Buy a genuine physical disc or cartridge from a seller with clear photos, authenticity checks, returns, and payment protection if your priorities are control, resale, lending, and preservation. Physical media gives you a particular copy you can usually transfer under applicable first-sale rules. It does not, however, guarantee that the game will run without patches, an account, proprietary hardware, or an operating server.
Digital purchases are generally account-bound licenses, while subscriptions provide continuing access only while the service and your membership remain active. Use those formats for convenience or experimentation, not as a substitute for a durable, transferable copy unless the specific terms clearly say otherwise.
What you are actually buying
The word “buy” describes several different arrangements in games. The format determines whether you receive a tangible copy, a restricted license, or temporary access.
Physical disc or cartridge
A disc or cartridge is a particular, tangible copy. In the United States, the Department of Justice describes the first-sale doctrine in 17 U.S.C. §109 as giving someone who lawfully purchases a copy the right to “sell, display or otherwise dispose of that particular copy,” subject to statutory qualifications. That normally supports resale or lending of the copy itself, rather than transfer of a publisher account or a separately licensed digital entitlement.

First-sale rights are jurisdiction-specific. Consumer, copyright, contract, and import rules differ outside the United States, so do not assume that a US rule applies where you live. A physical package can also contain a one-time code, online pass, or account requirement that does not transfer with the disc or cartridge.
Digital console or PC purchase
A storefront’s Buy button commonly grants a license governed by account, device, digital-rights-management (DRM), and storefront terms. Federal Trade Commission consumer guidance warns that clicking “buy” may provide only a license and that access can depend on the seller remaining in business. Microsoft’s digital-goods rules, for example, state that digital-good licenses generally may not be transferred or resold. PlayStation directs customers to product-specific usage terms and separates digital terms from its physical-goods cancellation and refund rules.
A licensed download can remain available for years, but continued access may depend on the account, a compatible console or PC, a redownload service, activation checks, or a functioning authentication server. A platform closure, account suspension, delisting, hardware failure, or DRM change can affect access even when the transaction was described as a purchase.

Subscription or streaming access
A subscription is access contingent on your membership and the service continuing to operate. Catalog games can be removed, licenses can expire, and streaming versions can disappear when a provider changes its servers or agreements. Unless the terms clearly grant a durable and transferable copy, treat a subscription as rental-like access. Check whether an installed game works offline, how often it must re-authenticate, and what happens when your membership ends.

How to choose the safest format for your goal
Choose physical media when control and resale matter
Start with a genuine physical video game disc or cartridge when you want to lend the game, recover part of its cost, or keep a copy outside a single account. Prefer editions that include the playable program on the media and do not rely entirely on a download code. Verify whether the disc or cartridge is region-locked, whether the package includes a redeemed code, and whether the title needs a large installation or mandatory patch before it can be played.
Choose digital when convenience outweighs transferability
Digital is practical for instant delivery, frequent play, shared household consoles where the platform permits it, and games that are rarely available physically. Before paying, read the product-specific license, platform requirements, account-linking rules, offline behavior, refund window, and redownload policy. Do not assume that “purchased” means you can give the license to another person or move it to a different account.

Use subscriptions to sample a catalog
A subscription can reduce the cost of trying many games, especially when you expect to finish them during the membership period. It is a poor fit for a personal archive. Record which games you care about and buy a transferable physical copy or a clearly durable license if losing catalog access would matter.
Step-by-step checklist for buying a used game safely
1. Identify the exact release
- Write down the platform: for example, a specific console generation, handheld, or PC edition.
- Confirm the region, language, rating, and edition. “Complete,” “special,” and “collector” can mean different things to different sellers.
- Check whether the release includes the full game, an installation disc, a demo, a soundtrack, or only a download code.
2. Ask for evidence of condition
- Request current photographs of the disc’s readable surface and label, or the cartridge’s label and electrical contacts.
- Ask for photos of the case, manual, inserts, serial or edition markings, and every included code card.
- Assume a code has already been redeemed unless the seller can demonstrate otherwise and the marketplace protects you if it fails.
- For a used console, request a video showing the system booting, reading the game, and reaching playable software. Confirm that the prior owner has factory-reset the device and deactivated their account.
3. Check technical dependencies
- Look for a required installation, day-one or mandatory patch, online pass, account link, or recurring server connection.
- Determine whether multiplayer, cloud saves, achievements, or downloadable content stop working when servers close.
- Confirm that your console or PC has the required storage, operating-system version, accessories, and display connection.
4. Evaluate the seller and payment
- Read recent feedback, not just the headline score, for complaints about counterfeit media, missing codes, swapped editions, or refund refusal.
- Confirm the return window, who handles disputes, and whether shipping damage is covered.
- Use a payment method with a documented dispute process. The FTC recommends checking refund and return rules, who helps when something goes wrong, and whether the payment method is safe.
- Be cautious with vague photos, implausibly low prices, pressure to pay outside the marketplace, or listings for pre-installed copyrighted libraries.
5. Preserve proof until the return period ends
Save the receipt, listing screenshots, seller messages, tracking record, serial or edition details, and your own arrival photos. Keep the packaging until you have tested the media. These records establish what was advertised if the item is counterfeit, damaged, incomplete, or the wrong region.
Physical-media checks that prevent expensive surprises
Playable from the disc or cartridge is not the same as complete offline independence
Some physical releases contain most or all of the game; others are launchers that download substantial data. A game may boot from the disc but still require a patch, account sign-in, online authentication, or a server for a campaign or multiplayer mode. Search the publisher’s current requirements and test the copy while returns are still available.
Codes and bundled content are separate rights
A used package can contain an unredeemed expansion, cosmetic item, soundtrack, or online pass. Once redeemed, that entitlement is normally tied to the original account and cannot be transferred with the media. Price the package as the base game unless the seller provides verifiable, marketplace-protected evidence that codes remain valid.
Region and language can change usability
Physical editions can differ by region in language packs, censorship, downloadable-content compatibility, and account-store matching. Confirm the exact region printed on the item and whether your account can obtain updates or add-ons for that release.

