Yes, a shop may generally refuse a UPI payment in India. The official tax guidance does not create a universal rule that every shop must accept UPI or display a QR code. It identifies a specific exception: a business whose sales, turnover or gross receipts exceeded ₹50 crore in the immediately preceding year must provide prescribed electronic payment modes, including BHIM-UPI and a BHIM-UPI QR code.

That distinction matters. A refusal at the counter is not automatically an unlawful act, and it is not the same as a UPI transaction that was initiated but failed, was delayed or was unauthorised.

What the law actually requires

Section 269SU of India’s Income-tax Act, together with the related Rule 119AA guidance, targets businesses above a defined prior-year threshold. The Income Tax Department and CBDT materials state that a business whose sales, turnover or gross receipts exceeded ₹50 crore in the immediately preceding year must provide the prescribed electronic payment facilities.

The rule is about the business’s legal coverage and its obligation to provide specified payment modes. It is not evidence that every retailer, professional, stall or small shop has the same duty.

The threshold is based on the previous year

The ₹50 crore test is not a limit calculated from the customer’s bill or from the shop’s current-day sales. It refers to the business’s sales, turnover or gross receipts in the immediately preceding year. A customer usually cannot establish that figure while standing at a counter, and a shop’s appearance or location does not prove whether it crosses the threshold.

Which payment modes are prescribed?

The official guidance lists RuPay debit card, BHIM-UPI and a BHIM-UPI QR code among the prescribed modes. The legal requirement therefore concerns the provision of the listed facilities, not just a generic promise to accept “digital payments.”

What is the stated penalty?

The Income Tax Department says that failure by a covered business to provide the prescribed electronic modes can attract a penalty of ₹5,000 per day under section 271DB. This is a compliance penalty imposed in relation to the business’s statutory obligation. It is not an automatic refund, discount or compensation payable to a customer whose UPI offer was refused.

Two situations that should not be confused

Situation What is established What a customer should do
Business that crossed ₹50 crore in the immediately preceding year The official guidance describes a duty to provide the prescribed modes, including BHIM-UPI and BHIM-UPI QR. Ask which prescribed modes are available. If you believe a covered business is not providing them, record the business details and seek advice through the appropriate tax or legal channel.
Business for which that threshold-based obligation is not established The official materials reviewed do not establish a universal UPI-acceptance duty for every such shop. Ask what payment methods the shop accepts and use an available alternative if practical.

This comparison does not settle every possible state-law, sector-specific, contractual or consumer-law question. Those issues can depend on the location, industry, licence, contract and facts of the dispute.

Does every shop have to display a UPI QR code?

No universal QR-display requirement is established by the official materials described above. A BHIM-UPI QR code is one of the prescribed modes for a business that falls within the specified threshold-based rule. That does not turn every shop’s counter into a legally mandated UPI point.

There is also a practical difference between a QR code being physically displayed and a payment system being operational. A code can be missing, damaged, linked to a closed account or temporarily unavailable. Conversely, a shop may accept UPI through another approved arrangement without placing a large code at the front of the counter. The legal question for a covered business is whether the prescribed facility is provided, not whether a particular poster is present.

How a merchant gets UPI capability

UPI acceptance requires merchant-side infrastructure. NPCI’s UPI FAQ explains: “To enabling UPI system, merchant need to partner with the acquirer bank. Acquiring bank will provide the UPI infrastructure to merchant.”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

In practice, the acquiring bank connects the merchant’s account and payment setup to the UPI network. A QR code, soundbox, point-of-sale device or online checkout can be part of that setup, but the exact equipment and workflow vary. A customer cannot create a working merchant acceptance facility merely by transferring money to a personal number without confirming the payee and the seller’s instructions.

Why a shop might refuse a UPI payment

A refusal can have an operational explanation rather than a conclusion about the law. For example, the merchant may not have enabled UPI, the acquiring-bank service may be unavailable, the QR code may belong to a different account, or the seller may be following a stated payment policy. Network or device problems can also make a merchant unable to confirm a payment immediately.

These possibilities do not excuse a covered business from a statutory obligation if the rule applies to it. They simply explain why the fact of refusal alone does not prove either compliance or non-compliance. Do not assume that a shop is above or below ₹50 crore based on a single interaction.

