Usually, yes—but not simply because the app is called open source. You may independently reimplement the app’s ideas and behavior, or reuse code under the exact license that covers it. Copyright still protects original source code and expressive assets, and every license imposes conditions. A lawful clone requires a component-by-component license review, preservation of notices, compliance with source and copyleft rules, and separate clearance of names, logos, data, fonts, documentation, and other assets.
What “clone” means legally
“Clone” can describe two very different projects. A clean-room implementation reproduces functionality—such as an API, workflow, or algorithmic result—without copying the original source or distinctive expressive material. A fork copies some upstream code and then changes it. The legal analysis is different for each.
The U.S. Copyright Office explains that copyright protection extends to copyrightable expression embodied in a computer program, but not to ideas, program logic, algorithms, systems, methods, concepts, or layouts. Its software FAQ likewise distinguishes protected software expression from unprotected facts, ideas, systems, and methods of operation. That boundary is fact-specific: copying a distinctive interface illustration, text string, icon set, or source-code structure can create risk even when the underlying feature is not protected as an idea.
There is no safe percentage of code to copy from a public repository. A small but highly original portion can matter, while a large amount may be permitted if the applicable license authorizes it and its conditions are met. The relevant questions are what was copied, which rights cover it, and whether every condition is satisfied.

What an open-source license actually gives you
“Open source” is a licensing model, not a waiver of copyright. Open-source licenses generally grant rights to use, modify, and share software, subject to the approved license’s terms. The repository may contain several licenses at once: one for the main program, others for dependencies, generated code, fonts, documentation, data, or bundled media.
Start with the exact license text rather than a project description or a repository badge. Identify the version, read any exceptions, and check whether individual files carry SPDX identifiers or copyright headers. An SPDX identifier communicates the applicable license; it does not replace copyright notices, which should not be removed or altered.
A practical license-reading sequence
- Freeze the source you are evaluating. Save the upstream commit, release archive, and license files used for your build so you can later show precisely what entered your product.
- Map every component. Record the main application, libraries, transitive dependencies, generated code, build tools, assets, fonts, datasets, documentation, and hosted content.
- Read the conditions. Look for attribution language, license-text requirements, patent provisions, linking or plugin clauses, trademark exclusions, copyleft terms, and source-distribution rules.
- Track your changes. Keep a record of files copied unchanged, files modified, and code written independently. This is useful for both compliance and ownership questions.
- Plan distribution before launch. Decide what users receive—a binary, source archive, container image, hosted service, or plug-in—and match each delivery method to the license obligations.
Clean-room rewrite, permissive fork, or GPL/AGPL fork?
These routes differ in how much upstream expression you reuse and in what you must give downstream users.

“Copyleft” is not a ban on commercial use. It is a condition that preserves recipients’ freedoms by requiring covered derivative works to use the same license. GPL, LGPL, MPL, EPL, and AGPL are not interchangeable: they differ in covered-work definitions, linking rules, and source obligations. The exact license text controls.

Permissive licenses: commercial reuse still has conditions
Permissive licenses commonly allow commercial reuse, modification, redistribution, and proprietary additions. They do not normally let you delete the upstream attribution package. For MIT-licensed code, the usual requirement is to retain the copyright and license notice in copies or substantial portions. Verify the exact MIT text in the repository and follow any additional file-level terms.
Apache-2.0 adds more detailed notice practice. Include a copy of the Apache license, retain existing copyright, license, and disclaimer language, and include or make available the applicable NOTICE information when the license requires it. Do not imply that the original authors endorse your product. Apache’s patent provisions and any exclusions or modifications in the project’s files also need review.
A usable attribution package
- A component inventory listing each dependency, version, SPDX identifier, and copyright owner.
- Original copyright and author notices, preserved in source or an appropriate notices file.
- Full license texts, or durable access to them where the license permits that approach.
- Required NOTICE and attribution wording, including Apache-2.0 material.
- Your own copyright notice only for original changes, clearly distinguished from upstream notices.
- Any source-code offer or corresponding-source information required by a copyleft license.
GPL: what distribution requires
GPLv3 defines propagation broadly, including copying, distribution with or without modification, and making software available to the public. Conveying is propagation that enables another party to make or receive copies. Mere network interaction without transferring a copy is not, by itself, conveying.

If you distribute a GPL-based clone as a binary, the GNU GPL rules generally require you to provide the corresponding source in the manner the license permits. “Corresponding source” must match the binary you shipped; publishing only the unmodified upstream repository is not enough when your build contains changes. Keep the complete source, build scripts, interface-definition material required by the license, license text, notices, and a reproducible record of the shipped version.