Read the terms that govern this specific product
Storefront-wide terms do not answer every product question. Open the game’s usage or license information and check permitted devices, account requirements, family sharing, refunds, offline play, and whether a publisher account is mandatory. Save a copy of the terms or a screenshot of material restrictions because storefront text can change.

Test redownload and offline behavior early
- Install the game on the intended device while your account is in good standing.
- Launch it once online, then test the advertised offline mode with the network disconnected.
- Check whether the game asks for periodic authentication, an external launcher, or a second account.
- Keep recovery email, two-factor authentication, and backup codes current; losing the account can mean losing access to every license attached to it.
Do not confuse a discount with ownership
A sale price lowers the cost of access but does not change transfer restrictions, DRM, or server dependence. Compare the discount with the likely years of access and the replacement cost if the account or service becomes unavailable.
Preserving a game you bought
Keep the complete physical set together
- Store the original disc or cartridge with its case, manual, inserts, and notes about redeemed codes.
- Use an archival video-game storage case only after verifying its size, material, and fit for your media; avoid pressure, abrasive sleeves, heat, moisture, and direct sunlight.
- Keep a receipt or ownership record with edition, region, and serial details.
Preserve the platform as well as the software
Library of Congress guidance notes that console games often require the proprietary platform or a virtual or emulated equivalent running on a commonly available operating system. Retain compatible hardware, power supplies, adapters, memory cards, controllers, and a known-good display connection. A disc without a working reader, or a cartridge without its console, may be difficult to use even when the media is undamaged.
Document dependencies while they work
- Record the game’s version number, patch state, region, required account, and online features.
- Note which modes work with the network disconnected and which fail without a server.
- Save manuals and packaging as stable documents or scans.
- When an online dependency cannot be recreated, preserve video showing the software in use, menus, and representative gameplay. Library of Congress guidance identifies such documentation as a useful substitute when an independent preservation copy of gameplay is unavailable.
Understand the limits of preservation law
US regulations permit eligible libraries, archives, and museums to restore access to lawfully acquired games after an authentication server shuts down, but the exemption is limited. It does not create a general consumer right to copy, bypass protection, or distribute a game. Nintendo states that unauthorized copies can infringe copyright and that unauthorized devices may stop working after network updates. Unauthorized ROM collections, pre-installed-copy devices, and circumvention products are therefore unreliable preservation shortcuts and can create legal and security risks.
What happens if a store or server shuts down?
Physical copy with no online dependency
If the media contains a playable build and you still have compatible hardware, shutdown of a storefront may have little effect on the basic game. You may lose patches, downloadable content, account features, or online multiplayer. Download any legitimately available updates and document the working version while the service remains available, but do not assume an update is optional if the unpatched build cannot run.
Physical copy with authentication or required downloads
The disc or cartridge remains tangible, yet access can fail if first launch, installation, or a key mode requires a server that no longer exists. This is why “physical” is a stronger preservation starting point, not a guarantee.
Digital license
A shutdown can affect redownloads, activation, updates, cloud saves, or account recovery. A previously installed game might continue to run, might require periodic checks, or might become unusable after a device reset. The outcome is controlled by the license, DRM implementation, and platform policy for that title.

Subscription title
When the subscription or catalog license ends, access normally ends as well, even if the game remains installed. A service may offer notice, refunds, or a purchase option, but those remedies depend on its terms.
How to compare the real cost
Sticker price is only one part of the decision. Estimate total cost over the period you expect to play:
- Physical: purchase price, shipping, taxes, storage, replacement hardware, required accessories, patches, downloadable content, and expected resale value.
- Digital: purchase price, required storage, subscription or launcher fees, hardware upgrades, and the value of access you may lose if the account or service changes.
- Subscription: recurring fees, internet requirements, catalog turnover, and the cost of buying favorites later.
A higher-priced physical copy can be cheaper in the long run if you can resell it. A discounted digital copy can be better value if you will play it extensively and accept that the license cannot be transferred. Make the comparison using a realistic resale price, not the original retail price.
Common failure modes and fixes
The listing is a different region or edition
Stop installation, photograph the markings, and use the marketplace’s return or dispute process before modifying the item. Do not rely on a seller’s generic title when the region code or edition number says otherwise.
The included code was redeemed
Treat the code as missing unless the listing promised a working code and the marketplace protects that promise. Request a partial refund only when the base game remains acceptable; otherwise return it within the stated window.

Photograph the defect and the console’s error message, then use the documented return process. Avoid polishing or opening the item before the seller or platform has inspected it, because alteration can weaken your claim.

The game demands a server that no longer responds
Separate offline modes from online-only features. If a required authentication server is permanently unavailable, a physical copy may not solve the problem; seek a refund if the listing promised offline play, and record the dependency for future purchases.
You lose access to a digital account
Use the platform’s official recovery process, secure the account with current recovery information and two-factor authentication, and retain receipts or transaction IDs. Do not buy another account or use a seller’s account; those arrangements can violate terms and can be revoked.
A practical buying decision
- Need resale, lending, or an archive? Buy a genuine physical disc or cartridge, verify dependencies, and preserve the hardware.
- Need instant access and low handling? Buy digital after reading the title-specific license and testing offline behavior.
- Want to sample many games cheaply? Subscribe, but identify any must-keep games and purchase a durable copy before they leave the catalog.
- Is the price unusually low? Increase scrutiny of authenticity, region, condition, codes, seller feedback, and payment protection before paying.
