Can restaurants charge different prices to different customers? In the United States, usually yes—but not without limits. A restaurant can generally vary prices by time, demand, location, menu offer, customization, or eligibility for a disclosed promotion. A different price becomes legally risky when the advertised price is misleading, a mandatory fee is hidden, a payment surcharge violates applicable rules, or the difference targets a protected customer category under state or local law.

The answer depends on what changed on the bill, why it changed, when you were told, and where the transaction occurred. This is a general U.S. overview, not legal advice for a particular dispute.

The basic rule: different prices are not automatically illegal

U.S. law does not impose one nationwide rule requiring every diner to pay exactly the same amount. Restaurants commonly use different prices for lunch and dinner, adjust prices when demand or inventory changes, offer loyalty discounts, and charge different amounts for different portions or customizations.

The key legal distinction is between a disclosed price difference and a deceptive or discriminatory charge. The Federal Trade Commission (FTC) says dynamic pricing can be lawful when the pricing information is not misleading. A restaurant still has to communicate the applicable price and conditions clearly enough for a customer to understand the offer before ordering or paying.

  • 12-Month Warranty: Backed by a 12-month manufacturer warranty for peace of mind. Designed to meet strict quality control standards for reliable everyday performance.
  • Usually permissible in principle: a higher dinner price than lunch, a weekday promotion, a members-only discount with stated eligibility, or an extra charge for an optional ingredient.
  • Potentially unlawful: advertising one total and adding undisclosed mandatory fees, misrepresenting a conditional discount as the ordinary price, charging different prices because of a protected characteristic where state law forbids it, or imposing a payment surcharge contrary to payment-card or state rules.

When time, demand, or location changes the price

Time-based and demand-based pricing

The FTC’s May 2025 fee FAQ states: “Businesses may use dynamic pricing strategies to adjust prices, for example, based on demand or inventory, so long as the pricing information is not misleading.” That covers ordinary situations such as a restaurant charging one price during a busy event and another during a slower period, or changing a delivery menu when a particular item is scarce.

Dynamic pricing does not give a restaurant permission to conceal the price until after the order is committed. The customer should be able to see which menu, time window, location, or other condition applies. A price shown in an app can differ from an in-person price if the distinction is presented accurately and the platform or restaurant does not falsely imply that one price applies everywhere.

Location and channel differences

A restaurant may have separate prices for its dining room, takeout counter, website, app, or a third-party delivery channel. Delivery commissions, packaging, staffing, and platform terms can make the economics different. The important questions are whether the customer sees the applicable price before ordering and whether any mandatory fee is disclosed as part of the required total.

Local law can add requirements. A city or state may regulate menu disclosures, service charges, or payment surcharges even when federal law does not prohibit the underlying price difference.

Customization and portion differences

Charging more for a larger portion, an additional protein, a substitution, or a special preparation is generally a difference in the product or service purchased rather than a different price for identical service. The menu or ordering interface should identify the extra amount before the customer confirms the order.

Promotions, loyalty programs, and conditional discounts

The generally available price must be clear

A discount limited to qualifying customers is not automatically the restaurant’s generally available price. The FTC’s fee guidance says a business should show the generally available total price prominently when a reward-program or other conditional discount has not yet been earned. After the customer meets the conditions, the total can be updated to show the discount.

For example, a restaurant can offer a lower price to loyalty members, students, subscribers, or customers using a stated coupon if the eligibility rule is disclosed. It should not present the discounted amount as though every customer receives it and reveal the higher required total only at checkout.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What to check in an offer

  • Who qualifies: membership, age, student status, purchase history, a coupon, or another stated condition.
  • What the discount applies to: the item price, the entire order, or a fee.
  • When the condition is verified: before ordering, at checkout, or after enrollment.
  • Whether taxes, service charges, or payment fees are calculated before or after the discount.

These details matter because a promotion can be lawful while a misleading presentation of that promotion is not.

Credit-card fees, payment surcharges, and mandatory service fees

Payment-method fees

The FTC distinguishes the total price from the final amount due. A business may charge a payment-processing fee when other law permits it, but the fee and the final amount must be disclosed before payment and cannot be misrepresented.

If the customer must use the fee-bearing payment method, the fee is mandatory and should be included in the displayed total. If a genuinely usable, fee-free payment method is available at the same location or on the same ordering platform, the FTC FAQ treats the payment fee as optional for purposes of the total-price disclosure. That distinction does not override separate state, federal, or card-network rules that may limit surcharges.

“A credit-card fee” therefore requires more information than the label alone. Ask whether cash, debit, or another payment method is actually accepted without the fee, whether the fee was shown before authorization, and whether the restaurant’s state has additional surcharge requirements.

Mandatory service, health, or other surcharges

A mandatory service charge is different from an optional tip. If every customer must pay it, it is part of the amount the customer is required to pay and should be clearly disclosed wherever prices are displayed. Calling a mandatory charge a “suggested tip” does not make it optional.

California illustrates the distinction between price-setting and price transparency. The California Attorney General’s SB 478 guidance says: “The statute does not change what price a business can charge or what may be included in that price.” The law addresses how required charges are presented. California guidance also explains that restaurant mandatory fees receive specific treatment under SB 1524 and must be displayed clearly and conspicuously wherever prices are shown. Discounts below the listed price remain allowed under that law.

California rules are not a nationwide template. A restaurant in another state or city may face different disclosure, service-charge, or menu requirements.

