Sometimes, but not automatically. A company may be able to process a voice recording for a specific purpose, yet the right to use it for AI training or to identify you depends on the jurisdiction, the notice you received, the purpose, the recording’s source, retention and deletion practices, and whether the speaker is a child. Possessing an audio file does not grant unlimited permission for every later use.
Two activities are often confused: training a model with audio data and creating a biometric voiceprint to recognize a person. They can occur together, but they raise different legal and practical questions.
Audio recording, voiceprint and AI model: three different things
An audio recording is the captured sound file, such as a call, voice command or interview. A company can store, transcribe, review or analyze that file.
A voiceprint is a derived representation of vocal characteristics intended to recognize, verify or identify a speaker. It may be stored as a mathematical template rather than as a playable recording. Whether a particular template is legally treated as biometric information depends on the law and how it is used. Illinois law expressly lists a “voiceprint” as a biometric identifier and defines biometric information by reference to an identifier used to identify an individual. An AI model is the software produced or adjusted through training, fine-tuning or evaluation. A model may be trained on recordings without being used to identify the people who spoke, and a voice-identification system may use a template without training a general-purpose model on the original audio. The same company could nevertheless retain the recording, create a voiceprint, use clips to improve speech recognition and allow employees or contractors to review samples.

When a company uses recordings to train AI
Training use can include speech-recognition improvement, accent or noise handling, fraud detection, quality evaluation and fine-tuning a customer-service system. The company may use complete files, selected clips, transcripts, labels or human ratings. It may also send recordings to a service provider that performs transcription or model development.
The key issue is not simply whether the company calls the purpose “training.” It is whether the original collection and each later use match the notice, contract and law that apply to the speaker. A notice saying that recordings are used to provide a service may not clearly authorize indefinite retention, employee review or unrelated model development. Conversely, a company may have a legal basis other than consent in some jurisdictions, but it must still satisfy transparency, fairness, security and other requirements.

The post presents allegations and enforcement lessons, not a universal finding about every company’s practices. Questions specific to training
- Was the audio collected directly from you, supplied by someone else, or captured during a call involving multiple people?
- Did the notice describe model training, fine-tuning, evaluation or “service improvement,” and did it distinguish those purposes from providing the requested service?
- Are recordings de-identified, or can the company still connect clips and transcripts to your account, device, telephone number or voiceprint?
- Can human reviewers, contractors or model vendors access the raw audio?
- Does deleting the recording also remove copies in training datasets, evaluation sets, backups or derived products?
When a company identifies or verifies you by voice
Identification asks, “Who is this speaker?” Verification asks, “Does this speaker match the person who claims to be account holder?” A system may compare a live utterance with a stored template, search a database for a likely match or flag a voice associated with prior activity.
That process can create a voiceprint or another biometric template. The legal consequences can be different from ordinary audio processing. Illinois’s statute lists voiceprints among biometric identifiers. For covered entities, section 15 requires a written release before collecting or otherwise obtaining covered biometric identifiers or biometric information and requires a publicly available retention schedule and guidelines for permanent destruction. Review the statutory collection and retention text at 740 ILCS 14/15. The exact scope, exemptions, amendments and relevant case law must be checked for a particular dispute.
Do not assume that every recording becomes a regulated voiceprint. A file used only to transcribe a command may not be used as an identifier, while a system that extracts vocal features for account authentication is more likely to raise biometric-specific questions. The purpose, technical process and jurisdiction matter.

How jurisdiction changes the answer
Illinois and other biometric regimes
Illinois provides a clear example of why a separate analysis is needed for identification. If a private entity covered by the Act collects or obtains a voiceprint or related biometric information, the written-release and retention provisions may apply. A general privacy-policy statement is not automatically the same as the specific written release required by a statute. Whether an exception applies, where the collection occurred and how the system actually operated can change the result.

European Union: a legal basis is required
For processing governed by the General Data Protection Regulation, an organisation must identify an appropriate legal basis before processing personal data. The European Data Protection Board lists six possible bases: consent, contract, legal obligation, vital interests, public task and legitimate interests. Consent is therefore not the only possible basis, and the appropriate choice depends on the context. The EDPB’s explanation is at Legal basis.
A legal basis does not end the analysis. The organisation must still provide required information, respect purpose limitation and data-minimisation principles, apply security controls and honor applicable rights. Biometric processing used to uniquely identify a person can also involve additional GDPR conditions. Whether a particular voice system meets those requirements depends on its design and the facts.
United States consumer-protection enforcement
In the United States, the FTC can challenge deceptive or unfair practices involving sensitive data. A company that promises deletion but keeps recordings in a training set, or that discloses one use while secretly making another, may face consumer-protection scrutiny. The FTC’s biometric policy statement, dated May 18, 2023, describes biometric information as sensitive and discusses risks from misuse. It is agency policy and enforcement guidance, not a statute that independently answers every voice-recording question. See the FTC biometric information policy statement.
Children and COPPA
The Children’s Online Privacy Protection Act (COPPA) gives special attention to voice recordings. The FTC says an audio file containing a child’s voice is personal information under the rule. For covered operators, verifiable parental consent is generally required before collecting it.

