AI can influence how prices and promotions are recommended, but that does not mean every grocery shopper sees a personalized price—or that AI autonomously sets McDonald’s menu prices. A price difference can also come from location, timing, store inventory, channel, promotions, or fees. Here is how to tell those mechanisms apart and what the current evidence says.

What does “AI pricing” mean for shoppers?

The phrase can describe several different practices. They matter because a changing price is not automatically a price tailored to you.

Mechanism What may drive it What it does—and does not—show
Manual or local pricing A business or franchisee chooses prices, potentially reflecting local costs and market conditions. A difference between locations does not by itself show that an algorithm or personal data set the price.
Algorithmic recommendation Software analyzes data and suggests a price or promotion to a human decision-maker. A recommendation is not the same as an automated price change; a person or business may accept, change, or reject it.
Demand- or inventory-based dynamic pricing Market conditions, demand, or stock levels. Prices may vary over time or by location without being individualized to a particular shopper.
Individualized, or “surveillance,” pricing Personal data or inferred attributes are used to tailor a price or offer to a consumer. This is the practice most directly associated with one shopper being offered a different price because of information about them.

The Federal Trade Commission (FTC) discusses dynamic and surveillance pricing as related but distinct issues. Its FAQ says demand- or inventory-based dynamic pricing can be used if pricing information is not misleading; that statement is not a resolution of every legal issue or jurisdiction. The FTC’s explainer on surveillance pricing and its FAQ on pricing and fees provide context.

Can AI change the price of a Big Mac?

McDonald’s says it does not use dynamic pricing and that AI does not set menu prices. In a corporate statement dated October 1, 2026, the company said, “AI does not set the price of a Big Mac or any other menu item,” and, “McDonald’s does not use dynamic pricing.” Those are the company’s claims, not independent findings. Read McDonald’s explanation of how it says prices are set.

An Associated Press report published October 6, 2026, covered a lawsuit alleging that an AI-enhanced tool recommends prices to franchisees using store-level data and other factors. McDonald’s responded that franchisees set prices and the tools do not automate or fix them. The lawsuit’s account is an allegation, and the company’s response is its position; neither establishes that AI independently sets every restaurant’s prices. The case may develop. Are grocery stores charging different shoppers different prices?

There is evidence that pricing intermediaries work with businesses, including in grocery, and that personal data can be among the inputs used to develop pricing or promotions. That does not establish that every grocery chain—or every item—is individually priced for each customer.

In its initial 2025 study findings, the FTC said pricing intermediaries had at least 250 clients across sectors including grocery. It described potential inputs such as consumer data, location, time, and purchase channel. The figure refers to intermediary-client relationships across sectors; it is not a count of grocery chains proven to charge personalized prices. See the FTC’s study announcement.

A separate consumer investigation found that volunteer shoppers encountered differing prices for some identical grocery products on Instacart in 2025. Consumer Reports’ December 22, 2025 follow-up said Instacart ended the item-price tests. This is evidence about the reported experiment, not proof that the same tests continue or that all shoppers generally receive personalized grocery prices. Does a digital shelf label mean prices will change every hour?

No. A digital label is a way to display a price; its presence alone does not establish how often that price changes or what determines it. The price could remain stable, be updated to reflect a local decision, or be changed for other reasons. A label by itself is not evidence that the store is using personal data to charge you more.

How can you tell whether a grocery price is personalized?

A single price difference is not enough to identify its cause. To make a useful comparison, match the conditions as closely as possible:

  1. Compare the exact same product and size, at the same store.
  2. Use the same shopping channel—such as the retailer’s app, its website, or an in-store shelf—and compare at a similar time.
  3. Check whether a promotion, loyalty status, or account-specific offer applies.
  4. Compare the final checkout total, including delivery, service, and other fees, rather than only the item price.

Record the location, time, channel, loyalty status, promotion, and fees if totals differ. These checks can help identify ordinary explanations, but they cannot prove whether a pricing algorithm used personal data.

What should you do if the same item costs more online?

First separate the item price from the total. An online order may include a different promotion or delivery and service fees, and it may reflect a different store or fulfillment channel. Recheck the item, size, store, and timing before treating the difference as evidence of personalization. If the item price itself differs, note the conditions and ask the retailer how the price or offer was determined; a difference alone cannot tell you whether personal data was involved.

What is the FTC’s position on personalized pricing?

In August 2026, the FTC sought public comment on a proposed enforcement policy statement regarding personalized pricing. The agency said undisclosed use of personal data to set prices may violate laws it enforces. Seeking comment on a proposed policy is not a blanket ban, and the announcement does not establish that a particular retailer has broken the law. Read the FTC announcement.

The practical distinction is between a price that changes for market or operational reasons and one tailored using information about an individual. Current evidence supports concern about algorithmic recommendations and data-driven pricing practices, but it does not support assuming that every different grocery total—or a Big Mac’s menu price—was individually set by AI.
