Yes, usually—but not automatically. A studio can ship AI-assisted or AI-generated art, audio, code, writing, or other assets in a commercial game when its provider contract allows that use, every human-created input is cleared, the final asset does not unlawfully copy protected material, and the studio meets registration, platform, and jurisdiction-specific disclosure rules. A provider’s commercial-use clause is contractual permission; it is not a guarantee of exclusive copyright, originality, or freedom from infringement claims.
Four separate questions determine whether an AI asset is safe to ship
Teams often collapse several legal issues into the word ownership. Keep them separate when reviewing an asset:

A written answer to the first question never answers the other three. Treat each asset as a rights-clearance item, not as automatically clean because a model generated it.

Human authorship is the controlling test
The U.S. Copyright Office’s Part 2 report, released January 29, 2025, says generative-AI output is protectable only when a human author determines sufficient expressive elements. A prompt by itself normally describes an idea or desired result; it does not establish the human-authored expression needed for copyright.

The Office distinguishes a bare prompt from perceptible human-authored material, creative arrangement, and meaningful modification. For a game asset, potentially protectable contributions can include an artist’s original character design, texture painting and edits, level composition, animation cleanup, shader work, sound editing, or the creative arrangement of otherwise unprotectable pieces. Keep evidence showing who made those choices and how.

The Office received more than 10,000 comments in response to its 2023 artificial-intelligence notice, reflecting how fact-specific and unsettled many edge cases remain. The report is a useful framework, not a blanket approval for every generated file.

A larger human-made work can remain protected
AI material does not automatically destroy copyright in a game, scene, soundtrack, or composite that a human team authored. Protection can cover the studio’s original selection, arrangement, editing, and other human expression while leaving purely machine-generated portions unprotected. In a registration application, identify the AI-generated material and describe the human-authored contribution; do not claim a wholly machine-generated image as entirely studio-authored merely because an employee wrote the prompt.
Copyright ownership is different from a license to use an output
A service agreement may promise that a customer can use or own an output between the parties, but copyrightability is decided by applicable law. If an image contains little or no human expression, the studio may have permission to use it commercially without receiving an exclusive copyright it can enforce against everyone else. Another user could independently receive a similar result, and the studio may have limited ability to stop copying.
Read the exact plan and service terms in effect when each generation occurred. Check whether the agreement covers commercial distribution, derivative works, sublicensing to a publisher, confidentiality, retention, and service-specific exceptions. Save a dated copy rather than relying on a webpage that may change.

Infringement risk remains after a provider grants commercial use
Review the inputs
Clear every reference image, concept sheet, photograph, scan, voice, likeness, logo, music stem, and texture uploaded to a model. An employee’s access to a file does not prove the studio has the right to submit it, modify it, or use the result in a paid game. Contract restrictions, confidentiality obligations, and publicity rights can apply even where copyright is uncertain.
Review the output for recognizable protected material
Ask whether the result is substantially similar to a protected work, reproduces a distinctive character or logo, imitates a recognizable person, or uses a voice without authorization. Similarity review should be stricter for a protagonist, cover image, trailer, signature environment, or other high-visibility asset than for a disposable internal prototype. Keep screenshots and reviewer decisions so the studio can explain why an asset was accepted, changed, or rejected.
Understand the fair-use factors
Section 107 of Title 17 lists four factors: the purpose and character of the use (including commercial purpose), the nature of the copyrighted work, the amount and substantiality used, and the effect on the potential market or value. A commercial game receives no automatic fair-use exemption because a model produced the file. Training on copyrighted works, infringement by outputs, and licensing are separate policy questions; a conclusion about one does not resolve the others. Unusual style imitation, dataset provenance, or a disputed likeness should go to qualified intellectual-property counsel.

Provider terms vary: compare the contract, not the marketing headline

These clauses allocate contractual rights; they do not override copyright, trademark, personality-right, employment, or confidentiality law. Re-check terms before launch if an asset was generated months earlier, and record any enterprise indemnity, exclusions, or claim-handling procedure.
EU obligations change the vendor-review checklist
European Commission guidance on general-purpose AI providers says the EU AI Act requires providers to maintain copyright policies and publish summaries of training content, with the relevant obligations applying from August 2, 2025. This is principally a provider duty, but it gives a studio concrete procurement questions: Can the vendor show its copyright policy? Is a training-content summary available? What licensing or opt-out mechanisms apply to customer inputs?

