A player with five or more years of Major League service generally cannot be assigned to a Minor League club without written consent. Separately, players with at least three years of service, qualifying prior-season Super Two status, or a previous outright may be able to elect free agency instead of accepting an outright assignment.
What “refusing an outright” means
An outright assignment moves a player’s contract from a Major League club to a Minor League club. The rules provide different protections: one can require the player’s written consent to a Minor League assignment, while others let a player choose free agency instead of accepting an outright. These are not interchangeable rights.
A player being designated for assignment (DFA) has not yet been outrighted. The DFA removes him from the 40-man roster and starts a process that can lead to a trade, a waiver claim, an outright assignment, or a release.
Which players can refuse or elect free agency?

The five-year protection is set out in Major League Rule 6(e)(1). The outright-based free-agency elections are in the 2022–2026 Basic Agreement. The MLBPA’s free-agency FAQ also summarizes the distinction, noting that a five-year player may refuse a Minor League assignment and that the refusal may result in free agency.

How the five-year consent rule is calculated
Major League Rule 6(e)(1) generally bars assigning a player’s contract anywhere other than another Major League club without written consent once he has at least five years of Major League service. The rule has a separate threshold of seven years when Military List service is counted. For this calculation, the rule treats 172 days as a full season and excludes service before or after a championship season.
This is an assignment-consent right, not the same as the Basic Agreement’s express election to become a free agent after an outright. The MLBPA describes refusal under the five-year rule as something that may result in free agency; the outcome should not be described as automatic in every case.

Who qualifies as a Super Two?
For the outright election, the relevant Super Two status is qualification at the conclusion of the prior season. Under the 2022–2026 Basic Agreement, the player must have had at least 86 days of Major League service in the preceding season and rank in the top 22 percent of players in the two-to-three-year service group. Super Two is a specific service-time classification; having roughly two years of service alone does not establish eligibility.
What happens after a DFA?
MLB’s DFA glossary says a club has seven days to trade the player or place him on outright or unconditional release waivers. If he clears outright waivers, the club may be able to assign him to the minors, subject to the player’s applicable consent protections and free-agency election rights. The DFA itself is not an outright and does not, on its own, trigger an outright-based free-agency election.

How to assess a particular player’s situation
- Check the transaction stage. Confirm whether the player has only been designated for assignment or whether his contract has actually been assigned outright.
- Check Major League service. Five or more years generally gives the player the Rule 6(e)(1) written-consent protection; three or more years can support the separate free-agency election after an outright.
- Check prior-season Super Two status. A qualifying Super Two player can have the outright election even without three years of service.
- Check outright history. Any previous career outright can create the election on a second or later outright, regardless of service time.
- Check the specific contract and transaction. A player’s exact rights depend on the applicable rules and the facts of the move; do not infer the result from a DFA announcement alone.
How this differs from ordinary six-year free agency
Ordinary free-agent eligibility is a separate route. The MLBPA describes it for a player with six or more years of service whose contract is unsigned for the next season. The consent and outright-election rules above concern a player’s rights during a Minor League assignment process and should not be conflated with that standard free-agent threshold.

The cited Basic Agreement covers 2022–2026 and identifies March 10, 2022 as its effective date; the MLBPA lists December 1, 2026 as the current agreement’s expiration date. These rules are current as of October 4, 2026. If a successor agreement takes effect, check its terms before relying on the service-time and outright-election provisions.
