Sometimes, but not automatically. In the United States, a fan film that uses a game’s protected characters, story, dialogue, artwork, music, logos or footage may be an unauthorized derivative work. The copyright owner controls authorization of new versions. A rights-holder license or a fan-content policy that actually covers your project is the clearest route. Fair use can apply in some cases, but being a fan project, adding a disclaimer or making no money does not guarantee that result.
What the law can and cannot answer in general
There is no blanket rule declaring every video game fan film legal or illegal. The answer depends on the particular game, the material your film uses, any permission you obtained, how you distribute or monetize it, the countries involved and the rules of the services where you publish it. A general explanation cannot clear a specific script or release.
This article describes the U.S. copyright framework. It is not a legal opinion about a particular franchise. Trademark, contract, publicity-rights and platform questions can add separate issues that are not resolved by copyright analysis alone.

Why a fan film can be an adaptation
Copyright protects expression, not a game idea
The U.S. Copyright Office distinguishes an abstract game idea or method of play from the expressive material used to present it. Its games guidance says that titles, ideas and methods of play are not protected by copyright as such, while sufficiently original text and graphic art may be protected. That distinction matters in practice. A filmmaker can use a broad premise, such as explorers solving puzzles in a haunted facility, without automatically copying the game’s protected expression. Reusing the game’s named characters, distinctive visual designs, scripted dialogue, plot sequence, written lore, music, artwork or recorded game footage is different: those are specific expressive elements that may belong to the copyright owner.
A new film can still be based on someone else’s work
Chapter 1 of the Copyright Act defines a derivative work as one based on a preexisting work and gives examples including dramatizations and motion-picture versions. The copyright owner’s exclusive rights include preparing or authorizing derivative works. See Chapter 1 of Circular 92.
Therefore, shooting new actors, sets and effects does not by itself remove the underlying rights issue. Your footage and original contributions may be your own, while the incorporated game characters, story, artwork or music remain controlled by another owner. The Copyright Office puts the authorization point plainly: Only the owner of copyright in a work has the right to prepare, or to authorize someone else to create, a new version of that work.

The Copyright Office treats video games, animations and similar productions as examples of motion pictures for registration guidance. You may be able to register copyright in the original parts of your finished audiovisual work, but registration does not grant permission to incorporate another owner’s material. Fair use: the four questions a court would weigh
Fair use is a defense evaluated from the facts, not a fan-film exemption. Section 107 calls for consideration of four factors. The Copyright Office summarizes them in its Fair Use Index and related guidance. No cited guidance supplies a safe percentage, clip length or number of altered details.
1. Purpose and character of the use
Courts consider whether the use is commercial or nonprofit educational, and examine what the project is doing with the source. A critical commentary, parody or other transformative use may have a stronger argument than a straightforward cinematic continuation of the game’s story. Commerciality is relevant, but it is not an automatic loss; conversely, a free or nonprofit film is not automatically fair.
Fundraising, advertising-supported publication, paid festival access, sponsorships, merchandise or platform revenue can make the project more commercial in practical terms. Calling the film a “tribute” or “unofficial” work does not decide this factor.
2. Nature of the copyrighted work
Creative works receive stronger protection in the fair-use analysis than factual works. A story-driven game with original characters, artwork, dialogue and music is highly imaginative. That generally makes this factor more difficult for a conventional narrative fan film than for a film using material from a factual source.

3. Amount and substantiality used
The inquiry looks at both quantity and importance. A short excerpt can still be significant if it contains a central character, recognizable theme, key plot reveal or signature musical passage. Conversely, a larger amount may be viewed differently in a genuinely transformative context. There is no universal rule that using a certain number of seconds, words, images or characters is safe.
4. Effect on the potential market
Consider whether the film substitutes for an authorized adaptation, competes with licensed fan content, affects the value of the game’s characters or music, or interferes with markets the owner reasonably could develop. A freely posted film can still affect a market even when the creator earns nothing. The analysis is project-specific; a disclaimer cannot eliminate market effects.
Permission and fan-content policies
A license is the clearest path
Ask the relevant rights holder for written permission or a license before production or release. The document should identify the exact game and assets, the film format and length, territories, languages, platforms, duration, promotional use, festival submissions, advertising, monetization and whether edits or sequels are allowed. Permission for one asset, such as a logo, does not necessarily clear the characters, script, music or artwork.

Read the actual policy, not a screenshot or forum summary
Some owners publish fan-content policies, but a policy is not universal permission. Check that it applies to the specific game and to your intended use. Look for limits on commercial revenue, crowdfunding, sponsorships, merchandise, story changes, ratings, depiction of the characters, use of game files, attribution and platforms. Confirm whether the policy can be withdrawn and whether it grants a license or merely describes enforcement preferences.