What to include in a release process
- Tag the exact source revision used to build each binary.
- Archive your modifications, configuration needed to build, scripts, and interface files that the license treats as part of corresponding source.
- Place the GPL text and preserved notices where recipients of the binary can access them.
- Provide the permitted source offer or download method for the same version and for the period required by the license.
- Test that the supplied source actually rebuilds the distributed artifact, rather than merely containing upstream code.
Can you run a GPL or AGPL clone as SaaS?
Hosting software does not automatically eliminate license duties. Ordinary GPL analysis focuses on whether users receive a copy. A customer downloading a binary, container, appliance, or other copy can trigger distribution obligations even if the same program is also available as a service.
AGPL adds a network-service condition. Its purpose is to require an offer of corresponding source to users who receive the program’s functionality over a network in the circumstances described by the license. Therefore, “we only host it” is not a universal exemption. Review whether the deployed component is AGPL, whether users interact with a modified covered work, and how the source offer is presented.
Architecture can change the result. A separately communicating service, a dynamically linked library, a plug-in, and a combined application may be treated differently under the relevant license. Obtain counsel for a commercial deployment, especially where proprietary modules, customer installations, or multiple licenses interact.
Names, logos, screenshots, and data are separate rights
Permission to reuse code does not automatically grant permission to reuse the original app’s name or logo. Trademarks identify source and sponsorship, and a code license typically does not grant a trademark license. Choose a distinct product name unless you have explicit permission.

Clear every non-code item independently:
- Logos, icons, illustrations, screenshots, and other visual artwork.
- Documentation, tutorials, sample text, and website copy.
- Datasets, hosted content, user-contributed material, and factual databases.
- Fonts, audio, video, and stock media bundled with the application.
- Third-party SDKs, generated files, and dependency assets with their own terms.
A clean-room rewrite can still infringe if it copies distinctive text, artwork, screenshots, or data. Conversely, changing the name and logo does not cure unauthorized source-code copying. Treat software copyright, trademarks, and asset licenses as separate clearance workstreams.
How much code can you copy from a repository?
No fixed line count, percentage, or file-size threshold answers this question. If the repository license permits copying, you may copy within its conditions; if no license is present, public availability normally means you can view the code, not that you can redistribute or adapt it. A missing license should be treated as a permission gap, not as an invitation to copy.
For a licensed repository, check whether the particular file is covered by the headline license. Mixed-license repositories are common. A vendored dependency, generated output, example directory, or embedded font may have a different license. Copying a complete module under a permissive license can be lawful with notices, while copying a few distinctive lines from an unlicensed file can create a problem.

- Preserve provenance: save the upstream commit, release date, license files, and file-level headers.
- Build the inventory: list components, versions, SPDX identifiers, copyright owners, and whether each item is copied, modified, generated, or independently written.
- Separate rights: analyze code copyright, patents, trademarks, documentation, data, fonts, and media independently.
- Implement notices: keep original notices, add your own notice only for your contributions, and prepare LICENSE and NOTICE materials in a user-accessible location.
- Handle copyleft: for GPL-family binaries, prepare the exact corresponding source and any permitted written offer; for AGPL services, implement the network source offer required by the deployed version.
- Check integration: review linking, plug-in, dynamic-loading, and service boundaries against each license instead of assuming components are separate works.
- Audit the release: confirm that the source, notices, and binary correspond to the same version and that your documentation does not imply endorsement.
- Get legal review: ask software-copyright counsel about unresolved ownership, patent, trademark, compatibility, or jurisdiction questions before a material commercial launch.
Common mistakes and how to correct them
“It is on a public repository, so it is free to copy.”
Public access is not a license. Locate the exact license for each file. If none exists, obtain permission or rewrite the affected code independently.

A badge alone may omit copyright notices, full license text, NOTICE material, disclaimers, or source information. Deliver the complete package required by the applicable terms.
“We published the upstream source, so GPL compliance is done.”
The source must correspond to your distributed binary. Archive and offer your modifications, build material, and interface definitions required by the GPL.
“SaaS means no copyleft obligations.”
Check whether users receive copies and whether AGPL’s network clause applies. Hosting, distribution, and linking questions require an architecture-specific review.
“Renaming the app solves the legal issue.”
A new name can reduce trademark confusion, but it does not authorize copied code, artwork, documentation, or data. Clear each right separately.
When professional advice is warranted
License compliance is often manageable for a small, clearly licensed dependency set, but material launches deserve counsel when ownership is disputed, licenses are mixed or incompatible, patents matter, a GPL or AGPL component is central to a proprietary product, customers receive installed copies, or the service combines plug-ins and dynamically linked modules. The legal result depends on jurisdiction and facts; no general checklist can guarantee that a particular clone is lawful.
