Yes. In the United States, keeping cryptocurrency in a self-custody wallet does not make it immune from government seizure. The 2025 U.S. Department of Justice (DOJ) Asset Forfeiture Policy Manual says an agency should obtain a seizure warrant for cryptocurrency possessed and controlled by an owner in a domestic self-custodial wallet, unless a search warrant or the owner’s consent already authorizes the seizure. A seizure is a taking or restraint of control, not a final forfeiture decision. The exact result depends on the warrant, applicable statute, court orders, jurisdiction and facts of the case.

What “self-custody” changes—and what it does not

A self-custody wallet is software, hardware or another method that lets you control the private keys used to authorize blockchain transactions. The cryptocurrency remains recorded on the relevant blockchain; the wallet manages the key material that enables transfers. Private keys may be stored on a computer, smartphone, hardware wallet, USB drive or paper backup.

That arrangement changes who can technically move the assets. An exchange or other service provider may be able to freeze an account directly, while a self-custody seizure generally requires investigators to locate or obtain access to the key and then transfer the assets. It does not, however, create a legal shield. DOJ policy expressly contemplates warrant-backed seizures from wallets possessed and controlled by an owner.

When federal agents may seize a self-custodied wallet’s cryptocurrency

A seizure warrant

For cryptocurrency in a domestic self-custodial wallet, the DOJ manual says the seizing agency should obtain a seizure warrant and serve it on the owner or the owner’s counsel. The warrant supplies judicial authorization to take control of specified property under the stated legal basis. The manual is DOJ policy guidance; the authority in an individual case comes from the governing statute, the court’s order and constitutional requirements.

A search warrant that authorizes seizure

The manual recognizes that a Federal Rule of Criminal Procedure 41 search-and-seizure warrant for a premises or electronic device may authorize seizure of cryptocurrency when the wallet and key material are located there. Whether agents may take particular assets depends on the warrant’s language, scope and legal basis. A search warrant for a device is not automatically permission to take every asset associated with every wallet discovered on it.

Owner consent

Consent can provide another authorization route. Consent must be evaluated in context, including what was agreed to and whether the person had authority over the property. If agents rely on consent, the facts and any written or recorded terms matter.

How the practical seizure works

  1. Investigators identify the property and legal theory. The government may allege that the cryptocurrency is proceeds of a crime, property involved in an offense, or property used to facilitate an offense. The theory affects the required proof and the process that follows.
  2. A court-authorized process is obtained, when required. For a domestic self-custodial wallet, DOJ policy generally calls for a seizure warrant unless a qualifying search warrant or consent already authorizes the taking.
  3. Agents locate key material. The key may be on a computer or phone, inside a hardware wallet or USB device, or on paper. A seed phrase or private-key copy in another location can also matter because it may permit another person to transfer the assets.
  4. The authorized agency accesses the wallet. Once access is lawfully obtained, agents can use the key to initiate a blockchain transfer. The transfer is the technical act that moves control; the private key itself is not the cryptocurrency.
  5. The assets are moved to government-controlled custody. DOJ says agencies should transfer an authorized seizure promptly because another copy of a key could otherwise be used to move the funds. The manual generally directs that cryptocurrency remain in the form seized while forfeiture is pending.
  6. Forfeiture proceedings continue separately. The government must follow the applicable notice, claim and litigation procedures. A seizure alone does not establish that the property will ultimately be forfeited.

Self-custody compared with provider-held cryptocurrency

Custody situation Who controls the key or account DOJ policy’s service point Important qualification
Domestic self-custodial wallet The owner or another person holding the private key Obtain a seizure warrant unless a search warrant or owner consent authorizes the seizure; serve the warrant on the owner or counsel Agents may need to find key material and transfer the assets themselves
Account at a U.S.-based virtual asset service provider The provider maintains account access and custody arrangements Serve the seizure warrant on the provider, similarly to service on a bank This is not the same procedure as taking a key from a personal wallet
Wallet or account hosted by a foreign provider A provider outside the United States may control access or custody Prosecutors should consult DOJ’s Office of International Affairs A mutual legal-assistance request or similar international authority may be needed

The location and custody model therefore matter. “Not held on an exchange” does not mean “outside government reach”; it means the technical and legal steps may involve the owner’s device, backup or key rather than a service provider’s account ledger.

Seizure is not the same as forfeiture

Seizure is an interim act: the government takes possession or restrains the property while it pursues a legal disposition. Forfeiture is the final legal transfer of the property to the government under the applicable civil or criminal process. A person can contest the forfeiture even after the cryptocurrency has been moved into government custody.

