Bitcoin insurance and self-custody solve different problems. A custodian’s commercial crime policy may reimburse the insured business for specific, documented events such as fraud, a security breach, a hack, or asset theft. Self-custody removes the custodian from transaction authorization, but makes you responsible for protecting the private keys and recovering access. Neither arrangement guarantees that you will recover bitcoin after every loss, and neither is the same as FDIC deposit insurance.
The only reliable comparison is based on the actual policy, customer agreement, wallet design, operating controls and governing law—not on a provider’s “insured” marketing label.
What “bitcoin insurance” usually means
“Bitcoin insurance” is not a single standardized product. In most custody arrangements, the policy is a commercial crime or similar business policy purchased by the custodian or another company in the service chain. The insured party, covered events, exclusions, limits and claims process are defined by that contract.

A 2026 annual report filed with the U.S. Securities and Exchange Commission describes limited commercial crime coverage associated with a named custody operation. The disclosure identifies fraud, security breaches, hacks and asset theft among the events that may fall within the policy, while warning that coverage may be insufficient for all bitcoin losses. That company-specific statement does not establish a universal policy for every exchange, trust, wallet provider or customer account.

- BITCOIN EXCLUSIVE, PHONE VERIFICATION: Bitkey is designed from the ground up exclusively for bitcoin — a dedicated hardware wallet for secure bitcoin storage. Approve transactions with a tap using your phone and NFC. No device screen is required.
- SELF-CUSTODY, NO EXCHANGE OR CUSTODIAN REQUIRED: You hold two of the three keys in the Bitkey system – one on your phone and one on your Bitkey device. The third is stored on Bitkey’s server and cannot move your bitcoin on its own.
- NO SEED PHRASE: Set up and use Bitkey without creating or storing a seed phrase.
- 2-of-3 MULTISIG: Three keys are stored separately across your phone, Bitkey device, and Bitkey’s server. Any two keys are required to move your bitcoin.
- BUILT-IN RECOVERY: Encrypted backup and recovery tools can help you regain access if you lose your phone or Bitkey device. You can also designate a Recovery Contact.
The filing gives an important warning in its own words: “Our limited insurance protection exposes us and our stockholders to the risk of loss of our bitcoin for which no person is liable.” The statement is a risk disclosure, not a promise that customers will be reimbursed.
Insurance protects a defined risk, not the bitcoin’s market value
A crime policy is generally concerned with a covered act and resulting loss. It is not automatically a guarantee against a falling bitcoin price, a bad investment, an accidental transfer, a lost seed phrase, or every technical failure. A policy might also have an aggregate limit shared across many events and customers, a per-event limit, a deductible, conditions for reporting a loss, and exclusions for particular conduct or systems.
No generally applicable dollar limit or percentage of customer holdings was established in the cited disclosures. “Limited aggregate principal amount” is a description of scope, not a numeric promise. Treat any amount shown in a provider’s marketing material as incomplete until you have the policy wording and the customer agreement.
The insured company may not be the person who owns the claim
When a custodian buys insurance, the policy may insure the company’s business exposure rather than give each customer a direct right to sue the insurer. A customer could instead have a contractual claim against the custodian, subject to the account agreement, applicable law, insolvency proceedings and the amount the company can actually pay. The cited filing does not establish a universal direct customer claim right.
What self-custody changes
The World Federation of Exchanges describes self-custody as holding crypto-assets in a personal digital wallet and safeguarding the private keys. In practical terms, the owner controls the signing secret needed to authorize a transaction; a third-party custodian does not have to approve or execute it.

