Yes—if the financing is secured by your home or property. A home-equity loan, home-equity line of credit, or another loan with a mortgage, deed of trust, or security agreement can give the lender a lien and make the house vulnerable to foreclosure after a serious default. But “home-improvement loan” is not a legal category that answers the question by itself. An unsecured installment loan used to pay a contractor usually does not give the bank a consensual mortgage lien. A contractor, subcontractor, or supplier may still assert a separate mechanic’s lien under state law, and PACE financing creates a property-tax assessment that can expose the property to a tax sale.

What determines whether your home is subject to a lien?

The signed documents and the law of the state where the property sits control. Start by identifying who is claiming an interest and what event created it:

  • Lender’s consensual lien: You agreed to pledge the home as collateral in a mortgage, deed of trust, or security agreement.
  • Unsecured credit: You borrowed based on your promise to repay, without granting the lender an interest in the real estate.
  • Contractor or supplier mechanic’s lien: A party that furnished labor or materials may have a statutory claim for unpaid work, even though it is not your loan lender.
  • PACE assessment: Certain energy-improvement financing is collected through the property-tax bill and can create tax-sale exposure if unpaid.

These categories can overlap. For example, a homeowner might have an unsecured bank loan and a contractor dispute at the same time, or a secured home-equity loan plus a separate supplier lien. The fact that loan proceeds paid for repairs does not identify the security arrangement.

How a secured home-improvement loan works

The document that creates the interest

A secured loan normally includes a promissory note (your promise to pay) and a separate instrument that grants a security interest in the property. Depending on the state, that instrument is commonly called a mortgage or deed of trust. A security agreement may also describe the collateral. The paperwork should identify the property by a legal description, not merely by its street address.

Read the sections labeled “security interest,” “collateral,” “mortgage,” “deed of trust,” “default,” and “acceleration.” A clause allowing acceleration means the entire unpaid balance can become due after a defined default. The lender generally must follow state foreclosure procedures before taking ownership or forcing a sale; a missed payment does not instantly transfer the house.

What the CFPB says about home-equity borrowing

The Consumer Financial Protection Bureau explains that a home-equity loan lets a borrower use “the equity in your home as collateral.” It also warns that if the borrower cannot repay, “the lender could foreclose on your home.” The CFPB consumer answer was last reviewed September 11, 2024. Those statements describe the risk of collateralized home-equity credit; they do not classify every loan marketed for remodeling as secured.

Recording and priority

A mortgage or deed of trust is typically recorded in the county land records. Recording gives public notice and establishes priority under state recording rules. A lender may require title work, an appraisal, insurance, or payoff of earlier liens before funding. A later lien may be subordinate to an earlier mortgage, but priority is highly state-specific and can be affected by statutory exceptions, recording dates, notices, and bankruptcy. Do not infer priority from the order in which bills arrived.

When a home-improvement loan is unsecured

An unsecured installment loan can be used for a roof, kitchen, or other project without giving the bank a mortgage lien. The lender can still sue for the debt, obtain a judgment, or use collection remedies allowed by law, but that is different from a consensual lien against the house. Your loan’s advertising, interest rate, or intended use does not prove that it is unsecured.

Look for the absence of a mortgage or deed of trust and for language stating that no real estate is collateral. Keep in mind that a separate creditor could still claim a statutory lien. The CFPB’s Regulation Z commentary gives an example in which a contractor that is not a party to an unsecured bank loan is paid with the loan proceeds; that contractor’s independent lien questions are not automatically resolved by the bank’s loan documents. The commentary is addressing federal rescission analysis, not deciding every state-law lien issue.

Can a contractor, subcontractor, or supplier put a lien on the house?

Why a mechanic’s lien is different

A mechanic’s lien (also called a materialman’s or construction lien in some jurisdictions) is a statutory claim for qualifying labor or materials. It is not the lender’s mortgage. A contractor, subcontractor, or supplier may assert one when it says it was not paid, even if you paid the general contractor or financed the job. Whether that is possible, the required notices, filing deadline, amount, priority, and enforcement process depend on state law.

The Regulation Z distinction

Official CFPB Regulation Z commentary describes a security interest that may arise from “a mechanic’s or materialman’s lien that is retained by a subcontractor or supplier of the contractor-creditor.” It separately discusses a lien obtained by a contractor that is not part of the credit transaction and is merely paid from an unsecured bank loan. The distinction shows why the parties and contracts matter: a contractor-creditor transaction can have different federal disclosure and rescission treatment from an independent contractor paid with unsecured loan proceeds. It does not tell you whether a lien is valid in your state.

What to do if you receive a lien notice

  • Request the recorded lien, preliminary notice, and an itemized statement of the alleged unpaid amount.
  • Compare the claim with your contract, change orders, invoices, cancelled checks, and proof of payment.
  • Confirm the filing date and every deadline to contest, bond off, or release the lien. Deadlines can be short.
  • Notify the lender or title insurer if the documents require it, but do not assume the lender will resolve a contractor’s separate claim.

