Yes—you can decline the purchase instead of paying a credit-card surcharge. You may also be able to choose a fee-free payment method for the same transaction. That does not necessarily mean the merchant must complete the sale without the fee. Whether the merchant may impose the charge depends on the purchase location, whether credit-card payment is optional, how the fee was disclosed, and applicable card-network rules.

Federal rules do not create one nationwide answer. The Federal Trade Commission (FTC) says payment-processing fees may be passed through when otherwise permitted by law, while also preserving state laws that prohibit credit-card surcharges. The practical question at the register is therefore two separate questions: Can you refuse? Yes. Is the merchant allowed to charge it? It depends on the jurisdiction and facts.

What “refusing” a surcharge actually means

Refusing a surcharge generally means stopping the transaction or selecting an available payment method that does not carry the fee. It does not establish a general right to force the merchant to sell the item at the same price while accepting your credit card.

You can say that you do not agree to the surcharge, ask whether another payment method is available, and leave if the terms are unacceptable. The FTC’s example treats an alternative as meaningful only when it is available for the transaction being offered. For example, a business cannot necessarily make an online credit-card fee “optional” by telling you to travel to a separate physical location to pay cash.

If a merchant refuses to proceed without the surcharge, the cited federal guidance does not give you a general power to compel a sale on different terms. Your choices are usually to use a genuinely available alternative, decline the purchase, or pursue a complaint if the charge appears unlawful or misleading.

When a credit-card surcharge may be permitted

The FTC’s FAQ on the Rule on Unfair or Deceptive Fees explains that businesses may charge or pass through credit-card or other payment-processing fees if otherwise permitted by law. The federal rule then treats the fee differently depending on whether credit-card payment is optional.

If credit-card payment is optional

When the customer can complete the same offered transaction with a viable fee-free method, the surcharge may be excluded from the advertised total price. Before you consent to pay, however, the business must clearly and conspicuously disclose the fee’s nature, purpose, and amount. A checkout screen, sign, menu, invoice, or verbal statement should make clear that the extra amount is tied to paying by credit card and identify how much it is.

The disclosure must come before agreement to pay. Revealing the fee only after the card is processed, or presenting it in a way an ordinary customer would likely miss, creates a disclosure problem even if a surcharge would otherwise be lawful.

If the merchant requires a credit card

If the business does not offer a viable fee-free payment option for the transaction, the FTC treats the processing fee as mandatory. In that situation, the fee must be included in the total price rather than added unexpectedly after the customer has agreed to the advertised amount. The rule’s payment-processing provisions appear in the FTC final rule published January 10, 2025.

Calling a fee “optional” does not make it optional if every practical way to buy the offered item requires paying it. The relevant comparison is the payment choice for that transaction, not a theoretical alternative that requires changing the product, moving to another sales channel, or making an impractical trip.

Why the purchase location can change the answer

The FTC’s federal framework expressly leaves state surcharge prohibitions in place. State statutes can therefore be stricter than the federal disclosure rule, and a merchant that complies with a card network’s operating rules can still violate state law.

Florida: a prohibition example

Section 501.0117 of the 2025 Florida Statutes says a seller or lessor may not impose a surcharge for choosing to use a credit card when the seller accepts credit-card payment, subject to the statute’s stated exception for approved state or federal tariffs. This is an example of a jurisdiction that takes a prohibitory approach; it is not a nationwide rule.

Kansas: an advance-disclosure example

Kansas takes a different approach in Kansas Statutes § 16a-2-403. Its statute permits a surcharge only when the amount is disclosed clearly and conspicuously in advance at the point of entry or point of sale. The contrast with Florida shows why a state or territory must be identified before anyone can give a reliable location-specific answer.

These examples are not a current fifty-state survey. Rules can change, and statutory language may be affected by regulations or court decisions. For a disputed charge, identify the location where the transaction occurred and check the current statute and the appropriate consumer-protection complaint channel for that jurisdiction.

Card-network rules add requirements but do not legalize a prohibited fee

Network operating rules are a separate layer of analysis. Mastercard’s U.S. merchant guidance says a surcharge must be clearly disclosed at the point of interaction and that the dollar amount must appear on the transaction receipt. The guidance describes a 4% maximum surcharge cap, with additional limits tied to the merchant’s cost of acceptance and the card-product rules. See Mastercard’s U.S. merchant surcharge rules.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The U.S. General Services Administration’s SmartPay Bulletin No. 017 likewise describes a 4% outer ceiling and a limit tied to the merchant’s negotiated acceptance rate. Its guidance is available at GSA SmartPay Bulletin No. 017.

Those percentages are network or program constraints, not a universal authorization. A 2% or 4% fee can still be unlawful where state law prohibits credit-card surcharges, and a fee below 4% can still be deceptive if it was not disclosed before consent. The applicable card network, card product, merchant category, and jurisdiction all matter.