That control can reduce dependence on a company’s account system, withdrawal queue or internal authorization process. It also transfers the most consequential operational duties to you. If the key is stolen, exposed, destroyed or lost without a usable recovery method, there may be no company that can reset access.
Self-custody risks remain even when no custodian is involved
- Loss of access: A lost seed phrase, damaged device or forgotten passphrase can make funds unreachable.
- Key compromise: Malware, phishing, a malicious browser extension, a photographed seed phrase or an unsafe backup can let someone else spend the bitcoin.
- Irreversible mistakes: Sending to the wrong address, using the wrong network or approving a malicious transaction may not be reversible.
- Recovery failure: A backup that is incomplete, unreadable, undiscoverable by your heirs or stored with the original device does not provide meaningful redundancy.
- Operational error: Firmware updates, wallet imports and address-management mistakes can create avoidable exposure if performed without verification.
A hardware wallet can be a tool for keeping signing keys offline, but it is not an insurance policy and cannot make an exposed secret safe again. A metal seed-phrase backup plate is a plausible durability measure for a recovery record; it remains a practical inference rather than a product tested or endorsed by the cited sources.

| Question | Third-party custody with insurance | Self-custody |
|---|---|---|
| Who controls the private keys? | The custodian safeguards keys or controls the signing process under its operating model. | The owner safeguards the keys and authorizes transactions directly. |
| What can a policy potentially address? | Defined losses such as specified fraud, security breaches, hacks or asset theft, subject to wording, proof, limits and exclusions. | There is no automatic third-party policy; protection depends on the owner’s controls and any separate policy the owner obtains. |
| Who makes a claim? | Usually the insured entity or another party named in the policy. A customer’s direct claim right is not universal. | The owner bears the loss unless another contract or law provides a remedy. |
| What does not follow automatically? | Coverage for every hack, employee error, scam, lost key, accidental transfer, insolvency loss or market decline. | Recovery after a lost seed phrase, stolen key or mistaken irreversible transfer. |
| What happens if the provider fails? | Asset title, segregation, the customer agreement, insolvency law and jurisdiction determine the customer’s position; insurance may be insufficient. | There is no provider insolvency event, but the owner must maintain access and inheritance arrangements. |
| Who can authorize a transfer? | The custodian or its approved workflow, depending on the account design. | The holder of the signing key or required multisignature quorum. |
| FDIC deposit insurance? | Not automatically. Bitcoin held by a crypto business is not an eligible bank deposit merely because the business advertises insurance. | No. A personal wallet is not a bank deposit. |
Which losses custodial insurance may cover
The strongest supportable conclusion from the cited 2026 filing is that a commercial crime policy can potentially respond to specified criminal or cyber-related losses suffered by the insured custody business. The listed categories include fraud, a security breach, a hack and asset theft. “Potentially” matters: a claim still has to satisfy the policy’s definitions, conditions, proof requirements and limits.
Events that require policy wording before you assume coverage
- Exchange or custodian hack: Determine whether the incident qualifies as a covered security breach or computer crime, whether the affected assets were within the insured custody program and how the policy allocates a shortfall among customers.
- Employee theft or fraud: Check whether dishonest acts by employees, contractors, officers or service providers are covered and whether the policy has a special sublimit.
- Unauthorized internal transfer: Ask whether the policy treats a transfer made with valid credentials as theft, an operational error or an excluded event.
- Third-party failure: A wallet technology vendor, cloud provider, settlement agent or sub-custodian may be outside the insured definition or subject to a separate limit.
- Physical loss: Coverage for stolen devices, facilities or paper records is not the same as coverage for the bitcoin controlled by those items.
Do not convert a list of covered categories into blanket reimbursement. The filing expressly warns that the coverage may not cover all bitcoin losses, and it does not establish coverage for market-price declines, accidental customer transfers, lost seed phrases, every cyber event or every insolvency scenario.
What custodial insurance may leave open
Insufficient limits and shared losses
If the total loss exceeds an aggregate policy limit, the insurance cannot make every affected customer whole unless another source of funds exists. A provider should explain whether limits apply per incident, per policy year, per wallet or across the entire custody book. Ask how deductibles and uncovered portions are allocated.