The government’s burden in civil forfeiture

Under 18 U.S.C. § 983, the government generally must establish by a preponderance of the evidence that property is subject to civil forfeiture. “Preponderance” means the evidence shows that the forfeiture claim is more likely true than not. The statute’s requirements vary with the theory of forfeiture and the procedural posture.

Property allegedly used to facilitate an offense

When the government claims property was used to commit or facilitate a crime, § 983 requires a substantial connection between the property and the offense. The government must prove that connection; the mere fact that a person owned cryptocurrency or used a particular wallet is not, by itself, the statutory test.

The innocent-owner defense

Section 983 provides an innocent-owner defense in qualifying civil-forfeiture cases. The claimant bears the burden of establishing innocent-owner status by a preponderance of the evidence. The defense is fact-specific, and its availability can depend on when and how the claimant acquired the interest and what the claimant knew or reasonably should have known.

What happens after a notice or court filing

Federal forfeiture procedures include notices, claims, judicial filings and deadlines that depend on the type of proceeding and its stage. There is no single deadline that safely applies to every seizure. A notice of administrative forfeiture, a civil complaint, a criminal indictment and a court order can trigger different requirements.

  • Preserve every document. Keep the seizure notice, warrant, inventory, court papers, letters, emails and delivery information.
  • Do not assume a blockchain transfer ends your rights. A transfer to a government wallet changes custody, not necessarily the merits of the forfeiture claim.
  • Get case-specific legal advice quickly. A lawyer experienced in federal asset forfeiture and cryptocurrency cases can identify the applicable claim route, deadline, standing issues and defenses.
  • Do not move or conceal related assets to frustrate legal process. Transfers made after notice, or actions that obstruct execution of a warrant, can create additional legal risk.
  • Secure records without altering evidence. Preserve transaction histories, purchase records, tax records, wallet backups and communications as instructed by counsel.

Only the actual notice, warrant and governing law can determine what response is required. Missing a procedural deadline can affect the ability to contest a forfeiture, so waiting for a general internet answer is risky.

Can police take cryptocurrency from a hardware wallet?

They may be able to seize cryptocurrency controlled through a hardware wallet when a valid warrant, an applicable search warrant or consent authorizes the seizure. DOJ identifies hardware wallets and USB devices as possible locations for private keys. The hardware device is evidence or key-storage equipment; the cryptocurrency is controlled through the key and can be transferred to an authorized government wallet.

A hardware wallet can reduce exposure of key material during ordinary use, but it does not prevent lawful execution of a warrant. It should not be presented as a device that defeats seizure authority.

Can the government seize crypto without an exchange?

Yes, in the federal U.S. context, the absence of an exchange does not bar seizure. In a self-custody case, agents may serve the owner or counsel, locate the device or paper holding the key, and—if authorized—transfer the cryptocurrency directly on the blockchain. The technical challenge of obtaining the key is different from the legal question of whether the property may be seized.

If the assets are with a domestic service provider, the provider can be served much like a bank. If they are with a foreign provider, international legal-assistance procedures may be required. Those categories should not be treated as interchangeable with a personal wallet.

What a 2025 DOJ example shows

On August 14, 2025, DOJ announced that six warrants authorized seizure of more than $2.8 million in cryptocurrency and other property. DOJ said the cryptocurrency was seized from a wallet controlled by an indicted defendant and described the funds as allegedly connected to ransomware proceeds and laundering. The indictment was an allegation, and DOJ emphasized that defendants are presumed innocent.

The announcement demonstrates that authorities have executed warrant-backed seizures involving a controlled wallet. It does not establish that every self-custody wallet is forfeitable, that the alleged conduct was adjudicated, or that possession of cryptocurrency alone is unlawful.

Key distinctions to keep straight

  • Wallet versus cryptocurrency: the wallet manages keys; the blockchain records the assets.
  • Private key versus ownership: technical control of a key can be evidence of control, but legal ownership and forfeiture entitlement depend on the facts and law.
  • Seizure versus forfeiture: taking control is not a final judgment that the government keeps the property.
  • DOJ policy versus statute: the 2025 manual instructs DOJ agencies on procedure; statutes, constitutional rules and court orders govern a particular case.
  • Federal procedure versus universal law: this overview does not establish the law of every state or country.

Bottom line for wallet holders

Self-custody gives you direct control over transaction authorization, not immunity from legal process. Under the federal U.S. framework described by DOJ, a domestic self-custodial wallet can be searched or seized under the appropriate warrant or consent, and the cryptocurrency can be moved into government custody. Whether the government ultimately keeps it is a separate forfeiture question governed by the applicable statute, evidence, notice procedures and defenses. If your assets have actually been restrained or seized, preserve the papers and consult qualified counsel promptly rather than relying on a generic deadline or assumption about how self-custody works.
