Sometimes, but there is no single nationwide rule. The U.S. Department of Justice (DOJ) generally requires its own law-enforcement components to obtain a probable-cause warrant before deploying a cell-site simulator in a domestic criminal investigation, subject to limited exceptions. That internal policy does not automatically govern every state or local police department, and it is not itself a nationwide constitutional ruling.
The Supreme Court’s 2018 decision in Carpenter v. United States generally requires a warrant for the government to obtain historical cell-site location records held by a wireless carrier. The Court expressly left real-time location information and tower dumps unresolved and did not decide whether using a cell-site simulator is lawful with or without a warrant. The answer in a particular case depends on the technology used, the information collected, the agency, the purpose, and the law in the relevant jurisdiction.
What a cell-site simulator does
A cell-site simulator is law-enforcement equipment that imitates cellular-network equipment so it can interact with phones in its vicinity. The DOJ describes two basic investigative uses. Investigators can try to locate a phone when they already know its unique identifier, or they can collect limited signaling information from nearby phones to determine the identifier of an otherwise unknown device.
Free tools Windows power users keep installed
One-click scans. No signup required.
The second use is important because the equipment can affect more than the phone that investigators ultimately want to find. Phones in the simulator’s range may respond to the simulated network equipment, allowing investigators to sort through nearby devices and identify a target. The exact capabilities and operating methods can differ by model and deployment; the DOJ policy describes these capabilities at a general level rather than promising that every device works identically.

What the simulator is not
A simulator is not the same thing as a carrier’s historical location records, a real-time request to a carrier, a tower dump, GPS extraction, or a search of the handset. Those methods involve different sources of information and can trigger different legal rules. Calling all of them “phone tracking” hides the distinctions that determine whether a warrant, another court order, or no advance order is legally required.
What DOJ policy says it cannot collect
The DOJ’s policy says a cell-site simulator may not be used in a criminal investigation to obtain the contents of communications or data stored on the phone. The listed examples include texts, emails, contacts, and images. In other words, the policy treats the simulator as a way to locate or identify a device, not as a tool for reading messages or copying a phone’s files.
Why the warrant answer depends on the information source
“Can police track a phone without a warrant?” combines several different practices. The table below separates them by who holds or gathers the information, whether it is historical or current, and what the Supreme Court has actually decided.
| Method | Who holds or collects the information | Timing and scope | What is established about warrants |
|---|---|---|---|
| Historical cell-site location information (CSLI) | Wireless carrier records obtained by the government | Past location points retained by the carrier; may cover days or months | Carpenter v. United States generally requires a probable-cause warrant for this acquisition |
| Real-time CSLI | Usually a carrier providing current location information | Location generated or requested while the investigation is occurring | Carpenter expressly did not decide this question |
| Tower dump | Carrier records concerning devices that connected to specified cell towers | Historical records for many devices in a geographic area | Carpenter expressly did not decide this question |
| Direct cell-site-simulator deployment | Law-enforcement equipment interacting directly with nearby phones | Usually an operational, near-real-time effort to identify or locate a device | Carpenter did not decide simulator use; agency policy and jurisdiction-specific law matter |
This distinction explains why a statement such as “the Supreme Court banned warrantless phone tracking” is too broad. The Court ruled on one category—historical carrier-held CSLI—and reserved several others.
The DOJ policy: what it requires and who it covers
On September 3, 2015, the DOJ issued its “Department of Justice Policy Guidance: Use of Cell-Site Simulator Technology.” The policy generally directs DOJ law-enforcement components to obtain a search warrant supported by probable cause before deploying a simulator in a domestic criminal investigation. It points investigators to Federal Rule of Criminal Procedure 41 or the applicable state equivalent. Depending on the jurisdiction and the investigative technique, a pen-register authorization may also be required.

The policy is department-wide guidance for DOJ components. It is not a statute enacted by Congress, a decision binding every police department, or a declaration that every warrantless deployment violates the Fourth Amendment. State and local agencies may have their own policies, and courts may apply state constitutional provisions or statutes that provide greater protection than the federal baseline.
When the policy was announced, Deputy Attorney General Sally Quillian Yates said: “With the issuance of this policy, the Department of Justice reaffirms its commitment to hold itself to the highest standards as it performs its critical work to protect public safety.” The statement describes the department’s chosen investigative standard; it does not convert the policy into a nationwide constitutional rule.

The policy recognizes exigent circumstances but still calls for court approval. Its examples include protecting life, preventing the imminent destruction of evidence, pursuing a fleeing suspect, and preventing an escape. The policy does not require a warrant when the Fourth Amendment itself does not require one, but an exigency does not automatically mean investigators can deploy the equipment with no judicial involvement under the DOJ guidance.
The exceptional-circumstances provision
The policy separately allows an exceptional-circumstances path when the law does not require a warrant and obtaining one is impracticable. That provision is narrower than a general convenience exception. Whether it applies depends on the facts, the governing law, and the circumstances confronting investigators. A department following DOJ policy must document and evaluate those conditions rather than treating the exception as a routine alternative to a warrant.
What Carpenter v. United States decided
In Carpenter v. United States, decided June 22, 2018, the Supreme Court held that the government’s acquisition of historical CSLI from a wireless carrier is generally a Fourth Amendment search. In the circumstances addressed by the case, obtaining that information required a warrant supported by probable cause.

The scale of the records in Carpenter
The case involved 12,898 location points collected over 127 days—an average of 101 points per day—about the defendant. Those figures are case-specific context, not a standard amount of information gathered in every investigation. The decision focused on the privacy implications of obtaining a detailed historical record from a carrier, rather than on a simulator’s direct interaction with phones.