Exclusions and conditions
Policies can require timely notice, forensic cooperation, specified security controls and proof of ownership. An exclusion can apply even when the event sounds like a “hack” in ordinary language. The customer agreement may also cap the provider’s liability or set a claims process that differs from the insurer’s process.
Insolvency
Insurance is not a substitute for sound asset segregation and a clear property right. If a custodian fails, a customer may need to establish whether the bitcoin was held for the customer, pooled with company assets, pledged, or subject to a trust or other arrangement. The answer depends on the contract, records, local law and the court handling the failure. A policy claim can be delayed or disputed while those issues are resolved.
Custody location and insolvency law
FINMA guidance dated January 12, 2026 highlights the legal complexity that can arise when crypto-assets are held abroad, especially if the custodian becomes insolvent. Cross-border custody can involve different rules for property, segregation, insolvency priorities, evidence and recognition of a foreign proceeding.
Before using a provider in another country, identify:
- The legal entity that holds or controls the bitcoin.
- The country and state or province whose law governs the customer agreement.
- Where the wallet keys, records and operational systems are located.
- Whether customer assets are segregated, pooled or rehypothecated.
- What documentation proves each customer’s beneficial interest.
- Which court or administrator would handle a failure.
A provider’s physical office, legal domicile and the location of a particular wallet system may all be different. Do not assume that a familiar brand name determines the governing law.

Why FDIC insurance does not cover bitcoin automatically
FDIC deposit insurance applies to eligible deposits held at FDIC-insured banks. It does not automatically extend to bitcoin held by a crypto company, an exchange account or a personal wallet. The FDIC has warned about public confusion between crypto-company products and insured bank deposits.
An SEC-filed bitcoin trust registration document states that the trust does not insure its bitcoin and that its non-depository bitcoin custodian is not an FDIC or SIPC member for the trust’s assets. That statement is specific to the trust and should not be generalized to every crypto-related product. It does, however, illustrate why a label such as “insured custody” must be separated from the legal meaning of bank deposit insurance.
A July 2025 joint statement by the FDIC, Federal Reserve Board and Office of the Comptroller of the Currency on bank crypto-asset safekeeping said: “The statement does not create any new supervisory expectations.” That sentence describes supervisory guidance; it is not a guarantee of reimbursement for bitcoin holders.
How to check an insurance claim before trusting a custodian
- Request the exact program description. Ask whether the provider is the named insured, an additional insured, a beneficiary or simply relying on a vendor’s policy.
- Define the covered event. Get the policy’s definitions for theft, fraud, computer crime, security breach, employee dishonesty, social engineering and digital-asset loss.
- Confirm whose assets are covered. Ask whether customer bitcoin is included, which legal entity owns the policy and whether a customer can make a direct claim.
- Read limits and deductibles. Record per-event and aggregate limits, sublimits, deductibles, waiting periods and currency or asset valuation rules.
- List exclusions. Look specifically for lost keys, compromised credentials, customer-authorized transfers, insider acts, vendor failures, smart-contract incidents, regulatory seizure and insolvency.
- Ask how a shortfall is allocated. A policy can pay the insured company without specifying how proceeds are distributed among customers.
- Check the policy period and renewal. Coverage can change, lapse or be replaced. A historical disclosure does not prove that the same program exists today.
- Match the policy to the customer agreement. Liability caps, arbitration clauses, withdrawal rights and asset-segregation language can materially affect recovery.
- Verify jurisdiction. Identify the governing law, dispute forum, custodian entity and location of the assets and records.
- Keep evidence. Retain account statements, deposit records, transaction IDs and the policy documents in a secure location separate from the account itself.
If a provider will only say “your assets are insured” without supplying these details, you do not yet know what protection you are buying.

