Yes—an indie developer can license a movie, television, comic, music, or other entertainment property for a game. The rights holder (or an authorized licensing representative) must grant written permission that covers the exact game and its planned release. A license is a negotiated contract, not a fan-project disclaimer or an informal email.
The difficult part is clearing every right your game uses, finding the person who can grant those rights, and accepting the approval, financial, territorial, and time restrictions that make the deal commercially workable. The UK Intellectual Property Office recommends specialist advice for copyright and contract matters; an entertainment or intellectual-property lawyer should review any long-form agreement before you commit money or publish protected material.
What an entertainment-IP license actually gives you
The UK Intellectual Property Office defines a licence as “a contractual agreement between the copyright owner and user which sets out what the user can do with a work.” In a game deal, that permission is limited to the uses written into the contract. It does not automatically grant every right associated with a franchise.

Another agreement could cover logos and names but exclude music, likenesses, storylines, or user-generated content. Popularity creates no implied permission. A game based on a famous film or character still needs authorization even if it is free, made by one person, or clearly labeled as a fan project. A disclaimer cannot replace a license.
Rights are usually split among several owners
One entertainment property can involve separate rights in the underlying story, characters, trademarks, recordings, performances, artwork, footage, and likenesses. A film distributor may not control the music recording; a publisher may control a comic character while a separate company controls game rights; a performer may have contractual publicity or likeness protections.
Before pitching, identify who owns or controls each element you plan to use and whether your contact has authority to sublicense it. Ask for written confirmation of chain of title or the relevant licensing authority when the ownership is unclear.

| Game element | Rights or approvals to investigate | Why it matters |
|---|---|---|
| Character names, designs and backstory | Copyright, trademark and adaptation rights | The contract should identify the approved versions and any limits on new stories or designs. |
| Logos, titles and slogans | Trademark permission and brand rules | Store pages, trailers and merchandise may each require separate approval. |
| Music and recordings | Composition, master recording, performer and territory rights | A soundtrack license may not cover streaming, user videos or every country. |
| Actor or creator likeness | Publicity, likeness and performance permissions | Using a digital likeness or voice can require consents beyond the studio’s IP rights. |
| Film or television footage | Clip, synchronization and promotional-use rights | Gameplay use, trailers and advertising can have different clearances. |
How to get permission: a step-by-step route
1. Map the rights before contacting anyone
Write a clearance list for every protected element in the proposed game: names, characters, settings, plot points, artwork, logos, music, dialogue, footage, likenesses and any user-generated-content tools. Add the intended platforms, countries, languages, release window, business model and promotional channels. This list lets you detect gaps before a negotiation begins.
Check whether the property has territory-specific distributors, publishers, collecting societies or licensing representatives. The first company you find in a web search may have authority for merchandise but not games. If a representative cannot confirm game sublicensing, do not assume it can grant permission.
2. Prepare a rights-safe pitch
Prepare a vertical slice or detailed concept that demonstrates the game without publishing protected assets. Use placeholder art, original music and invented names until permission is in place. Your pitch should explain:

Keep confidential materials controlled. A pitch submission is not permission to use the property, and publishing a prototype with recognizable protected assets can create risk before negotiations even start.

Some owners appoint licensing agencies, while some platforms provide their own catalogs. Verify that a portal accepts game proposals rather than only merchandise or advertising requests. Read submission terms before sending confidential concepts; some forms disclaim confidentiality or unsolicited-idea obligations.
Do not treat silence, a friendly conversation or a request for more information as approval. Continue using placeholders until an authorized signer executes a written agreement.
4. Negotiate the business terms and document them
Once the rights holder is interested, negotiate the scope, money, approvals, risk allocation and delivery obligations together. A short term sheet can establish the commercial deal, but the detailed license controls what you may ship. Have an entertainment/IP lawyer review both documents and confirm that the signer controls the relevant rights.
5. Operate a clearance process throughout production
Maintain an asset and rights ledger that records the source, owner, license clause, territory, expiration date, approval status and permitted use for every external asset. Route scripts, builds, artwork, trailers, store copy and influencer materials through the approval process specified in the contract. Keep signed permissions and approval emails in a versioned archive.
Roblox: a structured example, not a universal industry rule
Roblox’s official creator guidance states: “A license allows you to create a Roblox game or Marketplace item using IP.” Its licensing catalog lets creators browse available properties and request certain IP. A full-game request asks for a pitch describing the overall vision, relevant team experience, IP integration, audience engagement, monetization, creative design and gameplay.

Roblox says creators must review revenue share, duration, content standards and brand guidelines. A rights holder can approve, reject or issue conditional approval. Roblox also distinguishes full-game requests from in-game-sales and Marketplace licenses, so permission for one use should not be treated as permission for another.
If an IP is not in the catalog, Roblox’s FAQ says creators must have explicit permission from the rights holder. License requests remain subject to the platform’s content standards, duration and revenue-share terms. Unlicensed use can lead to removal, and rights holders may pursue infringement remedies. These rules demonstrate one practical route for some Roblox developers; they do not mean that every franchise has an open catalog or that a Roblox approval grants rights outside Roblox.
Why direct studio outreach can fail
Rights owners often divide licensing by product category. For example, a company’s licensing page may list well-known game and entertainment properties while accepting only merchandise proposals through that portal. One such page carries the disclaimer: “Please do not submit any game ideas, clearance or permission requests, or any other submissions unrelated to merchandise licensing via this portal.” It also states that a submission does not grant permission or rights.

