In the United States, an asset created entirely by an AI system is not protected as human authorship. Copyright may protect the human-authored expression that remains visible in an AI-assisted asset, including original redraws, compositing, animation, writing, arrangement, selection, or other creative modifications. A prompt by itself normally does not provide enough control over the expressive details. Treat the machine-generated layer and the human-created layer as separate rights questions, document both, and handle platform disclosure and tool licensing as separate obligations.
What the current U.S. rule means for a game developer
The U.S. Copyright Office’s Part 2 report, released January 29, 2025, states that generative-AI output can receive copyright protection only where a human author determined sufficient expressive elements. The Office gives three relevant pathways: human-authored material is perceptible in the output, a person made a creative arrangement of otherwise unprotectable material, or a person made creative modifications that remain visible in the final work.
That is an asset-specific analysis. A game may contain a generated background that has no protectable human authorship, a hand-redrawn character layered over it, an original animation, and a human-written dialogue track. Those components do not all receive the same treatment. Copyright protects only the human-authored expression that meets the usual originality requirements; it does not convert every machine-generated pixel, note, sentence, or polygon into property simply because the asset appears in a commercial game.
The Copyright Office’s registration guidance, published March 16, 2023, requires applicants to disclose AI-generated material that is more than de minimis and briefly explain the human author’s contribution. Material whose traditional elements of authorship were produced by a machine is not registered as human authorship. The Office’s AI initiative page confirms that this guidance applies to works containing AI-generated material and that Part 2 addresses copyrightability.

Separate four questions that are often confused
Is there human authorship?
Ask who determined the expressive details that players can perceive. If the system selected the composition, colors, contours, wording, timing, or sound without meaningful human control, that layer is a weak copyright candidate. If a developer made original expressive decisions that remain in the shipped asset, those decisions may be protectable.
Can the work be registered?
Registration is a formal claim about a copyrightable work; it is not a license from an AI provider and does not make unprotectable machine output protectable. For a work containing more-than-de-minimis AI material, disclose the AI material and describe the human-authored portions. Claim only the human expression and avoid implying ownership of the disclaimed machine-generated material.
Does the tool contract permit your use?
A copyright analysis does not answer whether the service’s terms allow commercial use, sublicensing, attribution-free distribution, or use in a particular territory. Read the current terms for the exact tool, model, plan, and date on which each asset was made.

Ownership and infringement are different. A developer may lack copyright in an output and still face a claim if the output is substantially similar to protected material, uses a person’s voice or likeness without authorization, or violates another right. The cited Copyright Office materials do not resolve training-data litigation, output-similarity disputes, or contractual restrictions. Escalate commercially important releases to qualified counsel.
How the rule applies to common game assets
| Asset type | Machine-generated layer | Human contribution that may be protectable | Practical treatment |
|---|---|---|---|
| Concept art, key art, and backgrounds | A one-shot image whose composition, rendering, and details were selected by the model | Original paintover, redraw, silhouette and pose design, lighting decisions, compositing, and a human-created final arrangement that remains visible | Separate the generated base from the human-authored layers; claim only the latter |
| Sprites, icons, and UI graphics | Generated pixels or variations chosen with little expressive editing | Hand-drawn contours, pixel placement, typography, color relationships, and an original interface arrangement | Keep editable source files showing which pixels and layout decisions were made by people |
| Textures and materials | Generated patterns, surfaces, or seamless tiles | Human-painted elements, original masking and blending, and a creative material library or arrangement | Document the source texture and every substantial human modification |
| 3-D models and animation | Generated mesh, rig, pose, or motion data | Topology decisions, sculpting, retopology, rigging, keyframes, timing, camera work, and original animation edits | Preserve mesh versions, animation timelines, and the final compositing record |
| Music and sound effects | Generated stems, melodies, voices, or effects | Human-written lyrics or melody, arrangement, editing, performance direction, recording, and selection of takes | Identify human-written and generated stems separately in the project session |
| Dialogue and localization | Generated scripts, translations, or synthetic speech | Human-authored wording, character selection, editing, direction, timing, and original localization choices | Retain drafts, approvals, voice-performer agreements, and edited scripts |
| Code and procedural content | Generated code fragments, rules, maps, or level elements | Original source code, architecture, game rules, level structure, curation, and a creative compilation | Review generated code and content; do not assume a prompt creates ownership |
The Copyright Office has not published a game-asset checklist. The table applies its human-authorship, arrangement, and modification principles to common production tasks, so the result can depend on the exact files and workflow.

