“Is the new AI tool a creep?” is a useful first question—but the answer depends on what the feature receives, why the provider processes it, who can access it, and what happens next. Before connecting an unfamiliar AI feature to a client-facing website workflow, map its data, reduce what it can see, check the provider’s terms and documentation, assess the risks, and record a decision. If you cannot understand or control material risks, pause, limit the use, or choose another service.
What should you establish before testing the feature?
Start with the actual workflow, not the tool’s marketing description. Write down what the feature will do on the website or in your agency process: for example, draft responses from submitted information, summarize content, or help staff edit pages. Then trace the information it needs to perform that task.
Make a data map that follows information from collection through processing, storage, access, and deletion. The Federal Trade Commission (FTC) recommends tracking personal information across websites, service providers, storage locations, and access permissions. Its business security guidance also advises keeping only information needed for business.

- Inputs: List the website pages, files, prompts, user submissions, account details, credentials, logs, and personal information that could reach the feature. Include information sent automatically, not only what a user types.
- Outputs: Note what the feature returns, where the result appears, and whether staff review it before it reaches a customer or is added to a client website.
- Routes and storage: Identify how information gets to the provider, where it is held, and which parties can access it, including service providers or subcontractors.
- People and permissions: Record who can submit information, view results, administer the feature, or access related accounts and logs.
If you cannot describe the data flow well enough to complete this map, do not send live client or customer information while you investigate. Ask the provider for the missing details and consider whether a limited test can be done without personal data.

What should you ask the provider about data use?
Read the contract, privacy terms, and technical documentation against the workflow you mapped. Ask questions about each processing purpose rather than assuming one answer covers every activity. “Will the vendor use my client’s information to improve its models?” is important, but it is only one part of the review.
- Service delivery: What information is processed to provide the feature, and what instructions or settings govern that processing?
- Retention and deletion: How long is submitted information kept for each purpose, and what deletion options or commitments apply?
- Product improvement or model development: Is information used for these purposes? If so, which information, under what terms, and what choices or restrictions are available?
- Access and onward sharing: Who at the provider, or at another service provider, can access information? What roles do those parties have in the workflow?
- Change notices: How will you learn about changes to terms, features, models, retention practices, or subcontractors?
Do not infer an answer from a general statement about privacy or security. Seek terms and documentation that cover the specific feature and purposes you plan to use. If the information remains unclear, treat that uncertainty as an unresolved procurement issue—not as evidence that a particular practice does or does not occur.
Who decides the purpose and means of each operation?
Check who determines why and how information is processed at each stage. The answer can vary within one service: the Information Commissioner’s Office (ICO) gives examples that distinguish processing on a client’s instructions from a provider’s own model development and training. A provider may therefore have different roles for different operations.

Compare the contract and documentation with the way the feature will actually be used. Record which party decides the purpose, which party sets the relevant processing details, and what instructions or controls apply. Do not assume the website owner, agency, or provider has the same role for every activity simply because one party operates the tool.
Can you reduce what the feature receives?
For each input in your data map, ask whether the feature needs it to do the stated job. The goal is to keep only what is needed, not to route an entire website, customer record, or account into an AI system merely because the connection makes that possible.
- Remove fields, records, page sections, and attachments that are not necessary for the task.
- Redact or replace personal information in prompts and test material when the feature can work without it.
- Keep sensitive client or customer information out unless there is a clear need and you have assessed the applicable requirements and safeguards.
- Check whether a limited sample or test environment can answer your implementation questions without live personal data.
- Restrict access to the feature and its outputs to the people who need them for the workflow.
Minimization reduces exposure, but it does not replace reviewing the provider’s terms, access, storage, or other processing. A feature that receives less information still needs a clear purpose and an accountable decision.

