The most private AI chatbot for work is not a consumer app. For confidential client files, use a managed enterprise workspace whose contract, retention settings, identity controls, audit trail, encryption and regional-processing terms match your policy. Microsoft Copilot is usually the clearest fit for organizations already governed by Microsoft 365; Claude Enterprise is compelling when custom retention, customer-managed keys or deployment through your own cloud are priorities; ChatGPT Enterprise is a viable managed option when its workspace controls and contractual terms satisfy your requirements.
Those labels are only a starting point. A consumer and enterprise account from the same vendor can have materially different training, administrator, retention and legal terms. Verify the exact plan and configuration before uploading confidential material.
What makes an AI chatbot private enough for confidential work?
Privacy is a set of enforceable controls, not a marketing adjective. Evaluate an AI service against the following questions before treating it as suitable for client, employee, legal, financial or regulated information:
- Data use and training: Does the contract prohibit using workspace prompts, files and outputs to train general models, and does that commitment apply to every enabled feature?
- Retention and deletion: Can administrators set a finite period, place legal holds, delete conversations and files, and obtain evidence that deletion occurred?
- Identity and permissions: Does the service use your single sign-on, groups and role-based access, and does it preserve the permissions on connected documents?
- Audit and discovery: Are chats, file access, exports and administrative actions available to your compliance, security and legal teams?
- Encryption and key custody: Is data encrypted in transit and at rest, and can your organization control or rotate the encryption keys?
- Data residency and processing: In which regions are prompts, files, logs and backups stored or processed, and can high-load routing move processing elsewhere?
- Connector boundaries: Which drives, mailboxes, repositories and plugins can the assistant search, and are those scopes limited to the user’s existing authorization?
- Deployment: Is the model running in the vendor’s managed cloud, your cloud account, or on infrastructure you operate?
A chatbot can satisfy one of these tests and fail another. For example, a no-training promise does not by itself prevent an over-broad connector from revealing a document to an employee who should not see it.

Microsoft Copilot: the natural choice for Microsoft 365 estates
What enterprise data protection covers
Microsoft says enterprise data protection applies to eligible work or school accounts. Under that protection, Copilot is designed to respect Microsoft identity models, existing file and site permissions, sensitivity labels, retention policies and audit settings. Microsoft’s stated position is: “Your data is private: We won’t use your data except as you instruct.” The practical benefit is that organizations already administering Microsoft 365 can apply familiar governance rather than create a separate identity and information-protection system.
Retention, audit and regional processing
Microsoft Purview can govern retention of Copilot chat interactions, allowing an organization to align conversations with its broader records and compliance policy. Administrators should still confirm which Copilot experience, account type and Purview configuration are in scope; consumer Copilot is not equivalent to an eligible work or school deployment.
Processing is generally regional, but Microsoft documentation notes that processing can involve other regions during periods of high utilization. A strict residency requirement therefore needs a review of the applicable service terms and regional commitments, not just the location of your Microsoft 365 tenant.
Permission and connector risk
Copilot can surface content that the signed-in user is already authorized to access. That is a safety advantage only if SharePoint, OneDrive, Exchange and other connected repositories have been permissioned correctly. Before rollout, remove inherited or stale permissions, classify sensitive sites, restrict which connectors are enabled and test searches with ordinary user accounts. Copilot should not be used to compensate for an access-control problem that already exists in Microsoft 365.

Claude Enterprise: strongest when retention, keys or cloud placement are priorities
Organization-level retention
Anthropic distinguishes consumer plans from enterprise and covered-model configurations. For an organization, the relevant question is which contractual enterprise configuration is being purchased and which interfaces it covers. Anthropic’s platform documentation says chat, file and project content follows the organization’s retention policy, so administrators can define a policy rather than accepting an indefinite default.
There is an important, narrower exception: local Cowork and Claude Code session transcripts are stored for six years by default when no finite custom period is configured. That six-year default concerns those local transcripts; it should not be read as the retention period for every type of enterprise chat content. Set a finite custom period where policy requires one and include local tools in the review.
Customer-managed encryption and cloud deployment
Anthropic’s legal-work guidance says qualifying customers can manage encryption keys. Customer-managed keys can support separation of duties and permit an organization to revoke or rotate access under its own key-management process, subject to the purchased configuration and contract.

This is a cloud-platform deployment rather than a local model running on a company laptop; confirm the platform’s region, logging, backup and support paths before approving it for a matter.

Where Claude needs extra diligence
Do not infer enterprise protections from a personal Claude account. Verify that the retention policy, key option and cloud-platform route apply to the exact model, API, workspace and tools your team will use. A legal department should also decide whether prompts and generated drafts become matter records, who may export them, and how a legal hold overrides ordinary deletion.
ChatGPT Enterprise: managed workspace controls with a defined deletion schedule
Retention and deletion behavior
ChatGPT Enterprise, Edu and Healthcare workspaces use workspace retention policies for files. OpenAI’s retention documentation states that after a GPT, project or file is deleted, associated data is scheduled for permanent deletion within 30 days, unless security or legal obligations require longer retention. “Scheduled” matters: deletion is not necessarily instantaneous, and a legal or security exception can extend the period.
Set the workspace policy before users upload material. Document who can change it, how deletion requests are approved, and when a legal hold suspends normal deletion. Treat uploaded files, project content, custom GPT knowledge and exported conversations as separate records until your administrator confirms they share the same lifecycle.
Access and workspace governance
Enterprise is a managed workspace rather than a private consumer login. Confirm single sign-on, administrator roles, user provisioning and deprovisioning, export rights, audit availability and the controls for sharing GPTs or projects. Limit access to the groups that need a matter or client’s information, and remove departing users promptly.