How PACE financing changes the risk

Property Assessed Clean Energy (PACE) financing is repaid through property taxes rather than ordinary monthly loan billing. The CFPB says those payments raise the tax bill and warns that unaffordable payments can put a homeowner at risk of losing the property through a tax sale. This is a property-tax assessment risk, not proof that every PACE provider records a conventional mortgage.

Before signing, examine the assessment agreement, the projected tax-bill increase, payment schedule, transfer or sale rules, and what happens if taxes are delinquent. Check the actual property-tax bill after the assessment begins. A tax authority’s collection rights and the assessment’s priority over other interests are governed by applicable state and local rules.

Home-equity lines and existing mortgages

A home-equity line of credit (HELOC) is open-end credit secured by a dwelling. CFPB Regulation Z § 1026.40 and its commentary address these plans, including circumstances in which a senior lien may adversely affect the creditor’s security. In practical terms, a HELOC can be secured even when the balance changes as you draw and repay. Review the recorded instrument, draw period, repayment period, variable-rate terms, minimum payment, and default provisions.

An existing first mortgage does not prevent a second lien, but it can affect approval, available credit, priority, and foreclosure economics. The documents should state whether the new lender is in first or junior position and whether it may require subordination or consent from an earlier lienholder.

How to find out whether your particular loan is secured

  1. Gather every signed document. Locate the note, mortgage or deed of trust, security agreement, contractor-financing contract, disclosures, amendments, and payment records.
  2. Search for collateral language. Terms such as “encumber,” “grant a security interest,” “real property,” “legal description,” “mortgage,” “deed of trust,” or “foreclosure” are warning signs that the home is pledged.
  3. Check the default section. Identify the missed-payment threshold, cure period, acceleration clause, late charges, and enforcement remedies.
  4. Search county land records. Use the recorder, clerk, or land-registry office for the county where the property is located. Search under the owner’s name and the parcel or legal description for a mortgage, deed of trust, assignment, release, or mechanic’s lien.
  5. Inspect the tax bill for PACE. Look for a separate assessment or program charge and obtain the underlying assessment documents.
  6. Ask written questions. Request the lender’s answer to whether the loan is secured, the recording information, the current payoff, and the steps for releasing the lien after payment.
  7. Escalate urgent disputes locally. If a foreclosure, tax-sale, or lien-enforcement deadline is pending, contact a qualified lawyer or legal-aid provider in the property’s jurisdiction immediately.

Comparison of common financing and lien situations

Situation What may burden the property Default or nonpayment risk What controls the result
Home-equity loan Mortgage or deed of trust securing the home Foreclosure risk after the lender follows required procedures Signed documents, recording, and state foreclosure law
HELOC Open-end security interest in the dwelling Collection and possible foreclosure; terms can change as draws and repayments occur HELOC agreement, Regulation Z disclosures, recorded lien, and state law
Unsecured installment loan No consensual mortgage if the documents truly exclude real estate collateral Debt collection or judgment remedies; a separate contractor lien may still arise Loan contract plus any independent state-law claim
Contractor, subcontractor, or supplier claim Mechanic’s or materialman’s lien, if authorized and properly perfected Potential enforcement sale or payment dispute, subject to statutory procedures State notice, filing, priority, deadline, and proof-of-work rules
PACE financing Property-tax assessment or related program interest Tax collection and possible tax sale if assessments are unpaid Assessment documents, tax records, and state/local PACE law

Common mistakes that create avoidable exposure

  • Relying on the product name: “Home-improvement loan” describes purpose, not collateral.
  • Signing only the contractor’s summary: The legally important grant may be in a separate mortgage, deed of trust, or security agreement.
  • Assuming payment to the general contractor ends all claims: A subcontractor or supplier may have its own notice and lien rights.
  • Ignoring a recorded document: A lien can remain visible in land records after the project is finished until it is released or otherwise resolved.
  • Missing short deadlines: Mechanic’s-lien contests, bond procedures, foreclosure cures, and tax-sale redemptions can have strict local time limits.
  • Treating PACE like ordinary unsecured credit: The charge appears through property taxes, so monitor the tax bill and escrow calculations.

Questions to ask before signing

  • Is my home collateral, and exactly which document grants the interest?
  • Will you record a mortgage or deed of trust, and in what lien position?
  • What events trigger acceleration, foreclosure activity, or other enforcement?
  • Could the contractor, subcontractor, or supplier file a separate lien, and what notices will I receive?
  • For PACE, how much will the annual property-tax bill increase, and what happens if I sell or refinance?
  • What document proves release of the lien after payoff, and who records it?

Keep the answers with the final signed documents. If a salesperson’s explanation conflicts with the contract, treat the written agreement and applicable law as the issues requiring professional review.

When professional help is urgent

Seek local legal help promptly when you receive a foreclosure notice, tax-sale notice, recorded mechanic’s lien, lawsuit, or demand with a short response deadline. Bring the complete loan and construction file, payment proof, tax bills, and land-record copies. Federal CFPB materials explain the categories and risks, but they cannot determine whether a particular lien is valid, what priority it has, or which deadline applies in your state.