A checkout decision process

  1. Ask whether the fee is avoidable for this transaction. Ask for the exact payment methods accepted for the item, service, or order you are buying. A fee-free method must be genuinely available for the offered transaction—not merely available at a different location or for a different purchase channel.
  2. Ask what the fee covers and how much it is. The merchant should identify that it is a credit-card surcharge or payment-processing fee and state the amount or calculation. Compare the amount shown before payment with the amount on the receipt.
  3. Check when the disclosure occurred. Look for the fee before clicking an order button, signing an invoice, tapping a terminal, or otherwise consenting. A surprise added after authorization is materially different from a clearly displayed charge accepted in advance.
  4. Choose the fee-free method or decline. If an acceptable alternative exists, use it. If not, tell the merchant you do not agree to the surcharge and end the transaction. You are declining the purchase, not compelling a sale on revised terms.
  5. Preserve evidence if the fee appears improper. Keep the receipt, photograph posted notices when lawful, save the online checkout page or confirmation email, and record the merchant’s location, date, amount, and payment method. Evidence of what was disclosed and when is often more useful than a general statement that the fee seemed high.
  6. Check the law for the transaction’s location. Compare the facts with the current state or territorial statute and applicable federal guidance. If the fee appears prohibited or misleading, use the relevant consumer-protection agency or attorney general complaint process and contact the card issuer only for a genuine billing error or unauthorized charge—not simply because you disliked a disclosed fee.

How to evaluate a disputed surcharge

Question Why it matters What to document
Where did the transaction occur? State and territorial laws differ, and the federal rule preserves state prohibitions. Store address, delivery or service location, and the governing sales channel.
Was a viable fee-free method offered? If no practical alternative exists, the fee may be mandatory and belong in the total price. Accepted methods, restrictions, and whether the same item and terms were available.
Was the fee disclosed before consent? Optional surcharges require advance disclosure of nature, purpose, and amount. Sign, menu, web page, checkout screen, invoice, and time of disclosure.
Does the receipt match the disclosure? Network guidance calls for the surcharge amount in dollars on the receipt. Final receipt and the amount shown before authorization.
Is it actually a credit-card surcharge? A convenience, service, delivery, or other fee may follow different rules and must not be mislabeled. Exact wording used by the merchant and the transaction terms.
Does the amount fit network limits? Network rules can impose caps and cost-of-acceptance limits, but do not override state law. Card brand, card type if known, and the surcharge percentage or dollar amount.

Common situations and the likely practical response

The fee appears on an online checkout page

Read the total and payment-method disclosures before submitting the order. If the credit-card fee is clearly identified and a fee-free method is available for the same online order, you can choose that method or abandon checkout. Being told that cash is accepted only at a physical branch does not automatically make the online fee optional.

The cashier mentions the fee only after swiping the card

Ask the cashier to void the transaction before completion and request the fee-free option, if one exists. If the merchant cannot offer one, you can decline to complete the purchase. Save the receipt or terminal screen if the charge posts despite your objection, then investigate the law and complaint process for the transaction’s location.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The posted price excludes a required card fee

If every offered payment path requires the extra amount, the FTC framework treats the fee as mandatory and requires it to be included in the total price. A business should not advertise one mandatory total and reveal another only after the customer has committed.

The surcharge is higher than the stated percentage

Compare the posted calculation, the dollar amount shown before authorization, and the receipt. A mismatch can support a disclosure complaint and may also conflict with network requirements. Do not assume that correcting the arithmetic resolves a state-law prohibition.

What a merchant may do when you refuse

A merchant can generally decline to complete a voluntary sale if you reject its disclosed terms, subject to other laws that may apply to the particular business or transaction. The sources cited here establish your ability to stop the purchase or use a viable alternative; they do not establish a general right to obtain the item at the credit-card price without the surcharge.

The merchant should not misrepresent the fee, conceal it until after consent, or describe a mandatory charge as optional. If the business says the fee is required, ask whether every payment method for the same transaction carries it and whether the advertised total includes it.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Complaint and dispute options

Start with a written request to the merchant for an explanation and correction, attaching the receipt and the original disclosure. If the issue is a suspected state-law violation, file with the consumer-protection office or attorney general responsible for the transaction’s location. The FTC’s materials explain the federal framework, but they do not replace the state-specific analysis.

A card issuer dispute is generally appropriate for an unauthorized transaction, duplicate charge, or other billing error. It is not a guaranteed way to erase a surcharge that was lawfully disclosed and authorized. If the amount is significant or the facts are contested, a licensed attorney in the relevant jurisdiction can assess the current statute and available remedies.

Quick comparison: optional versus mandatory fees

Feature Optional credit-card surcharge Mandatory credit-card payment fee
Fee-free method for the same transaction Available in a meaningful, practical form Not available for the offered transaction
Price treatment under FTC framework May be excluded from the total price if properly disclosed Must be included in the total price
Advance disclosure Nature, purpose, and amount must be clear and conspicuous before consent Unexpected after-the-fact addition is not acceptable; the total must reflect the fee
Customer’s practical choice Use the alternative or decline the purchase Ask for the complete total, use another merchant, or decline
State-law check Still required; a state may prohibit the surcharge Still required; labeling the fee mandatory does not override a prohibition

Bottom line for a checkout dispute

You may refuse to pay a credit-card surcharge by declining the transaction, and you may avoid it with a viable fee-free method for the same purchase. Whether the merchant may impose it is a separate, location-specific question. Verify the timing and clarity of the disclosure, whether credit-card payment is truly optional, the exact amount on the receipt, state or territorial law, and the applicable card-network limits. Federal guidance, including the FTC’s January 10, 2025 rule, does not erase state bans, and a network’s 4% ceiling is not permission to charge a fee where the law forbids it.