When a customer category can create a legal problem

Protected characteristics and state civil-rights laws

Federal law does not provide one simple restaurant rule covering every customer-category price difference, and state civil-rights statutes can be broader. California’s Civil Rights Department gives charging men and women different prices for comparable services—including drinks at a restaurant or bar—as an example of conduct that can violate the Unruh Civil Rights Act.

The same California guidance identifies some age-based discounts, such as lower prices for seniors, young adults, or children, as potentially lawful when they encourage family attendance. That is a California example, not a guarantee that every age-based policy is valid everywhere. The exact customer group, service, purpose, and wording can matter.

For any customer-trait pricing issue, identify the jurisdiction and whether the customers received genuinely comparable goods or services. A lower children’s menu price for a smaller portion is different from charging different prices for the same drink solely because of sex.

Privacy-rights and personal-data pricing rules

Florida provides a separate, privacy-specific example. Its privacy statute restricts a covered controller from discriminating against a consumer for exercising specified privacy rights by charging different prices or providing different levels of service. The statute also preserves certain different offers connected to opt-outs and voluntary participation in bona fide loyalty, rewards, premium-feature, discount, or club-card programs.

This is a state privacy rule, not a nationwide finding that all personalized pricing is illegal. The FTC has issued a proposed enforcement policy statement concerning personalized pricing based on personal data. It is a proposal rather than a final nationwide prohibition, and its status should be checked before relying on it.

Why the Robinson-Patman Act usually is not the diner-equality law

People sometimes invoke the federal Robinson-Patman Act when two customers pay different prices. The FTC explains that the statute concerns commodities rather than services and generally involves like-grade goods sold to at least two purchasers in interstate commerce with a reasonable possibility of competitive injury. FTC guidance identifies defenses such as cost savings and meeting a competitor’s price.

That framework addresses particular commercial sales relationships and competition between purchasers. It is not a general federal command that a restaurant charge every individual diner the same amount. A restaurant’s different lunch price, loyalty discount, or delivery price normally does not become a Robinson-Patman violation simply because two diners compare receipts.

A practical way to analyze two different restaurant bills

Separate the facts before deciding whether the difference is a legal issue. Use these comparison points:

Question What to identify
What changed? The listed menu price, a discount, a payment fee, a mandatory surcharge, a tax, or the item itself.
Why did it change? Timing or demand, location, order customization, payment choice, loyalty eligibility, or a customer characteristic.
When was it disclosed? Before ordering, before payment, or only on the receipt.
Who was affected? Everyone using the menu, qualifying members, or a potentially protected group.
Where did it happen? The country, state, city, and whether the order was in person, through an app, or through delivery.

This classification prevents a hidden-fee complaint from being confused with a discrimination claim or a competition-law question.

Examples: ordinary variation versus a warning sign

Usually ordinary variation

  • A restaurant lists a lower weekday lunch price and a higher weekend dinner price, with both menus visible before ordering.
  • A loyalty member receives a stated discount after signing in, while the regular price remains visible to nonmembers.
  • An app lists a different price from the dining-room menu and identifies the applicable fees before order confirmation.
  • A customer chooses an extra topping or larger portion and sees the additional charge before submitting the order.

Questions that deserve closer review

  • The advertised total excludes a mandatory charge that appears only after payment details are entered.
  • A restaurant calls a required charge optional or describes a conditional price as though everyone qualifies.
  • Two customers receive identical services but are charged different prices because of sex or another protected characteristic under applicable state law.
  • A payment surcharge is imposed even though the restaurant’s jurisdiction or payment rules restrict it, or no workable fee-free method exists despite the restaurant treating the fee as optional.

What diners should do if the price changes

  1. Save the evidence. Keep a screenshot or photograph of the menu, online offer, eligibility terms, checkout screen, and receipt. Record the restaurant location and the date and time.
  2. Label the difference. Decide whether it was a menu price, discount, payment fee, mandatory surcharge, tax, or charge for a different item.
  3. Ask for the condition. Request the written rule for the time window, membership, payment method, or customer category that produced the difference.
  4. Check the jurisdiction. Look at the state attorney general, consumer-protection agency, civil-rights agency, or privacy regulator for the place of sale. Local rules can be more specific than federal guidance.
  5. Escalate proportionately. For a small undisclosed charge, request a correction from the restaurant or platform first. For suspected discrimination, repeated hidden fees, or a substantial amount, consult the relevant regulator or a lawyer.

Restaurant compliance checklist

  • Show the generally available total price prominently before a customer commits to the purchase.
  • State the eligibility and duration of every conditional discount.
  • Identify whether a charge is mandatory, optional, or a tip.
  • Disclose payment-method fees and the final amount before authorization.
  • Review state and city rules for menu pricing, service charges, payment surcharges, civil-rights protections, and privacy rights.
  • Keep records of price changes, promotion terms, and the customer-facing screens used at the time.
  • Do not assume that a proposed federal policy statement or guidance document has the force of a final rule.

Why the exact state and city matter

Federal guidance supplies a baseline, but it does not resolve every restaurant-pricing dispute. The FTC’s small-business advertising guidance points businesses toward the relevant state attorney general because local practices and laws can control disclosure and surcharge questions. California’s hidden-fee and civil-rights examples, and Florida’s privacy-discrimination provision, demonstrate why a nationwide yes-or-no answer can be misleading.

For a reliable conclusion, specify the restaurant’s state and city, the ordering channel, the two prices, the reason given for the difference, and when the customer learned about it. Rules on payment cards, mandatory fees, customer categories, and personalized pricing can change, so current primary-source guidance should be checked before taking legal action.
