Usually, no. Buying a digital game normally gives your account a personal license, not a transferable copy that you can sell, move to another account, or lend. PlayStation, Microsoft and Steam terms generally restrict those actions. A narrow European Union rule can apply to some perpetual computer-program licenses, but it is not a general right to resell digital games or transfer an account.
What you actually receive when you buy a digital game
A digital checkout usually records an entitlement on a platform account. The platform or publisher retains copyright in the game and grants permission to download and use it under specified terms. That arrangement differs from buying a physical disc or cartridge, where the particular object can generally be handed to another person.
The distinction matters because ownership of a device, download file or payment receipt does not automatically mean ownership of a transferable copy. A license may be limited by account identity, region, device rules, online-service requirements, duration and the platform contract accepted at purchase.

License versus ownership
PlayStation states that “All Software is licensed, not assigned,” meaning the customer receives rights to use software under its terms rather than ownership of the software. Its terms also say, “Your licence to use games is not transferrable unless your local applicable laws say it must be.” The same terms prohibit resale unless PlayStation expressly authorizes it.

Microsoft’s Usage Rules for Digital Goods take a similar approach: digital goods may be used only as the terms permit and, except where expressly allowed, users may not transfer or resell licenses to digital goods. These rules cover ordinary purchases through Microsoft and Xbox stores.
Can you transfer a game from one account to another?
Normally, no. A platform entitlement is ordinarily attached to the account that bought or redeemed it. Platforms may let you sign into that account on several devices, designate a primary or home console, or use family-sharing features, but those conveniences do not usually create a separate, transferable license.
Why account sharing is not a transfer
Giving another person your credentials is an account transaction, not a lawful reassignment of one game. It can expose payment details, saved data and other purchases, and it may breach account-security or terms-of-service rules. If the platform suspends the account, both the original buyer and the other user can lose access. Selling an entire account is especially risky because the account may include games, subscriptions, virtual items and personal information that cannot be cleanly separated.

What happens to saves and online features
Even where a platform technically changes an account owner or permits a family feature, saved progress, trophies, achievements, downloadable content and online entitlements may remain tied to the original account. Multiplayer access can also depend on a separate subscription. A buyer who receives a login may therefore not receive the practical benefits expected from a standalone game license.

Contracts can change, and a publisher’s game-specific EULA can add restrictions. Read the terms shown for the product and region rather than relying on a general statement about a platform.
Can you lend a digital game to a friend?
There is no general lending right for a digital license. Lending usually means either sharing account credentials or using a platform feature such as family sharing. Those options are governed by the platform’s current rules and may be limited to a household, designated devices or a defined number of users.

Family and console-sharing features
A sharing feature may let another profile play a game while the purchasing account remains in control. That is permission inside the platform’s system, not a transfer of ownership. The purchaser normally keeps responsibility for the account, and access can end when the setting is removed, the device changes or the platform updates its rules.

Temporary access through subscriptions
A subscription catalog is even less like a lendable copy. Access lasts only while the subscription and catalog availability continue. If a title leaves the service, or the subscription expires, the other user cannot keep playing merely because the game was previously downloaded.
Can you resell a digital game?
For an ordinary console or PC-store purchase, assume that resale is not permitted unless the platform expressly provides a resale mechanism or mandatory local law overrides the restriction. A marketplace listing, transfer of a redemption code after activation, or sale of an account can all create separate contract and fraud risks.

Why a downloaded file does not work like a used disc
A disc or cartridge is a particular physical object. The seller gives that object to the buyer and no longer possesses it. A digital download can be copied perfectly, and the original account can often continue using the same files. Digital-resale rules therefore focus on whether the seller has stopped using the licensed copy and whether the platform can enforce that result.
The European Union exception: what UsedSoft actually decided
In UsedSoft GmbH v Oracle (C-128/11), decided on 3 July 2012, the Court of Justice of the European Union held that transferring a downloaded computer-program copy together with an unlimited user license can amount to a first sale for EU copyright-exhaustion purposes. The ruling can allow resale of certain perpetual software licenses when its conditions are met.

