. The analysis is fact-specific: the tool’s role, the source material, your edits, and the final result all matter.

Disclosure obligations for registration
On March 16, 2023, the Copyright Office explained that applicants have a duty to disclose AI-generated content in works submitted for registration. If an application omits required information, the public record may need to be corrected. This registration duty is separate from a contest’s disclosure requirement. You may have to tell a contest about AI use even if you never seek registration, and you may have to disclose generated material in a later registration even if the contest accepted the entry.
Keep a precise description of what the tool produced and what you created. If you later register a game, identify the human-authored portions you are claiming and describe the generated portions as required by the application process. Do not treat a disclosure as an admission that the entire game lacks protection; it is a way to define the work and the authorship accurately.

Contests use these terms differently, so their definitions control. The following distinctions are practical questions to ask, not universal legal categories.

“I only used AI for backgrounds” is therefore not a safe assumption. A background is still an asset in the project, and a rule that bans generative AI “in the creation of your project” can encompass it. Ask whether the restriction covers any generated content, only final assets, or only unmodified outputs.

Rules can change between editions. Download or otherwise preserve the version you relied on, including linked definitions and appendices, so you can show what the organizer required when you made and submitted the work.
A compliant workflow for an AI-permitted contest
- Read the exact edition. Search the rules and submission portal for “AI,” “generative,” “assistance,” “assets,” “ownership,” and “disclosure.” Record the publication or update date.
- Classify each tool and asset. Make an inventory covering image, text, audio, code, animation, upscaling, cleanup, and reference tools. Mark whether each output appears in the submitted build.
- Capture the terms in force. Save the tool’s commercial-use, output-ownership, and training-data terms that applied on the creation date. Also retain licenses for source images, fonts, samples, and other external material.
- Keep a creation log. Record the tool or model, date, account or edition where relevant, prompts, input images, generated outputs, selected versions, and every substantial human edit. Preserve layered files and version history rather than flattening everything immediately.
- Separate human and generated layers. Label original sketches, paint-overs, compositing, typography, animation, and generated elements. This lets you describe your contribution precisely and respond to an organizer’s request for process evidence.
- Check the submission declaration. Answer the organizer’s AI question directly. If disclosure is requested, state what was generated, what was edited, and which assets appear in the final project. Do not wait for a later copyright filing to disclose a contest-regulated use.
- Request written clarification when needed. Send the organizer a concise description of the workflow and keep the response with your project records. Silence, informal comments, or an answer about a different contest are not reliable permission.
- Recheck before upload. Confirm that teammates followed the same policy, that every external asset has a usable license, and that the declared workflow matches the files in the final build.

Copyright questions to ask about a finished game
Which parts did a human author create?
List the expressive elements you designed or changed: character drawings, level illustrations, dialogue, sound recordings, animation timing, interface artwork, and the selection and arrangement of assets. Explain the creative decisions rather than simply stating that you typed prompts. A prompt can be part of a workflow, but the Copyright Office’s guidance says prompting alone does not provide sufficient authorship for the generated result.

Is the claimed material fixed?
Copyright applies to original expression fixed in a medium, such as an image file, recorded soundtrack, script, or compiled audiovisual sequence. A fleeting idea in your head is not the same as a fixed work. Keep the source files and dated versions that show when the expression was created.
Are you claiming game rules or expression?
Describe claims in terms of protectable expression. The idea of a game, its procedures, systems, and methods of play are excluded from Section 102 protection. Two developers can independently use a similar mechanic without copying each other’s artwork, text, music, or audiovisual presentation.
Would a registration require an AI disclosure?
If you submit an application for a work containing AI-generated material, follow the Copyright Office’s March 16, 2023 guidance on disclosure. An omitted disclosure may require correction of the public record. Define the human-authored material you seek to register instead of presenting the entire output as solely human-created.

Why the U.S. position does not answer every contest
The guidance above is U.S.-focused, and the contest example is one organizer’s rule. Other countries may apply different standards to authorship, training data, moral rights, or registration. A platform may also impose contract terms that differ from the law in the place where you live. Identify the governing law in the contest terms and obtain local legal advice for a high-value project or a disputed submission.
The Copyright Office received more than 10,000 public comments by December 2023 during its AI notice-of-inquiry process. That volume shows how quickly the policy area is developing; it is not a universal permission for contest entrants. Treat each edition’s written terms and each jurisdiction’s current law as controlling.
Pre-submission checklist
- Have you read the current rules, definitions, appendices, and submission declaration?
- Does the organizer permit the exact kind of AI use in your workflow?
- Have you checked every team member’s use, including backgrounds, references, drafts, audio, and cleanup?
- Have you recorded tools, models, dates, prompts, inputs, outputs, edits, and final files?
- Do you possess licenses or terms for generated outputs and every external asset?
- Can you identify the human-authored portions without claiming authorship of unaltered generated material?
- Have you made the required disclosure before the stated deadline?
- Did the organizer confirm any ambiguous point in writing?
If any answer is no and the rules are strict, the lowest-risk choices are to replace the affected asset with human-created work or obtain written permission before entering.
