Yes. A commercial game can ship even when an AI assistant generated some of its code. The deciding issues are not whether a model wrote the first draft, but whether your team reviewed and tested every accepted change, can account for third-party code and assets, has commercial rights under every applicable contract, and has met the distribution platform’s disclosure and content rules.
AI assistance does not transfer responsibility to the model provider, guarantee copyright protection, or make licensing questions disappear. Treat generated code as code your studio is shipping, document the human work that makes the game original, and keep a rights and testing record that you could explain to a platform, customer, contributor, or lawyer.
What “built with AI-generated code” actually covers
In practice, the phrase can describe several different workflows:
- An assistant autocompletes a function while a developer writes and reviews the surrounding system.
- A model produces a complete script, shader, tool, or plugin from a prompt.
- An agent edits multiple files, adds dependencies, and runs commands in the project.
- AI writes build scripts, test code, localization tooling, or editor extensions that never ship to players but still affect the product.
Those cases have different evidence and risk profiles. A small, reviewed autocomplete suggestion is easier to trace than an agent-generated subsystem with unknown dependencies. Build-time code still matters: it can introduce security defects, license obligations, or a reproducibility problem even if players never see the file.

The four gates you must pass before release
1. You can explain and test the code
Microsoft’s guidance is direct: the code an AI agent generates is code you ship, and the developer remains accountable for everything in the application. Read and understand each accepted change. Run the same functional, security, performance, and regression tests you would run on hand-written code. “The AI wrote it” is not a defense for a crash, exploit, data leak, or failed certification test.
Review should include error handling, authentication and authorization, file and network access, memory and thread safety, deterministic behavior, and failure recovery. Generated code often looks plausible while making assumptions about engine versions, coordinate systems, serialization formats, or platform APIs. Have a second person review high-impact systems such as payments, multiplayer authority, save data, mod loading, anti-cheat, and account handling.
2. You can account for provenance and licenses
AI tools may produce code resembling open-source code. Microsoft advises commercial developers to apply the same open-source license checks used for any other third-party code. Generate a dependency inventory for the game, editor tools, build pipeline, and deployment scripts. Record each package’s version, license, required notices, source-availability obligations, and whether its terms permit commercial distribution.

If you cannot establish where a generated snippet came from or what obligations attach to it, replace or rewrite it. Do not assume that a model’s output is automatically public-domain, original, or covered by an indemnity. Similar-looking code is not proof of infringement, but it is a reason to investigate rather than ship blindly.

3. Your contracts permit the use
Engine, assistant, model, asset, contractor, and employment agreements are separate gates. Check the current terms for commercial-use rights, ownership language, confidentiality, data retention, audit rights, indemnity or infringement support, and restrictions on using customer code for training. Terms can differ by plan, region, model, or feature and can change after you begin development.
Unity’s published AI principles state that users own input and output data from Unity AI tools and describe tracking and auditing generated content for intellectual-property and commercial considerations. That statement applies to those Unity tools; it does not establish the terms of another engine, assistant, model provider, or asset service. Keep a copy of the terms in force when you generated material and note which team members accepted them.
4. You meet the platform’s rules
Steam’s generative-AI section is aimed at content delivered to and consumed by players, not at efficiency gains from development tools. AI-generated art, sound, narrative, localization, and other player-facing material fall within the disclosure review. Pre-generated content must be described and is reviewed under the same promise that the product will not contain illegal or infringing content as any other submission.

Live-generated player content has an additional requirement: describe the guardrails that prevent illegal output. A game can therefore use an AI coding assistant without a special Steam disclosure about the coding process, while still needing an accurate Content Survey entry for an AI character system that generates dialogue at runtime. Answer the survey based on what players receive, not on marketing language about your development workflow.

Copyright: what is protected and what is not
The U.S. Copyright Office’s Part 2 report, dated January 29, 2025, states: “The outputs of generative AI can be protected by copyright only where a human author has determined sufficient expressive elements.” The Office reviewed more than 10,000 responsive comments during its AI study. The practical test is the human contribution, not the presence of an AI tool in the production pipeline.
Human contributions that can matter
- Writing original code or rewriting a generated draft in a substantively creative way.
- Determining the expressive elements of a scene, mechanic, dialogue system, or user interface.
- Creatively arranging and coordinating multiple elements into the finished game.
- Meaningfully modifying generated material so the final expression reflects human creative choices.
A prompt by itself is not enough. Nor does selecting the best result from a set of model outputs automatically establish authorship of every underlying element. Keep design documents, source-control history, review notes, sketches, level layouts, dialogue edits, and commit messages that show how people shaped the final work.
Registration requires a clear split
For a U.S. copyright registration, the Copyright Office’s guidance says to identify the human-authored contribution, exclude more-than-de-minimis AI material from the claim, and not name the AI system as an author or co-author. A registration application should describe what people created, selected, arranged, or modified and omit material for which the claimed authorship is solely machine-generated.
This does not mean an AI-assisted game is unprotectable as a whole. Human-authored code, art, music, writing, and the creative arrangement of unprotected or separately owned elements may receive protection even when some individual outputs do not. Have counsel review an important registration or enforcement position, especially when the game’s value is concentrated in generated assets.