- The license must be effectively perpetual or unlimited in duration, rather than a subscription or temporary access right.
- The transaction must concern a downloaded computer-program copy and the corresponding right to use it.
- The original acquirer must make the copy unusable at resale. Keeping a working copy while selling another one defeats the required exhaustion logic.
- The buyer must qualify as a lawful acquirer under the circumstances of the transfer.
- The transaction must fall within the jurisdiction and subject matter covered by EU software-exhaustion law.
A later judgment summarized the limitation: the copyright holder’s reproduction right still has to be protected, and the seller cannot retain a usable copy. UsedSoft does not order every game platform to add an account-transfer button, and it does not automatically override every game contract.

Why UsedSoft is not a blanket right to resell games
The decision concerned computer-program copyright exhaustion, not a universal secondary market for every digital entertainment product. Modern games can combine executable software with music, artwork, films, trademarks, servers, downloadable content, virtual currency and online services. Whether a particular package qualifies is therefore a legal and technical question, not something established merely by the fact that it was downloaded.
National implementation, the wording of the license, the game’s online dependencies and the platform’s account architecture can all affect the outcome. An EU resident should obtain jurisdiction-specific advice before treating UsedSoft as permission to sell an activated game account.

When you sell a physical disc or cartridge, you are transferring possession of the tangible item. The buyer may still face practical limits: a required day-one patch, a delisted server, region restrictions, an online pass or downloadable content that was supplied by a one-time code. Those limits do not make the physical object equivalent to a digital account license.

Check the packaging and publisher terms before promising that every feature will work for the second owner. The important legal distinction remains the same: a physical copy is an object; a digital entitlement is generally an account permission.
How to check your position before transferring anything
- Identify the item. Decide whether you are dealing with a physical disc or cartridge, an unredeemed code, a downloaded game entitlement, downloadable content, virtual currency or a subscription. These can have different rules.
- Identify the account and store. Note the platform, storefront, account country, purchaser and whether the item is linked to a console family or household-sharing feature.
- Open the current terms. Read the platform software terms, digital-goods rules and the game’s EULA. Search for “transfer,” “resell,” “lend,” “lease,” “account,” “license” and “subscription.”
- Check duration. A perpetual license is legally different from a monthly catalog entitlement, timed trial or temporary promotional access.
- Check online dependencies. Determine whether servers, a separate multiplayer subscription, downloadable content or an account login are required.
- Check local law. If you are relying on a statutory exception, verify that it applies to your country, the type of software and the exact transaction.
- Preserve evidence. Keep the receipt, terms in force at purchase, product description and any support response. Do not send credentials or payment information to a prospective buyer while the issue is unresolved.
Common scenarios and the safest answer

What can go wrong if you ignore the restriction?
- Account suspension: the platform can disable an account involved in credential sales, unauthorized transfers or suspicious activity.
- Permanent loss of a library: a suspended account can contain many purchases, not just the disputed title.
- Payment and identity exposure: sharing credentials may expose stored cards, addresses, messages and two-factor recovery methods.
- Broken expectations: a recipient may discover that saves, downloadable content, multiplayer access or regional activation do not follow the game.
- No reliable return path: once an account or code changes hands, support may refuse to reverse the transaction because the original license was personal.
How refunds differ from resale
A refund is a return to the seller under the store’s own policy; resale is a transfer to a new user. If a game is unwanted, check the applicable refund window, play-time limit and regional consumer rights before attempting a private sale. A successful refund normally removes the entitlement from the original account; it does not create a transferable license.
Bottom line for buyers and sellers
For most digital games, the practical rule is simple: the purchaser may use the game through the purchasing account under the current terms, but cannot sell, transfer or lend the license as if it were a disc. Do not sell or share an account to work around that rule. Only proceed when the platform expressly authorizes the transaction or when a clearly applicable mandatory-law exception has been verified. In the EU, UsedSoft may cover a narrow class of perpetual downloaded computer-program licenses, provided the seller stops using the copy; it is not a general permission to resell game accounts.