A compliant AI-asset workflow from concept to release
- Inventory the use. List every AI-assisted asset and mark whether it ships to players, appears in advertising, is supplied to a publisher, or remains an internal prototype. Include generated text, voices, music, animation, code, textures, and images.
- Freeze the contract record. Save the provider name, exact terms URL or downloaded terms, effective date, account or subscription tier, model and version, and generation date. Note enterprise indemnities, privacy settings, retention, and restrictions.
- Clear each input. Record the license or permission for every reference image, scan, logo, voice, likeness, sample, texture, and music stem. Do not upload confidential or third-party material merely because it is available to an employee.
- Generate with reproducible records. Preserve the prompt, negative prompt or settings where applicable, seed or job identifier if supplied, model version, and the original unedited output. Record who requested it and for which game build.
- Add meaningful human expression. Have identified artists or designers make and save creative selections, compositing decisions, edits, arrangements, redraws, animation cleanup, shader work, or sound changes when copyright protection matters. Keep layered files, version history, and review notes.
- Run rights review. Check visual and audio similarity, trademark conflicts, recognizable people, fictional characters, voice identity, and content-policy issues. Escalate a distinctive style imitation, unusual likeness, uncertain dataset, or missing indemnity to IP counsel.
- Document the final contribution. Record each human contributor, the AI material retained in the final file, the edits made, approvals, and the build or asset identifier. Prepare an accurate description of human authorship for any copyright registration.
- Re-check at submission. Review current storefront rules and the law in each launch territory immediately before submission. Answer AI-content questions accurately and preserve the submitted disclosure with the release build.
What an audit trail should contain

Storefront disclosure is a separate release decision
Platform rules change and do not follow one universal definition of AI content. Before submission, read the current developer documentation for every target storefront and answer its questions truthfully. Distinguish player-facing material—final art, sound, writing, or live-generated output—from behind-the-scenes assistance such as brainstorming, cleanup, or code suggestions, because a platform may classify those categories differently. Save the completed disclosure, policy version, and submitted build together.
Practical examples
Lower-risk production pattern
An artist generates several rough environment concepts under a plan that permits commercial use, selects a composition, redraws architecture, paints textures, replaces all recognizable logos, and records the edits and terms. The final scene is a human-directed composite, and the team can identify the licensed inputs and reviewers. Contract permission still needs verification, but the studio has stronger authorship and provenance evidence than it would for an untouched output.
High-risk pattern
A developer uploads a confidential character sheet and a celebrity photograph to a public service, asks for a famous actor’s voice and a living artist’s signature style, and ships the first result without checking the service’s sharing license or storefront rules. Potential confidentiality, publicity, trademark, copyright, contract, and platform problems exist independently of whether the provider labels the feature commercial.
If a claim arrives after launch
- Preserve the original prompt, input permissions, output, edits, terms snapshot, review notes, and build history; do not overwrite the record.
- Identify exactly which right is alleged: copyright, trademark, publicity, confidentiality, contract, or platform-policy violation.
- Pause new distribution of the disputed asset if counsel advises, and prepare a replacement or patch that does not destroy evidence.
- Check whether the provider offers an indemnity, what exclusions apply, and which party controls the defense.
- Have qualified counsel assess similarity, fair-use factors, authorship, and the laws of the affected territories.
Good records cannot guarantee a favorable result, but they let the studio explain its provenance, human contribution, permissions, and release decisions instead of reconstructing them after a dispute.
Bottom line for studio leads
Use AI assets commercially only through a documented chain of permission and human review. Confirm the provider contract, clear every input, add and record human creative contribution, test for similarity and likeness risks, preserve the complete provenance file, and verify storefront and regional rules immediately before release. That process supports lawful distribution and defensible copyright claims without pretending that a generated file is automatically original, exclusive, or risk-free.
