Maybe—but a brewery’s closure does not automatically create a right to a cash refund. Your options depend on what you prepaid, the contract, state law, whether the business is temporarily closed or in bankruptcy, and how you paid. A credit-card dispute can be available for goods or services that were not delivered as agreed, but federal law imposes a strict written-notice deadline.
Start by identifying what you paid for
“I have money tied up at a closed brewery” can describe several legally different situations. Separate the transaction before deciding what to do:

Also note the transaction’s location and payment method. State contract and consumer-protection rules vary. Credit cards, debit cards, cash, checks, and bank transfers do not have identical dispute procedures.

Federal gift-card rules regulate expiration and certain fees; they do not make a closed brewery solvent. Under 15 U.S.C. §1693l-1, a retail gift card generally cannot expire earlier than five years after issuance or the last load. Dormancy or inactivity fees are restricted: the card must have been inactive for the required period, the fee must be clearly disclosed, and timing limits apply. The Federal Trade Commission describes these protections for retail and bank gift cards.

A card can therefore remain legally unexpired while being practically unusable because the issuer has stopped operating. The federal five-year rule is not a promise that you can exchange the balance for cash when a brewery closes. Whether a cash refund is available may depend on the card terms, state law, a successor’s decision, or a bankruptcy distribution.
What to do with an unused card
- Preserve proof. Photograph both sides of the card, record the number and balance, and save the receipt, activation email, and purchase date.
- Check for a successor. Look for a public closure notice, sale announcement, or contact information for a purchaser. Do not assume another brewery must accept the card unless it expressly agrees.
- Determine whether a bankruptcy case exists. If a case has been filed, find the court docket and the deadline for filing a proof of claim. A gift-card holder is commonly treated as an unsecured creditor.
- Ask the card issuer about the original purchase. If you bought the card by credit card and the brewery never delivered the promised ability to use it, ask whether the transaction can be disputed. The issuer will apply its procedures and may request documentation.
- File a consumer complaint when appropriate. A state attorney general or consumer-protection office can record the conduct and publish case-specific instructions, but it cannot promise that money will be recovered.
During the 2025 Iron Hill closure, Pennsylvania’s attorney general advised customers to dispute unused gift-card purchases with their card companies and submit a consumer-protection complaint. Reporting about that closure also described gift-card holders as unsecured creditors in bankruptcy. That example illustrates the difference between preserving a claim and receiving payment: unsecured creditors are paid only if assets remain after higher-priority claims.
Memberships and prepaid beer clubs
A beer-club or mug-club payment is usually a contract for future performance rather than a simple stored-value card. Benefits can include recurring beer allocations, discounts, event access, merchandise, or use of a membership mug. Read the agreement for the term, renewal date, cancellation method, substitution rights, and refund language.

If benefits stop before the term ends
- Make a list of what you paid for and what was actually delivered, including missed shipments, canceled events, or unused discounts.
- Send a dated written cancellation and refund request to every available business contact. State the unused period or undelivered benefits and attach the agreement and payment record.
- Request a calculation of any unused portion rather than asserting that a full refund is automatic. The contract and applicable state law control the amount.
- Keep delivery records, emails, screenshots, and proof that your request was received.
For a credit-card-funded membership, federal billing-error rules cover a charge for services not delivered as agreed. A nationwide rule guaranteeing a full prorated membership refund has not been established. The practical remedy may be a negotiated cancellation, a partial refund, a card dispute, or a bankruptcy claim.
Recurring charges and renewals
If the brewery continued billing after it stopped providing membership benefits, identify each charge separately. A dispute is stronger when you can show the date services stopped, the renewal or billing date, and your written attempt to cancel. Do not describe a delivered benefit as undelivered merely because the business later closed.
Deposits and advance orders
Deposits for private events, catering, special-release beer, kegs, tours, or merchandise are advance payments for a defined performance. If the brewery closes before delivering the order or holding the event, request the deposit back in writing and document the nonperformance.

Build a complete demand
- Identify the customer and transaction date.
- State the exact amount paid and the promised product, service, or event date.
- Attach the invoice, contract, receipt, and closure or cancellation notice.
- Explain that the promised performance did not occur and request payment by a stated date.
- Ask whether a successor, landlord, or trustee will honor the order or process refunds.
North Carolina’s Department of Justice warns that business closures can leave customers with lost deposits and unfilled orders. Its consumer guidance recommends paying the smallest practical deposit and contacting the card issuer promptly about a chargeback when a business closes. That advice does not guarantee a successful dispute, but delay can make evidence and deadlines harder to manage.