The FTC has described a narrow policy for a temporary voice recording used solely to replace written words in a search or command. The recording must be held only briefly, used only for that purpose and deleted according to the operator’s stated policy. The operator still must give clear notice about collection, use and deletion, and cannot make another use before destruction. This limited treatment does not authorize training, profiling or identification from the child’s voice. Read the FTC’s guidance at FTC provides additional guidance on COPPA and voice recordings.
A practical investigation checklist
If you are assessing a real recording, collect facts before deciding whether the use was lawful. The following sequence helps separate the technical and legal questions.
- Pin down location. Record where the speaker was located, where the company is established and which service or subsidiary collected the audio. Privacy and biometric rules can depend on those connections.
- Save the notice. Keep screenshots, call scripts, sign-up language, consent screens and settings that appeared when the recording was made. Note whether the notice mentioned AI training, human review, voice authentication, sharing or retention.
- Describe the source. Identify who pressed record, whether all participants were informed, and whether the audio came from a device, customer-support call, workplace system or third party.
- Identify the actual operation. Ask whether the company stores raw audio, creates a transcript, extracts a voiceprint, authenticates an account, searches for a person, trains or fine-tunes a model, or performs only a short-lived command conversion.
- Map access and sharing. Find out which employees, contractors, cloud providers and other recipients can access the recording or derived template, and whether transfers cross borders.
- Check retention and deletion. Look for a stated retention period, deletion request process, backup treatment and an explanation of whether training datasets, model outputs or voice templates survive deletion.
- Check age and service coverage. Determine whether the speaker was a child and whether the service is directed to children or had actual knowledge of a child user. COPPA obligations depend on those facts.
- Compare settings with practice. If an account setting or separate choice controls “improve the service” or model training, document the setting at the time and any later changes.
What to ask the company
A focused written request can reveal whether the issue is ordinary audio handling, biometric identification or both. Ask the company to answer these points in plain language:

- Was a voiceprint or biometric template created, and is it used for identification, authentication, fraud prevention or another purpose?
- Who can access the raw files and derived data, including service providers and human reviewers?
- What is the retention period, and how do I request deletion of source files, transcripts, templates and copies in active datasets?
- Does deletion prevent future use of the data, or does a model, score, label or other derived product remain?
Keep the response, the applicable privacy notice and the date of your request. If the company refuses to explain the processing, gives conflicting answers or ignores a deletion request, consider contacting the relevant data-protection or consumer-protection authority and obtaining advice from a qualified privacy lawyer in the affected jurisdiction.

Common misconceptions and failure points
“I made the recording, so the company can do anything with it.”
Ownership or possession of a file does not settle permission for later uses. The collection context, contractual terms, privacy notice and applicable law still matter.
“If it is called anonymized, identification is impossible.”
Removing a name from a filename may not prevent re-identification if the audio, account metadata or a voice template can be linked back to a person. Ask what identifiers were removed and what the company means by anonymization.
“Consent is always required.”
Some laws require consent or a written release for particular biometric processing; others recognize additional legal bases. Under the GDPR, the EDPB lists six bases. The correct conclusion depends on the jurisdiction and purpose.
“Deleting the app deletes the voice data.”
Uninstalling software usually does not prove that server-side recordings, transcripts, backups, training copies or templates were destroyed. Use the provider’s documented deletion process and request confirmation.
“A short voice command can always be kept for improvement.”
The FTC’s COPPA policy for temporary child voice commands is narrow: the recording must substitute for written words, be held briefly, be used only for that purpose and then be deleted under a clear policy. It is not a general permission to retain or train on children’s voices.
How to reach a defensible conclusion
For a particular company, write the conclusion as a fact pattern rather than a blanket yes or no: identify the speaker’s location and age, the collection notice, the technical use, the company’s retention and deletion behavior, and the law that governs. A recording used briefly to transcribe a command presents a different question from a stored voiceprint used to authenticate an account or a dataset retained for model training.
The FTC’s Alexa materials illustrate why lifecycle details matter: lawful acquisition, access controls, retention, deletion rights and data-derived products all form part of the analysis. The same principles apply when evaluating another service, while the controlling rules may differ by country, state, sector and contract.
