A reported Bengaluru GSTAT decision set aside a ₹9,40,880 penalty under Section 129 after a PIN-code entry error shortened the e-way bill’s calculated distance and validity. The result turned on the reported circumstances of that consignment; it does not establish that every expired e-way bill or PIN-code mistake defeats a penalty.
What happened in the T. Stanes case?
In T. Stanes and Company Limited v. Sulakshana S N, JCCT (Appeals) Mangaluru & Ors., T. Stanes reportedly sent insecticides to Cheminova India Limited in Ballari as a purchase return. The goods were accompanied by a delivery challan dated 16 March 2024 and an e-way bill, according to TaxGuru’s case report.
The report says the vehicle was intercepted in Ballari at 8:35 a.m. on 18 March 2024. The e-way bill had expired at 11:59 p.m. on 17 March. The officer treated the movement as one without a valid e-way bill and imposed a ₹9,40,880 penalty under Section 129 in Form GST MOV-09. An appellate authority confirmed the penalty in an order dated 21 May 2025.
How did the PIN-code mistake affect validity?
As described in the report, the consignor’s PIN code was entered as 583102 instead of 580025. That entry produced a calculated distance of 100 km, rather than the stated actual route distance of 215 km, and therefore shortened the e-way bill’s calculated validity. These are case-specific figures reported in 2026 coverage, not general measures of route or validity calculations.

The report also says a physical check found no other discrepancy in the goods or accompanying documents. The appellant argued that there was no intent to evade tax and that the transaction was a non-taxable purchase return. Those details are part of the reported account of the case, rather than independently verified findings presented here.
What did the Tribunal decide?
The reproduced conclusion says the Tribunal set aside the appellate order confirming the penalty and allowed the appeal. On the reported facts, it did not sustain the Section 129 penalty where the PIN-code error was characterized as clerical, shortened rather than increased the bill’s validity, and was not accompanied by a reported finding of tax evasion.

The available report does not establish a general rule that expiry by itself can never support Section 129 action. Nor does it show that a PIN-code error automatically excuses a mismatch or other non-compliance. The outcome should be read as a decision on the reported facts, not blanket immunity for expired bills.

A Karnataka Commercial Taxes Department FAQ reproduces the relevant condition from CBIC Circular 64/38/2018-GST. For a PIN-code error to fall within the circular’s listed minor mistakes, the consignment must be accompanied by an invoice or other specified document and an e-way bill; the consignor’s and consignee’s addresses must be correct; and the error must not increase the e-way bill’s validity period.

Those conditions matter together. The circular’s treatment is not a blanket exception for any incorrect PIN code, nor does it itself establish that every expired bill is protected from Section 129 proceedings. In the T. Stanes report, the shortening of validity is a central factual distinction; readers should not turn that feature into a broader rule without considering the remaining facts and applicable requirements.
How should a business assess a similar detention?
A business facing a similar penalty should separate the documentary facts from the legal conclusion. The circular expressly supplies the documentary and PIN-code conditions above. Other matters—including whether the goods and documents otherwise matched and whether the authority identified evidence of tax evasion—appear in the reported case narrative, but are not presented as additional standalone conditions in that circular.

- Reconstruct the error’s effect: compare the entered PIN code, actual route, calculated distance and validity period. Record whether the mistake increased or shortened validity.
- Review the inspection record: identify any mismatch in the goods or documents and what reason the officer recorded for treating the movement as non-compliant.
- Keep the case-specific argument narrow: the reported T. Stanes outcome may be relevant where the facts align, but it is not a substitute for examining the notice, order, circular conditions and applicable law in the particular proceeding.

TaxGuru’s case-details panel, as described in the available reporting, identifies the challenged appellate order but does not provide the Tribunal order date or appeal number.
