Can your employer refuse your annual-leave request?
Under Fair Work Ombudsman guidance, you need to request annual leave before taking it. An employer may refuse only if the refusal is reasonable; that does not mean every preferred date must be approved. The reasonableness of a refusal depends on the circumstances, including relevant workplace arrangements and the employee’s situation. A major game release does not, by itself, make a refusal unreasonable.

The applicable process and terms may be set out in a modern award, registered agreement, workplace policy, or employment contract. The Fair Work Ombudsman’s annual-leave guidance explains requesting leave and refusal. The relevant provisions of the Fair Work Act 2009 address agreement on when annual leave is taken and unreasonable refusal.
How to make the request
- Check your workplace rules. Look at the notice process and any applicable award, registered agreement, policy, or contract.
- Apply as early as practical. There is no single notice period established here for every worker; follow the rules that apply to your job.
- Wait for approval before being absent. A request is not the same as approved leave, and the guidance says to request annual leave before going on leave.
The sources cited here do not establish a general legal rule about whether you must explain why you want annual leave. Keep your request straightforward and follow your workplace’s process.

How annual leave differs by employment type
Fair Work Ombudsman guidance says full-time and part-time employees generally receive four weeks of annual leave each year. Some shiftworkers receive five weeks, depending on whether they meet the applicable definition and circumstances. Casual employees do not receive paid annual leave under that general entitlement. Check the rules that apply to your employment if your status or shiftwork arrangements are unclear.

Public-holiday absence is separate from annual leave. Employees generally have a right to be away from work on a public holiday, although an employer may make a reasonable request for them to work. A public holiday that falls during paid annual leave is not counted as annual leave. Whether the date is a public holiday depends on your location and applicable calendar; no state-specific holiday match is established here.