Keep a dated copy of the policy and all written approvals. If the policy is silent on an element you plan to use, treat that element as unresolved rather than assuming consent.
What “share” means for legal risk

The sources do not establish that any one of these choices is categorically safe. Before release, read the current terms of each service and the rights holder’s current policy. A platform accepting an upload is not the same as the owner granting permission.
Audit every element before you film
Make an asset list and classify each item. This prevents a project from clearing its script while overlooking the soundtrack or promotional art.
- Characters: names, appearances, costumes, backstories, catchphrases and signature abilities.
- Story material: missions, scenes, dialogue, lore, fictional locations and distinctive plot turns.
- Visual assets: concept art, models, sprites, user-interface elements, maps, fonts and extracted game footage.
- Audio: original score, songs, sound effects, voice recordings and dialogue samples. Music and recordings may involve separate owners.
- Brand identifiers: game and character names, logos, title treatments and other marks. Copyright analysis does not answer trademark questions.
- Your contributions: new screenplay pages, performances, sets, costumes, effects, edits and original music. Document who created each contribution and under what agreement.
Replacing a logo or changing a costume does not automatically make the remaining character or storyline free to use. Conversely, a film that borrows only a general idea and creates entirely new expression raises a different question from a direct adaptation.

A practical decision process
- Define the release. Write down the game, countries, intended audience, platforms, dates, monetization, festival plans and promotional materials.
- Inventory the source material. Mark every character, line, image, musical passage, sound, logo, game recording and plot element taken from the game.
- Identify rights owners. The developer, publisher, composer, performer, artist or another party may control particular components. Do not assume one company owns everything.
- Search for the current official policy. Save the exact policy and check its scope, conditions, territory, revenue rules and termination language.
- Request written permission where needed. Describe the assets and every intended use. Ask specifically about editing, advertising, festivals, subtitles, sequels and monetization.
- Evaluate fair use only as a fact-specific risk. Analyze purpose, creative nature, amount and market effect together. Record why the project is commentary, parody or otherwise transformative if that is your position.
- Clear independent material. Obtain licenses for music, stock footage, artwork, locations, performers and trademarks that are not covered by the game permission.
- Check release contracts and platform terms. Look for warranties, indemnities, takedown procedures, territory limits and repeat-infringer rules before uploading or entering a festival.
- Get advice for a high-stakes release. Have an intellectual-property attorney review the script, asset list, permission documents and distribution plan when the audience, budget or commercial exposure is significant.
Common assumptions that do not clear a fan film
- “I do not make money, so it is legal.” Noncommercial status is only part of the purpose analysis. The other factors still apply.
- “I gave the owner credit.” Attribution is courteous and may be required by a license, but credit alone is not permission.
- “I added an unofficial-use disclaimer.” A disclaimer does not erase copied expression or prevent market harm.
- “I changed enough details.” There is no fixed number of changes that guarantees fair use. Courts examine what was taken and why.
- “The platform let me upload it.” Automated acceptance or the absence of an immediate claim is not a rights grant.
- “The game idea is not copyrighted, so everything is free.” Ideas and methods of play may be unprotected as such, while the game’s characters, writing, art, music and other expression can remain protected.
Geography, trademarks and changing policies
Copyright exceptions differ by country. A U.S. fair-use analysis does not automatically apply in Canada, the United Kingdom, the European Union or elsewhere. If your film is available internationally, identify the countries that matter and obtain local advice when the risk warrants it.
Names, logos and character identifiers can raise trademark or passing-off concerns even when a copyright argument seems plausible. Platform rules, contracts and publicity rights can impose additional limits. The general U.S. sources cited here do not determine a franchise’s trademark registrations, a service’s current enforcement policy or a particular game’s fan policy.
When professional advice is worthwhile
Consult an attorney experienced in intellectual property before release when you use central characters or storylines, include original game music or extracted footage, plan to monetize, have sponsors or investors, submit to major festivals, distribute in several countries, or receive a rights-holder complaint. Bottom line for a planned fan film
You can make and share a video game fan film legally when your use is licensed, fits a rights holder’s applicable policy, or qualifies as fair use under the facts. None of those conclusions follows merely from calling the project a fan film, keeping it free, adding a disclaimer or posting it online. Separate the game’s unprotected ideas from its protected expression, clear every asset and distribution channel, and obtain project-specific legal advice when the consequences matter.
