Ending nondisclosure agreements (NDAs) with public agencies could help, but it is not enough on its own to persuade data center opponents. Timely disclosure can let residents assess a project before key decisions are settled. The available evidence, however, does not show that ending NDAs by itself increases public support, secures community consent, or improves project outcomes. Transparency is a starting condition for informed participation—not a substitute for it.

How NDAs can shut residents out

When a company asks a local government to keep a proposed project confidential, residents may not learn who is behind it, how large it could be, or what it might mean for electricity, water, land use, and public incentives until negotiations are well advanced. The scope of these agreements can vary; they should not be treated as identical.

Companies’ stated rationale, as described in reporting, is that they may be reluctant to share proprietary information during site selection without confidentiality protections. That concern does not settle what should remain confidential. The central public-interest question is whether officials can protect genuinely sensitive details while still giving residents enough time and information to weigh community impacts.

What the available evidence says about NDA use

A March 31, 2026, release from Senator Richard Blumenthal’s office reports that University of Mary Washington researchers contacted 31 Virginia local governments and that 25 said they had such agreements. This is evidence about the localities contacted—not a national estimate, or a basis for claiming the same share of local governments elsewhere use data-center NDAs.

The same Senate release quotes a projected 30% to 60% increase in residential retail electricity rates over five years in regions near new data centers. That is a projection attributed to the release, not a universal outcome or an independently verified estimate; the underlying forecast and geographic definitions are not established here.

What policy changes are on the table

Recent examples differ in scope and legal status. Pennsylvania announced a state executive-order package, while the federal proposal described below was introduced as a bill—not enacted law in the cited House release.

Approach Status in the cited source What it covers
Pennsylvania executive-order package Announced by the state as an executive order The state says NDAs for data-center projects are impermissible. The package also calls for annual energy and water information, removing data-center projects from the permit fast-track program, and a public map of proposed projects that have engaged with the Department of Environmental Protection. The announcement links transparency with enforceable commitments under the state’s GRID requirements.
No Secrets for Data Centers Act Introduced in the House on September 24, 2026; the cited release does not show it as enacted The House release says the bill would void certain NDAs signed by government officials and restrict subsidies conditioned on confidentiality, with an exception for normal filings that could reasonably be considered trade secrets.
Senate-record text Text published in the Congressional Record on September 28, 2026 The text says NDAs cannot block information required to be disclosed under that section, while allowing NDAs for information the section does not require to be disclosed. This is a separate text with its own scope; it should not be conflated with the House bill or treated as an enacted rule.
Company commitment reported in October 2026 Described by Tom’s Hardware as an announced company commitment The report says Amazon committed to ending its use of NDAs with government agencies on its data-center projects, alongside community engagement and annual disclosures. Those details are reported secondhand here; the commitment is not evidence by itself that opponents were persuaded.

Pennsylvania’s example illustrates why an NDA ban and a broader transparency package are not interchangeable. They can differ in what becomes public, when residents find out, whether people can participate before approval, and whether promises can be enforced.

What residents need to judge a project

Public Citizen, an advocacy organization, recommends disclosing project ownership, size and number of facilities, estimated energy and water use, how power demand will be met, proposed incentives, and noise and light impacts. These are useful questions for residents to ask; they are recommendations from an advocacy group, not a neutral consensus standard established by the cited sources.

Disclosure is most useful when it arrives early enough to inform decisions and includes clear, comparable information. A document posted after approvals are effectively settled may be public without offering residents a meaningful chance to shape the outcome. Ongoing reporting also matters: projected demand and proposed safeguards are not the same as what a facility uses or delivers once operating.

Can transparency coexist with trade-secret protection?

It need not be an all-or-nothing choice. The House release describes an exception for certain trade-secret filings, and the Senate-record text distinguishes information required to be disclosed from information outside that requirement. Those provisions belong to different texts and have different status; neither establishes a single, generally applicable rule for all data-center projects.

A well-defined policy can specify what must be disclosed, what may be withheld, who decides whether information qualifies for protection, and how residents can challenge an overly broad confidentiality claim. The sources establish the debate over that balance, not a settled test that applies everywhere.

What ending NDAs cannot accomplish by itself

Making project information public does not guarantee that residents can influence a decision, that officials will respond to concerns, or that an operator will meet its commitments. Participation before approvals, enforceable conditions, and remedies for noncompliance address different problems from secrecy. A company pledge may change company practice, but it does not have the same force as a public rule or an enforceable project condition.

The sources reviewed establish political and policy debate, not a measured causal effect of ending NDAs on public opinion, community consent, project cancellations, lawsuits, or permitting timelines. No reliable persuasion rate or outcome improvement can be claimed from them.

How to tell whether a transparency policy is meaningful

  • Timing: Does notice arrive before major site, incentive, and approval decisions are settled?
  • Coverage: Does disclosure address ownership, project scale, energy and water demand, incentives, and local impacts?
  • Confidentiality: Are protected categories narrow, and is there a clear process for deciding what qualifies?
  • Participation: Can residents engage before approvals, with a way for decision-makers to address their input?
  • Enforcement: Are commitments binding, and are consequences or remedies specified if they are broken?
  • Follow-through: Is relevant information reported after approval and during operation?

Ending NDAs can remove one barrier to public scrutiny. Whether it helps persuade opponents depends on what replaces secrecy: early, relevant disclosure, a real opportunity to participate, and commitments that can be enforced. The available evidence supports that as a practical test for transparency policy, but does not show that an NDA ban alone wins community agreement.