To change the privacy levels, simply adjust your monitor's brightness level accordingly
- Matte and Glossy Sides: It's a reversible privacy screen filter, giving you the flexibility to choose glossy or matte finish. The matte side will have less glare, however the glossy side will have stronger privacy
- Perfect for Open Workspaces: Ensure your working space is bright and well lit. Privacy screens do not work in dimly lit areas
- Two Installation Option: Option 1 uses clear double side adhesive strips that securely attach to any computer screen. Option 2 (for computer screens with a raised bezel only) uses slide mount tabs that easily stick to the display frame, allowing you to take out the privacy screen filter easily as needed
What privacy risks need assessment before processing?
Assess the specific use, the information involved, and the people affected before processing begins. ICO guidance says AI processing will in the vast majority of cases involve processing likely to be high risk, while also requiring a case-by-case assessment. That is a reason to examine the use carefully, not a substitute for documenting why a particular deployment is or is not high risk.
Where required, complete a data protection impact assessment (DPIA) before processing starts. The ICO’s accountability and governance guidance, whose latest update is recorded as 15 March 2023, says: “You should not see DPIAs as simply a box ticking compliance exercise.” Use the assessment to identify possible harms, determine safeguards, assign responsibility, and record the risk that remains after safeguards are applied.
- Describe the purpose, data, people affected, and actual processing route.
- Identify risks arising from the information involved, access, storage, provider practices, and how outputs will be used.
- Record safeguards, who is responsible for each, and the residual risk after they are in place.
- Document the reasoning for the risk assessment and the decision to proceed, limit, or decline the use.
Under ICO guidance, if residual high risk cannot be sufficiently reduced, consult the ICO before proceeding. The ICO’s guidance is UK data-protection guidance and a regulator’s interpretation and good-practice resource, not a statutory code by itself. The ICO says its guidance is under review following changes made by the Data (Use and Access) Act, so check current guidance and applicable law for the deployment.

Does the use create transparency obligations?
Identify who may need to be informed about the processing and what applies in the relevant jurisdiction. The answer depends on where the business and affected people are, the feature, the data, and each party’s role. FTC business guidance is US-focused; ICO guidance concerns UK data protection. Neither should be treated as a universal legal test.
For the EU AI Act, the European Commission’s Article 50 transparency guidelines, published 20 July 2026, say those specific transparency obligations apply from 2 August 2026. This is not a blanket effective date for all AI or privacy requirements. Check whether the provision applies to the particular system and use rather than generalizing from the date.
How can you compare candidate tools consistently?
If you are considering more than one service, use the same questions for each one. Compare documented terms and capabilities, not assumptions about what an unnamed vendor must do.

| Comparison area | What to establish |
|---|---|
| Data requirements | Which inputs are necessary, and whether the feature can be limited to a smaller or redacted set |
| Purposes and reuse | How submitted data is used for service delivery, retention, product improvement, or model development |
| Retention and deletion | What terms apply to keeping and deleting data for each processing purpose |
| Access and subcontracting | Where data is held, who can access it, and which other service providers are involved |
| Security documentation | What information the provider supplies to help you assess safeguards for the planned use |
| Roles and contract terms | Which party determines the purpose and means of each operation, and what instructions or terms apply |
| Assessment transparency | Whether the provider’s documentation lets you understand the processing well enough to assess risk and obligations |
| Controls and exit | Whether you can limit or disable processing and change providers if the service or terms no longer fit |
A comparison is useful only if it leaves you able to assess the actual deployment. The ICO recommends making due diligence part of procurement and evaluating the trade-offs independently. If you cannot assess whether a third-party system can be used compliantly, choose another solution or do not adopt it.
How should you keep the decision accountable over time?
Make the review a procurement gate before adoption, then revisit it when the service or processing changes. Assign an owner who can check the vendor terms, data map, safeguards, and assessment against the live workflow. Decide in advance how the feature will be limited, disabled, or replaced if a material change creates risks you cannot accept.
The ICO advises involving the data protection officer (DPO) early where one is relevant: “Data protection should not be an afterthought, and a DPO’s professional opinion should not come as a surprise at the eleventh hour.” If your organization has no DPO, give the review to an appropriate person with authority to assess the risk and pause the deployment.
For generative AI risk-management planning, NIST’s Artificial Intelligence Risk Management Framework: Generative Artificial Intelligence Profile (NIST-AI-600-1), released 26 July 2024, can help organizations identify risks and consider actions aligned with organizational goals and priorities. NIST also says AI RMF 1.0 is being revised; treat the framework as a planning resource, not a substitute for the law that applies to your use.
