Brazil now has a national legal and policy framework for games. Law 14.852/2024 established the statutory basis, and Decree 13.138/2026 sets implementation goals covering finance, training, exports, innovation, intellectual property and player protection. The framework arrives as a large consumer market meets a fast-growing but underfinanced developer base.
What Brazil’s new games framework changes
Law 14.852/2024 created the legal basis
Brazil’s Marco Legal for the Electronic Games Industry recognizes game development within public policies and makes the sector eligible for cultural, technology, research and innovation instruments. That matters because studios can now be treated as part of several established policy systems rather than relying only on isolated support programs.
Decree 13.138/2026 turns the law into an implementation agenda
The 2026 decree assigns practical responsibilities across government. Its stated objectives are to “stimulate the development of the Brazilian electronic games sector,” “strengthen the presence in national and international markets of electronic games produced or co-produced by the Brazilian electronic games sector,” and “promote the training and qualification of personnel in the electronic games sector.”

- A national network of training and experimentation spaces.
- Coordinated work on exports, investment attraction and international promotion.
- Measures covering accessibility, privacy, health-risk prevention, child and adolescent protection, therapeutic-game parameters and intellectual-property procedures.
The decree does not guarantee that every program is immediately open for applications. It establishes the government structure and priorities through which later calls, regulations and budgets can operate.

How large is Brazil’s games market?
Brazil is already one of the world’s largest gaming markets, even before the new framework is fully implemented. The following figures come from different studies and years, so they should not be treated as a single time series.

The newer estimate indicates continued scale, while the older study explains the market’s demographic breadth. Together they show why Brazil is strategically important for local studios, publishers and investors: there is a large domestic audience as well as a substantial base of potential creators.
Domestic production has expanded quickly
Brazil’s developer base grew from 133 companies in 2014 to 1,042 in 2023, according to Ministry of Culture figures released in 2026. Companies released 2,624 games between 2020 and 2022. In the survey, 92% reported owning their own intellectual property, a useful indicator that many studios are building original franchises rather than working solely as contractors.

That growth gives the country more capacity to serve its own audience and to create exportable products. It also increases demand for specialists in design, programming, art, audio, production, localization, marketing and business development—roles the new policy framework treats as a workforce issue rather than a purely private-sector concern.
Finance remains the industry’s main choke point
Scale has not solved access to capital. A survey of 297 developers by Abragames and ApexBrasil, cited by the Ministry of Culture, found that 60% had never used public financing. For small studios, a financing gap can stop a project between prototype and commercial release, when production, certification, localization and marketing expenses arrive together.

The smaller proposed loan floor is particularly relevant to independent teams, whose budgets may be far below the previous threshold. Lower-cost credit could also help studios retain ownership while they build a first commercial release. Until an official call or rule confirms the changes, developers should treat the figures as policy direction, not guaranteed financing.

Education is another explicit pillar. The Ministry of Education is to create game-related undergraduate courses at five federal universities, with 230 places agreed in the plan. The Ministry of Culture is to provide training through Escult and CTAv. The decree’s proposed national network of training and experimentation spaces is intended to connect education, prototyping and professional practice.
The Ministry also announced Game Brasil, a planned free public platform cataloging Brazilian games, developers and platform availability. Its initial investment is stated as R$1.4 million. Availability and coverage should be judged by the platform’s eventual public launch rather than the announcement alone.

Exports are moving from aspiration to policy objective
Brazilian studios are not limited to domestic sales. Among firms that answered the international-activity question in the Ministry-cited survey, 58% reported selling abroad. The 2026 decree gives public bodies responsibilities for international promotion, attracting investment and supporting exports.
The Brazil Games Export Sector Project is a non-profit internationalization program described in the Brazil Games 2025 GDC catalog. It is an ecosystem resource designed to strengthen national development and create international business opportunities. Studios can use such programs to seek buyers, publishers, co-development partners and visibility at overseas events, but participation does not guarantee a deal or revenue.

Player protection and intellectual property are built into the framework
The policy is not only an industrial subsidy. It also addresses how games are made and used. Measures cover children and adolescents, accessibility, privacy, prevention of health risks, supervision and parameters for therapeutic games. Intellectual-property procedures are included so that creators and public programs have clearer rules around ownership and authorized use.

For studios, these obligations mean that compliance should be designed into production: document who owns code and artwork, obtain licenses for third-party assets, plan accessibility features, protect personal data and define age-appropriate safeguards. Therapeutic claims require particular care because the decree distinguishes therapeutic-game parameters from ordinary entertainment products.
What the framework means for a Brazilian studio now
- Document the project and its IP. Keep contracts, contributor assignments, asset licenses, build records and ownership information organized before seeking public or private capital.
- Match the project to the right instrument. A prototype, a full production, a launch campaign, export activity and a training project may fall under different calls or institutions. Do not assume that the R$460 million FSA envelope is a games-only fund.
- Track official implementation notices. The proposed R$150,000 loan floor, reduced rate and 2027 capitalization initiatives require formal rules or calls before a studio can rely on them.
- Prepare for international sales early. Build localization, ratings, tax, payment, data-protection and contract requirements into the production schedule, and use export-promotion channels to identify partners.
- Plan compliance alongside design. Accessibility, privacy, child protection and health-risk controls are easier and cheaper to implement before launch than after a product reaches users.
Is Brazil’s industry now a finished success story?
No. Brazil has the ingredients of a major games hub: a large audience, rapid growth in developer numbers, a high share of studios with proprietary IP and a measurable export base. The unresolved issue is conversion of that potential into sustained, well-capitalized companies. The new law and decree open institutional doors, while the financing proposals, training capacity and export mechanisms will determine how many studios can actually pass through them.