- Choose the signing design. Decide whether a single-key wallet is appropriate or whether a multisignature arrangement is needed to avoid one device or one person being a single point of failure.
- Create the wallet in a controlled environment. Follow the manufacturer’s documented setup process, verify the receiving address on the wallet’s trusted display and never type a seed phrase into a website, email or cloud note.
- Record the recovery secret accurately. Write or engrave the words in the exact order required by the wallet. Do not photograph or upload the record.
- Test recovery before funding. On a separate device or reset test environment, confirm that the backup restores the expected wallet. A backup that has never been tested is an assumption.
- Separate copies geographically. Keep more than one durable copy in locations protected from the same fire, flood, theft or household dispute. Do not place every copy beside the signing device.
- Document inheritance and access rules. Tell a trusted person that a recovery plan exists without revealing the secret in ordinary communications. Specify what should happen if you are incapacitated.
- Use transaction checks. Send a small test amount first, compare the full address on a trusted screen and confirm network details before a larger transfer.
- Review the plan after changes. Recheck backups, devices, passphrases, beneficiaries and locations whenever you migrate wallets or change household circumstances.
Self-custody does not eliminate risk; it changes who can prevent and recover from it. A perfect backup cannot rescue a seed phrase that was copied by an attacker, and a secure device cannot compensate for sending funds to the wrong address.

Risk scenarios: which arrangement responds?
| Scenario | Custodial insurance | Self-custody |
|---|---|---|
| A criminal breaches the custodian’s systems and steals assets. | Possibly covered if the incident fits the policy and limits; customer recovery is not automatic. | No custodian policy applies. The owner’s key controls and any separate personal insurance determine the response. |
| The owner loses the seed phrase. | Not relevant to a custodian-held account, unless the provider’s own records fail. | Usually unrecoverable without another valid backup or recovery path. |
| The owner approves a scam transaction. | Often outside the described crime categories; check the actual exclusions. | Normally irreversible once confirmed by the network. |
| The provider becomes insolvent. | Asset segregation, contract rights, insolvency law and any valid policy claim all matter. | No provider insolvency, but access remains dependent on the owner’s keys and recovery plan. |
| Bitcoin’s market price falls. | Not a theft or crime loss on the evidence cited. | Not an insured loss; the owner bears market exposure. |
| A device holding a backup is destroyed. | Only relevant if the custodian’s insured records or systems are affected and the policy responds. | Recovery depends on another usable backup stored elsewhere. |
When a hybrid arrangement can make sense
Some owners divide responsibilities: a working balance stays with a regulated custodian while long-term holdings remain under personal control, or multiple people share a multisignature wallet. This can reduce dependence on one failure point, but it creates operational complexity. Every participant needs a documented role, backup procedure and plan for illness, death, device loss and disagreement.
A hybrid design is not automatically safer. It can introduce additional counterparties, signing dependencies, geographic risks and opportunities for social engineering. Evaluate each component separately: the custodian’s policy and insolvency protections, the wallet’s key-management process, and the recovery plan connecting them.
Regulatory proposals are not current retail guarantees
An October 6, 2026 Federal Register document discusses self-custody disclosure and recourse in the context of investment advisers and regulated funds. It is a proposal, not a final rule for individual bitcoin holders. Do not cite it as evidence that retail self-custody has a new statutory reimbursement right or that every adviser must offer a particular custody model.
Rules can also differ by country, state, product structure and customer type. A trust, exchange account, adviser-managed fund and personal wallet may have entirely different disclosure and recourse regimes.
Questions to ask before choosing
- Am I comfortable being the person who must protect and recover the signing key?
- Would a temporary withdrawal freeze or account review create a problem for my use case?
- Can I verify who legally owns the assets and how they are segregated?
- Do I have a tested backup and an inheritance plan?
- Can the provider show the policy definitions, limits, exclusions and claims process?
- Where would a dispute or insolvency proceeding occur?
- Am I treating insurance as a defined remedy rather than as a guarantee?
Bottom line
Custodial insurance can be a layer of protection against specified losses suffered by an insured custody business, but its usefulness depends on definitions, limits, exclusions, customer claim rights and insolvency law. Self-custody can remove a third party’s control over transactions, but it makes key security, backups and recovery your responsibility. Neither option provides blanket protection, and neither makes bitcoin FDIC-insured. Choose only after matching the actual policy and legal structure to the risks you are prepared to manage.
