Usually, yes—if “full pre-deposit” means the entire disputed GST demand. A first appeal normally requires payment of the tax you admit is payable plus the statutory pre-deposit on the remaining disputed tax; it does not require payment of the whole demand. Once those conditions are met, recovery of the balance is deemed stayed.

The answer changes if you cannot pay even the statutory pre-deposit. Financial hardship does not give the appellate authority a routine power to waive or reduce a mandatory deposit. An appeal may still be viable where an earlier payment can be credited, a special statutory procedure applies, or a constitutional court grants case-specific relief.

What “full pre-deposit” can mean

Taxpayers often use “full pre-deposit” to describe two different amounts. The distinction determines whether an appeal can be filed.

What you cannot pay Normal consequence
The entire disputed demand Usually not a bar. The statute generally requires the admitted amount and the prescribed deposit on the disputed tax, not payment of the whole demand.
The statutory pre-deposit itself Normally a bar to a valid statutory appeal unless a prior payment is credited, a special rule applies, or a court grants relief on the facts.
An amount already paid but not linked to the demand The payment may be usable, but only after its record and allocation in the electronic liability register are established.

Do not assume that a notice, recovery order or portal balance automatically shows the amount that counts. The relevant figures are the admitted portion, the remaining disputed tax, payments already recorded against that demand, and the stage of appeal.

Current GST pre-deposit framework

First appeal under section 107

A first appeal to the Appellate Authority is generally due within three months from communication of the decision or order. A further period of one month may be available where sufficient cause is shown. The appellant must pay any amount of tax, interest, fine, fee or penalty that is admitted as payable and the statutory pre-deposit calculated on the remaining disputed tax.

The 2024 amendment discussed by the GST Council took effect on 1 November 2024. For the central framework described in that material, the disputed-tax pre-deposit at the section 107 stage is 10 percent. The amount is calculated on disputed tax, not automatically on every component of the order. Interest, fine, fee or penalty that is admitted is dealt with as an admitted amount; an item that is genuinely disputed is treated according to the applicable provision and order type.

Appeal to the GST Appellate Tribunal under section 112

The same amendment set the disputed-tax deposit at the Tribunal stage at 10 percent, with a maximum of ₹20 crore for the section 112 deposit. The exact amount and whether a payment is treated as an additional stage deposit must be checked against the operative amended Act, the applicable State or Union Territory enactment and the current portal instructions.

A CBIC statute page may still display older section 112 wording referring to 20 percent. That older display should not be quoted as the current requirement without checking the amendment that took effect on 1 November 2024. The GST Council’s 55th meeting agenda is explanatory material; the enacted, operative text controls.

Appeal level What is normally payable Important qualification
Appellate Authority, section 107 Admitted amounts plus 10% of remaining disputed tax Check the communication date, order type and the law applicable in the relevant State or Union Territory.
Appellate Tribunal, section 112 10% of disputed tax at that stage The deposit is subject to a ₹20 crore maximum; verify the amended statutory wording and whether an earlier payment is credited.

When the required payment and filing conditions are satisfied, recovery proceedings for the balance covered by the appeal are deemed stayed. That stay follows statutory compliance; it is not created merely by saying that the demand is under challenge.

How to calculate the amount before filing

  1. Identify the order and appeal level. Confirm whether you are challenging an adjudication order in a first appeal or an order that belongs before the Tribunal.
  2. Separate admitted and disputed items. Mark the tax, interest, fine, fee and penalty that you accept. Keep the disputed-tax figure separate because the pre-deposit percentage is applied to disputed tax under the relevant provision.
  3. List every payment already made. Include payments made with the return, through a demand payment flow, during recovery, or through DRC-03. Record the date, challan or reference number and the demand to which the payment was intended to relate.
  4. Check the electronic liability register. A payment only helps if the records show that it is available for this demand or can lawfully be allocated to it.
  5. Apply the current stage percentage and any cap. Use the operative central amendment and the corresponding State or Union Territory law, rather than an old calculator, portal screenshot or secondary article.
  6. Preserve the calculation. Save the order, communication proof, ledger extract, challans and a worksheet showing admitted amount, disputed tax, statutory deposit and credit claimed.

Illustration: if the remaining disputed tax is ₹12 lakh, the statutory 10-percent component described above is ₹1.2 lakh, before considering any admitted amount or credit for an earlier payment. This is only an arithmetic example; the order’s classification and the applicable enactment determine the legally payable figure.

If you cannot pay the required deposit

First, test for an existing credit

CBIC guidance explains how to allocate a payment to a demand through the electronic liability register. Certain payments originally made through DRC-03 can be adjusted through DRC-03A. Whether a particular payment counts depends on how it appears in the records, what demand it was linked to and whether the adjustment procedure is available for that payment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not treat a bank debit or an unallocated cash balance as automatic pre-deposit credit. Obtain the ledger view and the demand-wise allocation. If the portal shows the money against a different liability, correct the allocation, where permitted, before relying on it in the appeal.

Then check whether a special rule applies

The ordinary percentage framework may not answer every case. Penalty-only orders, detention or seizure orders and other special categories can have different appeal provisions or payment consequences. Read the operative section and the order type before assuming that the standard disputed-tax calculation applies.

Do not rely on hardship as an automatic waiver

An inability to arrange funds is not, by itself, a general statutory exemption. The Appellate Authority cannot ordinarily invent a power to waive or reduce a mandatory deposit because the taxpayer is facing cash-flow difficulty. Filing an incomplete appeal, or merely attaching a hardship letter, does not create the statutory stay.