Residency and deployment questions
ChatGPT Enterprise is generally a vendor-cloud service. If policy requires a customer-cloud or local deployment, ask whether the exact offering and region provide that arrangement; do not assume that an enterprise workspace is equivalent to running a model inside your own network. Confirm where prompts, files, logs and backups are processed, including any support or abuse-monitoring path.

How to approve a private chatbot before uploading confidential files
- Name the exact service and plan. Record whether users will access a consumer account, team workspace, enterprise workspace, API, cloud-platform service or local tool. Consumer, team and enterprise terms are not interchangeable.
- Obtain the data-use terms. Confirm in writing whether prompts, files, outputs, feedback and support logs can be used for model training or product improvement. Check that the promise covers connectors, APIs, custom GPTs or projects, and any model-routing feature you intend to enable.
- Map retention and deletion. Choose a finite period where possible. Define treatment of chats, uploads, projects, custom assistants, local transcripts, backups, exports and legal holds. Test deletion with a non-sensitive file and record the observed result.
- Connect identity and least privilege. Require single sign-on and automated provisioning where available. Use groups for client or matter access, remove dormant accounts, and review inherited permissions in every connected repository.
- Disable unnecessary connectors. Start with no connectors, then enable only the repositories and actions that have a documented business need. Prevent broad search across executive, HR, legal-hold or restricted client locations unless explicitly approved.
- Set administrator and user boundaries. Decide who can create shared assistants, upload knowledge bases, export chats, invite guests or change retention. Separate workspace administrators from matter owners where the platform allows it.
- Verify encryption and key custody. Document encryption in transit and at rest, key ownership, rotation, revocation and the provider’s support access. If customer-managed keys are required, test what becomes inaccessible when a key is disabled.
- Check residency and subprocessors. Identify storage, inference, backup, telemetry and support regions. Ask whether high utilization, failover or abuse investigation can move processing outside the preferred region.
- Test the audit trail. Run a controlled prompt, file upload, share and deletion. Confirm that administrators can identify the user, time, object, action and destination without exposing more content than necessary.
- Publish an approval path. Define which data classes are allowed, who approves regulated or client-restricted material, how incidents are reported, and when the service is suspended after a policy or vendor change.
Common failure modes and fixes
A user signs into a consumer account
Symptom: The user sees no organization retention, audit or administrator controls. Fix: Block unsanctioned consumer sign-ins where possible, provision the approved enterprise workspace and train users to verify the work identity before pasting data.
A connector exposes more than intended
Symptom: The assistant retrieves a document from a shared drive that the team assumed was restricted. Fix: Correct the repository permission first, then narrow connector scope and retest with a least-privileged account. The chatbot cannot make an already-public internal document confidential.

Deletion is assumed to be immediate
Symptom: A file disappears from the interface but remains subject to a scheduled deletion window or legal hold. Fix: Record the provider’s actual lifecycle, including the 30-day ChatGPT Enterprise schedule and any security or legal exception, and align your records policy to it.

Regional residency is inferred from the office location
Symptom: A company in one country assumes all inference and support stay there. Fix: Verify tenant, processing, backup, failover and support regions in the current contract. For Microsoft Copilot, account for the documented possibility of other-region processing during high utilization.
Local tooling is omitted from the retention review
Symptom: A team approves Claude’s workspace policy but overlooks local Cowork or Claude Code transcripts. Fix: Set a finite custom period for those local transcripts when required and include developer machines, local caches and exports in the data map.
Which option should you choose?
Choose Microsoft Copilot when Microsoft 365 is your control plane
Select it when your identity, permissions, sensitivity labels, retention and audit workflows already run in Microsoft 365 and your residency policy accepts the documented regional-processing behavior. The implementation effort is usually concentrated on cleaning permissions and configuring Purview rather than building a parallel governance stack.
Choose Claude Enterprise when control over retention, keys or cloud placement dominates
Select Claude when a finite organization retention policy, customer-managed encryption or a route through AWS Bedrock or Google Cloud Vertex AI is central to the approval. Obtain the qualifying-customer terms and include local Cowork or Claude Code storage in the design.
Choose ChatGPT Enterprise when its workspace contract fits your policy
Select ChatGPT Enterprise when OpenAI’s workspace administration, retention model, audit process and regional commitments meet your requirements. Build procedures around the 30-day scheduled deletion behavior and its security or legal exceptions rather than promising instant erasure.
Bottom-line decision rule
No vendor label makes data confidential by itself. Approve a chatbot only after verifying the exact plan, contract and settings for data use, retention, identity, permissions, audit, encryption, residency and connectors. Start with the least sensitive data class, test the controls, document the result and expand access only when the organization can prove that the chatbot follows its existing confidentiality obligations.