The limits the Court stated itself
The Court emphasized, “Our decision today is a narrow one.” It expressly did not decide the constitutional treatment of real-time CSLI or tower dumps. It also did not decide whether a cell-site simulator deployment is a search requiring a warrant, what process is sufficient for every simulator use, or how every state constitution treats the technology.
Consequently, citing Carpenter alone does not answer a challenge to a simulator deployment. A lawyer would need to identify the collection method, the information actually obtained, the agency involved, the order or warrant issued, and the controlling decisions in the court hearing the case.
A jurisdiction-specific example: Prince Jones v. United States
The District of Columbia Court of Appeals’ 2017 decision in Prince Jones v. United States discusses local police use of a cell-site simulator and warrant questions under the facts and law before that court. It is useful evidence that courts scrutinize simulator deployments, but it is local precedent, not a rule for every state, federal district, or police department.
The practical lesson is to identify the jurisdiction before drawing a categorical conclusion. A result in the District of Columbia does not automatically control a case in another state, and a state court may apply a state constitutional privacy provision that differs from federal Fourth Amendment doctrine.

How investigators may use a simulator in practice
The following sequence describes the two capabilities identified in the DOJ policy without assuming that every investigation follows every step.
- Define the investigative objective. Investigators determine whether they are trying to locate a device whose identifier is already known or identify an unknown device among phones in a particular area.
- Choose the collection method. If the information is historical carrier data, the request goes to the provider. If the operation involves direct interaction with nearby phones, investigators use the simulator. A handset search or GPS extraction would be a different technique.
- Seek the required legal process. For DOJ components, the ordinary path is a probable-cause warrant under Rule 41 or the applicable state equivalent. Depending on local procedure, investigators may also need pen-register authorization.
- Evaluate any claimed exception. Investigators must determine whether an exigency, an exceptional circumstance, or another recognized legal basis applies. Under the DOJ policy, exigency still calls for court approval, and the policy does not authorize bypassing a warrant merely because obtaining one is inconvenient.
- Limit the operation. The DOJ policy prohibits using the simulator to obtain communication contents or data stored on the phone, including texts, emails, contacts, and images. The operation should therefore be directed at identification or location rather than content collection.
- Account for nearby devices. Because the equipment can receive limited signaling information from phones in its vicinity, the legal and factual record may need to address the effect on people who were not the investigative targets.
What “without a warrant” can mean in a real case
A warrantless episode can describe several different situations, and they do not have the same legal result.
- No warrant was sought because investigators relied on an exception. The court may have to decide whether the claimed exigency or exceptional circumstance actually existed and whether the agency complied with its own policy.
- A different court order was obtained. A pen-register order, subpoena, or other authorization is not automatically equivalent to a probable-cause search warrant. The sufficiency of the process depends on the method and the governing law.
- The agency was not covered by DOJ policy. A local department’s failure to follow a DOJ policy does not by itself establish a constitutional violation, although a local statute, policy, or state constitution may impose its own requirements.
- The government obtained carrier records rather than operating a simulator. Historical CSLI falls within Carpenter’s holding, while real-time CSLI and tower dumps remain unresolved at the Supreme Court level.
Common misconceptions to avoid
“StingRay” answers the legal question
“StingRay” is commonly used as a label for a cell-site simulator, but the name does not identify the agency, the model, the mode of operation, or the legal process used. The relevant questions are what the equipment did and what information it collected.
A simulator reads texts and photos
The DOJ policy prohibits its criminal-investigation use to obtain communication contents or data stored on the phone, including texts, emails, contacts, and images. A simulator should not be described as a substitute for a forensic search of the handset.
Carpenter decided every form of phone tracking
Carpenter addressed historical carrier-held CSLI. Its opinion expressly reserved real-time CSLI and tower dumps and did not decide simulator deployment. Applying the case to another collection method requires analysis rather than a slogan.

No warrant always means the tracking was illegal
The constitutional question can turn on an exception, the type of information, the agency, and the jurisdiction. A warrantless use may be challenged, but its legality cannot be determined from the absence of a warrant alone.
Any location point is proof of a person’s exact movements
Carrier records, tower-based information, and simulator signaling each have different technical characteristics. The number and precision of points, the geographic area, and the time period must be established from the actual records and method used; the 12,898 points in Carpenter should not be treated as a universal investigative quantity.
What to do if you think a simulator was used
If this issue affects a criminal case, immigration matter, civil claim, or an effort to challenge evidence, preserve the details rather than relying on a general internet description.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errors- Identify the agency and the court or jurisdiction involved.
- Ask counsel to determine whether the government used a simulator, requested carrier-held CSLI, sought a tower dump, or searched the handset.
- Request the warrant, pen-register order, other authorization, and affidavits through the applicable discovery or court process.
- Check the dates covered, the devices or identifiers named, and whether the order limited collection and retention.
- Compare the stated technique with the actual evidence. A carrier billing record, a simulator log, and a handset extraction are not interchangeable.
- Ask a qualified lawyer whether suppression, a motion to compel disclosure, a public-records request, or another remedy is available under the governing law.
Public-records laws, discovery rules, and sealing orders vary, so the route for obtaining documents depends on the agency and proceeding. Technical terminology alone cannot establish that a particular phone was tracked or that evidence must be excluded.
Bottom line for readers
The strongest general answer is conditional. DOJ components ordinarily need a probable-cause warrant under the 2015 DOJ policy before deploying a cell-site simulator, with defined exceptions and court-approval requirements for exigent circumstances. Carpenter generally requires a warrant for historical CSLI obtained from a wireless carrier, but it did not decide real-time CSLI, tower dumps, or simulator use. To know whether police could track a specific phone without a warrant, identify the collection method, the agency, the legal process, and the jurisdiction before applying the rule.