If an order was partly fulfilled, separate the delivered portion from the undelivered portion. A card issuer or court will generally need a precise explanation of what was missing rather than a claim for the entire invoice.
Credit-card disputes: the 60-day federal notice window
The Fair Credit Billing Act covers a credit-card charge for goods or services that were not delivered as agreed. The Federal Trade Commission says your written billing-error notice should reach the card issuer within 60 days after the first statement containing the disputed charge.

What to send
- Use the billing-dispute address shown on the statement, which may differ from the payment address.
- Include your name, account information, transaction date, and exact amount.
- Describe the promised goods or services and what was not delivered.
- Attach copies—not irreplaceable originals—of the receipt, contract, closure notice, correspondence, and photographs.
- Send the notice in a trackable manner and keep a complete copy and delivery proof.
The issuer must process the notice under its billing-error procedures. A chargeback is a payment remedy, not a guaranteed refund. The merchant can contest it, and the issuer may conclude that the evidence does not establish non-delivery or that the dispute was late.
CFPB Regulation Z’s official interpretation includes a charge for property or services not accepted or not delivered as agreed within the billing-error category. It also explains that when the merchant is in bankruptcy, a consumer may assert the claim directly with the card issuer and does not necessarily have to file a bankruptcy claim for that card dispute. This does not eliminate the issuer’s documentation and timing requirements.
Other payment methods
Debit-card, cash, check, and bank-transfer protections differ. Some networks have voluntary dispute programs and short deadlines; others provide little practical recovery once funds have settled. Contact the payment provider immediately, ask for its written deadline, and do not assume the credit-card 60-day rule applies.

What bankruptcy changes
A bankruptcy filing moves collection into a court-supervised process. The filing date matters: a temporary closure, a sale, and a formal bankruptcy are not the same event. Check the federal bankruptcy court docket or an official notice for the case number, trustee, claims agent, and proof-of-claim deadline.
Gift cards and ordinary claims
Gift-card balances are often unsecured claims. An unsecured creditor generally shares in whatever remains after secured and higher-priority claims, so recovery may be small or zero. File a proof of claim if the case instructions require it, even if you are also pursuing a separate payment dispute; follow the issuer and court instructions to avoid inconsistent statements.
Priority for qualifying consumer deposits
11 U.S.C. §507(a)(7) can give limited priority to certain consumer deposits for undelivered goods or services. The California attorney general describes a $3,025 priority cap and cautions that priority does not guarantee repayment when a business closes permanently. The cap and eligibility depend on the statutory category and applicable law; a gift card or membership does not automatically qualify.
Keep the bankruptcy claim distinct from a card dispute. A proof of claim seeks payment from the bankruptcy estate. A card dispute asks the issuer to address a billing error under credit-card rules.
A consumer-protection complaint
A state attorney general or consumer-protection office may accept complaints, investigate patterns, or publish instructions for a particular closure. It cannot order a solvent refund in every case and cannot guarantee a distribution from a bankruptcy estate. The California attorney general summarized the principle this way: “Bankruptcy does not grant debtor companies blanket freedom from their commitments and obligations to their customers and creditors.”
Choose the route that matches your situation

Practical checklist before a deadline passes
- Identify whether the payment was for a gift card, membership, deposit, or an order that was partly delivered.
- Write down the transaction state, payment method, date, amount, and promised performance.
- Save receipts, card numbers, membership terms, invoices, emails, closure notices, and proof of non-delivery in more than one location.
- Ask the brewery, successor, landlord, or trustee in writing about redemption, transfer, or refunds.
- If a credit card was used, send the written billing-error notice within the 60-day period and retain delivery proof.
- Search the bankruptcy docket if a filing is announced, then calendar the proof-of-claim deadline.
- Submit a state consumer complaint when the business will not respond, while recognizing that the office cannot guarantee recovery.
- Do not assume another brewery must honor the closed brewery’s cards, rewards, or membership without an express agreement.
Common mistakes that weaken a claim
- Waiting for a reopening. A temporary closure can become a permanent one while dispute and bankruptcy deadlines run.
- Relying on a phone call. Written requests create a record of the promised service, nonperformance, and date of cancellation.
- Demanding the wrong amount. Separate delivered goods and used benefits from the undelivered balance.
- Treating the five-year gift-card rule as a refund guarantee. It regulates expiration and fees; it does not make a closed business able to redeem cards.
- Using the wrong payment deadline. Credit-card rules are not automatically available for debit cards, cash, checks, or transfers.
- Assuming a complaint equals payment. Government complaints can help document conduct but do not replace a card dispute or bankruptcy claim.
What recovery is realistic?
There is no authoritative national percentage showing how much consumers recover from brewery gift cards or deposits after closure. Your best chance usually comes from acting quickly, proving non-delivery, using the payment method’s available process, and filing any required bankruptcy claim. A successful chargeback, negotiated refund, successor redemption, or estate distribution are separate possibilities—not interchangeable guarantees.
