Sometimes, but U.S. manufacture alone does not decide whether a server may be sold or shipped to China. The answer depends on whether the item is subject to the Export Administration Regulations (EAR), its exact classification and configuration, the destination and transaction route, the parties involved, the intended or known end use, and whether a license or other authorization is required. Because no server model, buyer, or end use is specified here, this article cannot determine whether a particular transaction is permitted.
What “sold to China” means for export controls
A purchase order is not the same thing as export authorization. The relevant control analysis may concern an export from the United States, a reexport from another country, a transfer within a country after import, or access and activities covered by specific controls. A sale to a domestic intermediary, a direct shipment to China, and a later transfer or remote use can therefore present different facts.
Do not treat a server’s U.S. origin, a customer’s assurance, or a commercial description as a decision on jurisdiction, classification, or licensing. The controlling question is whether the item and transaction meet current EAR requirements.
What determines whether authorization is needed?
| Factor | What to establish | Why it matters |
|---|---|---|
| Item and configuration | Exact make and model; processors and accelerators; memory and interconnect; firmware and software; and relevant incorporated components. | Classification and controlled performance parameters can depend on the particular configuration, not just the product family or the word “server.” |
| Jurisdiction and ECCN | Whether the item is subject to the EAR and, if so, its Export Control Classification Number (ECCN), with supporting classification information. | The applicable ECCN and current Commerce Control List (CCL) entry inform the control reasons and license analysis. |
| Route and destination | Ship-from point, immediate destination, onward-transfer route, and any later reexport or in-country transfer. | Destination controls and authorization conditions can differ by route and destination. |
| Parties | Consignee, ultimate end user, other transaction parties, relevant ownership or headquarters facts, and restricted-party screening results. | End-user and restricted-party controls can apply in addition to item-based controls. |
| End use and knowledge | Stated and reasonably understood use, including relevant AI-training, supercomputer, semiconductor, military-intelligence, or WMD-related activity. | Part 744 controls may impose requirements for specified items and end uses or users when the exporter has the required knowledge. |
| Authorization | Whether a license is required, whether a specific exception is available, and whether all of its conditions are met. | An exception is not a general authorization to send otherwise controlled servers to China. |
How to assess a proposed transaction
-
Document the item and the deal
Gather the exact server model and installed configuration, including processors, accelerators, memory, interconnects, firmware, software, and quantities. Record the ship-from location, destination, consignee, ultimate end user, onward-transfer plans, and stated and reasonably understood end use. Do not assume facts that have not been confirmed.

Determine EAR jurisdiction and classification
Establish whether the server is subject to the EAR and determine its ECCN if applicable. Obtain the manufacturer’s classification support and compare the actual configuration with the current CCL entry. A product label or informal supplier description is not, by itself, a final classification determination. If the classification remains uncertain, consider requesting a BIS commodity classification.
-
Apply the current item and destination controls
Review the applicable ECCN, reasons for control, destination requirements, and special controls against the current EAR. Check whether the server or incorporated components meet controlled advanced-computing parameters. BIS has identified servers classified as ECCN 5A992.z as an example of commodities that may be relevant to advanced-computing controls. A 5A992 classification therefore does not, by itself, establish that a China-bound transaction can proceed.

Screen every relevant party and investigate end use
Identify and screen the transaction parties under applicable restricted-party and end-user controls. Evaluate the actual use, including any potential supercomputer, semiconductor, military-intelligence, or WMD-related activity. EAR §744.23 contains additional controls for specified items when the exporter has the requisite knowledge of covered destinations, end uses, or end users.

BIS’s May 13, 2025 statement says that access to advanced-computing integrated circuits and commodities subject to the EAR for AI-model training may enable military-intelligence and WMD end uses in Country Group D:5 countries, including China, or Macau. BIS guidance also describes potential Part 744 authorization triggers for certain AI-training activities. Assess the specific activity and applicable rule; do not infer that every AI-training use is prohibited or that none triggers controls.
-
Decide whether a license or other authorization is required
If the applicable controls require a license, do not ship or otherwise proceed with the controlled activity until the required authorization is in place. If considering a license exception, verify that the precise exception covers the item and transaction and that every requirement—including any destination, consignee, notification, or other condition—is satisfied. Part 740 contains advanced-computing exception conditions and exclusions relevant to China/D:5 destinations or entities; the exception name alone does not establish eligibility.

What BIS guidance does—and does not—establish
BIS’s references to 5A992.z and AI-training-related controls make clear that a familiar classification or ordinary server description is not enough to close the inquiry. They do not determine the outcome for every server bearing that ECCN, every AI-training use, or every China-bound sale. The specific configuration, applicable current regulation, parties, route, and end use still have to be assessed.
The available facts here do not identify a server model or configuration, ECCN, buyer, ownership or headquarters details, shipment route, end user, end use, or existing authorization. Consequently, they cannot establish whether any particular transaction is allowed, requires a license, or qualifies for an exception. Rules can change; verify the current EAR and transaction facts before shipment.