Who owns code generated by ChatGPT, Copilot, or another assistant?
There is no universal answer based solely on the product name. Ownership and permitted use depend on the provider’s current terms, the account or plan, the jurisdiction, the input data, and any obligations attached to matching or reused code. A studio may have contractual permission to use an output commercially while still lacking exclusive copyright in that output, or while inheriting an open-source notice requirement.
For an employee or contractor, also check the employment or services agreement. Make sure the studio receives an assignment of rights in human-authored contributions, that confidentiality rules cover prompts and source code, and that contractors disclose any tools or datasets they used. Preserve invoices, account records, accepted terms, and contributor assignments with the project’s rights file.
A release workflow that makes AI assistance defensible
- Inventory the project. List every AI-generated or AI-assisted code file, asset, text, sound, localization file, test, script, and build-time artifact. Mark whether the material is shipped to players, used only internally, or generated at runtime.
- Capture provenance. Record the tool and model name, version, generation date, relevant prompt, output, human edits, reviewer, and commit or asset identifier. You do not need to preserve private prompts that contain confidential information; record enough context to reconstruct the decision and identify the responsible reviewer.
- Review accepted code. Read the complete diff, not just the lines the assistant displayed. Check dependencies, permissions, error paths, performance, platform behavior, and security. Rewrite code whose origin, behavior, or license cannot be established.
- Run normal quality gates. Execute unit and integration tests, platform builds, performance profiling, fuzzing or abuse testing where appropriate, save/load migration tests, and regression testing on every supported device class. Keep logs showing the version tested and the result.
- Audit dependencies. Generate a software bill of materials or equivalent inventory. Verify license compatibility, attribution files, notices, source-offer duties, and restrictions on static or dynamic linking. Resolve findings before the release branch is locked.
- Check contracts. Re-read engine, assistant, model, asset, contractor, and employment terms for commercial use, ownership, confidentiality, retention, audit, indemnity, and export or regional restrictions. Archive the applicable versions.
- Complete platform disclosures. In Steamworks, describe pre-generated player-facing AI content in the Content Survey. For live generation, document the moderation and safety guardrails that block illegal output. Do not claim that a system is human-authored when players receive generated content.
- Assemble the rights file. Keep licenses, permissions, contributor assignments, dependency notices, model and tool terms, review records, and evidence of human creative contributions together with the release build.
- Recheck immediately before launch. Platform and vendor policies are volatile. Confirm the current survey wording, engine terms, model terms, and distribution requirements at submission time, then record the date and person who performed the check.
What to put in the rights and audit file
A useful file lets someone outside the original development conversation answer five questions: what was generated, by which system, under which terms, what did humans change or decide, and what tests and license checks were performed? Organize it by release or build so an update does not erase the history of an earlier version.

- Human-authorship record: design decisions, original writing or code, arrangement, modifications, and registration exclusions.
- Platform record: completed Content Survey, descriptions of AI content, and live-output guardrails.
Common failure modes and how to fix them
“The generated code passed once, so it is done.”
One successful run does not establish compatibility, security, or regression safety. Add tests for malformed input, network failure, corrupted saves, interrupted updates, low-memory devices, and the oldest supported hardware. Require review of generated changes in the same pull-request process as other code.

“The assistant promised commercially safe output.”
A provider’s statement may be limited by plan, jurisdiction, or the provider’s ability to defend a claim. It does not replace dependency scanning, license review, or your own contractual analysis. Escalate an uncertain snippet and replace it when provenance cannot be clarified.
“Steam only cares whether we used AI to code.”
Steam’s stated focus is player-facing generative content. A coding assistant may not trigger that section, but generated dialogue, art, sound, localization, or runtime responses can. Complete the survey based on the shipped experience and disclose live-generation safeguards where required.
“If the model made it, nobody can claim rights.”
Human-authored code and creative arrangement can still be protected, while a purely generated component may receive little or no copyright protection. Separate those contributions in your records and registration strategy instead of treating the game as wholly protected or wholly unprotectable.
How to compare AI coding workflows
If you are choosing between an AI-assisted workflow and conventional development, or between assistants, compare the operational evidence rather than raw generation speed.

Bottom-line decision
You can sell a game whose code was generated or assisted by AI when the studio treats that code as its own engineering responsibility, verifies licenses and contracts, documents human creative contributions, and follows the platform rules for any AI content players receive. The safest release is not the one that uses the least AI; it is the one that can show, file by file and asset by asset, what humans accepted, changed, tested, licensed, and disclosed.