A writ petition can raise a different question, but relief is exceptional and fact-specific. A court may examine jurisdiction, procedural unfairness, an incorrect demand calculation, or whether money already deposited was wrongly ignored. No taxpayer should assume that a court will replace the statutory deposit with a general hardship waiver.

What recent court decisions show

Gaurav Jain & Anr. v. Joint Commissioner (Appeals-II), CGST — Delhi High Court, 31 July 2026

The taxpayers sought hardship-based relaxation from the Appellate Authority. The court treated the deposit as a statutory condition and noted that the authority had no statutory or inherent power to waive or reduce it. The case was decided on whether a 2025 amendment applied to those taxpayers, while the constitutional challenge and an alternative request for waiver or reduction through writ jurisdiction were left open.

The practical lesson is limited but important: an appellate officer cannot grant a general affordability waiver simply because the taxpayer asks for one. The decision does not establish that every financially distressed taxpayer is entitled to writ relief.

Allahabad High Court order dated 20 January 2026

In a separate matter, the court set aside a rejection and directed the authority to decide the appeal without insisting on a further deposit. The record concerned money that had already been deposited and whether it should be adjusted against the demand. That is a credit and adjustment result, not a rule that hardship excuses the pre-deposit in ordinary cases.

When the GST Tribunal is not operational

CBIC Circular 224/18/2024-GST describes a route for taxpayers who want to preserve their section 112 position while the Tribunal is not operational. The circular does not turn inability to pay into a waiver. Instead, it describes a payment-and-undertaking process.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Use the portal’s payment-towards-demand flow to pay an amount equal to the required Tribunal deposit against the relevant demand.
  2. Retain the payment reference and confirm that the amount is linked to the correct demand in the liability records.
  3. Provide the undertaking or declaration required by the circular, stating that the appeal will be filed when the Tribunal becomes operational and within the relevant time limits.
  4. Monitor the Tribunal’s operational status and the applicable filing deadline. Do not assume that the temporary route extends every limitation period indefinitely.
  5. Keep evidence of each condition. The circular states that recovery of the balance will stand stayed when its conditions are met.

This route is different from asking an officer to reduce the statutory percentage. It is a transitional procedure for preserving the appeal position while the designated forum is unavailable.

How to file a first appeal on the GST Portal

The GST Portal FAQ identifies FORM GST APL-01 for the first appeal. It describes the final acknowledgment in FORM GST APL-02 as the point at which the appeal is considered filed.

  1. Sign in to the GST Portal and open the appeals function for the relevant order.
  2. Select the order being challenged and verify the date on which it was communicated. The three-month period is measured from communication, not from an assumed date.
  3. Enter the admitted liability and the disputed-tax amount. Reconcile the figures with the order and your worksheet.
  4. Enter or confirm the pre-deposit payment and attach evidence of any earlier payment claimed as credit.
  5. Upload the statement of facts, grounds of appeal, order, authorisation and supporting documents required by the portal and applicable rules.
  6. Submit FORM GST APL-01 using the permitted authentication method.
  7. Download the acknowledgment and later confirm issuance of FORM GST APL-02. Keep both with the payment and ledger records.

The portal FAQ has wording that a lower percentage may be declared after approval by competent authorities. That statement should not be read as a general hardship discretion for an appellate officer. Before relying on any reduced amount, identify the precise statutory or notified authority for it and confirm that the current portal permits the route.

Common failure points and how to correct them

  • Using the old Tribunal percentage: Recheck the amendment effective 1 November 2024 and the operative section 112 text instead of relying on a page that still shows 20 percent.
  • Calculating on the whole demand: Separate admitted amounts and disputed tax. The statutory percentage is not automatically applied to every rupee in the order.
  • Ignoring an earlier payment: Obtain demand-wise ledger evidence and use the available allocation or DRC-03A process where it applies.
  • Missing the communication date: Preserve the email, portal notice, physical delivery record or other proof that establishes when the limitation period began.
  • Assuming a filed draft is an appeal: Follow the portal through final acknowledgment in FORM GST APL-02 and save the acknowledgment number.
  • Confusing a special order with a tax-demand order: Detention, seizure and penalty-only matters may follow different provisions.
  • Expecting a hardship letter to stop recovery: The statutory stay follows compliance with the payment and filing conditions, or a specific court or statutory direction.

Checklist before deciding whether to file

  • Is this a section 107 first appeal or a section 112 Tribunal appeal?
  • What tax, interest, fine, fee or penalty is admitted?
  • What is the remaining disputed tax after that admission?
  • What percentage and cap apply under the current central and State or Union Territory provisions?
  • Has any amount already been paid, and is it allocated to this demand in the electronic liability register?
  • Was a DRC-03 payment made, and is DRC-03A adjustment available?
  • When was the order communicated, and has the statutory filing period expired?
  • Is the order a penalty-only, detention, seizure or other special category?
  • If the Tribunal is unavailable, have the circular’s payment, undertaking and timing conditions been met?
  • Are you seeking ordinary statutory filing, correction of a payment-credit error, or exceptional writ relief? Those are different legal routes.

Bottom line for taxpayers facing a cash shortfall

You normally do not need to pay the entire disputed GST demand to pursue an appeal. You generally must pay the admitted amount and the applicable statutory pre-deposit, and you should verify whether an earlier payment can satisfy some or all of that requirement through the liability-register records.

If you cannot pay even the required deposit, do not assume that financial hardship alone permits filing or creates a stay. Check for a lawful credit, a special procedure such as the transitional Tribunal route, or case-specific advice on court relief. Because State and Union Territory provisions, portal instructions and later decisions can change, calculate the amount from the current operative law and the actual order before the limitation period expires.