Why a prompt usually does not give you copyright ownership
Typing a detailed prompt can influence a system, but current U.S. guidance distinguishes influence from authorship of expressive elements. A prompt generally describes an intended result without controlling the final placement of every line, texture, word, note, or animation frame. The Office therefore says that merely providing prompts does not supply the required control over expressive elements.
Prompting can still be part of a larger human-authored process. Suppose a designer generates ten silhouettes, chooses one, redraws its anatomy, creates a new costume, paints the lighting, and animates the result. The selection, redraw, costume, lighting, and animation may be protectable where they are original and perceptible. The initial generated silhouette remains a separate, potentially unprotectable layer. Keep the prompt history because it explains provenance, but do not present the prompt alone as the source of copyright.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsA registration-ready workflow for an AI-assisted game
- Create an asset register. Assign every asset an ID and record the creator, creation date, tool and model name, model version, account or plan, prompts, major iterations, input references, approvals, and the final-file hash. Record whether the asset was generated, selected, arranged, redrawn, edited, written, performed, or otherwise authored by a person.
- Preserve the working material. Keep source images, layered files, masks, sketches, reference boards, animation timelines, DAW sessions, code history, procedural seeds, and compositing records. Export the final asset without deleting the editable project that shows human decisions.
- Mark the layers. In the register and project files, identify the generated portions, human-created portions, and mixed areas. For a sprite, that might mean generated color texture, hand-drawn outline, and human-composed UI placement. For music, identify generated stems, human lyrics, arrangement, edits, and recorded performance.
- Check the service terms before shipping. Confirm commercial-use rights, ownership language, attribution duties, restrictions on inputs, output warranties, retention, and changes to the terms. A provider’s contract can limit what you may do even when the Copyright Office’s human-authorship test is satisfied.
- Review third-party material. Examine reference images, voices, likenesses, trademarks, stock elements, and generated outputs for permission and similarity issues. Keep approval records for commissioned artists, writers, performers, and licensors.
- Prepare the application description. For a U.S. registration covering a work with more-than-de-minimis AI material, disclose that material and explain the human contribution. Claim the human-authored expression, such as the original redraw, arrangement, writing, or animation, and exclude machine-generated portions that are not human authorship.
- Maintain the evidence file after release. Retain the register, source files, hashes, contributor agreements, tool terms in effect at creation, approvals, and the final submitted version. A clear chain of evidence is useful if ownership, authorship, or a platform disclosure is later questioned.
What counts as a meaningful human contribution?
Redrawing and paintover
Replacing generated contours, anatomy, facial features, costume details, or lighting with original work can add human-authored expression. The more extensive and visible the changes, the easier it is to identify what the person contributed. A minor color correction or automated upscale may be too small, by itself, to establish substantial authorship.
Selection and arrangement
Choosing and arranging unprotectable elements can be protectable when the selection or arrangement is creative. A level designer who curates hundreds of generated props into an original scene, controls pacing, and creates a distinctive composition may claim the human arrangement, not every individual generated prop. Keep the rejected variations and layout files to show how the final arrangement was made.
Writing, editing, and direction
A human-written quest, lyric, character description, or localization can be protected even if a system supplied an outline or draft, subject to the usual originality analysis. Human editing must contribute expression, not merely proofreading. Direction of a synthetic voice or generated performance may support protection in the human-authored arrangement and editing, while the machine-generated vocal timbre itself may not be human authorship.

Code and procedural systems
Original code, game rules, level architecture, and a curated compilation can contain human authorship. Generated fragments should be reviewed for license and security problems, and generated level elements should not be treated as automatically owned because a developer supplied a prompt. The cited Office materials do not decide every software or procedural-generation fact pattern, so document the developer’s architecture and edits and obtain advice for high-value code.
Steam disclosure: what changes for an AI game
Steamworks requires a Content Survey before a store page and build enter review. Its generative-AI section covers player-consumed artwork, sound, narrative, localization, and other content created with AI during development or generated while the game runs.
| Steam category | What it means | Developer obligation |
|---|---|---|
| Pre-generated content | AI-created material is made during development and shipped with the game | Complete the survey and ensure the game contains no illegal or infringing content and matches its marketing materials under the Steam Distribution Agreement |
| Live-generated content | AI creates material during play or in response to player input | Meet the same legal and marketing obligations and describe safeguards intended to prevent illegal output |
Valve says AI output is reviewed under the same general standard as non-AI content. Survey disclosure is a platform-compliance step, not a copyright grant: completing it does not make infringing or illegal material acceptable. Keep a Steam disclosure record separate from the copyright evidence file, including the date, answers, content categories, moderation controls, filters, reporting tools, and any changes made before review.
Choosing a production pipeline
| Pipeline | Human expressive control | Registration treatment | Evidence burden | Main risk to manage |
|---|---|---|---|---|
| Fully human | People determine the expressive elements | Standard copyright analysis; disclose only material that was actually AI-generated | Contributor and source-file records | Ordinary ownership, permissions, and infringement issues |
| AI-assisted | People determine visible edits, arrangement, writing, or performance while using AI for drafts or components | Disclose more-than-de-minimis AI material and describe the human contribution; claim only human expression | Asset-level layer history, prompts, versions, and human edits | Unclear boundaries between generated and authored material |
| Mostly AI-generated | The system determines most expressive details | Machine-generated portions are generally not human authorship; any small human additions must be identified separately | Tool, model, prompt, output, and selection logs | Weak copyright position plus tool-term, similarity, and platform-compliance exposure |
Use five questions when approving a pipeline: Who determined the final expressive elements? Can a reviewer identify the human-authored parts in the shipped file? What must be disclosed or disclaimed in a registration? Is the content pre-generated or live-generated for the platform? Can the team reproduce the asset history and identify every contributor and tool version?
Common mistakes and how to correct them
Claiming the entire output
Mistake: A copyright notice or registration claim says the developer owns every pixel, note, or sentence in an AI output. Correction: Separate the generated layer, identify human-authored expression, and limit the claim to that expression.