What to do when UPI is refused at the counter

  1. Ask what payment methods are accepted. A merchant may offer cash, card, bank transfer or another digital method even when it does not accept your UPI request.
  2. Confirm whether the issue is temporary. Ask whether the QR or UPI service is down, whether another QR is available, or whether the cashier can accept a different method.
  3. Do not send money to an unverified account. Check the displayed payee name and amount before authorising a payment. A transfer to the wrong account can create a separate recovery problem.
  4. Keep basic evidence if the dispute matters. Note the shop name, address, date, amount, the payment methods advertised and what the staff said. A photograph of a displayed notice may help, provided you respect privacy and local rules.
  5. Separate refusal from a transaction failure. If you never authorised a payment, there is no UPI transaction to reverse. If you did authorise one, use the transaction-support route described below.

If an alternative is available and the purchase is urgent, using it may be the simplest solution. A customer generally cannot establish the merchant’s turnover at the counter, so an argument based only on the presence of a QR code or the size of the shop is unlikely to resolve the legal question immediately.

  • Refused before payment: the merchant declined the method or no usable facility was offered. There may be no transaction reference to investigate.
  • Pending or failed payment: you authorised the transfer, but the status has not completed. Do not pay again until you check the transaction status and your bank account.
  • Successful debit but merchant says it was not received: save the transaction reference, time, amount and payee details, then raise a complaint through your participating bank’s UPI app.
  • Unauthorised transaction: report it promptly through your bank’s official fraud and dispute channels. This is a security complaint, not a question about whether the shop had to accept UPI.

NPCI’s guidance directs consumers to raise or check a UPI transaction grievance through the participating bank’s UPI app. That process is designed for transaction support; it does not automatically decide every disagreement about a merchant’s refusal policy.

Where a merchant should seek help

A merchant with a UPI transaction problem should contact its acquiring bank. The acquiring bank is the institution that provides the merchant’s UPI infrastructure and can investigate settlement, QR, device or transaction-status issues. A consumer should normally begin with the bank or UPI app used for the payment instead.

Can you report a shop for refusing UPI?

You can document the incident and seek advice, but the correct route depends on what you are alleging. If the issue is a debit, pending status, wrong beneficiary or suspected fraud, use the participating bank’s UPI grievance process. If you believe a business is covered by the ₹50 crore threshold and is not providing the prescribed modes, the relevant question is its tax-law compliance, not simply whether one cashier declined your preferred method.

Do not describe the incident as proof of a section 271DB violation unless the business’s coverage and the underlying facts are established. The stated ₹5,000-per-day amount is a compliance penalty for a covered business; it is not a customer claim that can be demanded at the till.

What is not settled by the official guidance

The official materials used for this explanation establish the threshold-based Income-tax requirement, the listed modes, the stated penalty and the NPCI support routes. They do not provide a complete survey of every state rule, sector-specific requirement, contract term or consumer-law remedy that might affect a particular dispute.

Payment rules can also change. The threshold, prescribed modes and enforcement details are time-sensitive, so check the current Income Tax Department or CBDT material before relying on them in a formal complaint. For a significant dispute, obtain advice from a qualified professional who can examine the business, state and transaction facts.

Common questions

Is refusing UPI illegal for a small shop?

Not automatically. The official guidance reviewed does not establish a universal duty for every shop. The specific obligation described applies to a business whose prior-year sales, turnover or gross receipts exceeded ₹50 crore and covers the prescribed modes.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can a shop accept cards but refuse UPI?

The fact that a shop accepts one electronic method does not, by itself, prove that it is subject to every other payment obligation. Ask which methods are available and consider the threshold-based rule only if the business’s coverage is established.

Does a printed QR code prove that UPI acceptance is legally required?

No. A QR code shows that some UPI arrangement may have been set up, but it does not establish the business’s prior-year turnover or resolve whether the service is currently working.

Who handles a UPI complaint?

For a consumer transaction problem, use the participating bank’s UPI app grievance process. A merchant should contact its acquiring bank. These channels address transaction issues and do not automatically adjudicate every refusal dispute.