The practical lesson is to verify the exact channel before sending a concept. Look for a game-licensing department, an authorized agent or a platform-specific program. A merchandise form is not a game-license application, and submitting an idea through it does not establish a relationship or protect your concept.
Terms every game-IP license should address
Do not evaluate a deal by royalty percentage alone. A narrow grant with onerous approvals or a short expiration can be less useful than a broader grant with a higher fee. The agreement should answer each question below in unambiguous language.
| Term | Questions to settle |
|---|---|
| Licensed property and scope | Which characters, names, logos, story elements, art, music, footage and derivative works are included? May you create new characters or alter costumes and settings? |
| Media and platforms | Does the grant cover PC, console, mobile, cloud streaming, physical editions, demos, downloadable content, patches, ports, livestreams, trailers and user-generated content? |
| Territory and language | Is the license worldwide or limited to named countries? Who controls localization, censorship edits, subtitles and translated marketing? |
| Term and renewals | When does the development period begin and end? Is there a launch window, renewal formula, sequel option or post-expiry sell-off period? |
| Exclusivity | Are you exclusive by platform, territory, product category or time? What competing projects may the owner authorize? |
| Approvals and brand standards | Who approves scripts, art, builds, store pages, trailers, influencer campaigns and updates? What are the response deadlines and deemed-approval rules, if any? |
| Money and reporting | Is there an advance or minimum guarantee? How are royalties or revenue shares calculated after platform fees, taxes, refunds and recoupment? How often do you report, and what audit rights apply? |
| Warranties and indemnity | Which party warrants ownership and authority? Who pays defense costs, settlements, takedowns, recalls, replacement assets or insurance premiums if a third party claims infringement? |
| Termination and wind-down | What breaches have cure periods? What happens if the owner loses underlying rights, becomes insolvent or invokes a morality clause? Can existing players keep access, and may you sell remaining inventory or downloadable content? |
WIPO’s Mastering the Game explains that game agreements commonly require the developer or publisher to represent that third-party IP is owned or properly licensed and to assume responsibility for infringement-related losses and costs. That allocation deserves focused negotiation: an indie studio may not have the cash, insurance or legal team to absorb an unlimited indemnity.

Can you make a free fan game?
Free distribution does not remove copyright, trademark, music, likeness or adaptation rights. A non-commercial fan game can still be taken down or trigger an infringement claim. Some owners tolerate fan works informally, but tolerance is revocable and is not a license.
If you want to explore a concept before clearance, build a private prototype with original or placeholder assets. Do not use protected names in a public store listing, accept donations tied to the project, run advertising, collect player data under the property’s branding or promote the prototype as an official product. Replace the concept with original IP if a license is unavailable.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How much does an indie license cost, and how long does approval take?
There is no reliable universal indie price, royalty rate, minimum guarantee or approval timeline. Economics depend on the property’s popularity, the rights package, territory, platforms, exclusivity, projected revenue, marketing commitments and your bargaining position. A platform’s illustrative revenue-share example—such as one published for its own licensing program—must not be generalized to direct studio deals.
Budget for more than the headline fee: legal review, insurance, localization, approval revisions, reporting systems, replacement assets if rights expire and potential minimum guarantees. Ask for a written schedule of fees and payment triggers, and model the project under delayed approval, a shorter term and a lower-than-expected sales outcome.
Common failure modes and practical fixes
You contacted the wrong owner
Symptom: The company handles merchandise, music publishing or distribution but cannot grant game rights.

Your pitch uses protected material too early
Symptom: A public demo, trailer or store page includes recognizable characters, logos or music before approval.
Fix: Replace those assets with originals or placeholders, remove public builds and preserve evidence that the revised prototype is rights-safe.
The contract is too narrow for the release plan
Symptom: The signed grant covers one platform or country but marketing, ports, streaming or user-generated content extends beyond it.
Fix: List every intended use before signing and add explicit rights for ports, DLC, updates, promotional media and player-created content where needed.
Approvals become a production bottleneck
Symptom: Builds or marketing materials wait indefinitely for review, threatening the launch date.
Fix: Define submission formats, named approvers, response deadlines, revision limits and escalation contacts. Avoid relying on informal approval promises.
The license expires while players still own the game
Symptom: A term ends while inventory, downloads, servers or online events remain active.
Fix: Negotiate renewal mechanics, a sell-off period, continued support for existing purchasers, server obligations and treatment of downloadable content before launch.
Pre-signing checklist for an indie team
- Confirm the counterparty’s authority for every IP element and territory.
- Define platforms, languages, monetization, promotional uses and user-generated content.
- Separate development, launch, renewal and post-expiry rights.
- Set approval deadlines and identify the people who can approve changes.
- Model advances, minimum guarantees, royalties, platform deductions, taxes and audit costs.
- Cap or insure indemnity obligations where possible and clarify who handles takedowns.
- Decide what happens to updates, DLC, inventory, existing players and save data after termination.
- Have specialist counsel review the final agreement before public release or accepting payments.
A written license from the party that controls the relevant rights is the foundation. The commercial value comes from making that grant specific enough to ship, market and support the game without discovering later that a character, platform, country or promotional use was never covered.