Keeping only the final export
Mistake: The team cannot show which edits were made by people. Correction: Preserve layered sources, timelines, rejected iterations, prompts, and hashes in an asset register.
Assuming a commercial plan solves every issue
Mistake: A paid tool subscription is treated as a warranty of copyright ownership, non-infringement, or unrestricted distribution. Correction: Read the current contract and perform an independent similarity, likeness, trademark, and input-rights review.
Disclosing to Steam but not to the Copyright Office
Mistake: A platform survey is treated as a substitute for registration disclosure. Correction: Maintain separate records: the Copyright Office application explains AI material and human contribution; the Steam Content Survey describes player-consumed AI content and, for live generation, safeguards.
Ignoring commissioned contributors
Mistake: Human-authored edits are made by contractors or voice performers without a written rights arrangement. Correction: Obtain assignments or licenses covering the relevant human-authored portions and retain signed approvals.

Practical examples
Generated sprite with a complete redraw
A designer generates a creature sprite, redraws the silhouette and anatomy pixel by pixel, creates a new palette, adds original clothing, and animates eight attack frames. The generated base is not automatically protected as human authorship. The redraw, palette decisions, costume, and human-created animation may be protectable if they remain in the shipped sprite and meet originality requirements. Register and describe those human portions rather than claiming the raw output.

Generated concept art used as a mood board
A studio generates several images only to communicate a mood to an artist. The artist independently designs the final character and paints the production asset. The final human-created design can be treated under ordinary copyright rules; retain the mood-board files to document provenance and avoid implying that the generated references are part of the claim.
AI-drafted dialogue edited by a writer
A system proposes dialogue, and a writer rewrites the scenes, creates jokes, chooses character voice, changes the order, and approves the final lines. The writer’s original wording and arrangement may be protectable. The application should disclose the AI material when it is more than de minimis and explain the writer’s contribution.
Live-generated player quests
A game creates quests during play from player prompts. The studio must disclose live-generated content in Steamworks, describe safeguards against illegal output, and monitor moderation. Copyright ownership of each generated quest remains a separate, fact-specific question; do not promise players or partners that every machine-generated result is owned by the studio.
Geographic limits and when to obtain legal advice
This guidance is U.S.-focused because the primary authorities are the U.S. Copyright Office and related U.S. platform documentation. Other countries may apply different tests to AI-assisted works, and a U.S. registration does not settle rights worldwide. If the game will launch internationally, obtain country-specific advice on authorship, moral rights, database rights, performer rights, and employment or contractor ownership.
Seek specialist review when an asset is central to the game’s value, a recognizable person or voice is involved, a model’s terms are unclear, a partner demands exclusive ownership, a generated output resembles a known work, or live generation can produce user-visible material without pre-publication review. The Office’s materials do not settle training-data litigation, output similarity, contract interpretation, or future legislation.
Developer checklist before release
- Each asset has an ID, creator, date, tool and model version, prompt history, final hash, and approval record.
- Generated, selected, arranged, redrawn, written, performed, and edited portions are identified separately.
- Source layers, animation timelines, code history, session files, and rejected iterations are retained.
- Tool terms and commercial-use conditions were checked for the specific model, plan, and creation date.
- Inputs, references, voices, likenesses, trademarks, and output similarity were reviewed.
- Contributor assignments or licenses cover human-authored portions.
- U.S. registration materials disclose more-than-de-minimis AI content and explain the human contribution.
- The Steam Content Survey is complete, with live-generation safeguards described where applicable.
- Marketing does not claim exclusive ownership of machine-generated portions that are not human authorship.
Bottom line for developers
Do not treat an AI prompt as a copyright transfer or an AI output as automatically owned. Build an asset-level record that shows what the system produced and what people actually expressed, then claim and register only the human-authored layer. Check the AI service contract, investigate independent infringement risks, and complete Steam’s required disclosure separately. That approach gives you the strongest defensible rights in the work you created while avoiding overclaims about material that current U.S. guidance treats as machine-generated.
